Two decades old policy of deferred spectrum charges has brought big telecom players like Vodafone-Idea on the brink of bankruptcy, and threatens the entire telecom sector . I'm a Central govt employee since 2018.The first thing that my senior colleague advised me after joining was to play it safe all the time.He compared it to a volleyball game where you always have to keep pushing the ball away This extremely cautious approach means that you will block a full toss delivery and make it a dot ball to avoid the risk of getting out .This indecision happens due to a situation where the bureaucrats are literally playing for their life every single day..so no one dares to do a course correction.
Sadly the ultimate loser will be our nation only.

Reminds me of the time when the petroleum secretary told all the directors to increase oil production by mining up every single unproven reserve.🤡 He said it cuz there was pressure from the petroleum minister.

Everyone in India who is educated and understands the function of bureaucracy knows this very well and it is the combination of few politicians and a timid bureaucracy and lethargic and corrupt Judiciary that is killing this nation...India will need 30 years to just clean up this mess to make a fresh start and another 70 years to catch up with the developed nations and that if we start right today, which is not going to happen anyways as this has got messed up even further with current dispensation and it may go absolutely worse when he is done.. The only hope now lies in RG and Congress to turn around as the next in line of leaders from BJP will be even more autocratic in nature....General public who are adamant on Congress will mess this even further as they indirectly have only but one choice a.k.a BJP..

Indian bureaucracy is all about maintaining the status quo, and the 'maai baap' culture. And us Indians do like that, that's why lakhs waste their primes preparing for exams they'll never crack just for the sake of that 'power'.

SG clearly protected his masters Congress. He cleverly veiled how no fee was paid for spectrum in return of private favors (money) to political parties. The Supreme court is even not allowing recalculation of AGR, heartbreaking to see the telecom sector crumble and GOI watching carelessly. All this is hampering India's progress towards 5G.
supreme court or any court for that matter follows facts. if a deal for agr to include non telecom revenue was signed by both parties, then it is enforceable. that is what supreme court is saying. it is essentially govt's duty to change the rule.
Bro, the recalculation gimmick is just to buy more time.
My dad deals with such issues often, he tells me that if they start to listen everyone, no one is going to pay the taxes on time.
So they did right.
I think SC is only doing what it is mandated to do. Judiciary's job is to enforce contacts, changing the laws is ultimately the domain of legislature.
Telecom companies have paid huge Dividends outside india from their profits by avoiding paying AGR dues...

Option 1: amend this norm like the govt did with retrospective act.
Option 2: get an old minister who would not have many years to go… and make him the fall guy. Retrospective CBI enquiry of dead guy would be case closed

@@riteshgupta4002 You should look into what Jio did. They got together with a broadband company to serve as proxy in auction, facilitated credit to broadband company to buy bands, after that they bought company. Now, AGR were calculated on broadband company's revenue. So, there is less burden of AGR on Jio.
Minister will be of a party and party would not dare to do that.

It is shameful that reputed journalist is supporting VODAFONE in avoiding AGR dues !! Vodafone have paid huge dividends of thousands of Crore to UK shareholders and now they want to avoid paying AGR dues to Government of India.

It’s unbelievable that one single corporate entity can be so much favored in a single sector. Jio can sell for free or charge 100x as there will no completion left for it to fend. This government talks about conservative policy of Free Market but basically making sure market = jio only.

Jio is debt free because of Cheap spectrum price cause lack of Competition.

We have always learnt about the failures of private industry but we haven't learnt about how Govt. sets private companies up for failures. Jet airways almost collapsed until NDA-1 (Vajpayee) government liberalized aviation industry further.

One can understand (not accept)the compulsions of the politicians and the bureaucracy but why Supreme Court has repeatedly taken such a hard stand on this is not intelligible.
Many times even government lawyers have requested for some relief, even they had been warned not to do so. It seemed as if Supreme Court had something against the telecom sector.One can’t think of any other instance where the apex court has taken such a harsh stand.
The govt lawyers have been corrupted by the Cartel of VI and AIrtel. SC knows better hence gave a fair judgement against this unethical cartel

Sunshine is the best disinfectant. If the government is absolutely transparent about its goals and the process behind the law to amend the definition of AGR retrospectively, I don't see why anyone should be scared of a little scrutiny thereafter. I think the larger citizenry realizes that the current situation as the judgement stands is absolutely unsustainable.
Government will face a massive corruption charge then. This is India.
Thanks #theprint and SG Sir for speaking up on such an important issue. We (I say we because any collapse will have adverse impact on all of us) are paying the economic price of the political harakiri commited by the government and opposition of different periods and times.

In canada we only have 3 major telcos and its the most expensive telecommunication market in the world for consumers. The difference here is that we can at-least afford to pay. India would have a such a tough time in future if the government doesn’t work on this.

But why did you not cover the fact, that all telecom operators agreed to this AGR. What was back-ground to that?? Did their lawyers ignore the fine print or it was incompetence on their part? Someone has to do the reporting or we'll only get statements from Afghanistan govt or the Taliban (which will just be propaganda) and we'll never know what's actually happening on the ground. Takes a lot of courage to follow the passion and bring the reality to the people. Commando comic channels of Noida will never reach this level. They are only good for making wild assumptions and accusations without proof sitting in their studios.

This comment sounds like parents trying to stop their kids from going to serve on the battlefield! Journalists are no less than soldiers, truth is their weapon.
The real problem was created by a judgement by Justice Arun Mishra who did not accept the argument on calculating AGR which favoured Jio but killed the others. Even the Govt appealed against his judgement which was heard by the same Judge and he refused to review this judgement. Recently there was an appeal by the telecom companies to SC on the calculations of AGR was erroneous mathematically. But the case was dismissed because of the previous order.
Apart from the bureaucracy who did not address the issue expeditiously ( for fear of offending the Govt and being hounded by CBI etc. The old telecom companies also appealed to the Chairman of TRAI on the predatory pricing by JIO, but he decided to refrain from taking a decision. To sum up, the telecom industry today is sick except for JIO who has deep pockets plus favoured treatment. It is not at all surprising that Mr Birla - an astute business house- has withdrawn from the business to cut his losses.
Why should we pay when WION is actively working in Afghanistan and giving us latest updates.
You guys are doing good but sending someone to Afghanistan now will be a wrong decision. Taliban won't see that you're reporter or a harmless newsman. You guys are risking a lot for something other news agency is already working . Please don't risk someone's life. Take help from WION to get some news.

There is so much chaos which was unleashed after 2014 and still going on that it will definitely attract eyeballs from the neighbouring countries, especially from the subcontinent.

Indian bureaucrats can never get over their deep-seated jealousy and mistrust for commercial enterprises. Even in the general public, the perception seems to be all businessmen are ‘chor.’ Until that mindset remains, innovation and entrepreneurship in India are doomed. Longtime back, I read Rohinton Aga’s brilliant book (Changing the Mindset). Aga was the founder of Thermax and explained how an entrepreneur in India supports thousands of families because of their ingenuity and risk-taking ability but, in return, is treated as a ‘thief’ by the government and the public. This telecom law is one of the many proofs-excellent work decluttering this for us, Shekhar.

Telecom is an utility sector with real assets. StartUps (mostly in the software space) have no real assets. So no comparison.

If you implement AGR here you pay rent and give a cut from every kilo of Dal you sell in the market to the Landlord/Landlord is this at all JUSTIFIED ?
@@RoshanDixit absolutely not. I would rather say contrary to Gupta ji’s opinion that bureaucrats shouldn’t be harassed(held accountable) for their actions I would say such a creative bureaucrats should be identified and held accountable.
This AGR thing is not a simple mistake its a big blunder. I know many people in telecom industry who lost jobs in last few years. I would all because of this stupidity.

This appears to be a big and critical problem that should be decided by a legislative process. How about a Parliamentary Committee that makes a recommendation that gets passed (hopefully) to provide relief to the company’s involved. Is that so hard?

The brilliance of “fearless” Modi is to pass laws legislatively and/or let the courts decide on controversial issues before moving ahead.
In this case the brilliance was to let the case fester both in Bharat’s courts and international courts to reach a point where without a compromise both sides would loose.
He also presents some data on J&K to make us think.
What it points out is that:
1. An anomaly was rectified, except I believe Nagaland also has some sort of J&K like autonomy.
2. For geo-political reasons.
3. There could be an uprising in the Valley.

If the spectrum charges were on this high note, it could be a given to understand there will be bills paid too to the governments( before and current). What have the governments used the money on?
Why can’t these governments chair a bench for rewriting the conditions, it’s easier to say “it’s already a mess and I want to stay out of it”; but being a strong govt at least this govt should take a stand. But see what happens then, all opposition parties start saying that it is a big scam worth lakhs of crores and government is run by corporates etc., and makes a big mess. I think that all parties should have a back door consultation first and then pass a bill in parliament to rectify it. So that all can come out of it with least damage

Ambani seem to be like Rockefeller in it, but strategy is planed and executed by bureaucrats with no running cost.
Case 1: My mother works as an officer in Women and Child development department and has some villages under her supervision. One scheme was launched by state government under which Rs5k was to be given to first time pregnant lady. Contractors were hired to gather the data around the villages and then the office staff verified that digitally and the money got tranferred electronically. Initial few years proper due diligence was maintained by all officers. As there was pressure from government to keep disbursing and make the scheme successful every year, one of the lady officer ,soft spoken, god fearing, and due for retirement in a couple of years, requested an old contractor to help her areas as she had worked with that contractor for years and could not trust new people so easily. Long story short that contractor got money disbursed to fake 600+ cases and shared money amongst himself and those people (I think of all those 600+ families as culprits as well).
That sweet lady, who gave her life working diligently and honestly towards uplifting the poor women and children got a heart attack once police wad after her to arrest her. After she recovered a bit, she was arrested and now officers like my mother want to gather and go to their head office to speak on the issue. I know for better that practically her life is ruined. Families like ours worked hard to provide for their family so that the next generation like us get a good education and life and outcomes like this would only discourage beauraucrats from doing what must be done. I am too encouraging my mother to take an early retirement as she has done enough , giver her life for causes and now deserves a peaceful and happy retired old life. Young officers who would come in future would know what has happened and thus would not have courage to take the society forward and that's what's equally sad as good officers going to jail.
Case2: I have worked in Bank, that too IDBI Bank. Jewellery corporates among others were the clients handled by our AGMs and GMs. Long story short I have seen people at MY levels facing the burnt of CBI, for going through proper procedures like they should , because of the corrupt acts done by few too many people and corporates. I would stop here and you can imagine how I feel about it.

Too much interference of the supreme court will set a bad precedence resulting in such a mess, down the line, which would have resulted in a type of chaos larger than this.
Here is a counter view:
1. In 1999, you go to the govt saying your income is not sufficient to pay for the fixed licence fees. Govt takes a sympathetic view. Allows to only give a portion of the revenue
2. Based on that you build a telecom empire. And using that, you build other businesses?!? All the while making the government share the risk of falling revenue. So you make 100 from, say, your wallet business because you have 50 million telecom subs (who you wouldn't have gotten if you couldn't get the spectrum in the first place)
3. Now, you don't want a retrospective tax. But you want a retrospective change in agreement that was signed in 1999?!??
4. The only dumb thing is PSUs going for the rev sharing instead of buying the spectrum outright. Why did PSUs do that?
Please ask the reporters in Kabul to be very extremely cautious sir. As a paid subscriber, their health and well being is more important for us than a lost battle in Afghanistan.

Because of this rule even Indian Railways should be in big trouble. Indian Railways have a quite significant need for a wireless network. And they have a good wireless as well as wireline network of their own.

In the initial days even Reliance (when it was RCOM or Infocom) was using the Railway's network to provide connectivity in the unreachable areas. No one can beat Reliance, they have the strongest and most reliable Backbone OFC network. All other operators use Reliance network to carry their traffic. I worked in Telecom sector for more than 10 years in India.

Excellent video! We are missing the government's response to this issue. I think it is time to hold the govt feet to the fire on this. I understand that it is not their creation. But they own the problem and a significant time has elapsed since they got to power. Now there should be no excuses. I say this as a person that broadly supports the policies of the Modi govt. You should get the new minister and question them on the next steps to fix it. That is how we take India forward. They do the same thing here in the US too. If one govt creates the problem, the next person has to own the problem and fix it.
A Raja did nothing wrong. The Government needs to think about people having internet too, it's not just about the Government making money. The 5G spectrum is now so expensive that no telecom company is able to bid.

All this makes me think that telecom companies can not generate free cash flows and become profitable in near future inspite of so much demand for voice and data communication in the country. Indian burocracy is a result of 70 years' congress rule. Congress has inculcated this low quality work culture. Its not only in the govt but exist in almost every nook and corner including IT sector where it is supposed to be better. The proxy intellectuals (shwred with selfish interest) suffocate good quality people with high moral values being and destroy the culture. Just look at the progress report card of India's 50 years (till 2016 where Congress was the key player). Our low quality education system mixed with yes sir/yes mam proxy intellectual were able to bring India down to its knee. Just look at the number before commenting.

The level playing field issue is that PSUs are exempted from paying AGR License Fee on total revenue as per the Agr Judgement of Supreme Court.
