This case was extremely significant to civil liberties in the United States by showing the power that each citizen has to make change in the government, regardless of class or status. Gideon, being an inmate, had the power to write a five page letter directly to the Supreme Court, highlighting the actual effectiveness and fairness exhibited and encouraged by the legal system. This case exemplifies that the government is in fact "for the people," and this fact can be displayed through civil liberties.

Gideon v. Wainwright's Supreme Court decision required free representation, provided by the state, for any person charged with a criminal offense. After being charged with breaking and entering and burglary, Gideon requested free access to an attorney from the state because he could not afford his own representation. He was forced to represent himself as the state denied him such access. He believed he was subject to an unfair trial and continued to write a letter to the Supreme Court, asking if they could hear his case. He was assigned Attorney Abe Fortas who argued that the trial was unfair as it went against the 6th Amendment guarantee for citizens to have a speedy and public trial as well as a right to counsel in criminal cases. This applies to states as detailed in the 14th Amendment which ensures citizens due process. In a 9-0 decision in favor of Gideon, states were required to provide free legal counsel for defendants charged with any serious crime. This case ensured the civil liberty of access to counsel in court for Gideon and all impoverished defendants after him, a liberty which would have otherwise been denied on a state to state basis without his efforts.

Excellent overview of this case. My class, especially Ethan, loved it.

The decision ultimately made a huge impact on the criminal justice system as it required state courts to follow the same “right to counsel” as federal courts had to so someone illegal wasn’t forced into defending themselves against crimes that may have been considered unworthy of court-appointed counsel by state courts, since this would put their freedom in jeopardy due to their lack of knowledge and understanding of the law as a counsel would know.

There still considerable concerns over defendents receiving inadequate representation. An episode of Adam Ruins Everything noted that public defenders have smaller budgets than prosecutors.

the point of this was to give people who can’t afford a lawyer or legal support to be provided one by the government
