Well, if you read the TOS and EULA you only own the hardware not the software. Even then, you cannot "reverse engineer" or "modify" the hardware as it contains intellectual property. Same goes for your PC, Mac, iPhone, Apple Watch. The software on said devices is only licensed to you so long as you own the device.
Never, ever, ever heard or read of any person anywhere in the world going to court let alone jail for modding their own hardware. If/when you start to sell it or hand it around or otherwise profit from altering Nintendo's copywright firmware THEN you can be in trouble. UA-cam being a case in point. Id take a jailbroken switch OLED anyday. The oled panel is so good, and I already have a huge switch library. I have a pc for pc games, so steam deck doesnt really make sense for me😊
The only time I've ever bought a recent (last 10 years+) console, was if it could be jailbroken, I'm glad to know new switch models can be "jailbroken" (really it's a mod that allows CFW to boot (so it can run unsigned code). But with the steamdeck being at the price it is, I'm no longer interested in this device, but it's great to see developments in the switch modding scene.

a few years ago i found out how easy it was to jailbreak an old 3DS i had, and there was an app i installed that allows you to scan a qr code to download things, and there was a website with every single 3DS game freely available, alongside third party apps too, so i could just scan a qr code and download anything i wanted
If you love the customizability and the opennes of the jailbroken switch you will definitely love the steam deck, they both run on linux (with the steam deck having it's own distro).
But the deck is chunky as hell and it's heavy as well + a worse screen. For performance, the deck is better but I don't see myself playing PC games on the deck over my PC...

Here in Brazil, it's very easy to find someone who can do it for you. That's because if you don't jailbreak your Switch, you won't actually be able to buy any games because they cost a fortune. So most people who plan to buy a Switch already factor in the price of the jailbreak.
The "balls" are solder that connect the chip to the board and allow it to be accessed by the other chips on the board, when the switch was heated to make the mod chips balls attach it heated another chip, the emmc chip, to the point the balls released rom the chip so it was no longer available to the board, from the outside it looks just like normal, just theres a small air gap between some of the pins and a chip causing it to just need to be reheated so you can reattach the chip to its balls, he mad your switch a unique

Just so you know there is a new mod chip that is really cheap now, I think it’s like £10 and uses a small board which has been widely used to mod. The only downside is you have to remove the usb c port on the bottom of the board to get it to fit but it saves so much money
I always liked the idea of using the switch like a jailbroken android phone but given the difficulty of modding the console and Nintendo making it even harder it's not worth it right now. If the Steam Deck had an OLED screen then it would be out of the question to mod a switch but it still is a amazing Handheld, with the ability to play your games however you want with all the controlls the Deck offers.
Your custom theme looks pretty cool. I used to have an original switch, with a Trinket M0 (not because it's necessary, but because it's a PITA having to constantly use the jig). In the end I got of it. Nintendo is such an unfriendly and hostile company, and even though I never bought stuff from the eShop, I'm pretty sure they get a cut of all cartridge sales too. Plus, the community is honestly kinda dead. I was hoping to see the same spirit that the PSP community had, but it's just not there. Android ran really badly too for me. Overall I wasn't getting any real new features, at best it was fixing stuff that really should be part of the Switch on stock. In the end I sold it for a pretty penny and just bought a steam deck.
In response to the "would you rather have modded switch or steam deck" question. I actually have both and I would much rather have the Steam Deck. A modded Switch does a lot but the Deck does more. I usually do all my emulation on there but I rarely do emulation outside of playing retro games online with my friends as I have every Nintendo console since the 64. I really just modded my Switch for modding games and connecting other controllers. For example I use PlayStation Dualsense controller to beat up Pepsiman while playing as Dream in Super Smash Bros.

Also, it's fine for you to run custom firmware(atmosphere to be specific) and go online, playing something like ssbu online. there are things that will get you perma banned, like cheating, but things like home screen customization are perfectly fine. Some telemetry servers are blocked by atmosphere, so nintendo won't notice that. You can also run .nso homebrew(homebrew that you access via holding R while launching a game) while online, as it is overriding an existing app, so nintendo can't see.
a steam deck is defiantly better in most ways, especially if you plan on tinkering with it and getting emulation, windows, plugins, and 3rd party launchers going. the main downside for me is how big it is, a switch could somewhat fit in a pocket but defiantly not the deck. if i could have a hacked switch lite i would prob use it more just for the portability

I have a modded OLED switch (only paid 150 all in for it to get done) and a steam deck. I prefer having both because in the end it's much easier to play switch games on a switch
a long long time ago, i ordered a jail broken 3ds, and was playing it for about 3 days, and i made a huge mistake, i went online on my nintendo 3ds, and nintendo caught word, and basically basically sent a code to the console and bricked it. i didn't get banned i could have but somehow i didn't, so hes right, do not go online with a jailbroke switch, 3ds, ect. cause it can risk to eather getting banned, or having your console bricked.
FYI: Reballing the eMMC is this: eMMC is the 64gb of storage inside the Switch. It is attached with solder balls (Yes that is the official name for them I think) and when the first guy installed it, he broke them, usually by bending the motherboard. Reballing is the process of melting the solder balls to fix the broken connection. The more correct name is "solder ball reflowing".

I can really recommend the Ayn Odin as a portable allround emulation system. It is cheaper than the jailbroken switch and the steam deck.

a long long time ago, i ordered a jail broken 3ds, and was playing it for about 3 days, and i made a huge mistake, i went online on my nintendo 3ds, and nintendo caught word, and basically basically sent a code to the console and bricked it. i didn't get banned i could have but somehow i didn't, so hes right, do not go online with a jailbroke switch, 3ds, ect. cause it can risk to eather getting banned, or having your console bricked.

FYI: Reballing the eMMC is this: eMMC is the 64gb of storage inside the Switch. It is attached with solder balls (Yes that is the official name for them I think) and when the first guy installed it, he broke them, usually by bending the motherboard. Reballing is the process of melting the solder balls to fix the broken connection. The more correct name is "solder ball reflowing".
