In June, they had to stop construction and were faced with tearing it down because they deviated from plans that were approved by the North Shore Village Association, which sued.

@@whatever5922 Yes. Some cities require builders to start an HOA. When the neighborhood is finished the residents can decide to disband it. All we needed was 65% of all the neighbors to agree and sign a petition.
@@whatever5922 And it’s been about 12 years and our neighborhood didn’t fall into ruins or get crime ridden. And our property values have gone up. None of the fears people said would happen, happened.
It depends on state law, how the HOA was formed, the size of the community, the terms of the CC&Rs that were used to constitute the HOA and a host of other applicable legal requirements. It’s not a simple up/down vote. Not by any stretch of the imagination. That may be all an end user homeowner may see but there’s MUCH more involved than that. I’m an attorney and longtime HOA resident in multiple states thanks to my 25 year military career and I’ve been down this road more than a few times.
It takes a heck of a lot more than just some signatures. An HOA is a legal entity consisting of membership in the HOA and the legal entity (the HOA) itself to both agree to dissolution.
Exactly why I will NEVER live somewhere with a homeowners association. Many of them are tyrannical. 👎🏻

When we bought our house the only requirement I was unwilling to budge on was not having an HOA. I could be flexible on location, price, number of bedrooms/bathrooms, square footage, lot size, etc. But a house with an HOA was an instant dealbreaker.

I'm so glad this couple got to continue to build, here! That board was RIDICULOUS, giving these people such a hard time when they were being considerate of the landscape surrounding the home! What is wrong with people? My goodness...misery loves company!

I was part of an HOA whose board members didn’t know the difference between renting month to month and leasing. As a former multi family property manager, I finally gave up since they would not listen to my experience with both terms. I sold my townhouse (for a good profit in a high demand area), and will never, ever again be part of an HOA.
Renting leasing is the same thing. The only people who say it’s differnet are just trying to make money.

The HOA Should have to pay the owners and construction company for the delay. This is absolute bullshit what they did to this couple.
The homeowner should have submitted changes to the HOA before they started building. That would have been the smart thing to do.
The construction company was independent. Plans were submitted and approved. The builder had no liability. They DID receive a $5,000.00 settlement from the HOA for the three month delay. I'm sure it didn't cover the added costs.
This was Three years ago. Hopefully everything has been resolved.
That's what the HOA gets for filing a frivolous lawsuit...three of them are going to be fired and the house owners win...gotta love when justice shines through!!!

This is very simple, this is a lot of property was a lot of property, and when the lot was empty everyone was enjoying a free view of the Lake. Yes, it was a free view, at no cost to the other property owners. The man or family that purchased a lot are paying for it with their hard earned money, they’re also improving the lot with a nice home. Now that the house is blocking the other neighbors views all the other neighbors are now upset. Whichever neighbor is the most at upset, they should have purchased that lakefront property with their own money, and in doing so they would have the right to enjoy their view that they would pay for by purchasing that property for themselves. Whiny neighbors only wanting to steal a free view, God bless the owners of the lakefront property, and I sure hope you enjoy it very much.

Also, sounded like 98% of the hood was in favor of the beautiful home and had sense enough to realize that it would increase the comps of their own home. Others weren’t sharpest tools in the shed, just jealous neighbors living on a crappy lot with much less sq footage!!

I was actually looking at the previous video and it seems that the only one complaint was from the HOA president. Like he was mad because HE didn't t give the okay before the changes were made.

I live in Toronto and my jaw dropped. For 500k you can get a skanky apartment at Jane and Finch.
Moral of the story: Read and understand the HOA agreement before buying the property. If you can't or won't follow the rules in the agreement, don't be surprised when there are complaints.

The individuals that were complaining about this build were probably living across the street and were upset that a house was now going to be blocking their picturesque view of the lake. Also, the house probably looks better than their own house and is in the nicer lot. People need to be made aware, that their authority STOPS at their property line.
That house is a half million? My house looks like a Shack in Seattle and it costs 480k. I hate it here i swear.
A house like that in my area will cost around $220k ....
It was 200k and only because they built it. The other money came from buying the land to build the house on.
I live in the north east. House like that on the water is worth over 1.2 million.
These HOA's have lost it! Our HOA told our elderly neighbor they were going to be fined because their landscaping extended 6 to 12 inches (depending on the location) over their property line onto common space. The common space is weeds and dirt and the HOA has NO plans to ever put anything there anyways. Like who is walking around with a ruler measuring this stuff? They need lives and have nothing better to do!

Disband the HOA and put pressure on the 3 that had the project halted for personal reasons and make them pay for the delay, pain and suffering.
The Homeowners Association in this video needs to either back off or get shut down and placed behind bars for harassment.
As a builder, I'm dumbfounded by this whole situation. Rotating the house 7 degrees is nothing more than a field change that's meant to address conditions on-site. And moving it over 11 feet on their own land? Holy crap, you gotta be joking xD HOAs need to be removed and replaced with a much more American system.

The new home looks much better than the surrounding homes anway. The neighbors should be glad something nice was built. In another video you can see two homes across the street that are kind of ugly.

They changed the plans from what it was approved for, they are to blame. It doesn't sound like much, but moving the house 11' and altering the direction of the house, wasn't approved. My guess the people next door complained because it hid their house more from the street as it was set back more. I would have said earlier when it was just framed ok we'll do just like the plan says. Then went out the next day and cut down every tree in the way. People would've shit their pants and been more pissed off. They couldn't win for losing.
It said the neighbors were on their side and the HOA was the one that made it an issue. The residents also went after the HOA in the previous video.
Such a corrupt and dishonest HOA. This should have been a simple matter of submitting the new plan to the architectual committee, and being approved.

Another example of an “HOA” / “Board” being a BAD idea to have ... other people (often they don’t even live in the neighborhood) telling home owners how to have their own private property laid out and maintained!!! Get rid of these associations / boards!!!!!
The only HOA boards who don’t live in the neighborhood would be new developments still being built. Once the development is complete the HOA transfers to the homeowners. I’ve lived in several HOA’s and enjoyed the lifestyle where my neighbors couldn’t paint their house a hideous color, or leave broken down cars sitting on their property as an eyesore.

Don't let me catch you parked more than exactly twelve inches from the curb either, and I will be measuring the road grade to ensure you have your wheels cocked the correct direction. I have a tread depth gauge too, so you better make sure you have more than 2mm of tread in the two adjacent centerline treads or that's an improper equipment ticket (and the wear bars don't indicate until 1mm-too late). I'll go even further- I'll make sure my traffic cop buddy sits at the interstate on-ramp to make sure you get a ticket for speeding outside the acceleration lane because you're technically supposed to maintain the road's current limit until fully in the acceleration lane. Don't forget that even exceeding the speed limit by even 1 mph is still a moving violation, too. Someone has to police the idiots who can’t follow simple rules.

When my husband and I got married he already owed a townhouse in a community with an HOA. It was an ongoing nightmare to deal with them. So glad we sold and got out of there.

It was a settlement agreement between the owners of the house and HOA. HOA settled for 5500$ from the owners instead of having to go further in the lawsuit.

The deal is IF you live in a half way decent subdivision that you work your ass off to build a nice home, SIMPLY STUDY, READ AND RE-Read the HOA BYLAWS and guidelines BEFORE EVER BUYING A LOT. trust me, I’ve had a nit picky hoa yet I was ever so thankful that bubba couldn’t pile cars up on concrete blocks, constantly park in street, campers or boats in drive permanently, crappy lawn that was never maintained, etc. now if none of those things bother you, then live somewhere without your HOA but many of us choose to live neighborly and guidelines to maintain a beautiful community.

I live up North and I am not aware of any HOA's but it seems out West and down South they are very popular question is what is up with this? I have friends who live in Colorado and you think you could purchase a piece of property and build your home but it seems like most of the land is owned by a big developer and you are stuck purchasing land from them and letting them build your home and also being part of a HOA. I am from New England and I purchased eight acres pulled a permit and built my home. The town was easy to deal with.
And this is the reason I would never ever move to a neighborhood that you have to pay homeowners association fees some one just thought up of something make someone Rich .and give you more headaches for no reason.I know people that live in neighborhoods that have to pay homeowners association fees and the things that they are supposed to do for the neighborhood never gets done.
I found the perfect home once in the perfect location, asked for HOA information and noticed the six board members were all related! Husband and wife, their son and his wife and a sibling and his wife. Hard nope.

You already have something like HOA's. According to some BBC shows I've watched, you have to get approval from some sort of city/village council to do any remodeling & it requires approval from the neighborhood. That's similar to an HOA telling you what you can/can't do.

A bunch of joyless mood hoovers with nothing better to do. The neighbours who could see the home from theirs were happy with the move. Those protesting against it weren’t even affected by it but felt the need to try and financially ruin a family. You have to wonder what makes people want to go out of their way to make other peoples lives harder for no real reason.
I’ll never forget the time I received a certified letter that my mailbox was leaning only cm’s to the right yet when I went and looked at it, I thought it leaned to left!! So some idiot had to go OUT OF THEIR WAY, to ride around with a leveler I guess. It was complete BS. There were a couple other instances in the 10 years we lived there but it was almost always nitpicking items.
