That's not true . Death penalty was not given to only the Brahmin caste , that also a practising Pandit. Kautilya goes into detail on how the restriction on death penalty can be overcome. He recommended cutting of the Shikha and branding on the forehead the crime . Community/class based punishment were a norm and not an exception in the ancient times. Equal punishment before law is a relatively new concept worldwide.
To prove that they are ancient, show one proof of written sanskrit in india from ancient times.. all that we see are from late middle ages but we must accept that they are ancient 😂

There are other ways to prove the dating of a work other than literal physical evidence. Linguistic and literary hints help.
