Lawyer reveals how to stop HR destroying harassment cases and the ONE THING you must always do.

- A TikTok attorney has left viewers stunned after sharing his expert advice on how to stop HR departments destroying harassment cases before they even begin.
Ryan Stygar, from San Diego, US, is a labour lawyer who has 1.5 million followers on the social media platform where he regularly shares his knowledge and experience to help others.
In a recent clip, dubbed "classic HR trap", which has racked up over one million views and over 96,000 likes, Ryan gives tips on navigating making harassment complaints.
He claims that some HR reps will want to kill the paper trail before it starts by insisting on a phone call or face-to-face conversation to discuss the alleged harassment.
However, Ryan says that by doing so, the employee could weaken their case.
He then goes on to explain how you should approach the situation instead.
"Go ahead and take the call. There's no need to get confrontational but after the call or the meeting you need to send an email re-capping what you discussed," he says in the clip.
He then includes an email template in the TikTok, which could be used as evidence in a potential court case, which details times, dates and what the complaint entails, as well as quotes from the call or meeting.
Ryan ends the video by saying: "Any employment case is only as strong as the evidence."
This advice has resonated with his viewers with hundreds of people taking to the comments section to share their thoughts.
One viewer said: "ALWAYS LEAVE A PAPER TRAIL!" followed by clapping emojis. [sic]
"Yes, and they need to stop writing 'per our discussion', write it all out!," added someone else. [sic]
"My boss is the best, she is the one who tells us to send an email after any kinda call or issue," said another person.
Some social media users also tried to work out if they are allowed to record the call with HR.
"Why not just record the call?," one person asked, to which Ryan replied: "Illegal without consent in some states, also most audio recordings clients try to give me are useless." [sic]
Another said: "Also remember, some states are at 'one-party consent' which means you can secretly record and it'll be legal." [sic]
It's worth noting different countries will also have different laws.

I would confront the person/people involved and then go straight to a lawyer if it's a serious issue and it's not getting solved. I wouldn't bother speaking to HR without the advice of a lawyer. I remember having some workers in another department be negligent and then lie saying I never called them to report an issue when I did multiple times, my union did not care until it became a class action lawsuit and the company chose to pay all the employees who went to through the same bs. After I quit, HR tried to get me to do an exit interview, I couldn't be bothered reliving that stress and anxiety. I also wrote on paper why I quit on an incident report, they know full well what happened.
I work for CVS. They require computer based learning, but do not want you on the clock while completing the web base training. This is a message from my store manager. Is this legal? I told her I will NOT work off the clock.
"Good evening, I understand we all have modules that need to be completed but we are not to work on them while on the clock/ or when scheduled unless we are super slow(I don't mind) and all task are done...We have to find time on our own to complete them. These are compliance modules that should have been done all along, they are late and in and should have been done...no one is to be clocking in "

How do you report HR? I had a compliant about a boss and they covered it up
HR are the cops. Never think they are "helping" you out in the slightest. Get it in writing and give it to a lawyer. Don't let them know you are speaking with an attorney, ever.
Same! I work at a warehouse and HR let's my managers know when someone makes a complaint about them. Two of my techs got fired that way

Holy SHIT! that's what a the Head of Security did to me when I sent a letter to Corperate to complain about my management bosses for nepotism,racism and harassment. We had( NO H.R. when this happened.)
