Reminder that what Niji did (constant and frequent graduation spree) is indirectly affecting the vtuber community as a whole especially us fans/viewers, some people might already quit the hole entirely, became immune to it or became fed-up and kind-of traumatized by the term...

Bruh, those people are still traumatized after Coco's graduation announcement, an event that forever changed fans' perspective. Currently, vtuber graduations no longer have as much impact as they did years ago, due to Nijisanji.

When it comes to non-competes, it doesn't matter who the company is or where they are based. American law applies to any employee or contractor currently residing or working in America, or on American soil (territories, consulates, etc.). If this rule does go into effect and survives challenge, then yes, all non-compete clauses in ALL work contracts will be null and void, with no other material alterations to that contract. Only the non-compete goes away. This does not necessarily impact EXCLUSIVITY clauses, where you are only allowed to work for the one company for the duration of your contract, just that you can't be barred from working for a competitor in the same industry once your employment ends.
We'll see how the courts rule once this gets rolling. It could be multiple YEARS before we actually see this rule go into effect, depending on stays and appeals.

That FTC news is pretty big. It doesn't take effect for 90 days(assuming it is blocked/delayed in court), but that is a big game changer for anyone working in the US. If the employee is residing in the US, then they follow US labor laws with few exceptions.

Hololive and Nijisanji are both Japanese companies, so the FTC wouldn't really matter in a case between them. VShoujo is a different matter, but that's always been true, since VShoujo is a Californian company. It might be relevant in a case like if somebody owned their own model, used it in a VTuber company as an employee, and left that company sometime after, but that would be a heck of an edge case.
I do beleve the state has their own verson of the non compliance ban.
Non-compete clauses are basically never held up in court, this is just going a step further to prevent the clauses in the first place
In terms of JP vs US law, if the employee is in the US, then the company needs to follow US employment laws, so a non-compete clause in a Niji/Holo contract for a creator living and working in the US would not stand up against the FTC ruling

@@velfare It doesn't go to court, if they try to force a non-compete, you just report it to the FTC (which they provide a link for people to do in the online version of the new ruling).
It'd be like saying you need to go to court for millions because a slavery clause was in your contract and you've signed yourself as a piece of property to a foreign country.
According to LegalMindset, the answer is always "it depends". A non-compete in a contract which doesn't stipulate JP law and the talent being a US citizen residing in the US would probably be most affected. What I don't understand is what would happen if a JP company goes to a JP court to enforce a contract under JP law on a US resident... might have to ask LM that next time I see him stream. As I understand it, the point isn't that "the employee is in the US", it's a question of if the employee gets a chance to assert US law. If the case occurs in a JP court following JP law then the court doesn't exactly have to listen to the FTC.
Also, pretty sure this is entirely separate and unrelated to "who owns the model". Just because Matara had a different model when she worked for a blacker company wouldn't change her liability for the purpose of a theoretical non-compete (not that Niji has one if we can believe the unexecuted contract that was displayed). And if bizarro-world Black VShojo tried to enforce a non-compete (obviously before this FTC ruling came into effect) that wouldn't be affected by the fact that the talent owns the model.

I saw right through that announcement from Bae and knew it wasn't real. I'm going to stick to that if anything would drive her to graduate it would likely be shipping. Not a lawyer, but if a US citizen signed a Japanese contract with a non-compete and wanted to move to a Japanese competitor during the non-compete period, I imagine that wouldn't fly since the non-compete is legal in a Japanese context - even if it's void in a US context. But if you wanted to move to a US-based agency, they wouldn't be able to do anything about it.
If the contracted is in the US they get to be cover by the US laws.
Depends on the country of residence. A Japanese contract signed by a US citizen living/working in the US cannot be bound to non-compete. If another Japanese company wanted to hire them and they stayed in the US it wouldn't matter. Obviously if they were in Japan the non-compete would apply.
