  • Speaking at the 20th edition of the Hindustan Times Leadership Summit, 2022, Chief Justice of India DY Chandrachud said that the law should not be used as an instrument of oppression by those who handle it. He added that judges should have the ability to hear unheard voices and unseen faces in the system as this alone can sustain the judicial institutions in the long run. “Entering chambers of senior counsel -- it's an old boys club. How do you gain access to chambers? By tapping your connections and networks. Until we have a democratised and merit-based access to the entry point in the legal profession, we won't have more women,” said the CJI. Watch his full address here.

    Only a highly intelligent person like CJ Chandracaud can make the statements he makes which are mind-blowing. I can listen to him all day without being bored, he is my favourite SC CJ and shall remain so for the foreseeable future.

    Woke Liberandu Intellectual people found "patriarchy" everywhere in Indian Culture. But the most patriarchal, misogynistic, women suppressive, bigot, regressive culture which also have in India came by invasion from middle east they don't say a single word against it.
    So their motive is not to be against patriarchy but to spread negativity and attack a single community 🙏

    Fantastic! We, citizens of India, are under the safe custody and leadership of Hon.CJI D. Chandrachud who has dealt with every aspect of the Indian Judiciary. The marginalized, dearth of women justices , weak infrastructure at the rural places, gender equality, challenges of social media in the age of internet and the limitations of the Judiciary. I am reminded of Justice V R Krishna Aiyer's and Justice O Chinnappa Reddy's eloquent speeches and judgements in favour of the oppressed laymen. Salute to your concern for the common man, Sir.     Justice system should be upto mathematical correctness , not on biologIcal based miscarriages . Because judges deals with cases of life and death , but astonishing fact is this , sometimes three judges give three different verdicts for same case , is justice system is based upon individual mindset opinion or on law formulas ? Without filling the flaws in justice system only name " justice done " will be a misleading word .

    Yes CJI, but present model of Caste system introduced during the rule of Mughals and British is not yet eliminated by judiciary or political parties after 1947, in 75 years. There are many issues in judiciary, not only undue delay but political leanings, left / right ideology, corruption , exceeding judicial jurisdiction , dynasty etc
    While there are serious issues in democracy, why not resolve the issues within judiciary to start with and let us solve democratic issues after setting our own house in order ?

      Actually there is an exam called HJS exclusively for lawyers to be directly recruited as ADJ at the age of 35.....So it somehow expedites their elevation to DJ and eventually as HC justice(when compared to those in lower judiciary through state judiciary exam) ....But to be directly recruited at the HC or SC , unlike any machanism like upsc, you must appear to be expedient to the collegium.....

    No CJI, CLAT/JEE/NEET are not based on mugging up. CLAT checks for basic math proficiency, you cannot mug it up, Even the GK section is based on whether the candidate reads newspapers or not, nothing is asked beyond that, whether he has the capability to interlink various subjects and make an intelligent guess even if he does not know the answer, negative marking helps here to prevent blind guessing. Similarly the English section checks for verbal ability, since that is the language of the courts. Why don't you just say you want to implement proportional quota and ensure proportional outcomes? Why bend the definition of merit so that the groups who will avail from this redefinition do not feel an inferiority complex for not meeting the standards? Why don't you publish the average cgpas and their correlation with the entrance test scores pre and post this redefinition of merit?(assuming atleast within the college standards remain the same, unlike Tamil Nadu where they had to lower the ceiling so that everyone remain happy)? Entrance exams are not selecting for good people, they select for whether the candidate can meet the rigor of UG and have a fair shot of scoring a 10 pointer, they correlate best with academic success.
    Indian entrance examination system is probably the most fair meritorious selection system that you can have with such a large population even after the reservation policy of 70% of the seats. You want to redefine merit , sure go ahead, bring in the letter of recommendation system and extra curricular and other criteria, let us see then what happens to merit and social justice? You think you are too smart by half, but you ain't judge. Probably your own son did not make it to a top indian college for his UG such as an NLU but thanks to your own connections made it abroad for masters, where such connections are more handy and since then you have some complex.
    Why not just randomly allot students without any tests, abolish all exams and destroy standardisation, let us see how long your universities and institutions stand. The republic will collapse within a century.
    Implement Caste and Gender Quotas in the Officer Entry of the Indian Military as well while you are at it, even that institution needs to collapse if we are gonna go the whole hog on reservation.

      Excellent. Of course no test can predict how well the person will perform later in his profession and anyway that is not the intention of entrance test checking for his merit. What wrong is there in taking coaching classes when even few marks matter in intense competitive environment in our country and that is good. Of course some students may not able to afford it but what can be done? Anyway concessions are there for the best but can't afford. Some parents are responsible and ensure that their children study well and some parents are not but that is no excuse to accommodate the less merited.
      You have a good point in exposing the western system that kills our merit system by including literary activities, recommendation etc.

    If the Supreme Court has trust in the lower courts for them to make independent decisions, without fear or favour, and if the SC is able to support their decisions on appeal, I am sure the SC will not be inundated with many minor cases and issues and will not have to face a backlog of cases. What the SC can do is lay down guidelines for the lower courts to follow on how they can decide cases and appropriate training should be given to them by judges who are selected for this purpose.

    Justice chandrachud has assumed office as CJI . As he is a highly qualified person will he bring about this urgent changes in judiciary ? : (Unfortunately he does not know what is happening in his backyard. PLEASE ALLOW Party-in-persons to argue their cases with out the mischief of registry : Asking silly questions, Raising silly defects, sleeping over it for years and finally ensuring dismissal of case by mischief in defects stage itself and that is happening in Supreme Court and the judges are looking the other side !! The judges are colluding with the registry to do that !!)
    1. In high courts any appeal on decision of single judge must go to a bench of odd number of judges. If CJ is part of bench other judges on bench should be selected by another judge and not CJ. ( There should not be any even nuumber judges bench at all)
    2. Any judgement that does not counter all the points raised in a petition should be automatically considered null and void
    3.Any judgement must consider all the evidences presented and not a few selective ones .Otherwise the judgement should be considered null and void
    (Points 2 & 3 is already there in judges training manual of UP. A team citizens should monitor a case and ensure compliance. Just like jury but unlike jury system here the citizens should be given a check list .)
    4. Any defect raised by registry maybe contested and should be resolved only by a judge this will prevent mischief by registry and now the registry is law unto itself raising silly defects
    5.A party in person should be allowed to argue his case without giving any reason and without answering irrelevant questions like why he cannot engage a lawyer ? etc and without undergoing irrelevant procedures made to harass him and to finally drive him out or to force him to accept a lawyer
    6. Most important the registrar or secretary general should not be allowed to make any rule without approval from a committee of judges appointed by CJI
    7. Also cji should form a committee of judges to do a weekly review of the progress made by the registry. Today registry and secretary general are uncountable. cji should assert his authority over the secretary general.
    Lawyers are least concerned about the flaws in the system but are only after collecting their fee.Please note it is not just speedy justice that is required but also high quality, fair judgment that is more important. However today it is totally lacking in judgements of High courts. Litigants wait for years but judges dispose of cases with out even reading the petition. Only option left for litigants is to go on appeal but even there situation is same or worse.

      Sometime we find even judges strongly rebuking a litigant. or a lawyer or even a govt official or even a government or minister. Often this rebuking expose the judge of his ideology or belief in the personal level. Is such a practice healthy for the common man to repose faith in the judge's impartiality.

    Can ordinary citizens read and understand cases easily available through the internet by the courtesy of the judiciary when the lawyers themselves have problems understanding the judgements as there is no finality and is subject to different interpretations and not forgetting legal jargon? The solution is to simplify the law by the court and judges themselves, they should use simple language and avoid complicated language. The lay citizen should be allowed an audience in the lower courts and allowed to present themselves with the court's assistance on the procedures to be followed.

      Though judiciary considers that ‘justice hurried is justice buried,’
      it is certain that it takes lightly of the sad plight of the ‘victims.’ Placing
      itself in the ‘accused box,’ the Supreme Court of India observes that
      ‘where the termination is questioned as invalid or illegal, the workman
      has to go through the gamut of litigation and his capacity to sustain
      himself throughout the protracted litigation is itself such an awesome
      factor that he may not survive to see the day when relief is granted.
      More so in our system where the law’s proverbial delay has become
      stupefying.

    *Stop the Summer vacation holidays for courts, it was for Britishers, as they used to sail back to UK as they could not bear Indian summer, now India is a free country and the judges are not British, Indian judges can bear Indian Summer, already their are tons of pending cases*

    The Indian judiciary should decide matters before them impartially, on the basis of facts and in accordance with the law, without any restrictions, improper influences, inducements, pressures, threats or interferences, direct or indirect, from any quarter or for any reason. There is a possible threat from the executive trying to wield their power and silence the judiciary and such a threat also exists from the legislative body i.e. the parliament. A balance in power is needed, no individual or group - legislative, executive, or judicial - should have too much power. The judiciary should be able to check the Prime Minster's power when he tries to overstep them or tries to resort to laws when it suits him or his party, otherwise not. The SC judiciary should ensure the rights of ordinary citizens are protected and the fact that the Indian SC is prepared to look at minor cases is a credit to them as this does not happen in the Western democracy where the SC only takes major groundbreaking law proposals or challenges as a criterion before they can intervene.

    There is a constant effort to create a perception that the judicial system lacks speed in justice delivery... The collaboration between legislative and executive for self interest in majority of the cases is the main reason for such a delay, coupled with deliberate lack of amenities, workforce and systems for the effective judicial system...

    There are serious offenses committed on women in this country especially in states like UP with the backing of political class and police. We need law with preferential treatment for women till normalcy is restored.
    Serious monitoring is required about enforcement of inheritance laws.Women still are denied their due share.
    This patriarchal family set up still need to undergo a drastic evolution even before we start thinking about gender equality.
