- Can parents write me out of will and I challenge undue influence?
We get this phone call: Can Parents write me out of their Estate Planning all of the time, but you might be able to challenge undue influence. Parents write kids out of will all of the time. Don't get written out of will. If there is undue influence, then you probably should challenge thier capacity.

In case you are watching this from BC, giving the house away to favoured child violates the Law of Equity that presumes one would not deliberately give property away for free. The Presumption of Resulting Trusts means the favourite child holding the house keys is presumed to be holding the asset in trust. So the favourite kid with the house keys has the onus to prove the transfer was a gift. If the transfer was to a spouse or a minor child then you’re sol. If it was to an adult child, you’re in the game, get a lawyer. (On a contingency if necessary)
This is so interesting and good to know!
Thanks for watching!
