    I think this guy wants to represent himself so that he is the one to question the victims. I think that's what all this is about. The fact that he brought up the fact that he didn't see the victims in the courtroom and was focused on that is very telling. He's nuts.

      He want's to go to trial which would force the victims to come testify and he would be able to examine them. Horrific and gross, but that's his right. They have to come. That's why the state is offering him a plea deal that does not include the sex offense.

    This guy would have gotten no jail and not have to register. Some of these plea deals make me question our judicial system. He already violated his bond by going back to the library and did the same thing he is charged with. Then the prosecutor offers him a deal with no jail time and he can get out and go right back to the library. Make it make sense. This guy is going to reoffend.

      I don't know anything about the case, but the prosecution has to weigh what they believe they can successfully prove to a judge or jury beyond a reasonable doubt. SA cases in particular are likely not very often cut-and-dry cases. It's likely usually a matter of he said she said. There's probably not a lot of physical evidence to work with. So proving that it happened being a reasonable doubt is likely very difficult. So instead of letting the person potentially completely walk away without any sort of consequence, they try to get them on a lesser punishment.

    • @Lady1974M
      @Lady1974M 3 місяці тому

      @@cambiata That's actually not true. Japan's legal system operates under the same adversarial system that America's legal system does so defendants in small matters are perfectly able to defend themselves if they choose, as is their right. Problems arise during large criminal matters because (just like in America) an incarcerated defendant in Japan will not have the freedom to view certain documents pertaining to protected witnesses or attend court to choose jury members. Therefore, in jury trials all defendants must be represented by counsel. But if the matter is a parking ticket or something small, a Japanese defendant absolutely has the right to appear as their own counsel. Their constitutional rights are very similar to those held by Americans.

    Once again, you can tell this isn't Vegas! Instead of a mall cop, Kudge Simpson's courtroom has his regular deputy positioned between the guy in the jumpsuit and the judge, another deputy behind the defendant, and a third deputy at the door. Folks, this is how you conduct a courtroom.

    Usually at a preliminary hearing, the officer that arrested you is there and most of the time the victim is there to testify before the court to see if there is enough evidence to either move forward with this case or to dismiss it.

    A competency hearing is the correct and just move. It seems like there is a huge difference between “competent” to represent one’s self versus competent to participate in one’s own defense? He does seem aware of the implications of a competency hearing so he must have a history of mental health challenges.

    4 years in state prison, two felony convictions, $1,000 fines + court costs, and being a registered offender …
    Or two misdemeanor convictions, similar fines, up to a year (concurrent, can’t hold longer in county) in county jail, and NOT being a registered offender….
    I’d have to be dead certain that they could not have a shred of evidence to risk the larger charges in a jury trial
