Songwriting AND Publishing Royalties were never in contention. Joyce went to court for Recording and Performance Royalties as well as other band income like merchandise sales etc....He felt he was an equal partner in the band and was due his 25% rather than the 10% he received. This wouldn't have been an issue if the band had had a written agreement, unfortunately things were complicated b'coz 2 different verbal agreements were made with Rourke and Joyce in the early days: One for 25% and one for 10%.

Morrissey has written many excellent songs since Your Arsenal back in 1992. Although YOU don't rate Vauxhall and I most people see it as one of his greatest works. The problem I have with those people who knock Morrissey's solo work is that they rarely have listened to any of it!

Fact is the band would have sounded totally different, maybe better maybe not ( I suspect not ) with a different rhythm section. Rourke and Joyce were an integral part of the Smiths' sound. They were part of every recording session and played at every gig, so it's reasonable that they get a fair percentage of the performance and recording royalties. I think that they are all great and I thank God that they recorded all the great music that they did during their short career.

The rhythm section in bands is often underlooked. Marr wrote all the guitar melodies and Mozza wrote all those great lyrics - but they should have split the money equally. Yes the songwriters deserve most of the credit but it did undermine the excellent drumming and bass playing their fab rhythm section had. They were all great at what they did and Joyce seems cool
From watching various Smiths/Morrissey videos, it has become obvious that there is a degree of confusion regarding the handling of a band's money. Income is earned via (1) song writing and publishing royalties (2) performances (3) merchandising - sale of licensed items carrying the band name and/or likenesses. The writers of the songs generally receive the royalties and everything else is divided equally. Morrissey and Marr seemed to think that the other 2 should receive only 10% each.
As for that lawsuit, I do not know enough about the law to determine whether or not the decision was right, but I have to agree that a 40/40/10/10 split of recording and touring royalties was very unfair, especially since songwriting royalties were never an issue if I understand it correctly. Morrissey and Marr may have been the creative force behind The Smiths, but Rourke and Joyce also played an important role and I would never consider it a reunion without them.

The last thing I bought was "Maladjusted," and it's been about 9 years since I ever pulled it out to listen to any of it . I only like "Satan Rejected My Soul." I don't think much of the lyrics on that song either, but I dig the music. The other songs on "Maladjusted" are absolute crap.

My personal take though is that I believe Joyce was by far the least integral member of The Smiths. He was good, and Rourke was a fabulous bassist, but I think Marr and Morrissey really were the core of the band. No one is even close to being like them.

They got 0 % from the songwriting, which is normal*, and 10 % of the rest. *) I don't remember if Roure and/or Joyce are credited on some b-sides. That would of course give them some 0,1 % type income from the songwriting. Also, one could maybe argue that esp Rourke's brilliant bass lines sometimes should have earned him a credit.

Absolutely .. Rourke and Joyce deserve a better shake. Everyone loves the Smith's drums and bass lines, and knows them to be definitively of a 'Smith's' styling.

Owen Martin Well they got much less than 10 %, since this is not about songwriting royalties at all. They got 0 % from the songwriting, which is normal*, and 10 % of the rest.
*) I don't remember if Roure and/or Joyce are credited on some b-sides. That would of course give them some 0,1 % type income from the songwriting. Also, one could maybe argue that esp Rourke's brilliant bass lines sometimes should have earned him a credit.

Morrissey is so abnoxioussss to me, I don't understand the love although I love the instrumentation in the Smiths, sort of dreamy folky but still kind of punchy.

You've just answered your own stupid premise. Joyce has a world? Are you kidding? How many Mike Joyce albums are you buying these days?
Morrissey and Marr had every right to take the majority of The Smiths earnings. If you had noticed, Joyce and Rourke were living not only comfortably, luxury with that 10% they received. But Joyce stabbed Morrissey's back. Morrissey and Marr were the Smiths. Joyce would not have even been in The Smiths if Morrissey and Marr had know that he was completely drugged up on his audition into the band. Morrissey wrote the songs, Marr wrote the melodies and Rourke and Joyce played along.
