i feel bad for bedrock players, java players get mods and datapacks for free, and its easy to create them. meanwhile bedrock players have to use a stupid marketplace and have to pay money for everything
They wont even go against blatantly stolen mods/ideas either even when sending legit DMCA claims and similar so yeah - not really suprising honestly :7
The marketplace is basically selling what was popular free content for java, slowly getting close to producing a watered down version of the classic mods available on java like tinkerers forcing those original modders to create the "port" for themselves first to secure ownership and provide quality to the best od their ability with limited tools. The big incentive for getting addons is the ability to play with console players due to the majority of Minecraft players playing on consoles instead of ever jumping over to PC.
And they had the audacity to say that people can make their own addon on there by joining the creator program (which is a gaslit fueled lie. Because it is a business. Not a place for individual modders to sell their own addons.)
Yep, that's the thing that makes Java players hate Bedrock with such a burning passion. It's the fact that the Marketplace is used to take things that used to be free and put them behind a paywall.
It is entirely possible to just create and install resource and behavior packs for free and the same would presumably go for mods, if one were to actually mod the game(Which is not really a thing at the moment). Bedrock is more restrictive than Java in a technical sense, but there is nothing physically stopping players from engaging with it the way they want to. On PC and to a lesser degree phones at least. Consoles are sadly screwed, but that's not particularly diffrent from how it was in Console Edition.
Not surprised by microsoft doing this but its still rather disrespectful and distasteful good way to show your consumers hey we will do anythjng to get money from you even if its going to backfire piss you off and screw you over
The community has banded together and protested against something we disliked before, the mob vote. We can try once more to support someone, or at least get bad press on the company.

Remember, at the same time the community banded together against chat reporting, account migration, removing C418, etc. and nothing has happened. Trying to get them to ease up on microtransactions? They're trying to keep increasing profits despite having basically maxxed out the number of users due to their vast reach. Unlimited upwards growth is just plain unsustainable, but that doesn't stop people from trying...

Microsoft is in the wrong here. You can't step in and claim something is a general concept when it's not like that at all (nor did they have any part in it). That's like someone going in and saying that every type of game console is all a "nintendo", or like claiming every single voxel or cube type game is just a "Minecraft". The name "Skyblock" refers to the GAMEMODE, it in no way would just refer to a "block in the sky". The original map creator has a right to coin the term and claim commercial ownership on the name of a concept they came up with. They argue that "oh but the name is so widespread". Yeah... that's because every bootleg version is still, in many ways, based on the original. Even if every bootleg is all using the same name, it doesn't mean that they aren't based on the original. Nor does it mean that they should be able to get away with not crediting the creator of the gamemode.
You actually can, and the funny fact is that you use the example of Nintendo was actually something that Nintendo quite LITERALLY!!! fought VERY hard to avoid it becoming a general term, even with ads, to make parents (especially) from using the term "Nintendo" for consoles in general. If that campaign had failed, Nintendo would have no way to avoid an XBox being called "Xbox, a Nintendo". Nintendo quite literally fought tooth and nail to make sure that didn't happen. Noob did none of that and self-admittedly allowed it, meaning that as a TRADEMARK his legal claims are EXTREMELY!!! weak. It's not about whether bootlegs use the name, it's about whether it has become a generic term to describe something. Kleenex and Xerox did the same. It was actually becoming pretty common to say "Xerox something" instead of "Photocopying", and that would have killed the Xerox Trademark... which is why they also did advertisements and other campaigns to try and make people stop. Google did the same with the term "Googling", which was so close to becoming the generic term to just search up something on the net, on a search engine. I'm not saying who is morally right or wrong here, merely pointing out that legally, you even use examples that debunk your own argument.
Microsoft is not at all in the wrong here. Morally maybe, but legally not. The map was released like a decade ago and the creator only tried claiming the trademark in 2020. They didnt release it under any specific license that would regulate the distribution of the map or regulate the trademark and they never before tried to defend the trademark. They are just too late to the party and the term is definitely a generic term by now.

The thing that irks me most about this is the fact that the MAJORITY of these sales all came from _children_ buying it, or asking their parents to buy it... Children that likely have no clue that they aren't the original Skyblock maps. This kind of thing should be ILLEGAL, but typical for corrupt capitalism... Its not.
techincally what those companies are doing is illegal, i can't recall the term but it's something to do with misleading product or just straight up theft

There are problems on both sides; People defending the bad decisions Microsoft makes as company, such as removing bedrock developer mappings, are being taken advantage of to advocate for decisions that weren't made to benefit players. People slamming Minecraft development for not being good enough are only attacking the developers who put a lot of hard work and effort into designing the new updates. It's crucial to separate Microsoft the "company" from the individual developers who put a lot of passion into their work. In this video even, you can see the night and day difference between *Microsoft's* response and KingBDog's response.
its microsoft, not mojang, or minecraft. Microsoft is a for profit company, with the goal of making as much profit as they can. Mojang is a game studio, owned by microsoft, trying to please microsoft. And minecraft is just a game.

for the experience, I dropped 50-60 bucks at the MP this week. The stuff is second rate copies. What I see is a lot of BR players saying how great it is. How the hell do they know? playing on phones and old consoles... It's like 2 separate games.
@@strange-universe genuinely, at the price point people pay for consoles these days, you can get a pc that is far better for a similar price, ESPECIALLY if you are willing to actually learn a few things, it isn't even all that difficult, and if you find it kinda difficult, there are plenty of guides online to help you with it. Just buy or build a pc and get minecraft there, it's ten times better.

6:52 It specifically refers to itself as "this version of the original skyblock" - implying that it isn't THE original, despite it being virtually identical. Technically false advertising since it basically IS the original map ported to Bedrock (potentially with a few very minute changes), but at the very least they aren't claiming to be the original creator like Razzleberries. Edit:It is technically written in a misleading way however, effectively tricking users into thinking it IS the original.
Legally speaking you can call a recreation original in any way, shape, or form, you have to use classic, even if a company holds copyright of a brand and remakes something without the original creator involvement they open themselves to charges of impersonation and or false advertisement That word has a lot of power when it comes to intellectual property
Buying skyblock in general is crazy just step 1 flatworld in creative fly upwards and throw like twenty dirt blocks and a tree down alongside the preset chest this is crazy
@@barerninja970it isnt that simple, flat world type is usually based 3 blocks from the minimum block level while skyblock is ALOT higher up. Which you can't adjust on bedrock
Flatworld only has 1 biome. You will not be able to get all items using a flatworld. You will never be able to get snow, bamboo, mushrooms, bees, etc etc.
On one hand it’s nice to have a unified Minecraft version with crossplay so people can play on a lot of different platforms (especially on mobile), but on the other hand greed becomes even more prevalent…
The market place is poorly(ok yes HORRIBLY moderated) is very bad but most ppl play bedrock edition so it lets so many people play Minecraft because bedrock exists so no Microsoft make bedrock bad.
marketplace & heavy monetization* if those didn't exist, bedrock would be a perfect edition just like java and bedrock players could enjoy the app without being slammed in the face twenty times by 'minecoins' or whatever.
I'm on Noobcrew's team here, the sheer amount of fraud going on the marketplace is intense, and yet, Microsoft's incentivized to just screw over the original creator, because Skyblock is an intense money printer

@@random.studios Not how trademarking works. If you do something like Skyblock, you'd proactively ensure other people don't use the name outside of your trademark otherwise it becomes public domain.
I don't think you understand what Capitalism actually is. This is a very anti-capitalist move by Microshaft. Capitalism is the word to describe the free market. There is absolutely nothing even remotely resembling a free market about this move.

Microsoft opposing the existence of a trademark is a capitalist move. If Microsoft were the ones trying to snag a trademark on "Skyblock" then they'd be anti-capitalist.
I think what he is asking for is reasonable. He will probably win the legal battle if it ever gets to court but it sounds like the larger companies know they aren't going to win and since his request is reasonable they are starting to change. He is not attacking them like nintendo does for even the slightest affiliation he simply just wants people to know that they are not playing the origonal version which is not that big a deal.
The problem is that it seems like the corporations involved are seeking to make sure the process of him getting justice will move so slowly that either… 1:He gives up due to lack of funds to keep paying lawyers 2:The thiefs get the case given to a judge thats extremely pro business and its thrown out 3:Appeal until it reaches scotus,which will make a batshit ruling that says copryright/trademark is a one way street and that only large corporations can have it. 4:He settles for an undisclosed sum to drop the trademark and cease demanding credit for his own work. Said sum is not nearly as much as they made, so they still come out ahead.

No he wont, because he is doing it under the claim of Trademark, and Trademarks can be completely and utterly lost if it becomes a generic term for something.... It's sometimes called "Genericide". Xerox, Google, Kleenex, Hoover, and many more companies have fought hard to avoid their brands becoming a generic term, or they'd lose the capability of stopping others from using the name. Like a wet wipe could literally have had the name kleenex on it, despite it not being the brand Kleenex, like "Uber Bango Wipes, the best Kleenex for your bum!", because that term would simply be "A wet wipe", because it is so commonly used like that. This is like the fifth comment I've seen in a short amount of time completely misunderstanding trademarks.
tbh, i don’t think that the creator has much of a case here. Here’s a comparison, imagine you make an plugin for Adobe After Effects. If Adobe 1:1 copies your feature and puts it in their next version of After Effects, should you be able to sue? I don’t think so, your work was built on their platform, after all. I think that the same thing applies here, even if what Microsoft is doing is scummy.
yeah "Minecraft" is actually a registered trademark that is actively being defended by a company. Skyblock is not registered by the creator and he never defended it before. Funnily enough a company called mineverse llc claims the rights to the trademark since 2011. So I guess they can sue everyone maybe. But it doesnt look like they are related to noobcrew in any way. If they were he probabaly wouldnt try to register the trademark

Honestly the whole marketplace is a scam. A lot of the stuff that is on the marketplace was literally free on java. Also most of them are stupidly overpriced.
You know why a lot of it was free on Java? It was illegal to monetize. You really think that programmers, artists, and other people, would not attempt to monetize something they've worked on for sometimes 100s if not 1000s of hours, if they could? And what is overprized? If someone knows what they make is niche, and they spent (collectively) a 100 hours on it. Then 7250$ would be "the minimum wage"... So saying Microsoft takes a substantial cut, let's just say 50% (It's their IP, they paid for it, and Mojang did most of the work in the first place), that means they would if they sold it at 10$ have to sell at least 7250 copies to just break even. And on something like Marketplace, only the most popular stuff sells well, the rest is relegated to a few interested... And if people are willing to pay? Well, technically it isn't overpriced, is it? Overpriced means people wont buy. There is so much wrong with your comment, and not understanding a lot of stuff. If people could be paid for the modding, they will. Quite a few modders of Java went to Bedrock specifically because they can... but selling mods in general is a copyright issue at its base, but not when sanctioned.

It's not theft. The creator never defended the trademark before and didnt release the map under a specific license that would grant him any rights to it. For sure sad for the creator, but they just made a mistake and are way to late to fix it.
The days of "free and collaborative gaming" never really existed. Like what the hell are you talking about? Are you talking about the early days of the internet where tons of kids pirated what ever they could get their hands on, or that people have been able to get free content through modding? (Btw, modding has essentially existed for as long as gaming has)
Companies learned their lesson with mods when the original Dota got famous on Blizzard's warcraft 3 and spawned countless games like League of Legends. If you check the user agreement for any game you can pretty much guarantee to see "We own the right to any community modifications blablabla"

this is quite sad for me to say, but it seems like Bethesda treats their fans whom make mods for games like Skyrim or Fallout 4 with more respect than Microsoft does: in fact Microsoft is LUCKY that they still have players willing to make new stuff for their game to keep it going and all they're doing is shooting their players in the foot
Sadly it seems Microsoft's influence is leaking into the mods for Bethesda's games, Creations is looking more like Minecraft Bedrock's Marketplace, and there's like no moderation of what goes on there, so you got stolen stuff being put as paid content, just like the Marketplace.
@@wfr878 Fallout 4 Next Gen update was a whole different beast, it wasn't really to "destroy modders", it was definitely bad management, and Bethesda trying to fix the game but in old Bethesda fashion, they broke it.
I vaguely recall Stampy saying that he doesn't mind if others copy his world as long as they don't try to pass it off as the original. He's even visited copies made by others in the past. I think it's a reasonable and unspoken rule in the community that you can directly take the maps of others and showcase as long as you don't try to take credit for the work. You don't necessarily have to credit the creator, Ie "hey everyone welcome to the video. I found this map but I forget the name of the creator. it sure wasn't me tho". I believe shortly after lovely world ended, Stampy released his map on the marketplace and probably elsewhere for all to enjoy. Toycat has done the same thing and released his world. I believe the Hermits tried to do the same but idk the status of if they got on the marketplace or not. I think Truly Bedrock got in on the action as well.
@@wfr878 most of Stampys audience is either people who watched as kids or people who have kids and are rewatching. I'd bet it's mainly adults at this point that would want his world since they would be the only ones who have be able to binge SLW's 840 or so episodes. I personally did a recreation of Flower Power on bedrock back in 2015 for me and my siblings to play. I showed them the video and they wanted to play. I conveniently had a world to play immediately. It's gonna be the older crowd buying SLW and other youtubers maps. I'd buy a stampy plush if he had one (I missed out on the past opportunities due to lack of money to burn)

You could argue that it is false advertising / fraud to claim that your version of Skyblock is the original when it really is not. And if that was the case, then it would be breaking the law.

Microsoft, being Microsoft. I bet this man barely makes any money off Skyblock, unlike Microsoft and the shi**y Minecraft Marketplace, I always hated people taking free-to-play maps/mods on Java and reuploading them onto the Marketplace for their own monetary gain. Unfortunately, I think he will lose this battle. Microsoft is just too powerful.
Once again, the market place keeps proving itself to be the single worst thing to happen to minecraft, and just to clarify I'm not against modders monetizing their works it's just the way the market place handles it.. is not great to say the least..
Just because the trademark wasn't registered doesn't mean he didn't have a trademark. Unregistered trademarks exist, but aren't as powerful as registered ones. Though now that the trademark is disputed, I'm not sure if he can take advantage of the rights of an unregistered trademark anymore.
This is honestly one of the reasons I dont buy stuff from the marketplace. A lot of the stuff on it is stolen content that the original creator can't do anything about except watch as their creation get milked for thousands to millions of money. Unless it's an official version or someone list/link the original, I won't get anything on the marketplace. Not that I buy anything on it anyways because nothing there is actually worth my money. I really hope the creator of One block follows NoobCrew step and either file for a trademark or talk to Mojang because it's also a very milked content on the Marketplace and other content creators.
It's things like this that make my blood boil. All this is is pure greed and corruption from big companies taking advantage of loopholes to punish anyone they don't agree with. Noobcrew is 100% in the right here as he used a tool (Minecraft) to create his own original work (Skyblock). That's like if someone created a game using a Game Engine and then find out that the game engine company has been saying they created the game with zero credit to the original creator.
Noobcrew seems like the reasonable guy in all of this and the companies are the Nad guys. He just wants to be known as the OG creator well the companies just want money even though they are probably losing money in the legal battle. It would cost so much less to just change the name.
You'd be surprised, marketing is a big thing. If you add noob's name, you also point out "free" solutions to get it, etc. Besides, the "community" that watches UA-cam is tiny compared to the actual "community" that plays the game.
The whole trademark/copyright/patent/intellectual property situation is very sad and stacked towards large corporations. A lot of open-source developers etc. have problems with this as well. It desperately needs restructuring, and most of it probably needs to go away in the interest of consumers and smaller corporations.
I wish there was something we could do to help him. I guess the only thing we can do is support in him his efforts to acquire the trademark and encourage him to continue pushing forward and to not give in to these greedy companies only caring for the money.
Quite literally everything I've seen about the Microsoft/Minecraft Marketplace just cements it as the most scummy, exploitative excuse for a in game marketplace I've seen Such as there being no confirmation prompt before purchasing anything and all sales, no matter what, are FINAL and no refunds
You know what's funny? There's a resource pack called Ty'el UI that available for free on curseforge, it overhauled the bedrock UI from menu, inventory, containers, with TONS of small useful UI and features too.* IT also has confirmation prompt before you purchasing any paid content on marketplace, it is like middle finger to microsoft because they cannot implement that very simple prompt but community can.*
All I have to say is: shameful behavior from Microsoft. And to the would-be creator hearing the truth, they will give second thoughts whether to contribute to Minecraft or not, hurting the game in the long run. Why contribute to something that will one day kick you out while saying "this is OURS"? We as humans have 2 sides: social side and individual side, it's the thing that differentiate humans from the ants.
I'd be pissed too if greedy companies including Microsoft would stealing my creation, claim they made it and printing millions from it. This is why Minecraft bedrock is a joke.

All good effect aside, Microsoft also removing "Holiday creator feature" without make any official announcements before removal, making 90% of add-on in internet became no longer functional, like bedrock port of Create mod.
So the fact that noobcrew is fine with people using skyblock in a non monetizing (or at least not claiming to be the original) fashion I think is something that hurts the case for getting the trademark because in order to maintain a trademark you have to enforce it, and selectively enforcing it is not good enough (people could license it for use or otherwise use it in fair use though). If you only selectively enforce it, you're essentially allowing some competitors to also use the term and therefore decrease the connection between your product and competitors product, making it a more generic term. As much as I hate to see this play out, noobcrew is going to have a hard time winning if they continue with selective enforcement of the term skyblock.

i hope noobcrew can push through and win the lawsuit the marketplace stands against everything minecraft lives for minecraft would not be where it is today if not for mods and community driven content which is being stolen, reproduced at a worse quality and marketed as if it was the original for money when the actual original was free
Good thing my buddies and I just made a Skyblock map ourselves manually. We used command blocks to eat the world and then built the islands manually in creative
Microsoft has never known to be a kindhearted company, and it never will be. If you don't like them, stop using their products. I love the free Minecraft updates currently poured out by passionate devs, but I hate the reign and constraint put over them to monetize everything they do.

The marketplace is basically selling what was popular free content for java, slowly getting close to producing a watered down version of the classic mods available on java like tinkerers forcing those original modders to create the "port" for themselves first to secure ownership and provide quality to the best od their ability with limited tools. The big incentive for getting addons is the ability to play with console players due to the majority of Minecraft players playing on consoles instead of ever jumping over to PC.
And they had the audacity to say that people can make their own addon on there by joining the creator program (which is a gaslit fueled lie. Because it is a business. Not a place for individual modders to sell their own addons.)
Yep, that's the thing that makes Java players hate Bedrock with such a burning passion.

It is entirely possible to just create and install resource and behavior packs for free and the same would presumably go for mods, if one were to actually mod the game(Which is not really a thing at the moment). Bedrock is more restrictive than Java in a technical sense, but there is nothing physically stopping players from engaging with it the way they want to. On PC and to a lesser degree phones at least. Consoles are sadly screwed, but that's not particularly diffrent from how it was in Console Edition.

Microsoft is in the wrong here. You can't step in and claim something is a general concept when it's not like that at all (nor did they have any part in it). That's like someone going in and saying that every type of game console is all a "nintendo", or like claiming every single voxel or cube type game is just a "Minecraft".
The name "Skyblock" refers to the GAMEMODE, it in no way would just refer to a "block in the sky". The original map creator has a right to coin the term and claim commercial ownership on the name of a concept they came up with.
They argue that "oh but the name is so widespread". Yeah... that's because every bootleg version is still, in many ways, based on the original. Even if every bootleg is all using the same name, it doesn't mean that they aren't based on the original. Nor does it mean that they should be able to get away with not crediting the creator of the gamemode.
You actually can, and the funny fact is that you use the example of Nintendo was actually something that Nintendo quite LITERALLY!!! fought VERY hard to avoid it becoming a general term, even with ads, to make parents (especially) from using the term "Nintendo" for consoles in general. If that campaign had failed, Nintendo would have no way to avoid an XBox being called "Xbox, a Nintendo".
Nintendo quite literally fought tooth and nail to make sure that didn't happen.

It's not about whether bootlegs use the name, it's about whether it has become a generic term to describe something.
Kleenex and Xerox did the same. It was actually becoming pretty common to say "Xerox something" instead of "Photocopying", and that would have killed the Xerox Trademark... which is why they also did advertisements and other campaigns to try and make people stop.
Google did the same with the term "Googling", which was so close to becoming the generic term to just search up something on the net, on a search engine.

Microsoft is not at all in the wrong here. Morally maybe, but legally not. The map was released like a decade ago and the creator only tried claiming the trademark in 2020. They didnt release it under any specific license that would regulate the distribution of the map or regulate the trademark and they never before tried to defend the trademark.
They are just too late to the party and the term is definitely a generic term by now.

If Adobe 1:1 copies your feature and puts it in their next version of After Effects, should you be able to sue? I don’t think so, your work was built on their platform, after all. So saying Microsoft takes a substantial cut, let's just say 50% (It's their IP, they paid for it, and Mojang did most of the work in the first place), that means they would if they sold it at 10$ have to sell at least 7250 copies to just break even.
And on something like Marketplace, only the most popular stuff sells well, the rest is relegated to a few interested...

I vaguely recall Stampy saying that he doesn't mind if others copy his world as long as they don't try to pass it off as the original. He's even visited copies made by others in the past.
I think it's a reasonable and unspoken rule in the community that you can directly take the maps of others and showcase as long as you don't try to take credit for the work.
You don't necessarily have to credit the creator, Ie "hey everyone welcome to the video. I found this map but I forget the name of the creator. it sure wasn't me tho".
I believe shortly after lovely world ended, Stampy released his map on the marketplace and probably elsewhere for all to enjoy. Toycat has done the same thing and released his world. I believe the Hermits tried to do the same but idk the status of if they got on the marketplace or not. I think Truly Bedrock got in on the action as well.

I personally did a recreation of Flower Power on bedrock back in 2015 for me and my siblings to play. I showed them the video and they wanted to play. I conveniently had a world to play immediately.

Just because the trademark wasn't registered doesn't mean he didn't have a trademark. Unregistered trademarks exist, but aren't as powerful as registered ones. Though now that the trademark is disputed, I'm not sure if he can take advantage of the rights of an unregistered trademark anymore.

This is honestly one of the reasons I dont buy stuff from the marketplace. A lot of the stuff on it is stolen content that the original creator can't do anything about except watch as their creation get milked for thousands to millions of money. Unless it's an official version or someone list/link the original, I won't get anything on the marketplace. Not that I buy anything on it anyways because nothing there is actually worth my money.
I really hope the creator of One block follows NoobCrew step and either file for a trademark or talk to Mojang because it's also a very milked content on the Marketplace and other content creators.

It's things like this that make my blood boil. All this is is pure greed and corruption from big companies taking advantage of loopholes to punish anyone they don't agree with. Noobcrew is 100% in the right here as he used a tool (Minecraft) to create his own original work (Skyblock). That's like if someone created a game using a Game Engine and then find out that the game engine company has been saying they created the game with zero credit to the original creator.

Noobcrew seems like the reasonable guy in all of this and the companies are the Nad guys. He just wants to be known as the OG creator well the companies just want money even though they are probably losing money in the legal battle. It would cost so much less to just change the name.
You'd be surprised, marketing is a big thing. If you add noob's name, you also point out "free" solutions to get it, etc. Besides, the "community" that watches UA-cam is tiny compared to the actual "community" that plays the game.
The whole trademark/copyright/patent/intellectual property situation is very sad and stacked towards large corporations. A lot of open-source developers etc. have problems with this as well. It desperately needs restructuring, and most of it probably needs to go away in the interest of consumers and smaller corporations.
I wish there was something we could do to help him. I guess the only thing we can do is support in him his efforts to acquire the trademark and encourage him to continue pushing forward and to not give in to these greedy companies only caring for the money.

There's a resource pack called Ty'el UI that available for free on curseforge, it overhauled the bedrock UI from menu, inventory, containers, with TONS of small useful UI and features too.* IT also has confirmation prompt before you purchasing any paid content on marketplace, it is like middle finger to microsoft because they cannot implement that very simple prompt but community can.*

And to the would-be creator hearing the truth, they will give second thoughts whether to contribute to Minecraft or not, hurting the game in the long run. Why contribute to something that will one day kick you out while saying "this is OURS"? So the fact that noobcrew is fine with people using skyblock in a non monetizing (or at least not claiming to be the original) fashion I think is something that hurts the case for getting the trademark because in order to maintain a trademark you have to enforce it, and selectively enforcing it is not good enough (people could license it for use or otherwise use it in fair use though). If you only selectively enforce it, you're essentially allowing some competitors to also use the term and therefore decrease the connection between your product and competitors product, making it a more generic term. As much as I hate to see this play out, noobcrew is going to have a hard time winning if they continue with selective enforcement of the term skyblock.
