      Possibly still hungover or drunk from night before, just nipping down to the shop for a newspaper with his flip flops on and that's why he left the scene. Should have been able to get his reg for the insurance claim though and as it says insurance companies drag their heels when it is an import vehicle 😮😮

    Simple. The van driver should have come further around the bend to see what was approaching before making the turn. Love the way he gave the 'i'm the victim' body language.

    Gets out of his van like a hard man, 100% his fault cutting across the corner like that with barely any view of the oncoming lane. Can tell by his attitude he was trying to blame you 😮‍💨 cutting across oncoming lanes - the oncoming cars have priority 👍 if you fail to look that just makes you even more of a bad driver.

      White van men have the biggest sticks up their arses. Always trying to prove something. They think because they're "local hero" tradesmen that they can do whatever they want on the road and everyone else should just shut up and put up. Admittedly, his van wasn't white, but the archetype stands.

      Yes, van driver seems to drive into the turn on the wrong side of the road (in LH lane and over the solid white line). I think he was going too fast for the turn. There was a cone, away from the curb, seemingly to support a diversion sign, but van seems to have been driven too lazily and maybe too fast and cuts the corner off the main road. Road layout with the junction just after the blind bend is not ideal but it's likely been that way for ~500y. Van driver in the wrong. Good to have the camera and send to Ashley as an example of poor driving. Be good to get his view.

      It’s not the fuel companies. The profiteers off of fuel sales by a factor of 10 are the government. But certainly agree on insurance. There’s no competition and they’re becoming cowboys

      Anything that is a legal requirement is an excuse to jack up the prices. Make it optional and watch the prices tumble as the companies drop their prices to entice custom of their now optional service.

      My car was written off last year (partners fault). Direct Line paid out £1500 more than I thought the car was worth and only £700 less than I paid for it over five years before!

    He didn't turn too late, he turned far too early. He's on the wrong side of the road because he cut the corner.
    Slowing down and turning where he should, he most likely would have seen you and this wouldn't have happened.

    The van literally entered the new road, And WENT IN on the wrong side of the road.
    He cut up lanes and at speed, and not giving way to on coming vehicle
    And in such junctions. The van is not priority. The cammer car is.

      @@temparalflux914 He didn't hang around for long. He said his piece and then left before I could get his details. The dash cam does not show this as it powers off with the ignition no longer being on. In his exact words "I don't have time for this".

    You only have to view the clip once at the start to realise the 🔕END in the van wearing stupid flip flops is at fault. He should be banned for 6mths and put on a driver awareness course. He has no driving skills what so ever and couldn't care less for other road users which his attitude shows straight away when he exits the vehicle.

    Quick enough to take the money but not so quick when they have to pay up. The GOV should introduce a time limit from the moment the accident is reported to them to the time when something gets done, foreign or domestic make no difference.

    I know from personal experiences, one of the key factors is right of way in situations like this. You have right of way there and if any vehicle driver makes a move across it, the main responsibility to do it safely lies with them. Of course you must still be observant, drive at a safe speed and be able to stop if need be, regardless if you do have right of way. But when someone turns across you like that at such a short distance, then they haven't been careful enough about making that turn.

If someone drives into someone else claiming ‘right of way’ but the accident was preventable it can go 50/50 as both parties were driving negligently. The Highway Code mentions ‘priority’. Priority is given not taken though. If someone fails to give priority where it is due the other party doesn’t have the right to drive into them and claim innocence if the accident was preventable. I’m not referring to the incident in the video just collisions in general.

      No such thing as 'right of way'. Nobody ever has 'right of way'. This is important to understand because it can lead people to believe they can't be attributed partial fault in a particular collision because they had an imagined 'right of way'.
      You can however have priority. But this is given, not taken. If another road user fails to give you priority where they should, you still have a duty to avoid a collision where possible. You never have the right to crash into somebody because of an imagined 'right of way'.
      In this instance while the cammer did have priority and there doesn't look to be anything they could have done to avoid the collision in the moment, they could be criticised for their approach speed into a hazard (bend with no visibility) which gave the other vehicle virtually no time to observe and react to their presence and themselves no time or space to avoid a collision. While it may not have been significant enough in this instance, it's entirely possible (and common) for a driver with priority to be assigned some percentage of fault where they contributed to the collision (e.g. through inappropriate speed or failing to react appropriately to another user failing to give them priority).
      There are a lot of dashcammers on youtube that need to learn this. Too many drive into obvious risk because of an imagined 'right of way'. No doubt they will be in for a rude awakening when they are involved in a collision as a result and find themselves being assigned partial fault.

      Must be if it comes to the UK and passes its IVA and MOT tests with it on. The IVA test is an MOT on steroids that covers everything.

    How did you manage to keep the pushbar of that interceptor? In Germany that wouldn't be possible due to pedestrian protection laws. Are there no such laws in GB?

      You can fit a bull bar in any car that was made before 2007 in the uk. (I think)

      I think it only applies to UK-spec cars that were first registered in the UK. My Crown Vic came from PA in the US and was imported and tested with the push bar already on it. It probably isn't safe for pedestrians but hopefully nothing bad like that happens. I drive carefully enough as the steering wheel is on the left which can affect visibility around parked cars or blind bends.

    "Too fast", sure - he, unlike you, could see the road was narrowed to one lane at the corner and should've been creeping round with a foot ready to stamp on the brake to maximise the available stopping time for anyone coming from the opposite direction (like you!). But what do you mean when you say he pulled out "too late"? He was already solidly on your side of the road by the time you even saw each other!

      Absolutely! The highway code states that road users must give way to oncoming traffic before committing to a turn across the opposite lane of traffic. Playing back the video in slow motion, you can see that my car enters his view before he has committed to turning. He had time to brake and stop but he chanced it and tried darting in front of me. My reaction and braking times weren't simply enough to prevent a collision.

      Yeah it is a dodgy junction, especially being on a blind bend. They reduced the speed limit from 30 to 20 in that area 2 years ago probably because it is so dangerous.

    I mean, those CVPIs are designed to take a beating and dish it out, his van needed major repairs whereas yours just needed buffing out and maybe a replacement bullbar?? Honestly, I'd be surprised to see a CVPI without dents and scuffs these days. 🤣🤣 Absolute machines.

      Push bar needed a bit of reshaping back to normal, but aside from that the damage was minimal. The front bumper isn't the same kind of plastic used on everyday cars, it is like a reinforced thick plastic or fibreglass that can take impact without damage. Then the bonnet and side fenders are solid steel, which probably explains why the car weighs 2 tonnes lol. Brilliant car, indestructible and very reliable.

      Doesn't really matter tbh. The van decided the fate when the driver did not follow the highway code. If he is within the posted limit, it does not factor in.

    i can see why this has happened and tbh I wouldn't give him too hard a time about it (the collision, not the delay on the payout). many people could make that mistake. its because there's a road closed sign on his side of the road, and its position encourages an early turn.
    ultimately if 1 person has to take liability then it has to be him and he did take the turn quick, but it isn't a great place to put a road sign right next to a junction that is on the apex of a bend either... 😐

    tbh i slightly get the vans view. There's some road closures and he goes past a diversion sign that probably gives him the spur of the moment idea nothing is going to come from your direction. Signage can be poor and confusing. You're not particularly driving cautiously

      If you understand the van's view, you must not be a cautious driver yourself. I don't understand how anyone can not be cautious before turning across the opposite lane of traffic on a blind bend. Yeah also I have had other people saying I've been driving too quickly and to put it to bed, the framerate of the video is a solid 60FPS which gives the illusion that I'm driving much faster. The speed limit in that area is 20mph understandably because that blind bend is sharp. If you saw my car and ever drove it, you'd know that you can't speed around corners in it. Car must be 5.5m in length, 2m in width and weighs 2 tonnes, it might as well be a boat, a boat which rocks to the side when turning lol. With that said, I can assure you that I was doing under 20mph before the bend, which would constitute in the eyes of the law and highway code as safe driving.

      @@madasafish2010 What would you have done at 0:17 if the van was going round the barrier (Though why a barriers on a corner!). At 0::26 the van is already turning before you appear (Again going round a stupidly places sign). You arent expecting to slow or stop going through road works and passing an old 3 turn badly spaced junction. You run into the back of the van not the front. People on the internet love to pile on but most who comment havent even noticed any of the hazards, badly placed signs, etc.

      @@m60kaf It is true that the road signs were badly placed, but that does not change the fact that he should have stopped before turning, which is what the highway code states. His turn was too late. Could have been avoided had he just slowed down for the turn or stopped. He's the one in trouble for driving like a wanker, just like most van drivers do.

This wasn't a case of a van turning across you on a straight road, you should have already been slow and ready to stop for any obstruction that you couldn't see around the bend. What if instead of a turning van it was a horse or pedestrians in the road? Lucky it was a van and not a horse or pedestrians, because you couldn't stop before hitting it!
      Obviously the van could have done a lot better. But so could you. You just admitted in your previous comment it was a blind bend, yet you weren't in a position to stop for an unseen obstruction on the bend. Clearly the van did bad, but I'm just irritated at your total failure to acknowledge that you could have done better as well.

      Despite being pulled twice, nothing was mentioned about the push bar. I believe the law allows for imports to have them as they came with the car, whereas UK vehicles do not have them and adding a push bar to them is illegal as it could and probably would kill a pedestrian. It is a grey area but the car passed the IVA and MOT tests so it is road legal!

      @@ryanmitcham5522 Call it whatever you like mate, I'm retaining the car's originality. If someone wants to play chicken with a 2 tonne steel police car then that's on them. I drive the car safely as I'm aware of how big it is and how dangerous it can be. Even without the pushbar, the front bumper still sticks out further than the grille which would impact at the knees and force someone's head to bang on the steel bonnet. The car is still going to hurt someone with or without the pushbar. American cars in general rate poorly for pedestrian safety. If it passes the government tests (MOT and IVA) then it is legal and that works for me.

    Fault and liability are different, the insurance companies will see the word slow on the road, pay the claim but mark the drivers midas file as high risk and premiums will be increased to cover the enhanced risk.

    Van driver definitely in the wrong, however I think he was emerging from the road on the right, ie CROSSING the junction. He emerged directly across the junction, rather than treat it as a staggered junction, which he should have. He should have turned left, stayed left, and then when lined up to turn right, paused, check clear, and then crossed the white line. However to be absolutely fair his emerge and turn left from the road on the left was partially obstructed by the road works sign, though I do think he was too far across the white line even given the obstruction. He took a chance at an obstructed junction and paid for it! Ultimately his fault with a few mitigations.

      Amusing really as my car is the same size as the Audi A8, yet nobody says the A8 is too big for the roads lol. You should see the RAM 3500 pickup trucks in Britain. Not only are they longer than my car but much more wider. My car is a tight squeeze but some just simply will not fit on most of our roads. RVs are the best. Those big bastards are wider than a coach with a steering wheel on the wrong side!

    Van driver was 100% in the wrong. He didn't turn too late, he turned too early. He should have waited. If you had sent this video to the police he would have been prosecuted too, for careless/dangerous driving. You have his reg.no. so easy to trace. Imagine if you had been on a motorcycle.

      Yeah exactly, but sadly the police wrote the case off two days after this incident. They said in their words that "the case has been archived" which in my head just means written off. The police incident number was used for the insurance claim.

      What he says might be helpful but insurance company didn’t need it - the van pulled across the path of a ‘correctly proceeding’ vehicle. Even if he argued speeding it doesn’t hold water with the courts he should have checked to make sure it was safe. The only problem with the claim would be repair parts for an American import and time taken to source

    You would think the one car they would be willing to get repaired is a CV. Even if they import parts, they can get them for pennies on the dollar lol. 😂😂😂 they are everywhere in the states. It would be the cheapest repair they can make.

      Sadly this was in the UK. The importation of parts is very expensive due to the size and weight. The car barely had any damage from the collision though, and parts won't be needed.

    The van driver was totally at fault. He cut into a right turn without slowing down AND he entered the road on the right-hand side of the road. He also left the scene of an accident without giving details. In the UK that is an offence as he caused the accident. Depending on where you are in the UK that is at minimum 6 points on his licence, a £250 fine (that varies) but in some areas that is a 9, or even 11 point penalty, which invariably means loss of licence for a minimum of 3 months (most people don’t have a clean licence).

    The van is definitely at fault. But just for fun, I thought I'd try and work out your speed by working out the distance you travelled. At 0:08, you pass a 30mph sign. It took you 20.5 seconds to get from that sign to the point of impact, a distance of 276 metres. After crunching the numbers, this means you must have been traveling at 30mph for that part of the video. Not as fast as it appears in the video (it's the wide angle that gives that illusion, not the frame rate) but in excess of 20mph.

      Interesting calculation, but my Mrs saw this comment last night and said "how does he know the distance travelled?" which is now what I ask you, just out of curiosity. It is very hard to exceed 20mph in that area as the road narrows before the bend which forces my boat of a car into the middle of the road, and then the bend alone demands a 15mph speed as the car just sways over to one side if you turn to harshly. I do believe the framerate of the video gives the illusion of the car travelling faster than it is.

      @@madasafish2010 I also did the calculation, before noticing this comment. Though, I had estimated 270m in 22 seconds (31.77mph average).
      I used the Lat/Long in the bottom of the video to find the location, plotted a route in google maps, gives a distance in metres.
      I used shorter distances to try and guess your speed at the moment you saw the van, and got about 29-31mph.
      I think you were doing about 20mph around the corner with the closed lane barrier, and ~35mph prior to it.
      Definitely looks faster in the video, but that's normal for dashcams (it's because of a narrow FOV).
      There is also a "SLOW" marking on the road, which implies the speed limit is faster than you should be going for the corner.
      You did drive too fast for that corner.
      The van clearly cut the corner, wasn't concerned with oncoming traffic, robbed himself of the ability to view any oncoming traffic, and that was the cause of the accident.

    I owned a 2006 LAPD police Crown Victoria. I had a similar accident. I was hit from the offside. This van driver hit me as he was turning left. Thankfully, they repaired my car. i also got a personal injury claim.

    There is nothing in law forcing you to deal with the other driver’s insurance company. If you have evidence he is clearly at fault get the car repaired to your satisfaction and invoice the other driver to recover your reasonable costs. If he doesn’t pay take the case through the small claims track of the county court.

      Cutting a corner on a driving test is a Major Fault and will get you a fail. So yes the driver is at fault for that too. Far to many drivers cutting corners these days instead of turning into them correctly.

      The Crown Victoria was only sold as a fleet vehicle and went out of production in 2011. American police departments generally now use the snoozefest Ford Explorer and other bland Yank SUVs. If they want a bit of speed then it's a Dodge Charger.
      Cops there don't have the same car culture ours do. The idea of American PDs using an unmarked BMW for traffic work is just unthinkable.
