Prosecutors would have a hard time trying to prove he was attempting to kill him. He was carjacking and kid threw a bottle at him so he fired the gun. Easier to prove aggravated assault and make that charge stick

@@Christoph-ub5oe It gets complicated because prosecutors have to prove that the gun man's intention was to kill that night. Defense attorneys can argue that his intent was to just steal the car and shooting the boy was something that happened in the spur of the moment. They could say his gun was just meant for intimidation. If prosecutors cannot prove intent, then the case gets dropped. It's much easier to prove aggravated assault charges.
@@sarahkim4585 Also, it should be mentioned (I don't live in Texas but I learned this from a cop from Texas in the comments below a video regarding another shooting in which a police officer and the suspect both shot at each other and both lived ) that aggravated assault carries the exact same penalty in Texas and is far easier to pursue as @sarahkim4585 stated. In the other video, the cop was shot in his leg, and the defense attorney would probably be able to convince the jury that the suspect did not attempt to kill the cop, even if the kid was attempting to murder the cop and the pistol slipped downward during the shootout. So, the guy would get off on the attempted murder charge in that case most likely. Whereas the prosecutor only has to prove the suspect used the pistol recklessly, and the officer was injured, which is pretty much all they would need for aggravated assault considering the suspect had no reason to be shooting in the first place. In this case, if a defense lawyer could convince a jury that their client was on drugs and/or was having a mental health episode, the prosecutor would have difficulty proving that in his mind he meant to kill the teenager. Aggravated assault would only have to prove the guy knew enough to be committing a crime and recklessly fired at the kid. I am no lawyer, but something along those lines. If the sentence in a certain case is 40 years for attempted murder, a person will get 40 years for aggravated assault, at least as far as I understand. It just does not sound as 'harsh' when one thinks of aggravated assault as someone getting into a bar fight, whereas attempted murder is someone clearly meant to kill another.

It’s not attempted murder, it’s aggravated assault with a deadly weapon because the son confronted him with a weapon first and if they were to charge the robber with attempted murder, then he could just say he was defending himself from the bottle and then he would get off Scott free so it makes a lot more sense to charge him with aggravated assault with a deadly weapon

@@C-24-Brandan Thank you for the reply although it is only partially correct because there is a charge for felony murder and in this case that person could be charged with attempted felony murder that's when someone is killed or almost killed in the result of a serious crime being committed and that is a way more serious charge than aggravated assault. The moment you pull out a deadly weapon against somebody else and you use it, it should automatically be attempted felony murder and if the person dies as a result, then it's a felony murder. PERIOD!
