Grandparents don’t have any official legal rights (at least here in the states). She can ask for visitation, but she’ll be at the mercy of the mom’s discretion.
@ericamartin7238 with her son dead she can get rights in the courts. Rights aren't inherent but given through family court. Even for estranged parents. Many parents aren't fit to have rights or be with the child unsupervised. This is why judges make the decision.

The rights you are discussing are contingent on the mother being unfit. Assuming the mother is fit (while she is wild, we have no reason to believe she is unfit based on the information we have), grandma doesn’t automatically get rights because she applied for visitation. The mother’s wishes are the number 1 factor that judges consider when it comes to visitation to her child and determining what is in the best interest of the child. I only commented because your comment came across like grandma could just go to court and get rights to see the child, so I wrote to clarify that it’s not necessarily that easy because she doesn’t have an automatic right to visitation like her son would.
