Ok. The ruling means they dodged making a decision. It will come back. There are 4 questions here. Did the FDA misadminister the drug? can a state ban the use of a product within its own boundaries? I'd say yes. Can a state prohibit the possession of a product within its own boundaries? This one is muddled. There are products you can be in possession of, but not use. Stupid, but when politics and law collide, you get situations like that. And can a state prohibit the delivery of a product across state lines. A little bit less muddled, but interstate commerce law tends to punt this decision to the Federal level.

I have my issues with the current Supreme Court but this call was definitely the right one! Once Justice Alito and extremest Justice C. Thomas are replaced with hopefully 2 progressive Justices then the court will be balanced again with a 5 (rep), 4 (dem) court. Congress on all sides my be extremest but the Sumpreme Court might be ok
