That actually is legally assault/battery in most states. You can't claim self defense to words. Though in some states they do have the " fighting words " defense which can be used as a defense for battery but you almost never see it actually work out. The fact that no one who handled this case was bold enough to call out the root of this murder being discrimination and transphobia. The fact that this happened in a bathroom, a highlighted trans issue, speaks volumes. Nex is trans, used they/them pronouns, used the bathroom the state declared they need to use, and got killed. That joke of a so called medical examiner should be fired. They said they died of "natural causes." The school then punished Nex by suspending them and didn't punish the ones that assulted them! They lied and downplayed the severity of the beating, didnt call an ambulance. Then the cop says that Nex was the one the cop accused of assult! My mind is blown and my heart is broken.
The medical examiner did not say that nex died of natural causes. Examiner said that the death did not appear to be the result of trauma, I.e that it does not look like nex was beat to death. The school punished everybody who was involved. The actual fight did not last very long at all, not a full 2 minutes. The cameras from the school show that it lasted maybe 20 seconds at most. After the fight everybody is seen walking out just fine up to the principal's office. Something that would not be possible if there was a severe 2-minute beating that resulted in death in the bathroom. Which by the way also did not happen. There was no need to call an ambulance at the time since everybody appeared to be fine but it was suggested that nex get checked out later It was deemed necessary. Nex did initiate the assault. It was admitted in the body cam video that some other girls were talking amongst themselves saying things that nex found offensive so a bottle of water was filled up and was poured on all three of the girls, which is by definition and assault. The other girls did not like it and proceeded to assault back. Nex was cleared by the hospital and died the following day. Whether or not it was some lingering effects from the fight the day before is yet to be determined. Could be.

It’s a tragedy but this video is just false. Not to minimize what those girls did but they didn’t “beat her to death”. First point, watch the bodycam footage. She’s completely coherent with no sign of any immediacy to her injury, also not a visible scratch on her, something I’d say is umm very very very unusual for someone who was beat to death. With the victims claimed head trauma I would be flabbergasted if the hospital didn’t do tests to rule out brain trauma or even a concussion. None of that matters though considering we have an autopsy report showing a completely unrelated cause of death having to do with a fatal mixture of Benadryl and anti depressant, autopsies aren’t perfect and they do error sometimes but in the case of a fatal beating there would be ample evidence if that was the cause of death. That means that categorically this was either an accident or a suicide, in any case still a tragedy but not a murder. To suggest otherwise is a lie and your post is so flagrantly inflammatory and false I think you should get the Alex Jones treatment and be sued into poverty by the parents of the kids you’re accusing of murder. Rest in peace to the child that died, but shame on you for using her death to push your narrative.
Though Nex did commit suicide the bullies still had a part in it as they were bullying Nex relentlessly. Nex and her friends were in the restroom laughing about a joke they told to eachother, and the the bullies were in the same restroom but talking to eachother. AFTER the bullies heard Nex and her friends laughing one asked "Why do they laugh like that?" And then the bullies started laughing. Nex wasn't targeted, they were referring to her and her friends. Nex didn't like this so poured water, THE ENTIRE BOTTLE, on one of the girls and they all started beating up Nex which was absolutely deserved and entirely legal. Pouring water on someone for asking why your friends laugh a certain way is no excuse to pour SPIT filled water onto someone. After being Nex's pathetic little ass, Nex weht to the hospital. After the hospital and police interrogation, where nex was told she aasulted someone so was wrong, and was told she only had a few scratches on her hands and arms from fhe punches she threw. Nex died AT HOME. Nex had an autopsy done and it turned out she didn't die from any head trauma, so they have sent her body to toxicology. Schools tend to focus on the first blow, not the events leading up to it. Nex may have started the fight with water, but the bullies reacted with a disproportionate amount of force beating them until the teacher stepped in. The actual timing shouldn't matter as anyway it gets spun. Nex was being bullied because they were nonbinary and the school added fuel to the fire by attempting to fix what wasn't broken. If we were talking about the same situation with adults, the students would be charged with murder and some of the staff as accomplices, but these are teenagers, so it's your everyday occurrence of bullying.

THIS IS ALL WRONG! Toxicology came out. Next accidentally overdosed on was is presumed some pain meds likely due to some bruises or maybe another reason. Nex and their friend went to the bathroom to fight these 3 girls that had been bullying them. You can see in the video that nex never had their head hit on the tile repeatedly saying as they have no blood their head in both of the cut outs of the body cam footage that this dumba showed in the video. Also nex was not suspended again just had extra time added to their previous suspension, saying as the 3 girls and nex and nex’S friend were already in ISP when the fight occurred. It was an antihistamine and a depression medication. No painkillers involved but that’s just what the medical examiner reported, maybe you know something the examiner didn’t.

Nex was alive an conscious when they left the bathroom to go to the school office/nurse, and was alive the following day leading up to going to the doctor. Nex's family took them to the doctors twice, once after school where Nex was seemingly fine, and the second when Nex's parent called 911 because Nex was having involuntarily movements. I'm not saying that the attack did not lead to their death, but they were conscious and alive immediately following the attack. Its still undetermined the actual cause of death, but it seems like brain damage occured during the attack. Regardless, may Nex rest in peace.
So her head was repeatedly smashed into the tile, but she was walking fine to the office and speaking coherently to the officers in the hospital. The CT scan she did showed no injuries or trauma...... something doesn't add up. And students coming out calling her a bully... stop spreading false information. It's not cute.
It doesn't add up because from what I understand about the situation from other reports she committed suicide after the incident. For the record throwing/spraying/ or any other intentional attack with water or any other fluid is considered assault just as spitting on someone is also.

From what the actual story says, if anyone chooses to actually read into this instead of assuming, they must have taken something the next day which led to their death. (Non binary so trying to be correct in speech, if difficult to understand) It seems as though they took some sort of poison or overdose which will be confirmed (or not) when toxicology comes back. So the bullies did not literally murder, but what they did leads to what looks like a suicide. So no, the beating was not the direct cause of death, although it certainly was a contributing factor. Very sad story.

She died of a suicide. Likely because she knew shed be charged with assault for this, as she admitted to the coos that she saw the other girls laughing and assumed they were talking about her and filled up her water bottle and went after them. Nex was a bully. The initial fight that resulted in Benedict going to hospital began after she believed a group of teens were gossiping about her. She responded by throwing water over them and a fight ensued. "Yeah, because of the way that we dress," Benedict said. They assaulted a random group of people because they were making fun of how they dress. Nex was a bully.

Saying such, without elaborating that Nex died the next day from a suspected drug overdose, is disingenuous. It makes it sound as though the physicality of the confrontation, literally killed Nex. Which is not the case. A mentally stable person doesn't just decide to end their own life because they got beat up or some bigoted adults pinned it on them. This is years of trauma built up and these girls were just the ones to push Nex over the edge. Do they deserved to be punished? Absolutely. But it's important to distinguish the fact that they weren't out to end Nex's life. Nor did they physically do so. You said it yourself. Contributing factor. Physical assaults and bullying alone are not enough to make a mentally stable and secure person kill themselves. It is quite easy to cover up stuff when the majority have a bias. See when this story first came out there was no mention of Nex being trans so people got angry at the three kids who beat the hell out of Nex and more then likely being the cause or their death. Dying from a single TBI is next to impossible (without symptoms) it doesn't just suddenly happen. At the very least she would have gotten hematoma symptoms (where the brains chamber filled with spinal fluid, at a perfect pressure, gets flooded with blood from a TBI) They are serious and often cause loss of consciousness, stroke like symptoms, slurred speech, etc, and happen immediately after the TBI (Tramatic Brain Injury). TBI induced Hematomas require such an immense amount of force, even MMA fighters cant do it. It often only happens after a car vs pedestrian collision, a gunshot to the head, or a fall on to a hard surface. If you read more news sources their death was an apparent sewer slide, and guys like this are disgracing their family and their potential life. Disgusting.

That actually is legally assault/battery in most states. You can't claim self defense to words. Though in some states they do have the " fighting words " defense which can be used as a defense for battery but you almost never see it actually work out.
From what I have read so far the girls were making fun of Nex threw water on them and then they attacked Nex. Is how they responded right? No in no way but Nex starting the physical confrontation will be used as part of their legal defense.

That joke of a so called medical examiner should be fired. They said they died of "natural causes." The school then punished Nex by suspending them and didn't punish the ones that assulted them! They lied and downplayed the severity of the beating, didnt call an ambulance. Then the cop says that Nex was the one the cop accused of assult! My mind is blown and my heart is broken.
The medical examiner did not say that nex died of natural causes. Examiner said that the death did not appear to be the result of trauma, I.e that it does not look like nex was beat to death. The school punished everybody who was involved. The actual fight did not last very long at all, not a full 2 minutes. The cameras from the school show that it lasted maybe 20 seconds at most. After the fight everybody is seen walking out just fine up to the principal's office. Something that would not be possible if there was a severe 2-minute beating that resulted in death in the bathroom. Which by the way also did not happen. There was no need to call an ambulance at the time since everybody appeared to be fine but it was suggested that nex get checked out later It was deemed necessary. Nex did initiate the assault. It was admitted in the body cam video that some other girls were talking amongst themselves saying things that nex found offensive so a bottle of water was filled up and was poured on all three of the girls, which is by definition and assault. The other girls did not like it and proceeded to assault back. Nex was cleared by the hospital and died the following day. Whether or not it was some lingering effects from the fight the day before is yet to be determined. Could be.

It’s a tragedy but this video is just false. Not to minimize what those girls did but they didn’t “beat her to death”. First point, watch the bodycam footage. She’s completely coherent with no sign of any immediacy to her injury, also not a visible scratch on her, something I’d say is umm very very very unusual for someone who was beat to death. With the victims claimed head trauma I would be flabbergasted if the hospital didn’t do tests to rule out brain trauma or even a concussion. None of that matters though considering we have an autopsy report showing a completely unrelated cause of death having to do with a fatal mixture of Benadryl and anti depressant, autopsies aren’t perfect and they do error sometimes but in the case of a fatal beating there would be ample evidence if that was the cause of death. That means that categorically this was either an accident or a suicide, in any case still a tragedy but not a murder. To suggest otherwise is a lie and your post is so flagrantly inflammatory and false I think you should get the Alex Jones treatment and be sued into poverty by the parents of the kids you’re accusing of murder. Schools tend to focus on the first blow, not the events leading up to it. Nex may have started the fight with water, but the bullies reacted with a disproportionate amount of force beating them until the teacher stepped in.
The actual timing shouldn't matter as anyway it gets spun. Nex was being bullied because they were nonbinary and the school added fuel to the fire by attempting to fix what wasn't broken.
If we were talking about the same situation with adults, the students would be charged with murder and some of the staff as accomplices, but these are teenagers, so it's your everyday occurrence of bullying.

THIS IS ALL WRONG! Toxicology came out. Next accidentally overdosed on was is presumed some pain meds likely due to some bruises or maybe another reason. Nex and their friend went to the bathroom to fight these 3 girls that had been bullying them. You can see in the video that nex never had their head hit on the tile repeatedly saying as they have no blood their head in both of the cut outs of the body cam footage that this dumba showed in the video. Also nex was not suspended again just had extra time added to their previous suspension, saying as the 3 girls and nex and nex’S friend were already in ISP when the fight occurred. Nex's family took them to the doctors twice, once after school where Nex was seemingly fine, and the second when Nex's parent called 911 because Nex was having involuntarily movements.
I'm not saying that the attack did not lead to their death, but they were conscious and alive immediately following the attack. Its still undetermined the actual cause of death, but it seems like brain damage occured during the attack.

I say, it’s clear an assault took place here and it’s clear this assault causing head injury lead to Nexs death.
We are setting a precedent here to say assault is tolerated, assault leading to death is dismissible and a child assaulted in a school bathroom later dying from the injuries is excusable. Here, the flood gates are open and it says to the people, go ahead, “we don’t want this filth in our schools” says Tom Woods, Republican of Oklahoma.
Anyone who has a child must really let this sink in. Then ask yourself, what if it was my child or any child you care about?

From what the actual story says, if anyone chooses to actually read into this instead of assuming, they must have taken something the next day which led to their death. (Non binary so trying to be correct in speech, if difficult to understand) It seems as though they took some sort of poison or overdose which will be confirmed (or not) when toxicology comes back. So the bullies did not literally murder, but what they did leads to what looks like a suicide. So no, the beating was not the direct cause of death, although it certainly was a contributing factor. Very sad story.

I'll have to do some digging, but I remember a case from a decade or so ago where a girl was charged and convicted because her relentless bullying led to a kid commiting suicide. She text him hundreds of times telling him to kill himself. And he eventually did. I'll be back once I find the case info.

Yes RIP. But this youtuber completely twisted the information and blatantly made up parts of it to get more views and attention. No one even confirmed that those girls beat her. The authorities haven't released enough information for closure/privacy of the family. It was an apparent 'sewer slide'. The reason why the body cam got released is because it is state law when someone request bodycam its called public records request. However, it is most often the media that wants it for attention, giving no respect or privacy to the family who lost someone. It's disgusting. This dumbass is participating in it. Obviously her sewer slide could have been caused by this incident, but you can't believe everything these people make up.

The "bullying" was teasing of how Nex dressed.
Nex was instructed to ignore them since they were not actually harming her. Her counselor has told her this repeatedly.
Nex and her friends were in the restroom laughing about a joke they told to eachother, and the the bullies were in the same restroom but talking to eachother. AFTER the bullies heard Nex and her friends laughing one asked "Why do they laugh like that?" And then the bullies started laughing.
Nex wasn't targeted, they were referring to her and her friends.
Nex didn't like this so poured water, THE ENTIRE BOTTLE, on one of the girls and they all started beating up Nex which was absolutely deserved and entirely legal. Pouring water on someone for asking why your friends laugh a certain way is no excuse to pour SPIT filled water onto someone.
After being Nex's pathetic little ass, Nex weht to the hospital. After the hospital and police interrogation, where nex was told she aasulted someone so was wrong, and was told she only had a few scratches on her hands and arms from fhe punches she threw.
Nex died AT HOME. Nex had an autopsy done and it turned out she didn't die from any head trauma, so they have sent her body to toxicology.
SHE probably killed herself when she learned she was going to be held accountable in COURT for what she did. She was TOLD she would be held in COURT for assulting someone with her SPIT filled water.
Stop victimizing and not telling the full story. No one cares about LGBTQ people, you're not a priority to harrass or entertain. She wasn't bullied, she was mocked for how she dressed, and from that picture, she does look pretty fucking goofy.
She died of a suicide. Likely because she knew shed be charged with assault for this, as she admitted to the coos that she saw the other girls laughing and assumed they were talking about her and filled up her water bottle and went after them. Thats not self defense. Her head was NOT repeatedly slammed repeatedly into tiles or toilets or sinks as it was a quick scuffle. Go watch all the footage yourself.

Nex was a bully. The initial fight that resulted in Benedict going to hospital began after she believed a group of teens were gossiping about her. She responded by throwing water over them and a fight ensued. "Yeah, because of the way that we dress," Benedict said. They assaulted a random group of people because they were making fun of how they dress. Nex was a bully.

I personally think she unalived herself due to the fact the other student was pressing charges against her for throwing water on her. From some reports and Nex own accounts she’s never talked to these other girls before. So she just threw water on a random girl, got beat up. Cried wolf, that didn’t work out. Took a bunch of pills. Mom cried wolf.

She overdosed cause she had mental health issues she was already on anti-depressants for issues she was having. People need to wake up and help theses kids and stop catering to them or we will continue to lose more and more at their own hands cause they can't deal with the lifestyle they created and feel they are unable to go back to a normal life.

Saying such, without elaborating that Nex died the next day from a suspected drug overdose, is disingenuous. It makes it sound as though the physicality of the confrontation, literally killed Nex. Which is not the case.
A mentally stable person doesn't just decide to end their own life because they got beat up or some bigoted adults pinned it on them.
This is years of trauma built up and these girls were just the ones to push Nex over the edge. Do they deserved to be punished? Absolutely. But it's important to distinguish the fact that they weren't out to end Nex's life. Nor did they physically do so.

Physical assaults and bullying alone are not enough to make a mentally stable and secure person kill themselves. There are countless other factors, influences, and environmental aspects along with who-knows what else beneath the surface that lead Nex to that decision.

This sounds a little one sided and exaggerated? How did the news and hospitals cover up the cause of death so thoroughly it was 100% trauma to the skull? Also, she didn't die the same day, she gave interviews and police statements
It is quite easy to cover up stuff when the majority have a bias. See when this story first came out there was no mention of Nex being trans so people got angry at the three kids who beat the hell out of Nex and more then likely being the cause or their death. But the second the information Nex was trans got out suddenly so many people turned around trying to make excuses for the three that beat Nex up.

Yep. There are so many mixed up stories. Next was found dead the next day, I believe in their home but not sure where. I believe it was self-deletion, but a slow leaking brain trauma could absolutely be the cause. We will find out.

@absolutelyridiculous6743 Except that any sort of blunt force trauma to the head would cause incoherent speech, balance and other TBI symptoms. Dying from a single TBI is next to impossible (without symptoms) it doesn't just suddenly happen. At the very least she would have gotten hematoma symptoms (where the brains chamber filled with spinal fluid, at a perfect pressure, gets flooded with blood from a TBI) They are serious and often cause loss of consciousness, stroke like symptoms, slurred speech, etc, and happen immediately after the TBI (Tramatic Brain Injury). TBI induced Hematomas require such an immense amount of force, even MMA fighters cant do it. It often only happens after a car vs pedestrian collision, a gunshot to the head, or a fall on to a hard surface. If you read more news sources their death was an apparent sewer slide, and guys like this are disgracing their family and their potential life. Disgusting.

This is not what happened. First off, the whole “the head being bashed was so loud a teacher heard” is BS. If a fight is going on, it’s going to be loud no matter what. Second, Nex’s autopsy has been released and they did commit suicide by taking a shit ton of meds.
