  • Florida Public Beaches are Private Now? There have been a lot of questions, opinions and even inaccurate information circulating about the recent Customary Use ruling in Walton County, Florida. These beaches include Miramar Beach Florida, Santa Rosa Beach Florida, 30a Florida, Grayton Beach Florida, Watercolor Florida, Seaside Florida, Seagrove Beach Florida, Watersound Beach Florida, Seacrest Beach Florida, Alys Beach Florida, Rosemary Beach Florida and Inlet Beach Florida.
    With this video, I try to clear up any confusion regarding beach use for current owners, future renters or even future buyers.

    The 30 A area has got to be the least appealing part of Florida. The density level alone is insane, the tacked on fees, parking is a disaster, there aren't enough restaurants, the beach problem. My sister insisted on having our family reunion there a couple of years. I told her I wouldn't be coming any longer.

    That's why we love Bay County, all beaches in Bay County are public. The bad thing is this drives away tourism from the entire region and gives the Emerald Coast negative publicity, interactive map or not.

      Before moving way west in the 90's Grayton Beach was the go to drive your Baja bug on the beach and have a bonfire. It's just unbelievable how piled on top of each other the properties are not to mention the prices. At least it hasn't turned into Panama City Beach where any shady thing goes

    I grew up in this area and needing a map feels absurd. It may seem like the blue and lime green and state park areas are plentiful but keep in mind those areas have to service ALL locals and anyone not staying in luxury rentals. So sad!

    Good explanation, thank you. Has the beach issue impacted bookings and buyer demand in 2024? We spend the off-season at 30A and it was a non issue. It looks like the west end has appreciable beach access for vacationers and locals.

      Richard, thank you for the question. We have not seen a decrease in demand..and honestly do not expect one. I think there will just be continued conversation about the beach access points to accompany the buyer needs and make sure they understand the options. While this video was primarily for renters and visitors, we have demand on the Buy side from those seeking large and easy public access....but also requests for private options as well.

    You've totally ignored the area west of Top Sail park, it is restored beach with an ECL Erosion Control Line ie Public beach , why u skip that (???)

    I'm glad to be in the Pensacola & Navarre Beach area to have public beaches. It's sad that a person or persons paid off county commissioners & politicians to get HB631 passed! What I read if the beach gets destroyed the owners are responsible! So don't ask the government for assistance!

      It's tricky...I believe it reads that, if destroyed, they can ask for help with re nourishment, but if they do, then it becomes available for public.

    A few spots??? Most of the beaches on 30a are private. This past weekend was a disaster. Very unpleasant and unwelcoming.
    A beach access does not guarantee a beach to sit on. Is just a path. Realtors try to minimize this issue.

      Hey thank you...you are correct on the beach access...some are just access while some are larger and have more room. It was a packed weekend at the beach for sure. "Realtors try to minimize"....my goal was to be transparent and provide a map so that incoming families can find the best location that works for them. Thank you for the comment.

    Hi, my family and I are staying at Blue Mountain in June. We have a house that is near the neighborhood access with bike parking. Do you think/know if the red areas are like the ones next to the County Vendor Managed beach, where there are strict signs, or is it more relaxed?

      Hey there! It's definitely not as heavy with signage etc as the larger public access with parking etc...but some do have some signs up. I can run down and take a few pics for you this weekend if that would help? It should be fairly busy and a good indication

    Could you address the high tide or median tide line?

      The Mean High Water Line is the boundary between potentially private property and public land. It's difficult to define as it is constantly changing. Many refer to it as "the wet sand", but not totally accurate as the true line may be north or south of what is currently wet. That being said, the wet sand can be used as a rule of thumb when using the beach in front of private property.     Can you clarify? Are the blue vendor managed areas where they are having the "ghost chair" issues or do those vendors have to wait to set up until someone actually purchased a spot? I've seen pictures of ghost chairs all up and down the beach....so sad.

      Great question. “Ghost chair” seems to be a challenge everywhere I go on vacation these days. Walton county has introduced a ghost chair policy stating that if left vacated for 30 minutes they are supposed to pick up, and then put back when renters arrive back. It’s an evolving process for sure. But there is definitely attention being paid to this.

      The county is reglating "ghost chairs" only on their County owned beaches.
      The "private" beaches apparently get very little regulation, ie it's private property so they can do anything they want.
      However, any other business on private property IS subject to regulations.
      For example, the county could tell private beaches to keep their chairs 30-50 feet from the waterline, or 20-30 feet away from next door property line...but they don't.

    No one owns the beaches on the east coast of Florida! The property line stops where the last high tide line was! This means no one owns the beach! I have witnessed several times where homeowners called police and the police explain to them where the highest tide line was, ( where the sea oats/dunes are), is where the homeownwers property stops. They tell them everytime, no one owns the beach!

    Tbh, 30a is overcrowded and overpriced for what it is. Food sucks too if you can find anywhere to eat.
