      Moreover, accidental filings don’t happen. There needs to be supporting documentation.
      What happened, FACTUALLY, was people kept their cars past the contract due date. In some states that’s considered larceny (a crime). In others it’s a civil tort. Car rentals are interstate very often. If a car was rented from New York, it may consider it a crime, but the car is now in say… Georgia where it’s a tort. The car will show up as stolen when a GA police officers sees it, and makes the arrest, but technically it’s not a crime by GA law, as it technically wouldn’t be stolen there… but it is in NY. That’s when the courts are supposed to rectify the situation and the state may or may not seek extradition.

    I had a hertz rental for 30 days, paid for by my automobile insurance company which they covered due to a car accident. Two weeks into the rental I received texts, emails, and certified letters looking for payment even though my insurance company arranged direct payment directly with Hertz. Hertz has a collection department that runs away with themselves. Even had a tow truck show up my home at 2 am three weeks after the 30 day rental was returned to Hertz. That's one fxxked up company.

      @@kitcoffey7194 It was bothersome but I lost nothing. The expression on the Tow Truck Drivers face when he heard me load a round into my Ithaca Pump was precious. I learned that if he recovered the rental he earns a bird dog. Without the vehicle he doesn't earn anything.

      The same thing happened to me after an accident! The tow truck arrived when I still had the car. They couldn't tow because my brother's car happened to be parked behind the rental car. My brother refused to move his car.

      @@0annonymous Leading the cops on a car chase will earn you felonies regardless of your guilt or innocence in relation to the alleged car theft. It's also extremely dangerous. Many innocents have been killed by accidents caused by a car chase. I encourage everyone to ignore this guy. He's obviously a fool.

    Whistleblower recently came out, apparently Hertz will file a police report for an overdue rental, using the police as a repo service (which they aren't supposed to do). Once they get the car back, they don't bother reporting that to the police, so it's still listed as stolen, which inevitably comes to bite the next person who rents the car. Hertz collection department really out here destroying people's lives.

    Thank goodness this is finally gaining traction! One of Hertz’s victims was a new mom. She was forced to spend forty days in jail away from her baby. Hertz needs to be held accountable. I hope this bankrupts them.

      Another lady in Miami lost her nursing job and spent 37 days in jail and she had all the valid paperwork and receipts. She almost lost her home and all, she has 2 kids that she had to basically abandon while fighting to prove her innocence. They need to be heavily FINED.

      There was also a case where a man from Denver got arrested at the airport over a warrant out of Georgia from Hertz that he never once rented from November of 2020.

      Absolutely. This type of gross incompetence starts at the top and can be corrected at the top. All they need to do is say stop reporting these cars as stolen unless you're 100% sure or you're fired. You mistake ends up with some paying customer being arrested you need to be fired.

    How do you get thrown in jail when you have a receipt? There is always a paper trail, you can't rent from Hertz without a credit card. Sounds like overzealous cops are partly to blame if it's that hard for people to clear their name.

      It's hertz poor system of Inventory management. Class action for evrything they have. It's been going on for way to long. They report a car stolen and even if found hertz doesn't fix the fact that they received the vehicle. So money hungry that they rent it out right after recovery withought a system to register the car as not stolen.

      you have your paper, but Hertz said the car is stolen, so police officer believe your document is fake. I'll never rent from Hertz to avoid this incidents.

      @@qdonny in the time between arrest and arraignment all the necessary evidence should be available, nobody should be facing prosecution of sitting in jail for months. As officers of the court, the police should have recognized a problem and been more willing to actually *investigate*.

    A Hertz representative recently stated in a court hearing that a false charge of car theft should not be a concern because it only happens to a tiny percentage of customers. Really? Customers should not be concerned about this?

      You can't go and arrest someone who lives in Sacramento, California who rented a car in Houston, Texas. He flew there and he can't take the car back home. He used the car during the visit to that city.

      Can you imagine that? You make a legitimate purchase and the police arrive at your door saying yo stole it and take you to jail. Many of these people showed police their documentation and still went to jail.

      @@krane15 I bought a car in Toronto Canada and drove it back to California. I got pulled over in Illinois and I showed the police paperwork that it was "kosher". IE transfer of title, Ontario has a different style, there was a ten day tag issued by Service Ontario, insurance papers from Ontario Motor League CAA/AAA, and a form 801 from DHS Department of Homeland Security.
      I bought a 1988 Mercury Grand Marquis sedan from an estate sale. The owner had passed away and was up for sale and I bought it.

    The thing to keep in mind is that the people who got arrested, they now have an arrest on their record, even when the charges are found to be bogus and got thrown out.

      This. Even if they get a court to order the records expunged, the expungement is only from publicly-available records. The arrest will still show up on government-ordered background checks for the rest of their lives.

      @@MuhdisinLiving you have to hire an attorney to draft the proper paperwork and state the right legal literature to remove the charges after the false arrest. But even after that if you are considered for a job that arrest comes up.

      @@MuhdisinLiving The exact procedure varies from state to state. You have to know that the possibility even exists. It also requires hiring an attorney, meaning it is a costly process.
      In some states, the expungement is two-tiered. A basic, consumer -type backgound check won't turn up the arrest record, but a criminal check at the AG level will reveal it.

    I was arrested put in jail for 2 weeks in March 2021 renting a Hertz vehicle stay away from this company lucky I have a good lawyer and judge that hopefully will dismiss my case of receiving stolen property property I rented.

      Get in touch with the lawyer who is leading the charge on this issue. He is in a lot of these news stories, his name will be easy to find. This is looking like it will turn into a class action suit.

      Dont listen to the commentor. Dont be part of the class action lawsuit. You'll get pennies in compensation. File a lawsuit by yourself. Class action lawsuits only favor thr lawyers that file them as they increase the monetary settlement by millions of dollars just to fluff their commission when they eventually win the settlement, usually to the tune of 30 to 40% of a multi million dollar settlement. Is isn't surprising to see these lawyers to push for class action status as it increase the potential gain, FOR THEM, to reap the benefit at YOUR expense.

      Intimidation into what exactly? He’s explaining his legal right as a police officer in that state. Where is the “intense exchange”? If a car shows up as “stolen” and you cannot immediately provide evidence of lawful possession then you should be detained for further investigation. It’s absolutely how that works everywhere in the US and around the world. An arrest isn’t a prosecution.

    The cops have some explaining to do here, too. How do you arrest someone for a stolen car they have paperwork that proves they didn't steal it? I could see impounding the car, and then putting a warrant out later if their paperwork is false, but to throw an innocent person in jail when they have the paperwork they are supposed to have? That's as bad as what Hertz is doing.

    If you can't conduct a good faith business wherein the customer is placed into undue risk of legal action, you are not eligible to conduct business in any of the states. Hold them accountable to their good faith business and fine them appropriately.

    That ex fed was lucky.
    Any average person would have gotten the cap kicked out of them, or even shot dead by that cop.
    Saying that cop was calm is a mistake.
    He knew he was dealing with someone that could hurt him back careerwise, so he had to restrain himself.
    How many victims got shot or even killed by cops going after people that rented from HURTZ?
    Will we get that information?

    We use to rent hertz for corporate use. Month after month. We no longer allow any hertz rentals for corporate cars when traveling.

    What they need to do is educate the police so they stop arresting people that have documents showing they legitimately rented these cars. What I'd like to know is why are they totally ignoring that? Especially when they already know Hertz has made hundreds of errors already.

      False. There are no “pay ahead” systems. Deposits are held at time of rental, but payments are processes at car turn-in.

      I went to rent during covid and the lot was completely full of cars, and they tried to tell me I had to jump through all these hoops to rent. I rented on a corporate account and was a President Clubs member. I left and never rented from them again.

    I can see that accidentally happening a small handful of times but HUNDREDS of times? Yeah something fishy is going on with that. That sounds like a class action lawsuit waiting to happen.

    They have lost the ability to be trusted when they report a car stolen so they should not be able to report cars stolen until they regain that trust.

      They didn’t go bankrupt, you can easily look up why they did file for bankruptcy protection years ago, and all companies do this.

    I have heard horror stories lately about car rental companies. Not just Hertz. During the pandemic a lot of the companies sold off their cars. Now that people are traveling again a lot of these companies don't have the inventory but are booking cars they don't have. Some people have reported renting a car on a friday and it getting repo'ed by the rental company on a Saturday so that they can give it to whoever needs a car on Saturday that they booked. So not only are they reporting them "stolen" but just outright taking the cars to make it look like they have them available.

    Rented a car from Hertz and dropped off, they examined the car and signed off and I left. A few weeks later I recieved a false claim from Hertz stating that I dropped off a damaged car!! Luckily I fought them and they finally threw it out, but wonder how many other people paid for false claims like that..

    So Hertz filed cars stolen and was still renting out these cars out that they claimed were stolen. This gotta be illegal, right? There was a man jailed over 7 months for this. SMH

    Why does congress need to call for probes into this? Both at the state and federal level there are laws against false claims. Enforce them. Send the higher ups in the company to jail over this. I guarantee you it would stop overnight. But when government treats corporations as too big to prosecute, the corporations continue this behavior

      Simple: there were mo false claims here. The issue is that there is a lot of ambiguity in state laws regarding rentals of property. That ambiguity becomes even worse when the car is driven from state to state.
      Some states consider a car that is no longer under a contract to be a theft, based on the definition in their penal code. Intentionally depraving an individual or entity of property or use of said property is considered larceny in most states.
      Other states have laws that make this not a larceny if you voluntarily handed them the keys (possession), regardless of what happened later.
      Yet other states simply see this as an issue of an unpaid contract/breach of contract.
      If you rent from a state where it’s auto theft, then the company can report it stolen. However, that report goes to all 50 states and Canada. If the vehicle is then stopped in another state and it shows up as stolen, they will arrest you, even if that state’s laws don’t see it as a theft.
      Interstate commerce is a federal concern, so they see it fit to investigate.
      My issue is that courts have already ruled on most of these cases, and investigations took place. After the Congress investigated this and finds no major issues with Hertz, will these known anti-corporate legislators hold press conferences to notify of the findings? No. That will get no air time.

    1:01 “accidentally reported as stolen,” Hertz was “deliberately” valid rentals as stolen! 3:36 “valid claim,” getting arrested on false car theft charges with a Hertz rental receipt is a valid claim.

    As a former Hartz employee from Los Angeles I can truly say that they were perfect with their customers service I was a retired person that worked for a large aircraft company and I was trained very well at Hartz but you don't no how offal those customers were they would rent a car on their c
    Credit card then leave and go spend all the money that was on the card they would steal the batterys the tires leave the car park any where they would get it for one price because of a special then they would not follow the rules of the special they would rent the car for under age kids and o those gold customers the would have a certain class car in their profile from their company then they would upgrade and then come back and lie and say they didn't upgrade because they didn't want to pay the difference and i can't forget the new York customers they were some of the most offensive people to serve a one lady that had a complaint coupons that was good for a year she had it for two and a half years and came back and said she did read it so she didn't know it was expired but she new to keep it and use two years later and management said just take it because she is going to complaint again that is why she got that one for 100.00. Only if people new what customers service workers go through
    That is why so many people did not return to those jobs o by the way I also had a job with the airline industry and I am glad that I am two old now

    It took Anna more than five minutes to get there, but she did finally get to the core of the issue. When cares are not returned when they are due, after a certain number of days, Hertz reports the car as stolen. Contrary to what they told CBS however, when they recover the cars, they do NOT report them as recovered, at least, not in a way that gets the license plate out of the national reporting system. So the cars get recovered, and re-rented, while still showing as stolen.
