Squatters rights is honestly the dumbest law I’ve ever heard
Only really makes sense if the property is abandoned for years and the squatter is maintaining it. Further the squatter has to be clear and obvious about their possession, in this case it's just a bunch of degenerates house-squatting.
Really puts into perspective the way Democrats think. They don't respect your most basic rights and they want everything you have ever worked for. They think they are so progressive but in reality they are a mirror image of every group of bigotted villains ever and their fate will be no different than that of the Third Reich but it will take people standing up for themselves.

The whole thing is stupid. A few years ago I went down a huge rabbit hole as this stuff interested me. The lady is well within her right to evict them. But there is an extremely long drawn out system that she has to follow that's linked to human rights. Please check for me as I'm not American. But as far as I'm aware all states follow very similar rules. Meaning Texas have it just as bad as everyone else. (Castle law doesn't apply to a place you don't live at day to day.)

In France its the same thing, for instance if you were to go on a couple weeks vacation and come back with people in your house, they are allowed to stay inside and you can't do anything about it, (especially if they changed the locks or did some renovations).

@FrostByteVoyager protecting a tenant who signed a lease and paid money is completely different than protecting some person who broke into your house and is living in it, or one who stopped paying their rent months ago and is living there free. A landlord still has taxes, insurance, and possibly a mortgage to pay, they need some level of income to cover that. It's a BS law that doesn't help actual renters or landlords.
Squatters shouldn't have rights and should be considered trespassing with no exceptions.

This is a law from ancient times when people sometimes went hunting or whatever and died. Their homes were therefore left vacant and anybody that came along could take over the home. After certain number of time had passed, the home eventually was the squatter's house. We freaking live in the modern times and such idiotic law needs to be repealed all over the country.

Squatters rights isn't anything new or "woke". It originates from way back in the 1800's and has rarely been updated in any way in any state.
the house owner can try to lease the house to her family member with a lease agreement. squatters are not going to have the paper evidences that they lived there over 30 days. let your relative with the lease call the police, tell them that someone broke into the house while you were on a vacation for a week or so. then it will be a "tenant to tenant" issue.

Before the authorities do anything at all, they should simply be required to check for proof from the 'renters' (squatters) that they have been paying rent, and have a signed, legal rent agreement. Squatters rights were meant to prevent tenants from being illegally evicted without notice or breaking the lease. The problem is the laws are so heavily skewed in favor of the tenants that landlords end up in situations like this where people flat out refuse to leave.
It’s just a flat out problem with how the laws are written. I.E someone can just live in a house that has been abandoned/not lived in for a long time and just own the property. That makes absolutely no sense and needs to be fixed.

@@tmoney1487 I can confirm that squatters rights do in fact exist in every single state. They are listed under "adverse possession" If you google "Adverse posession laws [State's Name]" you'll find them.
I think it's in all US territories as well, but I'm less sure on that since some places like American Samoa kind of do their own thing.
So all she needs to do is walk into the NY mayors home and claim squatters rights and call the police on her self with a whole news crew.

Squatters rights seems to basically be a law that says if you illegally trespass on someone's property and get caught you go to jail, but if you keep doing that illegal thing long enough it becomes legal. Why does the illegality have an expiration date?
Because these laws existed back before digital documentation when people would die or go missing with no relatives in the area and properties were left vacant. So either someone would claim the property or the town or state would take possession of it.
It was intended for people who had inhabited a destroyed/abandoned property, and began restoring it. Illegal migrants who have been elevated above the law by the NY mayor don't restore the buildings they inhabit

It was originally to prevent landlords from suddenly tossing out tenants without just cause or proper procedure, but scumbags will find a way to exploit any law. The rich do it with taxes forcing the lower-middle class to pay more, the lazy & dirty do it with our homes, causing us a slew of problems. America is fucking stupid.
When I first found out about squatters rights I looked into it. Apparently it's old laws from before everything was digital, and back then people would just disappear without a trace sometimes. When that was the case you would want laws that made it legal to reclaim this unused land, as otherwise larger and larger parts of a country would just become unused.
@@Luckyyshot- It can still be an issue even today - sometimes land is just outright abandoned, and most states give landowners a reasonable term of 10 to 15 years to get rid of the squatters before they actually lose the property. Just pop by once every two or three years to make sure nobody's openly living on it, and you can keep your land. This is especially true for hedge funds and speculators that buy and sell land without ever looking at it - it could end up being lost to squatters if they never actually send someone to take a look at it, but even then it has to go on for more than a decade before the land is actually lost.
Here in Italy the same thing exists but, 20 years have to pass with the owner never showing up or showing interest in the property. Only then can you ask a judge to give you property over the “house”

We literally have a service that is meant for dealing with this kind of situations, cause the law won't be of any use in most cases. It's called "Desokupas" and it's basically a legal way of threatening unwanted tennants.

My friend married a woman from Venezuela. Her family moved to America because they were a middle class family that had their property taken. They saved and purchased a beach house. One day, they go to the house and people broke in and started staying there. The police and courts told them that they had two houses, these people had none, so its only fair that the house goes to them.
A few years later the economy collapsed and Venezuela became the economic basket case it is today. Property rights are required for a functioning economy. This sort of thing is how you destroy a society.

They do have a lease agreement - its just fake. Short story, somebody else has hoodwinked them (it only requires a printer). The problem is that the cops don't do civil matters; the courts need to make the decision on the validity of the lease agreement. It is usually very quick once you get into court, but the courts are rammed and can take years to get a date.
The solution is to require lease agreements to be registered with an authority under witness from the owner (who will have documentation). Then, no registered lease, out you go (probably to jail).
The problem is you can goto the library, go online and print out a lease. Those people have fake leases to fool the cops

According to NY state law, after 30 days a homeowner must take the squatters to court as opposed to simply having them removed. The entire judicial processing for this could take TWO FUCKING YEARS.

My mother ended up killing herself because of squatters. Also in queens NY. She owned a 4 family house and after the tentants on the 1st floor moved out she tried to rent the apartments, but before she could a set of squatters took over the 2 apartments and trashed them. Took 8 months to evict them and they destroyed the two apartments. They also didn't pay for electricity as they somehow hooked into the electricty meter for the common areas, and my mother was on the hook for about $5k in electricty costs, beacuse the squatters said it was like that when they got here. In total she was out about $20,000 in rent, $6k in utilities and was quoted around $60,000 to repair the two destroyed apartments.

I dont understand how a complete lack of documentation doesnt simply end the discussion. There can't be that many people being exploited via eviction that have no paperwork to show theyre supposed to be there.

To get to tennant status you would have to openly announce your presence (usually a newspaper ad or signage) take over utility payments, and then file for adverse possession at your local court house with your SSN and ID. At this point the owner is contacted and can stop you.
If they choose not to, the owner cannot be contacted, or it just goes uncontested then you become a legal tennant of the property.
The newscast doesn't really go into any of this, probably for sensationalism.

There's a defined process for this in every state called "adverse possession" laws. The court is required to make "every possible attempt" to contact them, but what that actually means is a grey area... in practice it's probably just a letter and a phone call.
But the larger part of it is that you have to be demonstrably living there openly. If you hide, keep the lights out at night so it looks empty, disguise your presence in any way... that nullifies the attempts to adversely possess the property. Practically speaking: In most cases your neighbors will call you, or report the intruder to the police.
It's intended to be more of an "I'm here, and clearly nobody cares" than an "I'm in your house, what are you gonna do about it?!?!" situation.
The original intent is for things like finding an abandoned farm house or cabin, and living in it for a generation and then owning it because clearly the owner isn't coming back... or to resolve disputes like "I just checked the property line and his 20 year old barn is 3' over it so can I make him demolish his barn if he pisses me off" and with adverse possession these things wouldn't need to go to court. To be clear this is a holdover from the frontier days where finding abandoned properties was far more common.
The whole "squatting" thing is certainly not the intended purpose of the law. I would think extending the period before squatter rights kick in to two years (instead of 30 days) would be both reasonable and preserve the original intent of the law, as those 2 years would be trespassing.

We have a highly official system in Germany. There is a note in the land register that states in a legally binding manner who owns a piece of land and any property on it. It has been maintained from the first construction and move-in more than 1-x (100th) years ago. Everyone who had it stands in it like a family tree. to get in after a buy you have to pay thousands of euros to a notary and court. nobody can take for living in an empty house. extreme bureaucracy 😅

Scenario, you're renting a home. The landlord decides to show up and evict you with 6 months left on your lease. Instead of going through the eviction process in civil court, they change the locks.
This is how squatters are getting away with it. Make up a phony lease and make the homeowners have to go through the eviction process because it instantly goes to civil court. Also, keep in mind NYC has renter rights laws to allow people to continue renting.
