    We have to give it up to the mayor. He thought the signs where BS but was not sure, but instead of leaving them up till it was "settled" he took them down to make sure no freedoms were impeded.

    There should be a training scenario for cops with a fake suspect that gets their rights violated by let's say a captain in front of a sergeant just to see if they do the right thing and if not. Terminated immediately!

    it boggles the mind, and with no surprise I should say, how many cops and public servants in general are STUPID and DON'T KNOW THE LAW. They continue to make unlawful policies and impose those personal rules on the public without the publics consent. I taught that we the people are the employers and they those in uniform or those who work for the people become the employees once they dress up for the job, they are under contract to serve and protect the people's wishes and when the contract is found to be in violation, they guilty parties should all be fired and jailed if need be depending on the seriousness of the case. But sad to say, it's going to get much worst folks, hold on and put your seatbelts.

    That statute had a specific section listed that said nothing in this provision shall prevent any individual from recording public or law enforcement personnel in their official capacities in a public space. I just read the whole law. He was well within his rights to record public matters, and so they f-cked up by arresting him. The eavesdropping measures are to prevent electronic surveillance of private conversations that would occur inside secured areas, HR matters, etc. Filming publicly accessible areas and definitely outside are well within 1A rights.

      The worst part that this video completely fails to mention is that after they realized they were unlawfully charging him with a crime he didn't commit and they dropped the felony eavesdropping charge, they charged him with disorderly conduct instead and are still maliciously prosecuting him to his day. It's absolutely absurd, and I can't believe the story didn't mention it.

      We see this often. City officials give bad information to cops, and then cops falsely arrest someone. The cops blame the false arrest on the information given by the city officials, and the city officials say that they didn't actually do the arrest.

    I have been watching first amendment audit videos for close to 10 years now and there are still officers who don’t know peoples basic rights. This just further proves that Police Department’s are not teaching their officers about people rights because there are 100’s if not 1’000’s of these video’s all over the internet.

    People don’t understand when you go out in public you give up your right to privacy just like someone can go through your trash as you gave up the right to privacy when you threw it out. It’s why you don’t need to sign a waiver when your in a store or at an atm or any of the other million places that have Cameras. If your in public you can record.

    They originally charged the guy with Felony Surveillance, but then when they realized that the State Attorney's office would have to sign off on those charges, and they were no where close to appropriate, they changed the charges to disorderly conduct. Have those charges been dropped yet? Has this auditor initiated a federal lawsuit against the police yet?

      He is in the process sir he has a court date for the charges of disorderly conduct but the truth will prevail because the video shows that the officials and the staff were the ones being disorderly not him.

    Good job effecting change. However, I seriously hope you file civil rights lawsuits against those tyrants for illegally arresting you. Doesn't matter if the charges were dropped they still need held accountable.

    The Supreme Court has ruled multiple times, that the is no right to privacy while in public. You can also record cops any time from public property.

    It is frustrating to watch all of these videos where cops claim it is illegal to videotape. If that were true every bank, gas station, store and home with a doorbell camera would be violating the law.

    How is it that so many who watched this video don’t get 1A auditors? The whole idea behind auditing is to exercise first amendment rights to ensure they’re not denied by anyone. When the cops arrest an auditor, they’ve failed. I commented earlier that I’ve never seen any of the auditors I watch get arrested and have charges stick. It just doesn’t happen.
    Sure, they get arrested often, but that’s because the cops know they can’t charge them with anything and are essentially wasting dept time & resources to protect their own fragile egos. Individual cops should suffer consequences when they arrest someone, but can’t charge them. It’s akin to false imprisonment, which is a serious crime in all 50 states.
    Folks are suggesting here that citizens should ask permission for something that’s protected in the US Constitution, but a cop can throw you in the back of a car and leave you sitting in jail for days w/o any courtesy whatsoever?! What sheltered lives these people must live!

    You know, while it's absurd anyone in the legal system or law enforcement be ignorant of the U.S. Constitution and the Bill of Rights after completing their training, it's far more absurd that our education system fails so badly that ANY citizens could go through 12 years of mandatory schooling and not know their rights.

      THIS IS HOW UNPROFESSIONAL AND UNAWARE OF THE LAW THESE OLD SENIOR POLICE OFFICERS ARE. THE PROBLEM STARTS AT THE TOP WITH THE CHIEF AND TRAVELS DOWNWARDS ALL THE WAY TO THE OFFICERS ON THE STREETS. It’s more than abolishing qualified immunity. We need an actual separate oversight board to investigate complaints and incidents. One that can hand out proper punishment and submit charges to a prosecutor and judge that are not part of the courts the cops work in. We also need a dishonorable discharge for cops. You get fired, you become a felon equivalent like the military. Furthermore, cops need to be individually bonded/insured. Lawsuits need to come out of their pensions and personal assets. But with that, we also need a system that protects the honest cops that will arrest / report fellow pigs breaking the law. Lastly, they should have no ability to stop their cameras. It should all be publicly available within 24 hours of their shift ending. The 24 hours is to review any bathroom breaks AND insert flags for each interaction with the relevant information (so it’s searchable by cop, day, other cops on same call). Defunding or abolishing the police will not result in anything good. -Ban public service unions -install civilian oversight boards that: a. Have no secondary relations to any law enforcement b. Whose membership can be contested by any other citizen c. Are the body that reviews ALL complaints and ALL incidents involving use of force (bye bye QI) d. Have the authority to mete out termination/ punishment e. Have a special prosecutor to whom they can refer criminal offenses whether for actions taken by an officer OR actions such as hiding/tampering with bodycam footage, lack of footage, misleading/falsified reports - bodycams that run 24/7. Every minute you’re on shift is recorded. All the button does is add a tag. a. Blur video of bathroom breaks, but all audio must remain intact b. Tags (button presses) should all occur within 20s of being called (so well before arriving on scene) c. Tags are used to enter metadata such as: Date, officer, incident report, location, numbers and names of other responding cars and officers, type of call, type of incident. But no names of encountered free citizens unless they specifically request it so they can find the footage more easily d. These tags are then searchable a la UA-cam style e. Any videos longer than 5min should also have time stamp links for any event - ID request, use of force, radio calls, etc f. Said shift video, should be split, tagged, marked, and uploaded in a manner organized by date and officer within 72 hours of the shift ending. - any incident of a bodycam “malfunction” or serious video problems should result in an immediate suspension and validating investigation not to exceed 96 hours. A true equipment malfunction should see the cop back on duty and paid for missed hours after it’s been cleared. If evidence of tampering or “I forgot my bodycam because I took it off” or some other bullshit shows up, the suspension should be minimum 2 weeks without pay. Whether the tampering was “accidental” (I forgot to pick up my bodycam after illegally taking it off) or “intentional” (bodycam knocked off and after subject was detained I did not make any effort to immediately retrieve it” should result in punitive punishment up to and including termination - Nationwide blacklist: if you get fired for intentional disregard of policy, you cannot be a cop ANYWHERE. Also, it should be treated as a dishonorable discharge and you suffer the same loss of rights as a service member. Lastly, QI should have to be EARNED in a hearing with a double blind jury selection. That both sides argue against. With the extra consideration that a reasonable person would act in such a way. And must be a unanimous decision, any one dissenting juror kills your QI.

    I recommend people read that "720 ILCS 5/ Article 14". It's a pretty standard "eavesdropping" law. And *totally inapplicable in any public space.* The key part of the law is that the conversation being "eavesdropped" has to be "intended to be private." It is "settled law" (as LIA told the police) that privacy has to be created physically, not by fiat - saying "this is a private conversation" means literally NOTHING legally if you are in a place with "no expectation of privacy" (ie, any public space).

    I’ve called a few of these departments, on their non-emergency line, to give the receptionist shit for being a POS. They always hang up but I hope it bothers them that they are the law, and they regularly break the law.

    Funny how cops can record you without your permission; businesses can film the public 24/7; and these cops can just make up laws on-the-fly.

    The police need at least 1 year studying LAW at the academy level and those that prove they don't know law should immediately be taken off the street and sent back for more education , oh yeah at a significant pay cut .

    1:15 and this is why people say there are no good cops.
    In theory cops are supposed to uphold the law, even if it’s one of their own breaking it. But as usual, the “good cop” sees law breaking, and just stands by and lets it happen. And that’s a best case scenario.
    If that cop stepped in he would be fired and targeted himself. The system doesn’t allow for good cops to exist if they’re willing to hold other cops accountable.

    I will say it again, cops need to go to law school, with an emphasis on Constitutional Law and Ethics. It is ridiculous we live in a society where the people charged with ENFORCEMENT of law and the legal right to change or end a life based on their understanding of the law, don't have a basic knowledge of the law.

The cop is in the wrong because he doesn't know the law and you can't go around grabbing people and stopping them doing 1A protected activities. Guess what dumb ass if people like you and these cops did their jobs and weren't afraid of cameras their wouldn't be any auditors...

      @@yogib37 In 2012, it was successfully challenged by the ACLU to allow filming of police. Two years later, an updated law was passed that allowed filming in public where there was no reasonable expectation of privacy as well as the filming of police.

      @@yogib37 How about take your own advice....The law says NOTHING about not being able to record public officials in the course of their duties and regarding citizens it only becomes a crime if the recording is done in a surreptitious manner...so by them having the sign up claiming NO recording or filming that sign is on its face unconstitutional on the state and federal level
