Thank you for your rapid response. I just watched how to calculate the household size. So as the joint sponsor in part 1.d ; I am sponsoring the principle immigrant (my alien son-in -law) named in part 2 1 a-c . In part 3. 1 it's YES , I'm sponsoring the principle immigrant. So if I understand this correctly I do not need to fill out any more in PART 3 because my daughter and her two children are US Citizens even thought they will be coming the US at the same time as the principle immigrant, my son in law. In PART 3. 29 I will list only 1 Therefore in PART 5 I will count my household like this. Part 5.1 = 1 (same as PART 3. 29). Myself 5. 2= 1 ; and my wife 5. 3 = 1 ; Household size 5. 8 = 3 Is this correct? your help and these videos are great.
Thank so much for this video. I will send my form packet next month and my daughter just made it over the poverty level since she works pet time only. I wasn’t going to add my income but now I will. Thank you 🙏
Thank you so much for the video. It is very helpful. I just got RFE too. My husband is my sponsor and his total income for the recent year is slight above the 125% poverty guideline. But my lawyer said that this is the case, so he recommended us to filed again with the updated information if we have any since it might be USCIS error. But we don’t want to take the risk of getting deny so we don’t know what to do yet. What is your suggestion about it?
Hi, just got an RFE for I864 and realized we never submitted my w2s for my 2022 tax return! I had a huge change in income this year so I hope that they base decision on my current income and 6 months of pay stubs
They should have giving instructions on what they need from you on the RFE, 2023 would be the most recent year however being only 01/19/24 I’m assuming no taxes have been filled yet or W2’s haven’t been send out either.
Hi there, again! Thank you so much for your reply to my inquiry in your other video. Hoping for your attention again. ‼️‼️‼️‼️‼️‼️‼️‼️‼️ My concern is that I’m about to submit the I-864 for my husband, but i’m not sure if should continue using my maiden name on this stage just like the USCIS stage or use my married name now, since i have updated my ss card and some documents. not my passport or DL yet thougj
Hi Ksenia thank you very much for your videos they’ve helped me through my process of adjustment of status. I have a question, we submitted the Affidavit of Support with my husband petitioning for me and received an RFE. We submitted his tax returns from the last three years including his now employers letter. For the 2021 year he didn’t reach the poverty threshold since he was self-employed that year, could that be the reason of the RFE? And should we submit this time only the transcripts of 2022 when he was already employed and surpassed the Poverty threshold? I’ll really appreciate your answer. Thanks!
Congrats Kseniya. How to respond to RFE if sponsor is LPR new to the US and therefore has not filled previous years' tax reports, but has partial year income above poverty guidelines and enough assets to support 5 x 125%? TIA.
Hi Kseniya! Thanks for your videos they are so helpful! If my father will be a joint sponsor but he filed his taxes as married filing jointly with my mother, should I still use the total income on the second page of the transcript eventhough it includes my mothers income as well? His income alone is enough; however, should I just include my mother as a household member who is contributing to avoid confusion?
Hi Kseniya! First of all, allow me to say that your videos are amazing! I’m currently filling all my forms to submit my AOS and was overwhelmed with the process and your videos have made it so much easier for me! Thank you so much for the time you put into this. ❤ I do have a question about my particular case and form I864. My husband (petitioner) currently works as a real estate agent so his income are only based on commissions. His income is below the poverty guidelines requirements and we’re using a joint sponsor. However, my husband only made enough income to file for taxes on 2022. Is it OK if we send his tax returns for 2022 and a statement explaining why he didn’t report taxes for 2020 and 2021? Or the 2022 tax return should be enough?
Thank you I'm spouse of us citizen whom not employed and now I'm making adjust of statement: 1)can I use my bank account statement in my country to support ? 2)Can I file my case without 864 to have work permit, till I can have joint sponsor?
Thank you so much for this video. I will send my packet next month. My daughter just made it over the poverty level this year since she works part-time only. The prior two years she made less than the guidelines. I wasn’t going to add my income until I saw this video. One question, I do not have to fill out a separate I-864A for myself, correct? Thank you 🙏
Kseniya, Hi! I have watched your videos on filling out the I-864 but am stilled confused. With regards to joint Sponsorship. My daughter, a US citizen is partitioning for her Alien husband and they have two children both are US citizens and all four are living abroad. As petitioner my daughter does not have the required financial income. As the joint sponsor filing the I-864 how do you list the 3 US Citizens?
Little concerned in our case. We got an RFE don't know what for. My husband was on a work visa for 10 plus years so he has 40 credit hours and we sent evidence of that. I am wondering if she should just fill out the form. I have made consistently well over the poverty line for the last couple of years. It just stinks for him to have paid into the system for all this time and not get credit for it

Hi Ksenia, thanks for your very clear and helpfull video. I have a question about the household number, if the sponsor have a child under 18 and he doesnt have full custody and also isnt reported as dependant in the taxes, we need to incluide him?
If we are filling I-485 and I-864 online does my wife ( Petitioner) has to do it from her USCIS profile or me ( Beneficiary) has to create an account and submitted attaching the I-130 receipt ?
Hi! Thank you for your amazing videos. They have been helping me manage my anxiety through this process. However, I'm currently facing a dilemma. As the petitioner for my parents, I don't have any income of my own and file taxes jointly with my husband. He is paid through his LLC, which we just started this year. How should I handle this situation for the petition? Additionally, I am using a second sponsor who also files taxes jointly with her husband. Does he need to provide an affidavit as well?
Once you enlist a joint sponsor, the petitioner’s income (and the income of the petitioner’s household members) becomes irrelevant because the incomes cannot be combined. Although all the supporting documents must still be provided from both the petitioner and the joint sponsor. I encourage you to review the video I made “For married sponsors” to give you a better idea of how to fill our respective parts of the forms and what evidence to provide.
Hi,kseniya, thanks for the good work you put in to help us. My step daughter is outside the country but my husband is here adjusting his status, which forms do i need to submit am doing concurrent filing.
Hi, I need help, what is the amount that we should put in the part 6, item 7. current individual annual income? Same as in total income from the tax return form? Or what?
Question on this petition. Do I have to show proof that my fiancé Now husband is on my bank account? Reason I'm asking is because my credit Union will not add him unless he has a social security number, but that is why we are filing an i-485 form, so he can't get a social security number .so with him not being on my bank account as of yet will that hinder my approval?
I filed for my parents. Their paperwork is at NVC. I am aware that I need to do two separate DS-260 and two separate I-864. For my 2021 tax return I fall below and did not make enough 2022 and 2023 is above the poverty line. I live with my boyfriend and I am aware that I need to do an additional affidavit of support. Will my boyfriend be considered part of my household and do I need to fill out the form I-864A for him or do I include him on my I-864? Please help?
Hi Ksenya, I really appreciate your video!!! Could you help me this detail question? 1. On submitted online130 and 130a, the city and province of my birthplace are written as same province place, but on my birth certificate's city is different. Is there any way I can remedy this? 2. Can I write the same situation on I485 as submitted 130 and 130a? Or I have to correct birthplace on I485 same as birth certificate? Since I need to filing my birth certificate with I485. I am really worried about this. Really looking forward your help!!! Thank you so much!
Hello Kseniya, thanks for posting helpful videos. I am a student and the petitioner of my parents. I filed the form I-864 as a petitioner with zero income, but counted my wife's income ($87000) as household. We also submitted the form I-864A. USCIS sent us an RFE determining I am not qualified, but it does not talk anything about my wife's income. Did we do something wrong?
Petitioner must primarily be responsible. Intending immigrant’s income can be considered but USCIS mostly wants to see tax returns from petitioner or joint sponsor
Hello kseniya , Thank you so much for your youtube videos theyre so relevant and helping us alot ❤️ BTW i have a question im on RFE for aff of sup. My joint sponsor made 36k last year 2022 and made over for 2 households but didnt made the guideline for 2021 & 2020. is he still eligble to sponsor me ? if he is do i still need to put hes 2021 and 2020 on the I864 form even if theyre below the guidlines ?Thank you so much 🥰
Hello Kenya, I filled my Dad’s AOS package and got an RFE requesting our 1040. I mistakenly didn’t send those with, but I did send each of ours W2’s, we have filled jointly and they are requesting the 1040 for both. I’m assuming I just need to send the one I have since it will show we have filled our taxes jointly? Thanks for your help!
Hi Kseniya. Thank you for your videos, they are really helpful. I had a question, If the sponsor has an extension for the most recent tax year however the previous years tax returns are attached which are significantly higher than 125% of the poverty level for the household size, do you think this would still create a chance for a RFE?
Hi Ksenya, I hope you're doing well! First and foremost, I want to express my gratitude for the informative and helpful videos you've been sharing. I've learned so much from your content, and I truly appreciate your efforts in providing valuable information. I have a question related to U.S. immigration, and I thought your expertise might be able to help. My wife, recently completed her biometrics for an adjustment of status application. However, her I-94 states that she's only allowed to stay in the U.S. until September 6, 2023. I was wondering if you could offer some guidance on whether she can remain in the U.S. while her adjustment of status application is pending, even if her I-94 expires before a decision is made. Additionally, are there any steps or forms we should consider to maintain her legal status during this waiting period? Your insights would be greatly appreciated, and once again, thank you for all the knowledge you've shared through your videos!
@@KseniyaInternational Thank you so much for your prompt and informative response! Your video clarified our doubts and provided much-needed reassurance regarding my wife's situation. Hi dear I am filed I 130 for my both parents last year my father got approved and I filed for my husband this year he is also approved but am confused about total income.. I am only here in USA and I sponsored 3 people how much income need.. I am earning 47500 per year
Thanks for your your video , I got married but we didn’t change my name at the time we received our marriage certificate, if I would like my marriage name on my documents can I change it while filing ? Our do I need to file them and have the documents changed over after applying to change my certificate at the courts
Hi Kseniya! We received an RFE for not meeting 125% poverty guideline. can my main sponsor resubmit an updated I-864 including a household member because our initial document that was submitted did not include a household member as we thought that the current annual income is the basis of the poverty guideline and not the most recent tax return. We would want to include her sister to combine their income. Appreciate your response.
Hello I got an rfe for this form my wife is isn’t making enough money so I got my cousin to sponsor me he made 43,500 last year and he lives with his wife so I’d be the 3rd person in his household since he’s sponsoring me.. shouldn’t that be enough to cover the poverty guideline require for an household of 3? Also I’m about to submit the rfe with updated paystub his certificate of naturalization they asked for his most recent tax return (2022) however I submitted all three previously should I only send the 2022 TR? Finally we know she isn’t making enough should I still resubmit her i864?
Hello ! Thank you for your videos , my question is for example I am sponsoring my father , and my household is 3 me my wife and son, but after I add my father will be 4 but in my tax return for last year is 3 in the household so which line of poverty will be the right number ? My household tax for 2023 will be 4 ! So what number the uscis will take ?
Hello, Kseniya ! Please help me understand I filed the Form I-130 to reunite with my son in 2020. I additionally needed to submit Form I-824 (because I didn't provide the address on the form). My account says they received my Form I-824... My case was approved in 2022 and transferred to NVC. I became a US citizen two weeks ago and I need to make a request to change my status. I went to the NVC website and in Public Inquiry Form they are asking for a recipient number but I can't figure out which recipient number I need to enter, for the form I-130 or I-824. The numbers are different. Please help me understand. Thanks in advance for your reply!
The part on the i864 form that says current annual income im I to put the amount on my tax return or put the amount I make based on my hourly pay ? I’m confuse
Didnt clearly understand i e part. I have filed for extension for my tax retirn and i will file on october.. so what tax return info should i provide to uscis now? As i dont yet have the last year yet
Hey Kseniya the sponsor didn't file taxes for one of the previous years, she didn't make enough for this past year she made about $20,000. Can I the beneficiary use my income to supplement that because for the previous year I made way over 20,000.
Hi thanks for the video. I just wanna ask. So i filled a separate i130 for my wife and daughter. When i got the letter from uscis the online account access they only send one letter. It says on the letter the uscis online account number and receipt number. But under the receipt number it shows that the number is my daughter receipt number. When i create my online account on uscis both of them have separate receipt number. Now im filling out i864 for both of them. My question is since i only receive one USCIS account access, is it possible that they have the same uscis online account number?
They may have the same account number if you indicated the same email for both beneficiaries. However, usually the I-130 receipt shows the petitioner’s account number.
Hi Kseniya, quick question (if you can) If I send the I864 form and they charged the fee (1.225) does it mean that they accepted the form, or can they still ask for more evidence. thanks for your videos!
Hi kseniya thank you for your videos. I have a question, if for the question on the I-485 and I-765 form, that ask place of last arrival in the US. Instead of putting the state I was check by customs. I mistakenly put the state that was on my plane ticket as my final destination. Do you think this will cause major delays in my case, or I can just call or send a letter to highlight the error ?
Hi , I got my spous and child I-485 denied because I didn’t send them the Request for evidence that required almost 10 months ago ( because I didn’t get it in the mail and didn’t check my online account) so I’m that case I will reapply for the i-485 for both of them , so do you recommend that I reapply for I-130 for both of them , just to be clear they have approved all the other forms I-130 , 765 and they have even the work authorization, the denial was due to not sending the Request of evidence for the medical check , I appreciate your response, and thanks
Hello what if I am the petitioner and have never worked in my life and that is why I cant file federal tax returns and will be using a joint sponsor. I am a student in college currently taking a break from college and still dont work. What date do I put in the unemployed part and what proof can I use to indicate why I have not filed federal tax return. Please give me a response thank you.
Hi Kseniya, awesome video! I have a quick question: will USCIS consider the "Poverty Guidelines for Affidavit of Support" from 2023 or 2022? Also, since we are using a co-sponsor, do we still need an "Employment letter" for the petitioner? Thanks a lot
Very helpful video. I am change status from B2 to F1 visa. Im recently marriage and living US now. Please advice if I can file I-130 online prior and submit paper (package) of I-130a, I-485, I-864, I765 and I-131 at the same time to uscis. Am the only one living in the state my kids are still back home , will I count them as my household even if they are not living with me and they are thousands of miles away from me. Thank you
Hi Kseniya,I have a question thanks for videos.I am using my daughter income she’s a household member but she cannot sign the I 864 a form because she is disabled do I need to sign my name we’re it asking for her signature as household member or can I sign my name we’re her name suppose to be God bless u for all the information 😊

Hi kseniya. Wanted to share with you , that I had my green card interview yesterday . And it was approved
Congratulations!
Hi! Did you have legal consoling or were you able to do everything on your own? (with the help of these videos?)
Submit W2 and 1099? Or either
Sounds like it, yes
Hi Kseniya. Thank you for your videos, they are really helpful. I had a question, If the sponsor has an extension for the most recent tax year however the previous years tax returns are attached which are significantly higher than 125% of the poverty level for the household size, do you think this would still create a chance for a RFE?
Yes
Hi Ksenia, if the there is an error or missing documents. How long is the wait for RFE?
Hi Ksenya,
I hope you're doing well!

You are allowed to send updated documents yes.
Hi! Can i mail I-864 and I-485 in the same envelope, or do i need to mail it separately? Thank you!
For House hold Size what about roommates. He Is on The Lease but doesn’t contribute to my Income?

Hello, Kseniya !
Please help me understand
I filed the Form I-130 to reunite with my son in 2020.
I think it may be I-130 receipt

Thanks a lot!
I just got the request evidence about i-864, can I submit it online through my Uscis account, or I have to mail it too?
The part on the i864 form that says current annual income im I to put the amount on my tax return or put the amount I make based on my hourly pay ? I’m confuse
I have a question about i693,
In the uscis website says all military doctors are allow to do the medical exam, is that correct? Im military dependant
Didnt clearly understand i e part. I have filed for extension for my tax retirn and i will file on october.. so what tax return info should i provide to uscis now? As i dont yet have the last year yet
nice video,mam how much poverty g required 2024 ??
i went on the irs website logged in & download my transcript, & my total income is way more than sufficient, (over a hundred) can that only be use?
Hey Kseniya the sponsor didn't file taxes for one of the previous years, she didn't make enough for this past year she made about $20,000. Can I the beneficiary use my income to supplement that because for the previous year I made way over 20,000.

Can they send for me Ref and same time they said they are working. With my ambssy for set time for the interview?
They can still ask for more evidence. It means the forms are simply accepted for review
I don’t think so (my opinion)
@@KseniyaInternational thank you so much for sharing your opinion.
Approved I-130 does not expire that’s all I know
Hello what if I am the petitioner and have never worked in my life and that is why I cant file federal tax returns and will be using a joint sponsor. I am a student in college currently taking a break from college and still dont work. What date do I put in the unemployed part and what proof can I use to indicate why I have not filed federal tax return. Please give me a response thank you.
Yes you have to send proof, for example in a form of full-time school transcripts
So useful, thanks
Hi Kseniya, awesome video! I have a quick question: will USCIS consider the "Poverty Guidelines for Affidavit of Support" from 2023 or 2022?
Also, since we are using a co-sponsor, do we still need an "Employment letter" for the petitioner? Thanks a lot
Hi Kseniya,
I got a receipt notice for my concurrent filling but not an online access code. How to get it? Does it come with separate mail?
It should
You didn't mention another reason wich is rfe for medical exam !!!
The video is called common reasons you got an RFE for I-864.
Very helpful video. I am change status from B2 to F1 visa. Im recently marriage and living US now. Please advice if I can file I-130 online prior and submit paper (package) of I-130a, I-485, I-864, I765 and I-131 at the same time to uscis. I am assume all that form are required through GC application if i am wrong , please advice. Thank you!
yes, you can.. all at the same time
I love your videos it has really helped me a lot. I have a question about the I-485 . The place where they are asking for household. Am the only one living in the state my kids are still back home , will I count them as my household even if they are not living with me and they are thousands of miles away from me. Thank you
Hello! My wife who is sponsor she has given 2k21 and 2k22 Tax returns not 2023 so will I get RFE for it?
2023 tax returns are not available. We will start to file 2023 tax returns in 2024!
If she’s disabled how is she contributing income? USCIS wants to see a household member’s tax returns and W2s.
@@KseniyaInternational she receive SSI her own Income. And I file her on my taxes Thanks for responding back to me.
@@bettymason8506 you’re welcome, I don’t think USCIS will accept that, is she over 18?
See USCIS guidance on signatures www.uscis.gov/policy-manual/volume-1-part-b-chapter-2 maybe there’s something there about disability
@@KseniyaInternational Thanks again she’s 32 year old
Hello Kseniya I am so confused can you please help me. I have a question about I-864. Page 4 Part 6 question 7 ask about my current individual annual income where on my W2 or 1040 do I find this ?
Also page 5 Part 6 #20 it ask about my current annual household income where do I find this
Thank you in advance for your help
Question 7 you can estimate on your annual salary or “total wages” on W2. Question 20 is a total of all questions on previous page
@@KseniyaInternational thank you so much for replying. I am not using income from other people so I will just use part 6 #7 to answer the #20 ? Also do I need employer letter with paystubs I believe your pervious said I needed a letter
@@sunshyneluv83 exactly 7=20. Employer letters and pay stubs are optional though recommended
@@KseniyaInternational I went to my transcript online and I found where it says my wages for 2022 and wrote it. I will add the employer letter to be safe should it just state how many years I've been there and my annual income only and about how many paystubs should I add because I was going to put 4. Also with the tax transcripts do I print up all three years like I did for the K1 and do I print all the transcripts because there are four sections as you know or do i print from wage and income transcripts or return transcripts? Thank You again for your help.
@@sunshyneluv83 you can include 4-6 pay stubs (that’s what I’ve done) and you have to include all pages of federal tax return transcript OR all pages of form 1040.
