      That's great! Many ERISA policies limit benefits to 2 years. But SSDI has no such limit. I imagine there may be ERISA policies with no such limitation, though we haven't seen it. I'm glad you are taken care of though!

    I have been Disabled since 1976 and I can’t recieve Disability, and I am 70 now

      Yes, SSDI usually ends at retirement age and SSI picks up. We don't do either of those, however. We only do ERISA disability cases at that is what this video is about.

    Hello,
    I'm on SSDI for schizoaffective disorder since 2020. I was due for CDR last year but haven't heard anything from them. I have history of being in mental/behavioral hospilization 3x's b4 i got on disability. Since approval and treatments, i have not been hospitalized but continue taking psych meds, see my psychiatrist every 2-3 months and see my therapist every 2-3 wks. Do i have a good chance to continue receiving SSDI after CDR even though i have not been hospitalized for the past 4 years or should i be worried?

      I wish I could answer your question. Without seeing medical records, it is impossible for an attorney to give you that answer. Also, we only do ERISA disability insurance policies. We don't handle SSDI claims. We have lawyers we could refer you to if you're interested.

    I have a question for you and I live in Illinois. I have been a caregiver for over the last 15 years and the last five to six years I've developed extreme panic attacks and anxiety disorders where I was in and out of the hospital thinking I've been having a heart attack I have health anxiety I used to be an advocate hiker I don't do that anymore I've tried almost every SSRI and drug under the Sun where I've always been pulled off of it due to it not helping and causing more problems. I've kind of had my breaking moment where I don't feel I can work any longer as a caregiver due to the fact I have constant pain now in my body and would like to know is there anything I can do to try to get help because I don't think I can go out and get another job because of all the pain and just the constant panic attacks I have now. I love your video and it gives me hope that maybe there could be some help for me because I don't know what else to do.

      You probably should talk to a social security disability lawyer. Unless you have insurance through your employer, we can't really help. Sorry about that!

    Curios, had a hemmoragic stroke in 2018. Is this considered a mental disabilty?

      Probably not. A stroke is a physical condition that affects the physical structure of the brain. So, even though you might have mental health symptoms, the original disabling injury is a physical one.

    Depression, Agoraphobia, Adha, Anxiety plus panic disorder since 7 yrs old I’m 54 yrs hard. Horrible to live with. Many phys cancer, knee replacements and kidney failure

    How do you communicate with your case worker? Do I have to answer emails. I avoid talking on the phone. My caseworker likes to ignore medical records that I send. It's been a stressful experience.

      We hear this a lot. It is the claimants responsibility to put the information in the claim file. Keep sending it until the insurance company acknowledges receipt.

      This is only for ERISA disability benefits. It is usually around 60% of your prior wage. I couldn't tell you what it would be for SSDI because we don't practice that area of the law.

    I have been getting SSDI since 2010 for anxiety and depression. Don't know what you mean by "insurance policy" I have never had insurance until after I was approved for medicare/medicaid. Really don't understand what your talking about.

      This video is about disability insurance policies typically offered as employment benefits. It is similar to life insurance or health insurance policies. Insurance companies collect a premium payment, and in exchange, they accept the risk of disability and typically pay 60% of your wage. SSDI is a federal program just like Medicare. Medicaid is a state health insurance program largely funded by the federal government.

      That is a risk the insurance company takes insuring employees. There is still a preexisting condition limitation in ERISA disability policies that’s prevents abuse in this situation.

      It is true. Most policies have a 24 month limitation for mental illness. Yours may not have that limitation. That doesn’t make this video untrue. With every policy there are different requirements and limitations. Every one I’ve ever read has that limitation.
      Also, you may have SSDI, which this video is not about.
