Honestly the fact you were so honest and clearly not knowing, I wouldn't of given you a ticket. You weren't doing any malicious or unsafe. It was a true learning point. I wish officers would be more chill at times but I also work with a large agency where we don't make profit off traffic citations. This is a little ridiculous in my personal/ professional opinion.
It doesn’t matter what he said to the cop, in the state of Pennsylvania, if you’re driving a vehicle towing a trailer and the combination weight is over 26,001 lbs. you need a cdl,, doesn’t matter weather it’s for a business or personal. They have been getting stricter about enforcing this due to the number of RV owners who do not have cdl’s..

Watching this video was literally like stepping in to a time machine and traveling 7 years in to the past when I started my own business. All I had was a 3/4 ton truck and a 30 foot gooseneck and a normal driver's license and I thought I could just start a hauling business. I literally had the exact same thing happen to me, got pulled over with an empty trailer and got the same fine.. that marked the start of me learning all the DOT guidelines by getting pulled over and fined until I was eventually legal. You handled it much better than I did man good job. I hope you have a much smoother journey than I did.

A side note. Get the road rules, laws and regulations book from the state DOT/ BMV where the ticket occurred. Check your warnings, fines and citations/ tickets you are given against the book before paying. Those tickets etc can really hurt your license as a hauler.
DOT can be a lot more complicated than many people believe. If you have a Truck GVWR or 10,000, and a Trailer of 10,000, you're way under 26,000 so no CDL required. The DOT officer will also look at tire weight range too. A lot of people go buy cheaper tires that might be range D instead of E. So even if you're hauling under 26,000, and under your GVWR, you might still be over loaded on tire weight limits. If you don't put your loads on the trailer correctly, you might be under max gvwr, but you might be over on one of your axle limits.
Question. If you have a 26ft box truck and the gvr says 33,000 but at the weigh station it says 16,000 empty can you still get shut down without a cdl? The truck is registered at 26,000. The actual weight of the truck is 16,000 not 33,000 like the gvwr says. If proof from a weigh station is shown as far as the actual weight of the vehicle do you believe the driver should be alright as long as they never hit that 26,000 mark?

Just so you know, it is your right, constitutionally protected, and supreme court upheld, that you can record ANY interaction with ANY public worker i.e. highway patrol, county sheriff, city police, mayor, clerk,... They are public servants and do not have the right to privacy while performing their public service. Also, ANY act or sight that can be seen from a public place has NO assumption of privacy. @Security laws are not laws as you suggested. They are not always black and white and the purpose laws are created is not for Revenue but for Public Safety and assistance. Police officers are supposed to be able to use discretion because there are a lot of laws that are gray areas. You could safely pass a farm vehicle on a double yellow line or a mail truck on a double yellow line. There are times were rolling stops are much safer than coming to a complete stop. There are times that traffic lights do not change signals and you have to run the red light. Laws are not always black and white and officers are supposed to use discretion and their main objective is supposed to be to serve the public not to generate Revenue.
One of the companies I worked for. Switched the trailer ID info plate .They used one from a trailer that wouldn't require a class A license. They got away with it, until it was in a accident. Once all the information was required for the accident report/tickets.The cop realized the trailer was not correctly labeled. That really started problems, trailer red tagged. Driver didn't have a class A license only A class B .The trailer required a class A driver.So after a two hour inspection and dozens of tickets being given. Both the company and driver who claimed he didn't know about the trailer ID tag change .Received huge fines and points against them.
Oh and the trailer had to be flat bed towed.The ID tag change meant it wasn't legally registered .Wound up having to have the trailer inspected and new lable installed.

He could have been an asshole but wasn’t. @@ogshrimp219 I drive a semi and i got a ticket for weighing almost 87k last year. I was hauling grain and i did not have to drop my trailer. They almost never make us drop, just fine us a lot. It was around a $6,000 for the over weight ticket i believe.
De-rate your trailer vin# plate to 12,000 lbs and NEVER TELL THEM NOTHING ABOUT YOUR BUSINESS/COMPANY... Put NOT FOR HIRE stickers/magnets on both truck & trailer if pulled over tell them its for personal use
It does very by state but problem here is since he using as a business to create content jack could be put under those law's needing a CDL since he is using to make money. Yes legally speaking you are bound by the gcwr of ypur truck and trailer NOT the actual weight. So if you're trauler and truck combo are above 26k you are illegal without a cdl.
I wish that all states would have the same rules for vehicles above xx,xxx lbs. Then it is no longer a game, it would be the same BUSINESS for everyone. Nothing but a revenue generator. Technically, you were in the wrong if you were loaded. This BS of a trailer CAPABLE of hauling 10,000 lbs or more is just wrong. Just because you can don't mean you will. Anyone can overload a trailer. A derated trailer will be used above that, if you are THAT conscious of what you weigh. I would have told him you were headed to a parade. I haul my stuff for me. I don't need all the BS for crossing state lines and commerce. Do I believe in Safety? Absolutely. I also believe in leaving educated people in the industry alone.
With new trucks being rated so high, many people don't take this into account. This is also why some people are buying SRW instead of DRW. One solution is to buy an older, lower rated truck, or buy a trailer rated for less. If your trailer is rated for 17k, find something rated for 14k or less. It will still haul the trucks you haul without a problem (considering a 10k trailer would do what you need).
Safety blitz is no joke. I'm fully compliant Class A and I usually do a 34hr+ at home. CDOT will find something on a brand new combination, it's their job.
So your truck was GVRW 11,350 and you said you had a 15k trailer. If you would have said you had a 14k trailer would you still have gotten a ticket? If you would have had USDOT numbers and a CDL would you have been able to not get a ticket? If you had your CDL and USDOT numbers would you have to had your truck plated for 28k in Pennsylvania to not get a ticket?
When you buy a new trailer you can get the manufacture to de-rate the trailer by getting you a sticker with whatever weight you need to be under 26k lbs. that’s how you avoid getting a CDL.

I actually saw that trailer parked at that rest stop when I was on my way to visit family in Virginia! My wife and I both thought it was odd to be there but figured it was for a Hot-shot that had a mechanical failure and was just getting the truck serviced. What a small world!
If at all possible don’t get a DOT number and just use “Private Not For Hire” on the side of your truck. If you get the Dot number you have more regulations that you have to comply with as well as being required to enter weigh stations when open. Being that you are just pulling your own business stuff around and not going after other freight Private Not For Hire would be my suggestion on the way to go.

Scales or not wouldn't matter in the ways of his use of the rig. But if he did de-scale the trailer for his particular use and didn't cross those numbers which with simple math would be fairly easy to stay under he would be ok👍 but personally the direction Jack is headed I'd get CDL and some color matched dot stickers 🤘
I had my gooseneck trailer de-rated by 1000 lbs. This keeps the trailer and tow vehicle at 26,000 lbs. No CDL License required. You still need to have a DOT medical card and DOT registration in Pa. if your driving for a business.
I’ve never heard of something like that in Louisiana. People pull goosenecks with backhoes and dozers all the time with no CDLs or DOT numbers because it’s under 26,000 and for either private use or for a small business. And so many people pull 5th wheels and to me it’s the same concept

Go get your cdl. Class A. Not to bad to do. Worth it in the long run. Make sure you get endorsements like air brakes just for safe measure cause you never know where you may end up in the future. Good luck man!
I agree. Get a class A from the start with Air brake and tanker endorsement. You'll also need a medical card. Honesty is always the best policy, but in this case you offered too much information to the cop. Keep the great videos coming!
Get all the endorsements offered (double-triple trailers, tanker, etc.) Each are only a few extra questions on the written exam. They're easy to get and will give you maximum flexibility.
There you go all you may sayers. They go based off what the six sticker says on the truck and the sticker that says on the trailer so if you have a Dooley at 14,000 pounds and you have a trailer at 14,000 pounds you get pulled over you’re technically required to have a CDL whether or not you’re pulling that kind of weight they go based off the stickers of the truck and trailer. And this video proves my point.!.. even if he wasn’t using it for a business the fact is his combined weight that his rig is capable of hauling is over 26,100, do you need a CDL. Period. That is why trailer manufacturers has something called the reading or this is a non-CDL trailer.
Depends on the state whether you need more than a standard DL for 26K+ lbs for noncommercial use (1T dually w/5th wheel camper for example). I think TX requires it. Sounds like his state it's a no, but he brought up "business" to the trooper. In MN there isn't a special requirement.
You can thank big Tex for putting gvwr higher then 14k. They include the transfer weight witch screws you in this case. Load trail gvwrs the same exact set up at 14k like it should seem as the axles are 2 7ks witch you would be just fine without a cdl as you’d only be at 25500
Only if you have a [non] CDL class A license.... otherwise the you can only have a 10k trailer. The 14k trailer automatically puts you into that territory.
I'd say with what he's towing and doing with the truck, it'd probly be best to just get the CDL, with a DOT #, I would say its best to get one, but Dang that's hard to make look good on the side of a truck, maybe if you can get it on a magnet then you can take it off when you don't need it.....

CDL is baloney for pick up truck. This is not a semi. It seems so dopey when you use regular brakes and trailer length could be same as other trailers of lighter weights depending on trailer. Just brake sooner and don't follow as close. One would think.
This reminded me of the time I was pulled over by a Tennessee state trooper because he thought I wasn't wearing a seat belt. I was driving a company van and the seat belt was the same color as my jacket. He then proceeded to tell me that I had to have a CDL because I was driving a commercial vehicle. I informed him that I had been pulled over in company vehicles and had gone through several license and registration checkpoints in the time that I had been working for the company and nobody had ever told me that I needed a CDL. He proceeded to tell me that he was going to let me off with a warning. I told my boss about it and he called the Department of Safety to ask about it. They said that they wished he would have written the ticket so he would get educated by the judge when I went to court to fight it.

We de-rated our GN trailer from 15,900 to 14,400 for this exact reason. We have a 2007 LBZ so that combination wouldn’t have met the CDL criteria but we are looking at new trucks and for GVWR purposes we can only buy a 6.6 diesel in a 2500 or a 6.6 gas in a 3500. Both trucks have a GVWR near 11,500. The 2017-19 3500 has the same 11,500 GVWR. It’s a numbers game and is different due to different specs and truck builds. Dually, 2wd, different cab configurations, engines, etc… all changes the GVWR slightly.
for those who somehow don't know or didn't pay attention, in minnesota it says right on your physical license, you cannot drive anything over 26000 gvw. i have a cdl so that doesn't apply, but yah. pretty common knowledge. thats why all your rental penske trucks and whatnot are rated at 26000.

If the truck and trailer (with or without cargo) weigh MORE than 26,001 POUNDS, a CDL is required. Anything less than that doesn’t require anything but a drivers license. You don’t need DOT #’s or an authority or an MC #. Only if you’re more than 26,001 pounds. Each state can not dictate certain weights like he’s saying in PA anything over 17,001 pounds is considered for business use. That’s false. Like 1000000% false. It’s either 26,001 or 26,000 less pounds.
Learned that lesson about 10 years ago. One of the reasons that I stopped buying GM diesels that have a GVW of over 10K. RAM at least keeps their 2500 at 10K.
The thing people mostly do not understand is the Definition of what is considered a commercial motor vehicle, The basic CMV definition is found in 49 CFR 390.5. This definition refers to a vehicle used on a highway, in interstate commerce, that meets any one of the following criteria: Has a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR), or gross vehicle weight (GVW) or gross combination weight (GCW) of 10,001 pounds or more, whichever is greater. Plus other areas as carrying passengers and hazardous materials. You need a CDL Class A if your combination is over 26,001 pounds and your trailer GVWR is more than 10,000 pounds. Class B if your GVWR of the "straight" truck is over 26,001 pounds. Also the other term interstate commerce means if you are making money for a business in any form you are qualified for commercial vehicle. I was DOT back in the day, the officer who stopped you did exactly what he was trained to do. Although the laws are federal, states can add their own as long as they are more restrictive and states can dictate what officers can let slide and what can not when it comes to writing tickets. If this officer had let this slide and you got into an accident afterwards liability can fall back towards that officer or department or agency possibly, the reason most laws regarding federal regs don't slide.
i believe it is the combination of both truck and trailer, GCWR . Not the actual weight. The truck. GVWR was 11,350 + 15,000 trailer =26,350 So he is over the 26,000 regular D.L For RV towing you can get a Non-Commercial A licesen for over 26,000 GCWR. So he probably needs the CDL for the business.
That empty trailer only weighs like 6 0r 7000 lbs so it's not overweight as it is , so if Pennsylvania is fining for an unloaded trailer that's bullshit I don't care how the dot wants to manipulate it, they dont fine 18 wheelers empty , only when there loaded and overweight
total BS, GCWR is 27,000lbs on that truck. its built that way from General motors. you dont need an MCP or a CDL to dirve your truck and trailer within limits it was manufactured for.
You can depending on your use of trailer such as an RV a higher rated capacity drivers license than 26k pounds but not for commercial purposes in some states. So if you have an RV for personal use you are not commercial so you do not need CDL but need higher rating of lincese with tests to drive higher GVWR for personal use.

Watching this video was literally like stepping in to a time machine and traveling 7 years in to the past when I started my own business. All I had was a 3/4 ton truck and a 30 foot gooseneck and a normal driver's license and I thought I could just start a hauling business. I literally had the exact same thing happen to me, got pulled over with an empty trailer and got the same fine.. that marked the start of me learning all the DOT guidelines by getting pulled over and fined until I was eventually legal. You handled it much better than I did man good job. I hope you have a much smoother journey than I did.

A side note. Get the road rules, laws and regulations book from the state DOT/ BMV where the ticket occurred. Check your warnings, fines and citations/ tickets you are given against the book before paying. Those tickets etc can really hurt your license as a hauler.
Also, rules for adjacent states you may haul in or through.
DOT can be a lot more complicated than many people believe. If you have a Truck GVWR or 10,000, and a Trailer of 10,000, you're way under 26,000 so no CDL required. The DOT officer will also look at tire weight range too. A lot of people go buy cheaper tires that might be range D instead of E. So even if you're hauling under 26,000, and under your GVWR, you might still be over loaded on tire weight limits. If you don't put your loads on the trailer correctly, you might be under max gvwr, but you might be over on one of your axle limits.

Question. If you have a 26ft box truck and the gvr says 33,000 but at the weigh station it says 16,000 empty can you still get shut down without a cdl? The truck is registered at 26,000. The actual weight of the truck is 16,000 not 33,000 like the gvwr says. If proof from a weigh station is shown as far as the actual weight of the vehicle do you believe the driver should be alright as long as they never hit that 26,000 mark?

Police officers are supposed to be able to use discretion because there are a lot of laws that are gray areas.
You could safely pass a farm vehicle on a double yellow line or a mail truck on a double yellow line. There are times were rolling stops are much safer than coming to a complete stop. There are times that traffic lights do not change signals and you have to run the red light.
Laws are not always black and white and officers are supposed to use discretion and their main objective is supposed to be to serve the public not to generate Revenue.
The fact that he is inhibiting commercial tasks because the state needs to know exactly what you own and are doing is absolutely ridiculous.

One of the companies I worked for. Switched the trailer ID info plate .They used one from a trailer that wouldn't require a class A license. They got away with it, until it was in a accident. Once all the information was required for the accident report/tickets.The cop realized the trailer was not correctly labeled. That really started problems, trailer red tagged. Driver didn't have a class A license only A class B .The trailer required a class A driver.So after a two hour inspection and dozens of tickets being given. Both the company and driver who claimed he didn't know about the trailer ID tag change .Received huge fines and points against them.
Oh and the trailer had to be flat bed towed.The ID tag change meant it
wasn't legally registered .Wound up having to have the trailer inspected and new lable installed.

He could have been an asshole but wasn’t. @@ogshrimp219 I drive a semi and i got a ticket for weighing almost 87k last year. I was hauling grain and i did not have to drop my trailer. They almost never make us drop, just fine us a lot. It was around a $6,000 for the over weight ticket i believe.
De-rate your trailer vin# plate to 12,000 lbs and NEVER TELL THEM NOTHING ABOUT YOUR BUSINESS/COMPANY... Put NOT FOR HIRE stickers/magnets on both truck & trailer if pulled over tell them its for personal use

I wish that all states would have the same rules for vehicles above xx,xxx lbs. Then it is no longer a game, it would be the same BUSINESS for everyone. Nothing but a revenue generator. Technically, you were in the wrong if you were loaded. This BS of a trailer CAPABLE of hauling 10,000 lbs or more is just wrong. Just because you can don't mean you will. Anyone can overload a trailer. A derated trailer will be used above that, if you are THAT conscious of what you weigh. I would have told him you were headed to a parade. I haul my stuff for me. I don't need all the BS for crossing state lines and commerce. Do I believe in Safety? Absolutely. I also believe in leaving educated people in the industry alone.
With new trucks being rated so high, many people don't take this into account. This is also why some people are buying SRW instead of DRW.
One solution is to buy an older, lower rated truck, or buy a trailer rated for less.
If your trailer is rated for 17k, find something rated for 14k or less. It will still haul the trucks you haul without a problem (considering a 10k trailer would do what you need).

Safety blitz is no joke. I'm fully compliant Class A and I usually do a 34hr+ at home. CDOT will find something on a brand new combination, it's their job.
So your truck was GVRW 11,350 and you said you had a 15k trailer. If you would have said you had a 14k trailer would you still have gotten a ticket? If you would have had USDOT numbers and a CDL would you have been able to not get a ticket? If you had your CDL and USDOT numbers would you have to had your truck plated for 28k in Pennsylvania to not get a ticket?

Way to many laws
When you buy a new trailer you can get the manufacture to de-rate the trailer by getting you a sticker with whatever weight you need to be under 26k lbs. that’s how you avoid getting a CDL.
You cannot Derate your truck or trailer in PA.

I actually saw that trailer parked at that rest stop when I was on my way to visit family in Virginia! My wife and I both thought it was odd to be there but figured it was for a Hot-shot that had a mechanical failure and was just getting the truck serviced. What a small world!

If at all possible don’t get a DOT number and just use “Private Not For Hire” on the side of your truck. If you get the Dot number you have more regulations that you have to comply with as well as being required to enter weigh stations when open. Being that you are just pulling your own business stuff around and not going after other freight Private Not For Hire would be my suggestion on the way to go.
But now he's in the system and it's documented. Can't hide any of it anymore really.

Scales or not wouldn't matter in the ways of his use of the rig. But if he did de-scale the trailer for his particular use and didn't cross those numbers which with simple math would be fairly easy to stay under he would be ok👍 but personally the direction Jack is headed I'd get CDL and some color matched dot stickers 🤘
I had my gooseneck trailer de-rated by 1000 lbs. This keeps the trailer and tow vehicle at 26,000 lbs. No CDL License required. You still need to have a DOT medical card and DOT registration in Pa. if your driving for a business.
If you cross a state line and you are pulling a trailer 10000lbs or more you have to have a cdl regardless.
I’ve never heard of something like that in Louisiana. People pull goosenecks with backhoes and dozers all the time with no CDLs or DOT numbers because it’s under 26,000 and for either private use or for a small business. And so many people pull 5th wheels and to me it’s the same concept

Get all the endorsements offered (double-triple trailers, tanker, etc.) Each are only a few extra questions on the written exam. They're easy to get and will give you maximum flexibility.
He is over 26,000 lbs rated capacity. Doesn't matter if he has a business or not. DOT Troopers in every state know this.

They go based off what the six sticker says on the truck and the sticker that says on the trailer so if you have a Dooley at 14,000 pounds and you have a trailer at 14,000 pounds you get pulled over you’re technically required to have a CDL whether or not you’re pulling that kind of weight they go based off the stickers of the truck and trailer. And this video proves my point.!.. even if he wasn’t using it for a business the fact is his combined weight that his rig is capable of hauling is over 26,100, do you need a CDL. Period. That is why trailer manufacturers has something called the reading or this is a non-CDL trailer.
Depends on the state whether you need more than a standard DL for 26K+ lbs for noncommercial use (1T dually w/5th wheel camper for example). I think TX requires it. Sounds like his state it's a no, but he brought up "business" to the trooper. In MN there isn't a special requirement.

Only if you have a [non] CDL class A license.... otherwise the you can only have a 10k trailer. The 14k trailer automatically puts you into that territory.

CDL is baloney for pick up truck. This is not a semi. It seems so dopey when you use regular brakes and trailer length could be same as other trailers of lighter weights depending on trailer. Just brake sooner and don't follow as close. One would think.
This reminded me of the time I was pulled over by a Tennessee state trooper because he thought I wasn't wearing a seat belt. I was driving a company van and the seat belt was the same color as my jacket. He then proceeded to tell me that I had to have a CDL because I was driving a commercial vehicle. I informed him that I had been pulled over in company vehicles and had gone through several license and registration checkpoints in the time that I had been working for the company and nobody had ever told me that I needed a CDL. He proceeded to tell me that he was going to let me off with a warning. I told my boss about it and he called the Department of Safety to ask about it. They said that they wished he would have written the ticket so he would get educated by the judge when I went to court to fight it.
PA is really cracking down on this. I’m pulled over at least once a week getting an inspection

Cameron Bridges if their racing team is commercial they come under DOT. PS, any vehicle can be pulled over for safety inspection, lights, tires, visible stuff. Any cop can do that to any vehicle on a public road. You guys know that.

We de-rated our GN trailer from 15,900 to 14,400 for this exact reason. We have a 2007 LBZ so that combination wouldn’t have met the CDL criteria but we are looking at new trucks and for GVWR purposes we can only buy a 6.6 diesel in a 2500 or a 6.6 gas in a 3500. Both trucks have a GVWR near 11,500. The 2017-19 3500 has the same 11,500 GVWR. It’s a numbers game and is different due to different specs and truck builds. Dually, 2wd, different cab configurations, engines, etc… all changes the GVWR slightly.

Has nothing to do with owning a business or using it for business reasons. The law is point blank clear. If the truck and trailer (with or without cargo) weigh MORE than 26,001 POUNDS, a CDL is required. Anything less than that doesn’t require anything but a drivers license. You don’t need DOT #’s or an authority or an MC #. Only if you’re more than 26,001 pounds. Each state can not dictate certain weights like he’s saying in PA anything over 17,001 pounds is considered for business use. That’s false. Like 1000000% false. It’s either 26,001 or 26,000 less pounds.
Learned that lesson about 10 years ago. One of the reasons that I stopped buying GM diesels that have a GVW of over 10K. RAM at least keeps their 2500 at 10K.

Has a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR), or gross vehicle weight (GVW) or gross combination weight (GCW) of 10,001 pounds or more, whichever is greater. Plus other areas as carrying passengers and hazardous materials. You need a CDL Class A if your combination is over 26,001 pounds and your trailer GVWR is more than 10,000 pounds. Class B if your GVWR of the "straight" truck is over 26,001 pounds. Also the other term interstate commerce means if you are making money for a business in any form you are qualified for commercial vehicle. I was DOT back in the day, the officer who stopped you did exactly what he was trained to do. Although the laws are federal, states can add their own as long as they are more restrictive and states can dictate what officers can let slide and what can not when it comes to writing tickets. If this officer had let this slide and you got into an accident afterwards liability can fall back towards that officer or department or agency possibly, the reason most laws regarding federal regs don't slide.

i believe it is the combination of both truck and trailer, GCWR . Not the actual weight. The truck. GVWR was 11,350 + 15,000 trailer =26,350 So he is over the 26,000 regular D.L For RV towing you can get a Non-Commercial A licesen for over 26,000 GCWR. So he probably needs the CDL for the business.
That empty trailer only weighs like 6 0r 7000 lbs so it's not overweight as it is , so if Pennsylvania is fining for an unloaded trailer that's bullshit I don't care how the dot wants to manipulate it, they dont fine 18 wheelers empty , only when there loaded and overweight
top hand cuz tractor trailer drivers have a cdl. Anything with a gvwr over 26,000 needs a cdl

total BS, GCWR is 27,000lbs on that truck. its built that way from General motors. you dont need an MCP or a CDL to dirve your truck and trailer within limits it was manufactured for.

Ask the dealer to re-vin the trailer to lower gvw and keep it under 26k

Question are your "pretty wheels and tires" load compliant? TIres would have to be at least load range E 10 ply to handle towing.

You can depending on your use of trailer such as an RV a higher rated capacity drivers license than 26k pounds but not for commercial purposes in some states. So if you have an RV for personal use you are not commercial so you do not need CDL but need higher rating of lincese with tests to drive higher GVWR for personal use.
