    Been saying we needed this for years. I saw an early drone auditor flying literally right up to the edge of the restriction zone, and of course it prompted a police attendance. I remember pointing out to the idiot the danger of a gust of wind earning him a conviction. Sadly it fell on deaf ears, just as expected.
    I think a "skirt" around the prison no fly zone is a good idea. Maybe 400m is a bit too much though, 50m would be ample.

    Have no idea why anyone would want to fly near a prison anyway. Unless they have criminal intent to fly there.

      Hey! Agreed. I do get a decent amount of emails from people flying close to prisons and checking where they stand. Often it is because a park is close or something they want to photograph. However, they are rarely close enough to cause a problem with the new 400m.

      There can be a lot of ageing properties around the older prisons. Rich pickings for survey work. I spent a nice morning a few years ago surveying the roof of a police establishment well within 400m of one of the London prisons. Had a good chat with the leader of the drone team there. The funny thing was that they weren't able to do the survey themselves as they didn't have a reduced take-off and flight permission so would have had to use a bunch of resources to control the area 🙂. Fun times.

      There are plenty of urban prisons in the country. I live 400m from a prison which was built long before many of the houses in the area, with this legislation it would be illegal for me to fly 40 feet off the ground and take a picture of the house. I would never have reason to fly more than 200m away from my takeoff point in an urban area, why does the prison need 400m? Why isn’t it 600 or 800m? The restriction zone should be limited to reasonable line of sight from the prison, otherwise combined with other worrying legislation about flight records, we could be agreeing with the destruction of the hobby and criminalization of drone operators who have no intent in participating in these uncommon occurrences. The people who want to deliver contraband will do it regardless of the legislation.

      Unfotunately some prisons are built in city centres and residential areas. Thats why some individuals fly near prisons.

    There is an open Prison near me. They have their own contraband drop zone about half a mile from the Prison. I found it with my drone.

    Given that it's fairly easy to stand 2 miles away while flying a drone over a prison, drop a bag and then fly back without anyone being able to figure out where you are.... I have to ask what is the regulator hoping to achieve? These regulations won't do anything to someone who's already decided to take the risk of committing a crime, but they will add restrictions to legitimate operators.

      Hey Steve! This wasn't from the regulator. This is from the prisons minister, Mr Hinds.
      I don't see this as stopping anything as such. It will be an enforcement tool and possibly lead to counter drone tech being deployed in prisons.

      @geeksvana.if it's not from the regulator, then how can this be legal. Isn't the airspace regulated by the CAA. The prisons minister doesn't supersede the CAA, so its this government overreach

      @@kaotic345 IANAL - but my understanding is that the CAA or Regulator is given the powers to Regulate by Parliament who allow them to be amended by the Secretary of State. The Secretary of State can effectively make and change as he so wishes and direct the Regulator to comply. Secretaries of State can use the power of a Statutory Instrument to vary all sorts of things you may consider Law - you only have to look at the events of Covid Lockdowns to understand that.

      I think some police facilities will be covered with the National Security Act. Although there are tough benchmarks, it still only takes 'a' Secretary of State to designate a site as UK national security interest etc.

      Bravo...... and I can't wait for our selected serious crime, counter terrorism sites etc all added... I would like to see some kind of 'workable' permission to fly in the zones (not directly over) rather than no, no, no 🤪

      @tazzy3469 that is on the way. The working group are establishing an easy way to gain permission. Also, remember that any building added under the Nat Sec Act will be the property only and not a zone.

      I can think of good reasons why you shouldn't fly over a school. But to put the same restrictions as a prison, with a 400m safety zone would be extremely restrictive. There's an awful lot of them.

    Thanks for the information and your time in bringing it to us. For me I have no interest in flying around a Prison I can find enough places that look better to the eye. At least it is easily understood 400m metres is 400 metre no misinterpretation. I don't think its no hardship to responsible drone users. Anyone who wants to use a drone to get items into prisons will still do so because I am sure they have not registered their drone with the CAA. My concern is what is next down the road in no fly zones,

    400 metres is overkill, what about urban/city centre prisons. The Prison where i live is in the city centre, very close to the beach. 50 - 100 metres would be enough, 400 metres is too excessive.

    Hi Sean
    Nice to have some clarity. However I can find many places to fly without going near prisons or airports. I can’t see the need to cause concern to people around those establishments. Just keep away and fly in the many great areas we have in our country.

      Hey! I agree. Although I have needed to fly in both airport FRZs and close to prisons for commercial flights, I don't see much value for any of my hobby flights!

    This won’t stop criminals flying drugs into prison,drugs/contraband will always find its way in, be it with drones or corrupt staff, just means criminals will fly BVLOS with new drone technology

      Hey Razbo! Thanks for taking the time to comment! Absolutely agree. It will be an added enforcement tool. It could also lead to counter drone tech being based at prisons, too. I don't think anyone believes it will stop them. If only it were that simple.

      100% - Criminals make a career of not following laws, why would they follow this one? Given the number of prisons in the country this further limits the hobby with likely no benefit to reducing the occurrence of contraband entering prisons

      Hey Ian! It is a mixed bag. A lot of the red circles we see on airspace maps around prisons are currently only for manned helicopters. There are also some prisons with restrictions to keep drones over 164ft and stop hovering. This will at least make it consistent.

      Would be great to see maps updated correctly to reflect the size of the FRZ, Frankland/Durham on Drone Assist is huge and doesn’t reflect the size of the prison in any way.

      @ONTRACKIMAGES EGR432 Frankland/Durham applies only to manned helicopters. It is designed to ensure they do not crash into the site as people cannot escape quickly etc.
      It does not impact drone flight at the moment. Obviously, the new restrictions will in January.

      @@ONTRACKIMAGES Yes but as already stated, that restriction is for helicopters, not drones. You can fly anywhere over Durham, from January the only restriction will be 400m around Frankland/Durham. You can also ask for permission if you need to be closer.

    Hi Sean, I'm glad to see more restitutions on people who fly drones into Prisons. I don't have any patience for people who knowingly break the laws using drones. We need more positive reporting when it comes to drone flying and less negative. Thanks for the video and story.

    Hi, Sean. Thanks for the update. A bit off-topic, but I'll be coming to the UK next year and want to bring my Mini3Pro. I've been following your videos on UK regulations and, with all the changes/potential changes, I have become a bit confused on what I currently need to do.       Hey! This video is probably the best we have in terms of explaining the sub 250g rules for the UK at the moment:

      The rules are very simple for sub 250g, so it is certainly a good choice to bring with you. You will need an Operator ID but not a Flyer ID, although the latter is free so you might decide to get one anyway.

    It shouldn't bother most of the hobbiest, there generally isn't much around prisons that is off aesthetic appeal.

    I totally agree that drone flights need to be stopped flying in to prisons. It got to be a good thing. So we will be seeing a dramatic decrease in drugs getting in to prisons. After all the reports we see weekly of drones doing this its coming to an end brilliant. I looking forward to the figures later next year which will prove it was the right thing to do. 👍

    Have you had a look at Durham City ?! It's redder than Red Square ! Very confusing. There aren't THAT many prisons !

      Hey David! Do you mean EGR432? The HUGE restriction on Drone Assist? That is actually for manned helicopters only. It does not restrict hobby drone flight. It is an ongoing campaign to have these not show on the app, (still trying).

    Its still the ever creeping forward of drone restrictions I fear and I have 2 thoughts. Were any statistics provided on numbers of drone "drug flights" detected or even suspected to trigger this change? And surely illegally supplying drugs to prison inmates is already quite a serious offence?

      The stats are very low... I mean a few proven incidents a year. One newspaper decided to add the three years together and give it as one year. Still, it was less than 300, I believe.
      There is more discussion of the issue going undetected. My thoughts are that these changes will allow counter drone tech to be deployed within prisons. Either way, this is an enforcement tool only because, of course, it doesn't actually stop any illegal drone flights.
      In terms of creep, I am more concerned about the coming National Security Act and how easily a site can be designated.

      Between 2019 and 2021, 504 drones were either sighted, intercepted or seized around prisons in England and Wales, and police and prison staff have worked together to help secure more than 70 convictions since June 2016. Those sentenced are serving more than 240 years in prison.

      A single attempted drone delivery in May 2022 contained a payload of over £35,000 worth of illicit substances and contraband. This included 399 buprenorphine tablets, around 30 grammes of cannabis and 11 mobile phones.

    Another chunk of airspace restricted. Positive I know, but the last year or so been so stressful following all these drone changes, it makes you think is it all worth it? I bet all other hobbyist like myself will sell up in the next 5yrs due to stress and worried flight restrictions. That drone assist app will be like a party app with red ballooned circles all throughout the UK, so why are they still promoting all the latest technology drones also? One step forward, and two back in my opinion. You watch....Next will be Amazons air space, then schools, then industrial business etc....photography on foot is much easier.

    You make some valid points, but the issue isn't about drones flying near prisons - it's drones attempting to fly contraband into prisons, and anyone who is willing to risk a ten year prison sentence themselves for carrying contraband isn't likely to worry too much about a possible £2,500 fine. As with other drone regulations - this is preaching to the converted - the rogues don't give a toss.

    400 metres is a reasonable distance. Given the improvement in drone cameras and other technology such as listening etc, setting the level at 400 is a contingency covering future drone development. Responsible pilots will have no trouble with this and if there is a pressing requirement to be closer permission can be sought.

    Thanks for the heads up Sean. I have a few questions. Is the 400 Metres to the boundary of the prison grounds (e.g. the fence) or the centre of the installation ? Will the boundary, when the detection and fines could apply, be a circle or an irregular polygon ? Will there be notices clearly displayed regularly at the 400 metre points around the prison that say "No Drones - Penalty £2,500" . Will "intent" be a factor in prosecutions and fines ? Will the 400 Metres, which is quite a large distance, bisect public recreational lands and other private lands ? Who is responsible for the upkeep of the drone assist map, for example of the prison expands ? This clearly will also apply to other new restricted areas... what happens if all the NFZ, airports, restricted areas, etc... all just join up ? It could cover the whole country in time ? Thanks, let's all keep flying safely and within the law.

      Hey! I will try to answer all the questions...
      It should be a circle from the boundaries created by a grid from the reference numbers on the legislation. So, I would expect to see circle on Drone Assist and alike.
      It is unlikely that any physical reminder or boundary would be erected. You might find signs put up by the prison service at the prison itself but there is no requirement to do so. It is the pilot responsibility to check airspace and ensure they are not within restricted airspace without permission.
      I would very much expect the level of prosecution to match the intent. This is more of a tool for enforcement than anything else. Much the same as most flight restrictions.
      Drone Assist like other reliable sources, take their data from ENR 5.1. So they should all be updated almost automatically.
      In terms of increasing restriction zones, there are very tight rules around who can put restrictions in place and for what reason. This is something put in place by the secretary of state level.
      We do need to keep vigilant, though. At the heart of it, legislation remains a political matter.

      @@Geeksvana Many thanks for the clarity Sean. Keep up the good work, thank you. Next year we will have an election and probably a change of government. Will Labour be more, or less, private hobby drone friendly ? Or will all emphasis and freedoms be given to commercial and police drones at the expense of the freedoms of the hobbyist ? I did the recent CAA questionnaire but felt that the questions were structured and worded to elicit a particular response and that the leaning was towards more restrictions on hobbyists and less on commercial and police use. Anyway we await the future with constipation..

      ​@@Geeksvana thank you for sharing this is coming. From the statutory instrument that you showed (SI 2023/1101), I've looked at Wormwood Scrubs because that prison is next to nice open space of the same name.
      Column 2 says "Straight lines successively joining the following points" which I've worked out for Wormwood Scrubs produces a 5-sided shape/polygon (almost a square, but one side bulges out slightly).
      The overall size of this looks to be 400 metres from all of the prison boundaries.
      Mixed feelings about these changes because my understanding of the local borough byelaws makes drone flying currently ok across the whole of this open space and the new regulation would affect about half of this. 100 metres from the prison walls might have been enough.

      @jsr7096 There are similar spaces close to other prisons people are reporting they use regularly. It will be interesting to see the level of work required to get permission to fly but being a full FRZ, it is likely to stop a lot of flights.

    If these drone guns, only disrupt the signal from the controller to the Drone wouldn’t a DJI drone, just going to return to home, or whatever you said in the fly app for it to do when it loses signal

      Hey Mark! Good to see you. I have a video coming soon discussing how they work, but yes. They return the drone, and if it keeps persisting, they either find the pilot or take other action, depending on the threat, etc.
      There are doubts around the effectiveness etc and it is still early days for the technology. But it does at least offer some form of defence.

    Seems fine to me - any genuine flight can be notified to the prison and their permission sought - same as with airports etc.

      It was made law 16th October 2023 and will come into effect 25th January 2024.

      @@Geeksvana Ah did you say the dates in the video? My mind was elsewhere as I'd just got back from the gym.
      To be fair, the area around Strangeways doesn't have much to look at. There's Angel Square but I think that'll be a touch outside of the FRZ. The best places to use a drone are the far end of Deansgate where all of the fancy towers are and they're about as far outside of the FRZ as you can be before you leave the city.

    169 prisons and 5 young offenders institutions , that is a lot of restricted airspace lol , only 16 in Scotland so if we end up with the same restrictions not as much of a loss 🤣

    Is this any drone and any type of flight? What if you live within 400m of a prison - quite a lot are in built up areas - and want to fly an FPV tiny whoop indoors in your home?

      Hey Nick! Indoor flight is not regulated, so you could fly an Inspire 3 if brave enough!

      Personally I think this is overreach. I mean, if if someone is flying 400 ft above a prison outline. Then relies on the wind to carry the item to fall within the prison, a large gamble. If this does work and isn't caught, then clearly not enough is done within prisons to stop contraband entering prisons. Why not netting over prisons to stop contraband falling into open areas? This is honestly the first of many rules I see edged in to limit our drone freedoms. Next will be no flying near large population centres of 100+ people because we're not doing so for national security. Fucking sick of this. I'ver been forgiving of the CAA and needed implementation of rules and limits, especially from moronic fliers. But this is the first step of many overreaching. I fly near a town with a prison, avoid anywhere close to its boundaries as a courtesy, but to be banned effectively from the town for flying sickens me.
      Things like this make me think of a Drone ID blocker a good idea. It's only opening 'nefarious' use of drones to be seen as justified masking the true risks and blaming innocent fliers.

      @@Geeksvana literally had to reread and rewatch the video to make sure it didn’t say 400ft. If that was the case then okay. But I was right. 400m. Even 200m I’d be fair enough, haven’t even calculated 400ft from Lewes prison. I’ve flown close but probs not within that.
      An FRZ though? Within 200m from outer edge, I get that. Half a km? Like what? Come on?
      Drone fliers say they keep following the rules and flying well within them only to get slapped in the face because of some idiots and just because we haven’t the big bucks.
      I mean. WTF.
      This is the last, at least for me, I’ve been only flying for 2 years with 100+ hours and I’m tired of being vilified. It’s like walking around with a camera phone and being arrested or fined for that.
      As you often say. There are rules that tackle dropping contraband into prisons. Ie. The rule against carrying any “load” on a drone and dropping it.
      Surely, if that happens, then there is already a law in place to prosecute? Not a ban for those without any offence?
      Why not ban all drone fliers full stop in UK airspace unless they can pay 1k per year for a license and have done with it.

    While no one would disagree that flying over prisons is a reasonable thing to prevent it could be the thin end of the wedge. Next month the Secretary of State may 'be inclined' to add Police Stations to the list. A couple of months later will be schools and colleges and then power stations and ports harbours.
    When all these 400 metre boundaries join up there will be little space left in many areas where a drone can be operated from.

      Hey Barrie! It is something we need to keep a close eye on. Choosing the popular areas to restrict is always the first choice. The next stage will be seeing how the National Security Act impacts restrictions and how easily a building or site is placed on the list.

    Only impact I can see is for operators undertaking building/ roof surveys within 400m of a prison, who will then have to seek permission to fly. Thus adding a bit of time to their workload. Of course, the restriction will simply be ignored by the criminal fraternity, hoping they won’t be caught ( and if they are, they’ll commit further crimes to raise money for the fine ) Perhaps you could talk DJ Fraudits to audit Leicester Prison after January next year ? 😂😂😂😂

      I suppose it might help in terms of building a case etc and also deploying counter drone 'tech'. I can't imagine those flying drugs in stand within vlos etc 😂.

      Do you think? Drone restrictions within 400m of a prison? We have to be watchful of restrictions creeping but not sure this is one of them. To me, I hope it means they can stop blaming drones in every drug/prison story.

      @@Geeksvana There are already laws in place to stop the introduction of "contraband" into prisons, so how a drone 350 metres away is going to contravene that law is a joke. The actual method of introduction should not be restricted. Next thing you know little Johnny and his mates will have their catapults confiscated from their back gardens and Steve Backley had better not walk along the road outside a prison just incase he uses his strong arms to lob a mobile phone over the wall. If the Prison Service are that paranoid they should have applied to the CAA for the height restriction to be at least 400 feet instead of 164 feet. That would stop all overflights and solve everybody's problem.

    Think its fair as i dont see why anyone wants to fly near Prisons or over them . Same goes for Police stations . I would go one step further and ban Drones flying over industrial Estates without Permission .

      Hey Steven! I think that might be extreme. There is no evidence that drone flight over industrial estates or police stations cause any form of danger or issue that warrants restrictions.

      I do agree on both points. However, if we regulate everything to counter potential use of criminals, where would it stop? Flight restrictions over an industrial estate would not stop a criminal scoping out the area. It would just be more to throw at them if caught.

      @@Geeksvana good point and Criminals have been stealing Expensive Equipment long before drones were in the Sky . so maybe stronger laws should be brought in to protect Drone Pilots from being challenge at all . what gives any Security Guard or Personnel to be asking anyone Filming in Public what are they doing .
