Lies don't make someone guilty of 1st degree murder. I dont believe the state proved he was guilty of first degree murder and attempted murder. They should have charged less charges. He has a high chance of being found not guilty.

He wasn't convicted of murder as you're misunderstanding it because in that state, murder uses the legal term of manslaughter as the synonymous equivalent. Manslaughter means he intended to kill and this is why the prosecutor setup the alternative possible charges for the jury to convict him on.
This means he acted recklessly which resulted in unintentional homicide, and even though his actions were in pursuit of self-defense, the method he used was reckless and an unjustified use of lethal force. This is why all charges were reckless charges.
*I agree, they did not prove their case because the state's witnesses lied many times and they told their lies at different dates but all of their lies at various dates were heavily discredited by the video recordings.* Nicolae Miu definitely did some strange and stupid things, but ultimately the malice he struck out with as they assaulted him is circumstantial and what the jury used unjustly to convict him.
*The boil down is the attitude on his face as he stabs at them in every direction was reckless also meaning careless, and they completely ignored the fact that this was an orchestrated group assault and in close inspection of the video, the teens and young adults told a ridiculous amount of lies and ridiculous depth of lies, and Miu should have been spared a cruel and unusual sentence.*
They lied so much, I expect Miu will get the conviction overturned on appeal and the prosecutors committed so many crimes specifically to convict him that they will be forced to offer him an Alfred Plea Deal to protect themselves.
The state's witnesses literally changed who they claimed he struck, changed where they claim he struck her, how he struck her and had such distorted, inconsistent and contradicting stories that Anthony gave a sworn statement believing he punched Nicolae Miu in the face until he was shown the video and it never happened!
*I am disgusted by how out of order and dishonest their testimony is. Miu should be doing maybe 6-8 years tops with time served.*
Justice would be he does some time for the death and mortal wounds, but more than 5-6 years isn't justice.
*The other 2 groups initiated all the violence and had key aggressors that called many, many others over to join in and they did.* The video evidence was grossly misused by the prosecution who knew all of their witnesses were lying.

If he is guilty, that just means one thing: the rest of us who will defend ourselves will most likely end up in jail for a very long time.

      @JonDeth 8 місяців тому +1

@@jdoyle4811 the charges he was convicted of are based specifically on Miu acting in self-defense. Reckless homicide is not the same as murder, and if it were murder the legal term used would be manslaughter.
*He was convicted of acting in self-defense but it was reckless self-defense. It was an unjustified use of lethal force and that recklessness resulted in the unjust homicide of one of the teenagers.*
The prosecutors ultimately rigged the charges so no matter what, they were likely to get a conviction even though the state's witnesses were caught lying no less than 6 times each, and several times for each occurred while they were on the stand. *Their original sworn statements greatly contradict their testimony in court and the video recordings discredited both stories.*
He had no *INTENT* to kill but also acted recklessly not caring if his self-defense tactics killed.
In the end, I agree he should have been convicted but I also don't think he should be doing more than 6-8 years total and that's including time served. *He is likely to get this overturned on appeal because the prosecution failed to charge the teens or young adults for the drugs, the alcohol, the initiation of all assaults and repeatedly lying under oath which is perjury and well documented by the trial transcript.*
I have been profiling court cases for close to 20 years and my analysis is quite frequently correct. *He's going to get this conviction overturned or vacated on appeal even if it takes a few years.* I won't be surprised in the least if the prosecutor offers an Alfred plea to protect themselves. *It will be a far more likely outcome if there's a new attorney general at some point during their appeals.*
I might be wordy, but your question is a popular attitude toward the convicted and demonstrates that you grossly misunderstood. *The prosecutors and judge basically did the most outrageous and ridiculous things they could so he would have highly favorable odds of getting released within a few years on appeals.*

Miu sits there like a cardboard cut out of himself for the whole trial, hardly moving a muscle. What did they give him? It's totally unnatural.

Are people blind? This man was provoked, threatened, pushed and hit with over a dozen teenagers coming at him from every angle. I don't know what was going through his head but this was clearly a preventable tragedy. Based on the footage submitted by the youth none of the things the lawyer claims are false narratives are false at all.

In what context? People like Jawahn Cockfield lying about Miu saying he was looking for little girls to rape? Trying to get people to attack Miu? 6'1" heavily muscular wrestler and football DL Jawahn was 'scared' and needed a big group to beat down The Predator??
Or The drunken belligerent woman Maddie Coen who started screaming in Mius face and shoving him and grabbing his arms when he wouldn't comply with her drunken commands? Her apparent false accusation of a punch when Miu was trying to move her hands off of him?
Or Everyone else but the nurse and Tony Carlson lied? Just lying makes them all guilty of murder? Or just Miu?
