Briscoe wasn’t informed of the penalty before he dumped Hamlin. Also, there was no rule about where to merge before Lepage’s incident, they just assumed no one was that stupid.
Josh Williams had the same penalty as Hocevar at the 2021 Martinsville #1 Xfinity race. He had issues and spun the car out and NASCAR thought it was intentional.

penalty for intentionally causing a caution should be whatever amount of laps it can be estimated you lose by pitting or undergoing repairs in pitlane during a green flag run. take the leader's average lap time over the current run, have an official estimate the time needed to pit or be in the box for repairs and go from there as to the penalization

Depends on the situation and the circumstances. Loose wheel or other correctable issue and no other cars involved? 1 lap penalty is fine. Same situation but you wipe out another car in the process? 5 lap penalty. Do what Bowyer did at Richmond? Should be parked for the rest of the season for race fixing. Do what KyBu did to Ron Hornaday? Banned from that series or all of them for one calendar year from date of incident. Lepage the field? One race ban and YOU have to pay for all damages to other cars
I got to see Hocevar get beat at Toledo. Hocevar led most of a 100 lap CRA Super Series race and another guys comes all the way from the back and challenge him, rattled his cage/roughed him up and got passed. Hocevar stopped his car on the track and caused a yellow. Kid seems like a punk.

Briscoe should've at least been handed a hefty points fine for Indy. Not a fan of Hamlin by any means, but at the time he made contact with Hamlin, he was under penalty from NASCAR. Whether you agree with the penalty or not and even though he didn't know about the penalty, at the end of the day he still manipulated the running order while (technically) under the black flag. Imagine the outcry if the roles were reversed and it was Denny who spun to Briscoe. People would be calling for Hamlin's hard card.

Minimum of two laps just to make it guaranteed not worth it if they get caught but higher penalties if say for instance they cause a wreck whilst being found to be guilty of trying to intentionally force a caution.
The one thing I hate the most in sports is stuff that lets you abuse certain rules/regulations to gain an advantage. Intentional cautions, flopping, and things like that, should give a penalty so harsh, that it far outweighs the benefit of getting away with it. It’s so lame to see players or drivers benefiting for essentially cheating. And I know it’s not technically “cheating”, but it’s unethical and causes others to also try to abuse it, then you get everyone doing it. Exactly what happened to Soccer/Football, where flopping has become so normal, that it essentially integrated itself into the sport.
