  • ‪@Copwatchtv‬ obtained body camera footage of a Florida Keys deputy who was arrested early July 12th, 2021in Key West after city police said he removed a wheel that had a parking boot on it from his illegally parked pickup truck, replaced it with a spare - and then drove home after visiting a sushi spot.
    Edward Alan Swogger, 31, faces a misdemeanor charge of theft and refused police to search the residence for the missing tire and boot. His dad gave consent to the police and they retrieved it from the shed.
    Swogger's case is pending and his employment with Florida Keys County Sheriff's office is also pending.

    He fled the scene when the attendant called the cops because he was DUI. Why else would a cop not want to wait for other cops? They're backup. The cop acknowledges that the guy is both under the influence, and drove off with the boot. Isn't investigated for DUI.

      I tend to agree with you that there's more to this than meets the eye, and he may have been under the influence which might help explain that stupid game with the spare tire. And if he did that because he was UI in the parking lot, well, that's even more stupid.
      All he had to do was pay off the boot, and Uber home or call his dad to come drive his truck. Almost driving is not driving. If the cops showed up over a disputed boot -- well at that moment he wasn't driving, so they can't nail him for DUI.
      Now at the point he's at home, I don't see how they could have gotten him for DUI since the cops did not witness him driving. And if he's been home even a few minutes he can claim any alcohol in his system he drank after he got home. So there's not a case for DUI at that point.
      So I'm not disagreeing with you that he may have been UI and even done a DUI home, but the cops cannot prove it.

      You're right. Sure the cop was wrong. But having been married to a tow company owner, they know exactly how much is owed before they go back out and pull the boot off. The tow guy should of rattled that number off in seconds. Instead it sounds like he wanted to piss the cop off. You can't possible believe that given the chance when finding out he's a cop, you or anyone else wouldn't screw with them, wasting their time to piss them off

      Agreed. I do believe the off duty cop acted poorly, mainly because he was drunk/stoned, and should face the consequences for his actions but going to jail for $40 theft? No one should go to jail for that. Write a summons to appear and get the boot back.
      However, this off duty cop did get off without being tested for some type of intoxication. If That was me or you, w would at the least been asked if we had anything to drink and be given a field sobriety test.

      They didn’t go after him hard though. He obviously changed the tire and didn’t want a wait for the cops, because he had been drinking and would’ve gotten a DUI. The cops knew this of course, and I’m sure the footage will show him driving off, so the fact he got away without being charged for DUI shows that they really let him off light.

The officers were being very reasonable trying to explain how ridiculous what he did was and he spent nearly 30 min whining trying to justify why it was okay for him to steal because of a minor inconvenience caused onto him.       Yep, gotta be caught behind the wheel with key in ignition, on or off. Otherwise, who's to say you didn't park, go in and take 10 shots after the fact.
      Not bragging or proud to admit it but I got damn lucky once myself, based on that one technicality alone.

      If someone is known to have been driving recently, they can be arrested for DUI. They don´t have to be caught red handed behind the wheel.

      @@douglascroghan9657 They can catch you for whatever infraction it was they were chasing/investigating, but if they lose contact and you're out of the vehicle by the time they nab you, they would need an admission for DUI.
      The laws might vary by jurisdiction/state but generally, you're innocent until proven guilty; They have to prove you were drunk while behind the wheel. Of course they can arrest and charge you but good luck getting a conviction unless you fess up on yourself.

    So, he calls into work the next morning (from jail), saying he's going to be late. They ask what's going on. He tells them he's in a cell, waiting to be bonded out. OR....he calls and asks if he can 'clock in' from his jail cell! Such entitlement by a sworn officer is insane. I'm glad the guy pressed charges.

      Well let's be honest, most officers don't know the law, and even worse, an officer sees other officers as friends, unaware that his so called friends are prepared to use anything he says/does against him in a court of law.
