    You hit the basics, like wills, trusts, and naming beneficiaries, but it felt rushed. I left with more questions than answers.

      That’s the problem with these quick seminars. They’re good for getting you to think about estate planning, but there’s no way they can cover everything you need to know in that short time. My mom went to one last year and had to schedule a separate meeting with her attorney to really dig into the details.

      Yeah, estate planning isn’t something you can just skim over. My husband and I started looking into it a couple of years ago, and it’s a lot more complex than we initially thought. There’s so much to consider, especially when you have kids and want to make sure everything’s set up right.

      Same here. We were overwhelmed at first, so we decided to get some professional help. We’ve been working with Aaron Morgan Bell, our financial advisor, and he’s been a lifesaver.

      He took the time to walk us through everything-how our assets should be structured, tax implications, and even some things we hadn’t thought about, like healthcare proxies and powers of attorney.

      That sounds like what we need. The seminar barely scratched the surface, and I feel like we’re not prepared at all. It’s one thing to know you need a will, but it’s another to understand all the legal and financial implications behind it.

    Really appreciate the synopsis. So many variables, but great job being as concise as possible. I'm only 45 y/o and not dealing with any of this stuff head-on yet, but I'm keeping an eye on things so I'm not completely surprised if/when encounter this stuff with aging relatives.

    I like the idea of a Trust to leave to my heirs as it can go generation to generation right?

    My father has a will. I am his durable poa, health poa, etc. Definitely want to avoid probate. I am his primary caregiver and handle all of his finances. Please let me know what I need to do to avoid probate. We did use a attorney for the will.

      a greedy trustee forged our parents Trust, so we share your pain, wish they hired an Administration Lawyer instead of estate planer to protect us when we're vulnerable.

    I have a question I am looking into your website because I am 56 years old and own two homes and have three children but only in contact with one. Not sure how I feel about the other to just yet they are going through some issues and they got disrespectful with me so we had a disagreement. One of the two took my firebox that held the titles to my vehicles and the deeds to my houses and of course he denies it but he has bragged about it to others how would they even know that I had such a box. I am very angry with him you as you can imagine. I'm not sure what he can do with those documents and of course I am more upset about the family history that was in that box, I do not believe he even cares about such things. I am unaware of anyone having such a situation as mine and how to resolve it. I have no will or even a living will right now and I am trying to decide what I want. I live in the state of Virginia and not sure of all the laws here, can you guide me to a website where I can find out more information about Virginia laws. And maybe give me some idea on my choices that I have in this situation.

    How does a "transfer on death" account work with this? Wouldn't that be a simple way to avoid probate?

    say the only property they have left in their estate that’s not already covered by beneficiaries is real property.. instead of paying for a trust couldn’t they just put their property in JTWROS or TE (proper titling) and this would also avoid probate?!

      Yes. But don't forget about losing the step up in basis if you transfer property ( or a portion of property) prior to death.

    John dies.. leaves everything to Jane.. Jane remarried. Jane dies. The second husband gets everything and Jane and John's kids are left out.

      I just watched another of his videos where he says you can leave it in a trust to your wife that states if she remarried and then died, his share of her estate goes to their kids.

      @@cheshirecat6518 not if she gives it to her kids before she dies...hey I've experienced it. Take it all before she dies and there is nothing you can do.
      Try applying for guardianship before the thief/relative takes everything.

      @@cheshirecat6518 only in an irrevocable trust. Even with that you'd have to "trust" the trustee. Nothing is preventing the trustee from spending the money, making atm wdls, writing checks....

    How about designating beneficiaries for IRA's? Wife and I each have 900k+ in our own IRA's and have designated 2/3's to our 2 sons. Excluding accidental death together, those beneficiaries will likely have more than 10 years to manage tax-wise distributions from those accounts.
    (If we left all to the surviving spouse, they would not inherit until the 2nd parent dies and face the 10 year limit to fully distribute the IRA funds.)
