Yes you always have to watch you’re speed when slowing down from high speeds, it’s very easy to think you’re slow when you’re actually going a lot faster

@@paulsp2693 Some speed cameras are horribly placed near me. Downhill you could cruise to 40 without accelerating on a road that should be 40 anyway but you have to brake which is terribly inefficient

I’ll be honest once I passed and took the plates off people didn’t tailgate me anywhere near as bad. Some people are just dicks to learners unfortunately you’ve just got to drive at the speed you are comfortable at.

My old man dodged tickets back in the day doing this. He'd have multiple drivers named on a vehicle, they'd ask who was driving and he'd say im not sure and request eveidence from the police to proove who was driving. They never did and he got of with every tickets he's ever had.

My instructor panicked once because we went through part time lights as they just turned on and were red.. Those lights had cameras.. She said if it picked is up she'd get points as well as me

They are legally the driver even though the student is behind the wheel.😊 I would get really stressed if i had to learn without someone being able to brake for me😂
In theory if you have three points on provisional licence but get three more on full licence you go back to learner status. Points last up to 3 year validity (4 for removal) or 10 year validity (11 for removal)

Remember it’s just a maximum speed not a goal speed, just because it is national speed limit it doesn’t mean you should drive at that speed in certain areas. The limit is for perfect conditions, don’t through a back road that is very small and turny at 60.

Speed Cameras Don’t Give Points In The United States 🇺🇸 Because No One Can Identify The Driver However It Goes To The Registered Car Owner But However If Caught By The Police Sheriff Or State Troopers Then Points On License Can Happen Also Be Aware Of A Car Idling That’s Has Chevy Ford Or Dodge Logo Because Police Sheriffs And State Troopers Use Chevy Ford Dodge As Their Police Car
They essentially create a "Ghost license". It's a license record on the police system but it doesn't relate to an actual UK license because the driver doesn't have one. So what happens is they create the record, so that when you actually get a license they add the points to it then. You CAN get points on a provisional license, contrary to what some people seem to believe.
In my eyes that's not how it's supposed to go. In most of Europe the instructor gets the fine. The student driver is still learning and does not have any type of license yet and is bound to make mistakes. Now I do have to say that the rules for driving schools are a bit different here. Here a double control is mandatory and you can only drive without an instructor after getting your license. This is what my instructor told me when I was still having lessons: If a cop pulls us over for speeding, the cop will say that I also have a brake and you still need to learn it.
UK law is clear. The points you made have no relevance and don't apply to the UK. "The learner does not have any type of license". In the UK that's wrong - they have a provisional license - which points can be added to. Also, they're the ones driving, not the instructor. The instructor is there to supervise them, not to be "Blamed" and for them to palm the points off to the instructor when they miss a speed camera and set it off.. The very last person that should be speeding around is a learner. There are tolerances built into the cameras anyway so you have to exceed the speed limit by usually at least 10%+2mph before you even set it off.
Pro tip: when contacted by the court respond back “That lying toe rag” then blame the instructor. The whole point of having an instructor is you don’t have the skills or road sense yet to drive unsupervised. The clues in the name, you are under their instructions, if you stop at a red but they say to go through because “That’s not for you” or you’re on a dual carriageway at 40 and they tell you it’s a 60 because everyone else is doing 80 then you’re just doing what the person with authority over you is telling you to do and the whole point of them being there is that you don’t know enough to challenge their instructions. Snitches can keep the points!
No... your logic seems very odd to say the least. Your view of authority is wrong. The driving instructor doesn't have "authority" over you. They are literally there to supervise YOUR driving. You are the one driving, you are sat in the driver's seat, with the steering wheel, brake, clutch and accelerator. Dual car controls only have a brake and a clutch, no second steering wheel.... Some instructional cars don't even have dual controls and it's not a legal requirement. You have to be a right idiot to condone or suggest to people that they should blame someone else for THEIR own mistakes. I've always said the one thing I hate about this country is a lot of people take no self responsibility and always blame someone else. "It's not my fault I set the speed camera off.... my mates were egging me on to go quicker"... sorry, who's driving?! You are. You can make the decision whether to put your foot down or not, so it's your fault. An instructor is there to supervising your driving, not to be there to blame when you set a speed camera off or go through a red light camera setting that off. You also seem to forget that cameras have thresholds, so to actually set one off in say a 30 limit you'd need to be doing at least 35 or more. In a 40, it's 46 or more... if a learner driver sits at 35 in a 30, or 46 in a 40 for long enough and somehow doesn't notice the speed camera or the obvious white lines on the road then I'd argue they clearly aren't observant enough to be behind the wheel of a car. Even at night in the dark I can always spot a camera quite far down the road and see it in good time.

There are three types of authority, sometimes referred to as power, the words are synonymous in this context. What you seem to be referring to is role authority, the power someone has as a result of their role, typically in an organisation. The classic example of this is your manager in an organisation who can discipline you if you fail to follow a lawful management instruction. A driving instructor has a small amount of this both in that they can refuse to give you lessons and report you to DVLA/C if they believe that your provisional license should be removed, it might also be seen as their ability to use the dual controls, take hold of the steering wheel and manipulate the gearstick (I recall when I first started having lessons if my first instructor felt you weren’t changing gear soon enough would just change it himself rather than telling you to, I stopped using him after my second lesson). The second form of authority is expertise authority, the authority someone has due to being an expert in that area. This is the type of authority I was mostly referring to. As a learner you are under supervision of a much more experienced driver who has a heightened level of expertise because you do not yet have the knowledge and skills to drive safely and in accordance with the law. If the instructor tells you to do something then, unless it is obviously wrong (like they tell you to hit a pedestrian), the expectation is that you will do it. If they tell you that a stretch of road is a 60 limit when you believe that it is a 40 limit then the presumption is that your belief is incorrect due to your lack of knowledge and experience, you lack the expertise in comparison to them. Therefore, if you follow an instruction from them which you have no other reason than your, presumed lacking and erroneous, belief is not correct then the accountability falls on them. The onus is on them to ensure that they only give lawful and correct instructions. The third type of authority is relationship authority, authority that stems from another’s relationship to you, in essence you do things for them because they do things for you. Generally, driving instructors don’t have much if any of that. To summarise, a driving instructor has some role authority but a great deal of expertise authority so if they instruct a student to do something that is unlawful then they must be held ultimately accountable for that.
@@StephenBoothUK Yes, to an extent. However you seem to have forgotten a KEY point. On your logic, if an instructor tells a student to do something wrong, they must be accountable. I agree. HOWEVER. When was the last time you ever heard an instructor tell you to speed past a speed camera and set it off? If anything they teach you to drive slower than the limit as can be seen on plenty of these videos. The chances of a learner setting a speed camera off are extremely low, as they have tolerances built into them. Even so, it's still the learner's fault, they are driving not the instructor, they're ultimately the one with full control whereas the instructor in law is only deemed to have some control of the vehicle (but is required to pay attention and properly supervise). People can argue all they want but the UK law is very clear on this and has been since 1988.
@@thefiestaguy8831 you seem to be getting confused between what is legal and what is right. A lot of wrong things have been legal and right things illegal. In videos on this channel student drivers are shown being told to ignore a red light (in at least one case where a pedestrian was crossing at the light) and to accelerate above 40 on a road they believed to be a 40 limit.
Follow up question. You must conduct 20+ lessons a week. If you did have a speeding ticket in the post, and the photo wasn't clear, do you keep detailed enough records to be able to 100% identify which pupil was driving?
The correct answer is no. It’s the prosecution’s responsibility to identify the driver. You are not obligated to volunteer that information. Don’t be a snitch.
Authorised instructors should legally have to have gps speed limiter on their car………a learner is learning and may end up going over the 20mph speed limit because they are concentrating on the hazards of the road ahead and should be pardoned…or the instructor should take the points as the instructor has dual controls and should have brakes to slow car down to correct speed
If you mean learning how close things are to your right and left side: 1. Set your side mirrors correctly. You should be able to *just* see your back door handle. This will help you judge how far something is from your car when reversing. 2. Park against a kerb and see where the continuation of the kerb sits in your window. Maybe there is a notch in your windscreen wipers that you can remember to say "if the path ahead of me goes over this line, then im too close". Hope that makes sense!

Yes - but only for a maximum of 12 months, then you must exchange it for a UK one by taking a UK driving test if you plan to continue driving in the UK.
Well most instructors have a brake pedal, as well as clutch and access to the steering wheel. Plus they are the one who is meant to know how to drive so would make sense. They would be quick to react if it was to save their car from getting scratched… should take the same care with the learners license in their care.

You don't get points for either of those - they aren't endorsable as they aren't motoring offences. More a "breach of contract" a bit like if you were overstay in a shop car park which had ANPR cameras, you get sent a parking charge notice demanding a sum of money.

That's a court of appeal. By default if you don't name the driver, the registered keeper is then convicted for failing to provide particulars of the driver at the time... so in this case if the instructor (who would receive the NIP through the post) didn't name the driver at the time then she'd get the points, unless of course it was genuinely impossible for her to know who was driving).

@@Adz_Win I think you're talking rubbish. Saying it "will get wiped" as if in every situation it will happen is just plain wrong. IF the conviction was so easily "Wiped" the course wouldn't be so keen to convict people of it in the first place. Imagine if you got convicted of robbery, or GBH from stabbing someone, and then suddenly was told "everyone can get it wiped".... simply doesn't work like that does it? Points naturally come off the license after x amount of years, in the UK it's 4 years (including the admin year). UNLESS it's for drunk driving, death by dangerous or careless driving in which case they stay on the license for 11 years.

She's an instructor and she's talking about with instructors in the UK In the UK, the driver is responsible, however if you wanted to go to court and argue that the instructor was being grossly negligent, you could attempt that. The letter goes to the address and person that the car is registered under, and yes, instructors can do lessons in the learner's car
Not sure what you're talking about. In all of the examples you gave, the answer is still "Yes". Ultimately the driver is liable for the fine and points NO MATTER who's car it was, they're the one driving. The way that it works is they send a letter (NIP) out to the registered keeper of the vehicle, asking them to provide the name and address of the person driving at the time of the offence. When the person does this, they then write to the named driver and either issue a speed awareness course, points and a fine or in some cases a court summons if the speed is excessive enough. If the registered keeper of the vehicle doesn't provide these details - they get prosecuted for failing to provide the details of the driver, UNLESS they can prove to the court that there is genuinely no way for them to know who was driving at the time, only in that case would the court dismiss the whole charge and nobody gets points or a fine. This is far more common with fleet (business vehicles) as each vehicle is typically driven by a different driver, and sometimes more than 1 driver each day.

Shouldn’t it be in the instructor? They have the pedals to slow down and the learners learning. If it’s quite a few mile per hour over then fair enough but if it’s only 1 or 2 it seems a bit mean seen as the learner is probably already focusing on so much.
You missed something quite obvious. In order to set off a speed camera, you need to exceed the speed limit by a threshold amount, usually 10% of the speed limit plus 2 miles per hour, so 35 in a 30, or 46 in a 40, 79 in a 70.. You wouldn't set the speed camera off and receive a NIP in the post for just going "1 to 2 mph over the limit".

London has roads going from 40mph to 20mph, many motorists get speeding tickets.

It was at a roundabout so I passed the lights and didn't see the ones slightly around the bend till already entering if this makes sense

my driving instructor was such a stickler over speed limits. I got a mark for going 29 in a 30 zone. Passed though, so I’m not complaining

Remember it’s just a maximum speed not a goal speed, just because it is national speed limit it doesn’t mean you should drive at that speed in certain areas. The limit is for perfect conditions, don’t through a back road that is very small and turny at 60.

They essentially create a "Ghost license". It's a license record on the police system but it doesn't relate to an actual UK license because the driver doesn't have one. So what happens is they create the record, so that when you actually get a license they add the points to it then.
You CAN get points on a provisional license, contrary to what some people seem to believe.
In my eyes that's not how it's supposed to go. In most of Europe the instructor gets the fine. The student driver is still learning and does not have any type of license yet and is bound to make mistakes. Now I do have to say that the rules for driving schools are a bit different here. Here a double control is mandatory and you can only drive without an instructor after getting your license. This is what my instructor told me when I was still having lessons: If a cop pulls us over for speeding, the cop will say that I also have a brake and you still need to learn it.
UK law is clear. The points you made have no relevance and don't apply to the UK.
"The learner does not have any type of license". In the UK that's wrong - they have a provisional license - which points can be added to.
Also, they're the ones driving, not the instructor. The instructor is there to supervise them, not to be "Blamed" and for them to palm the points off to the instructor when they miss a speed camera and set it off..
The very last person that should be speeding around is a learner. There are tolerances built into the cameras anyway so you have to exceed the speed limit by usually at least 10%+2mph before you even set it off.
Pro tip: when contacted by the court respond back “That lying toe rag” then blame the instructor. The whole point of having an instructor is you don’t have the skills or road sense yet to drive unsupervised. The clues in the name, you are under their instructions, if you stop at a red but they say to go through because “That’s not for you” or you’re on a dual carriageway at 40 and they tell you it’s a 60 because everyone else is doing 80 then you’re just doing what the person with authority over you is telling you to do and the whole point of them being there is that you don’t know enough to challenge their instructions.

Your view of authority is wrong. The driving instructor doesn't have "authority" over you. They are literally there to supervise YOUR driving. You are the one driving, you are sat in the driver's seat, with the steering wheel, brake, clutch and accelerator. Dual car controls only have a brake and a clutch, no second steering wheel....
Some instructional cars don't even have dual controls and it's not a legal requirement.
You have to be a right idiot to condone or suggest to people that they should blame someone else for THEIR own mistakes. I've always said the one thing I hate about this country is a lot of people take no self responsibility and always blame someone else. "It's not my fault I set the speed camera off.... my mates were egging me on to go quicker"... sorry, who's driving?! You are. You can make the decision whether to put your foot down or not, so it's your fault.
An instructor is there to supervising your driving, not to be there to blame when you set a speed camera off or go through a red light camera setting that off.
You also seem to forget that cameras have thresholds, so to actually set one off in say a 30 limit you'd need to be doing at least 35 or more.
In a 40, it's 46 or more... if a learner driver sits at 35 in a 30, or 46 in a 40 for long enough and somehow doesn't notice the speed camera or the obvious white lines on the road then I'd argue they clearly aren't observant enough to be behind the wheel of a car.
Even at night in the dark I can always spot a camera quite far down the road and see it in good time.

What you seem to be referring to is role authority, the power someone has as a result of their role, typically in an organisation. The classic example of this is your manager in an organisation who can discipline you if you fail to follow a lawful management instruction. A driving instructor has a small amount of this both in that they can refuse to give you lessons and report you to DVLA/C if they believe that your provisional license should be removed, it might also be seen as their ability to use the dual controls, take hold of the steering wheel and manipulate the gearstick (I recall when I first started having lessons if my first instructor felt you weren’t changing gear soon enough would just change it himself rather than telling you to, I stopped using him after my second lesson).
The second form of authority is expertise authority, the authority someone has due to being an expert in that area. This is the type of authority I was mostly referring to. As a learner you are under supervision of a much more experienced driver who has a heightened level of expertise because you do not yet have the knowledge and skills to drive safely and in accordance with the law. If the instructor tells you to do something then, unless it is obviously wrong (like they tell you to hit a pedestrian), the expectation is that you will do it. If they tell you that a stretch of road is a 60 limit when you believe that it is a 40 limit then the presumption is that your belief is incorrect due to your lack of knowledge and experience, you lack the expertise in comparison to them. Therefore, if you follow an instruction from them which you have no other reason than your, presumed lacking and erroneous, belief is not correct then the accountability falls on them. The onus is on them to ensure that they only give lawful and correct instructions.
The third type of authority is relationship authority, authority that stems from another’s relationship to you, in essence you do things for them because they do things for you. Generally, driving instructors don’t have much if any of that.
To summarise, a driving instructor has some role authority but a great deal of expertise authority so if they instruct a student to do something that is unlawful then they must be held ultimately accountable for that.

If anything they teach you to drive slower than the limit as can be seen on plenty of these videos. The chances of a learner setting a speed camera off are extremely low, as they have tolerances built into them.
Even so, it's still the learner's fault, they are driving not the instructor, they're ultimately the one with full control whereas the instructor in law is only deemed to have some control of the vehicle (but is required to pay attention and properly supervise).
People can argue all they want but the UK law is very clear on this and has been since 1988.

Follow up question. You must conduct 20+ lessons a week. If you did have a speeding ticket in the post, and the photo wasn't clear, do you keep detailed enough records to be able to 100% identify which pupil was driving?
The correct answer is no. It’s the prosecution’s responsibility to identify the driver. You are not obligated to volunteer that information. Don’t be a snitch.

Authorised instructors should legally have to have gps speed limiter on their car………a learner is learning and may end up going over the 20mph speed limit because they are concentrating on the hazards of the road ahead and should be pardoned…or the instructor should take the points as the instructor has dual controls and should have brakes to slow car down to correct speed

If you mean learning how close things are to your right and left side:
1. Set your side mirrors correctly. You should be able to *just* see your back door handle. This will help you judge how far something is from your car when reversing.
2. Park against a kerb and see where the continuation of the kerb sits in your window. Maybe there is a notch in your windscreen wipers that you can remember to say "if the path ahead of me goes over this line, then im too close". Hope that makes sense!

You don't get points for either of those - they aren't endorsable as they aren't motoring offences. More a "breach of contract" a bit like if you were overstay in a shop car park which had ANPR cameras, you get sent a parking charge notice demanding a sum of money.

That's a court of appeal.
By default if you don't name the driver, the registered keeper is then convicted for failing to provide particulars of the driver at the time... so in this case if the instructor (who would receive the NIP through the post) didn't name the driver at the time then she'd get the points, unless of course it was genuinely impossible for her to know who was driving).

Points naturally come off the license after x amount of years, in the UK it's 4 years (including the admin year).
UNLESS it's for drunk driving, death by dangerous or careless driving in which case they stay on the license for 11 years.

In the UK, the driver is responsible, however if you wanted to go to court and argue that the instructor was being grossly negligent, you could attempt that.
The letter goes to the address and person that the car is registered under, and yes, instructors can do lessons in the learner's car

In all of the examples you gave, the answer is still "Yes". Ultimately the driver is liable for the fine and points NO MATTER who's car it was, they're the one driving.
The way that it works is they send a letter (NIP) out to the registered keeper of the vehicle, asking them to provide the name and address of the person driving at the time of the offence. When the person does this, they then write to the named driver and either issue a speed awareness course, points and a fine or in some cases a court summons if the speed is excessive enough.
If the registered keeper of the vehicle doesn't provide these details - they get prosecuted for failing to provide the details of the driver, UNLESS they can prove to the court that there is genuinely no way for them to know who was driving at the time, only in that case would the court dismiss the whole charge and nobody gets points or a fine. This is far more common with fleet (business vehicles) as each vehicle is typically driven by a different driver, and sometimes more than 1 driver each day.

Shouldn’t it be in the instructor? They have the pedals to slow down and the learners learning. If it’s quite a few mile per hour over then fair enough but if it’s only 1 or 2 it seems a bit mean seen as the learner is probably already focusing on so much.
You missed something quite obvious.
In order to set off a speed camera, you need to exceed the speed limit by a threshold amount, usually 10% of the speed limit plus 2 miles per hour, so 35 in a 30, or 46 in a 40, 79 in a 70..
You wouldn't set the speed camera off and receive a NIP in the post for just going "1 to 2 mph over the limit".
So basically you are paying to learn how to drive but if you get something wrong during the lesson, you have to pay the fine. Nice logic.
