Thank you Paul. You are a dynamic presenter. great communicator. Only one thing, how come your other earlier videos are so clear, but the later ones are blurry. I wish the later ones are just as clear as the earlier ones.

    Hi Paul
Thank you for sharing your knowledge with everyone. It’s much appreciated! With that said, I have a question. I am power of attorney for my uncle whom I just got into a nursing home. I have done a lot of work at his house. Cleaning and removing old furniture & just getting his house ready for sale. It’s a manufactured home in Maryland. Can I charge a fee for all the work I’ve done?

I would like you to please explain my father passed without a will. I do understand my sibling and myself are now current owners of the property. My mother is about to pass and a few months back after dad passed she wrote a will. She wrote my brother totally out of it. He is a very controlling individual and money hungry. He’s already after me to give him all the cash and $50,000 for the family home. To give you an idea I make about 40,000 a year I take care of my mom and I took care of my father in his last days. My brother on the other hand has never helped to lift a finger. He didn’t even come in when my father passed away instead he cussed me out. So mom wanted to make sure that he would not walk all over me. Her doctor Did a cottonseed test on her before she went to the attorney to do her well. My question is does this protect me from him? He makes over 100,000 a year and lives well beyond his means. Can you please give me some advice on how to handle the situation.

Nothing can protect you if he wants to contest the estate, but if your mom had a capacity test of some type and an attorney prepare her estate, don't buckle under his controlling pressure. Your mom wasn't dead yet, but he wants her money. How rude. Your mom sounds like she was protecting you. Just leave out all the details of family life--all the emotions and just deal with what's on the paper. And don't lose it or let him know where the original copy is. Get it out of your mom's house. Also, don't be alone with him and if it's legal to record a conversation in your state, keep a recorder in your pocket.

What is the timeframe to do a Living Trust?

  • @davidw7776

My father-in-law recently passed and has made my wife the Executor of his will. However, he created a revocable trust agreement in my wife's name and also listed her as settlor. To make things more confusing, he also created a irrevocable trust agreement in his name as settlor but my wife as trustee. So I guess the question is, what do we follow? The attorney who crafted the legal documents has not provided a lot of direction with the exception of, "You can move forward"

Question; I live in CA. I’d like your thoughts about not naming any child as Executor or Successor Trustee or POA? My father named my brother and sister co-executors and they argued and haven’t spoken as a result for the past 18 years. I am against that possible scenario and want to name an entirely neutral person - a responsible adult cousin to serve with compensation (CA has s formula). Is this a feasible solution?
