I believe he got lucky and did not get hit, then fought the other guy off. Saying he got tased would help his countersuit but he didn't even seek medical attention afterwards, just took care of himself. In police videos the person tased, if it was done unlawfully, usually gets a much bigger settlement in court than someone who was just unlawfully detained.
