The lawyer literally admits Netflix put disclaimer “based on true events” at the end. Thereby destroying their claim.
I knew there would be something in her past that came to light - I bet she went to a mental hospital to avoid jail. I’m guessing she got a legal degree to help herself navigate what she knew she was doing wrong. She stopped harassing Laura Wray when a legal paperwork was on file: proof she knows what she’s doing is wrong and wants to avoid legal action.
If Red Bull advertises "Red Bull give you wings" does that mean that red bull literally gives you physical wings? NO, thats a slogan to sell the produci.. now Netflix sells entertainment and saying "this is a true story" is an advertisement to sparkle the product. The story did not bring out any experts to say that it was an evidential true story. Even the genre indication on netflix is "british comedy drama". Nothing indicates that baby reindeer is an actual true story other then the main character typing "this is a true story". Netflix is under no obligation to broadcast factual truth.. their business is entertainment, nothing else. And entertainment does not have to uphold the factual truth under any circumstance. Baby reindeer is not a documentary or a biopic,, its a comedy drama. Red bull doesnt give me wings nor doni ecspect it to give wings.. if i am under the assumption it gives me wings then that is my own fault. If i make a tv show about the true story of a guy that was abducted by aliens, does the whole world think he was abducted by aliens? And then when later people find out he was trippingbhis balls off and mentally disturbed, is the world gonna sue me because my tv show didnt contain the truth? That people fell for baby reindeer's true story due to their own gullible unverified belief, is their own responsibillity and their lack of critical thinking and laziness of not checking out the genre and other factors (as the of expert verification etc) but just watching the episode(s) and believing a comedy drama series is their own fricking fault 😂😂
Omg imagine Fiona under cross examination??? Girl- you don’t want that smoke- trust us!!! I know she thinks she is a lawyer- but she has never actually worked as one- I don’t think?! And def not in the USA!! She would get eaten alive by an American defense attorney on cross- it would be a disaster!!! Not to mention- she still did stalk him and other people as well- and Laura Wray said that other people have come out to her that Fiona stalked them as well, but they are afraid to come forward!! So how many people does she have to do this to before she is actually stopped or reprimanded??? What if she kills the next victim? Oh, well then it’s a problem!! It is crazy to me! Regardless of whether Netflix exaggerated the story for the sake of a good story or not- I don’t think Miss Fiona had much going on in life. This lawyer said she can’t leave her apartment due to fear now and she isn’t well- umm- she wasn’t well to begin with- and he then said she was a woman who kept to herself in her apartment and now she’s all over social media! So- she never left her apartment anyway- it isn’t bc of the series that she is now a shut in….from what I heard and read- she doesn’t have a job- so it isn’t a loss of wages, or destruction of her character which will cause her problems trying to get a job or keep a job….so what are the actual damages here besides “emotional distress” which- again, it seems as though that is literally her entire personality….i don’t know. I don’t think she deserves this pay day or legal attention. This makes her feel super important and as though she is in the right and that is just not true. This is very frustrating and I pray Netflix have amazing lawyers that rip her lawsuit to pieces

Assume that any dramatization of a true story has been embellished for dramatic effect and entertainment purposes. I don’t know why that’s hard for people to grasp.

Again, this s a true story is typed on a laptop by the character Donnie! only once! This was the characters true strory! And there is a dsclaimer at the end of every episode! Neither Netflix nor Gadd has ever said it is about Fiona Harvey, she decided it was about her, she outed herself!! Omfg this is a sick world if she gets a penny! This has been a play for almost 10 years - she never said anything before because no one platformed her before for clicks!!!

I hope that, just on a principle, that Netflix will take this to court, not for the sake of the people clamouring for more details, but because if the news articles, and the Psychiatric Hospital Receptionist, Ms Wray, Sir Keir, the Police and anyone else who is brave and comes forward in the meantime, turns out to be correct and true; then there may well be some justice for those people.

@@bessinadress The receptionist goes by the name of Heather Burns, but I can’t remember how long ago that she was referring to, all I did was to google her name and it popped up. The other part, the Police was attached to this period as well if I remember correctly.

Let's see what happens if Fiona wins, and Laura sues Fiona. Maybe she'll hire Richard Roth to defend. See how his opinions change then and he slams Fiona for what she did. Also Piers saying she committed no crime and was just a 'troll'. Definition of a troll is someone who harasses someone else online. Fiona did this in real life, also calling social services on two lawyers isn't trolling. It's false allegations. She should have been charged just for that. Maybe that's on her rap sheet? They (Roth) did a 'basic' check for criminal convictions. As a lawyer, he should know that a basic check only goes back five years. This story goes back more than just five years and the basic check would be 'spent' now. He should have done an enhanced check. There's something not right about the basic check. Maybe American lawyers don't understand the way these work? Hopefully someone will request an enhanced check before this case gets to court.

There's no way that lawyer wants to go to court over this, they know they won't win any substantial damages.....but if they keep publicising the case, they're hoping Netflix will settle out of court for a more acceptable sum.
Netflix said they'd vigorously defend the case and I don't doubt they're pushing for a trial. roth knows he won't win a trial - like his client, he can't seem to keep his story straight either.
The lawyer is hoping to get money from having a crazy court case that he knows is a lose lose situation. Would it be televised?
Netflix need to dig their heels in all the way to the courtroom, it’s not on their dime anyway so costs for trial will be on the side who instigate proceedings

Fiona needs to provide an enhanced dbs check, not a basic dbs check. The basic covers the past 5 years. An enhanced covers everything. She was institutionalised. It's all online. She stalked a temp typist who worked at the facility. She also stalked 2 police officers.

The only reason these two men are on the screen talking about this is because there’s money to be made. It’s nothing to do with the rights and wrongs on either side, but more about exploiting a situation for their own gain. It’s as cheap as as it is nauseating.

Fiona has an inflated sense of her abilities- she was never a practising lawyer as she couldn't keep sane enough in any law office. She has been living off a benefit for decades & her work is stalking & complaining. She has had a hand in writing the letters to file. She'd be a nightmare client to represent- even from a different country.

I am no law expert. But once Fiona stalked people like Richard, Laura, etc, she should have closed her social media accounts and opened new ones without her name. She left all her 4 accounts that she used to stalk people, so that is partly her fault. Also, imo once she started receiving messages, she should have just blocked them or blocked her account until it dies off. But no, she decided to go to Piers Morgan show. She is not scared of the messages she is just playing victim. She wants the attention, you couls see it on her barrage of FB posts advertising herself being on PM show and bragging about her hair how good it looked. That does not sound like someone is shattered and scared of coming out of her house. I doubt this will go to trial, I am sure netflix have all their evidence they need and a lot of can of worms will open for Fiona. Most likely like a lot of people said over here inc Gary they settle outside and most likely it will be around the a 6fig number not 170mill, not even Amber or Johnny got millions from their lawsuit.

A disability pension is often quite a decent amount of money, especially if the person is living in a council property, like fiona is. She could well afford a few cheaper connections with various mobile companies; may only top up when she feels the need to "have her say". There has been no evidence that she's ever held down a job, but plenty to point to her being attached to NHS Mental Health Services, living in a council flat and being on a pension.

Maybe the UK does a better job if taking care of folks. The UK is starting to clamp down on antisocial behaviour which would include harassment and stalking. Just because Harvey stopped when given a restraining order that does not mean she isn’t a stalker simply because most stalkers still continue.

There are stalking and harassment laws on the books in the UK today. I literally wrote a comparative paper on it a few years ago. Obviously they don’t apply retroactively, but if Fiona stalks someone today, her actions can absolutely be criminal . Aside from that, she is only entitled to part of the profit if she contributed to the success of the show. But that’s not what they’re claiming. The claim is that she was defamed and suffered loss and harm. Thus she would be entitled to reparation for that loss and harm which in no universe amounts to $170 million. This attorney as delulu as Fiona is. Lastly, he’s saying that Netflix has to prove their claim, in California. No sir, Fiona is making the claim that Netflix is making false statements. Thus, she has to show that Netflix made false statements and Netflix has to defend their statements. That’s literally torts 101.

@jillb3072 OK hang on. Firstly counter suit means an accused person can counter suit, i.e reply to the plaintif with a retort for damages.
Eg (to make it easy) Johnny Depp took Amber Heard to court for defamation of his character and reputation as she claimed he beat her. Amber Heard then counter sued Depp for her own reputation being affected and wanted monetary compensation damages for her well being, reputation and loss of work.
Laura Wray is not a plaintif or defendant in this possible Harvey vs Netflix lawsuit.
Laura Wray can only countersuit if Fiona Harvey sues her first!

In my country, chasing, loitering, observing, contacting, or sending materials to another person that causes them to be afraid or harm them or any other third party are all examples of stalking behaviours. It is a crime. Laura could have had Fiona charged but she said herself that she felt Fiona had mental issues so didn't want her charged hence the intermittent interdict. It prevented Fiona for contacting her again for a year or there would be legal repercussions. Ie a criminal charge. Fiona stayed away from her because of it.
What Fiona's little brain did not know is that the interdict was for 1 year. Hence the word intermittent. Laura could have filed them every year. Turns out Fiona was scared off and did not bother her again.

Paranormal Activity says the same at the beginning. No one took them to court.
It also says at the end that some characters, situations, yadda yadda, have been altered or changed for dramatic effect... the same disclaimer that all true story works use.
