South Africa levels accusations of ‘genocidal conduct’ against Israel at UN Int'l Court of Justice

The International Court of Justice (ICJ), the principal judicial organ of the United Nations, held public hearings on the request for the indication of provisional measures submitted by South Africa in the case South Africa v. Israel on 11 and 12 January 2024, at the Peace Palace in The Hague, the seat of the Court. Session held under the presidency of Judge Joan E. Donoghue, President of the Court.
South Africa addressed the UN's highest court on Thursday in a bid to end the mass killing of civilians in Gaza, accusing Israel of carrying out genocide against Palestinians there - a claim that Israel has strongly denied as "baseless".
The development came amid the ongoing and massive Israeli bombardment across the Gaza Strip in response to Hamas-led terror attacks on 7 October that left some 1,200 Israeli and foreign nationals dead in southern Israel and some 250 taken hostage.
Laying out their case, the South African legal team told the International Court of Justice (ICJ) in The Hague that Israel had demonstrated a “pattern of genocidal conduct” since launching its full-scale war in Gaza, the 365 square kilometre strip of land it has occupied since 1967.
“This killing is nothing short of destruction of Palestinian life. It is inflicted deliberately, no-one is spared, not even newborn babies,” the court heard.

Convention’s obligations
It was because of these actions that Israel had contravened the Genocide Convention, the ICJ judges later heard, in reference to the global treaty inked by Members of the United Nations after the Second World War to prevent crimes against humanity.
The Convention was “dedicated to saving humanity”, insisted John Dugard, also representing South Africa, and all countries that had signed up to the Convention “are obliged not only to desist from genocidal acts but also to prevent them”, he maintained.
The hearing continues on Friday with the Israeli presentation.

Even if the international court doesn’t have the courage to declare the verdict of genocide it’s at least a good attempt to lawfully expose the violations with presented legal evidence. The verdict of the world opinion based on this level of awareness is more valuable and effective than a court order.
If it doesn't have the courage then it should be disbanded. They've already proven to be the tool of the West to punish their opponents. The US even has a low stating they'll invade Hague if they even try to prosecute an American soldier. Look up Hague invasion act.

The IDF says they are very efficient and deliberate with who they are targeting, yet even according to the IDF themselves the civilian death rate is over 60% (the numbers are almost certainly higher than that). So they basically admitted to killing tens of thousands of civilians and say they won't stop. The rate of bombing and destruction rained down on Gaza has not been seen since the bombing of Dresden in WW2. This is genocide and it's not a debate, it's real and it won't stop until the Israeli leadership is behind bars.

Highly publicized cases like this regarding international affairs never serve to bring justice or discover the truth. At the end of the day it's just another instrument for a political statement, and that is regardless of what they'll decide.
The South Africans didn't put up a compelling argument for genocide. They won't "win" because it would set a dangerous precedent that any country defending itself constitutes genocide.

The arguments made were clear and left no room for doubt, but this case is less about facts and more about politics. If the ICJ, the ICC, and the UN are unable to do anything, it only speaks to the ineptitude of these bodies and that we still live in a world where "might makes right". Any belief that this world is ruled on principles that stem from morals and ethics is a fantasy; any belief that democracy or freedom are what countries that back this genocide stand for is straight delusional.

This is such a monumental case, not only for Palestine in general, but it is particularly crucial, and especially so, if the ICJ finds Isreal guilty of crimes against humanity, i.e., genocide. A guilty ruling verdict will give states, countries, distinct populations, tribes, ethic groups, and territories, etcetera, an entryway to the righting of past wrongs regarding, and or establishing fact-based arguments to present and obtain reprieve and reparation against global colonial instances of genocide and displacement. A guilty ruling will put the government entities of, but not limited to Canada, United States and territories, Australia, France, Britain, Italy, Spain, and Belgium on notice.

South Africans are remembering that their liberation from Apartheid was largely helped by the international support. While they may not win this case, they've started a very important and articulate process to really make the world listen.
We, as global citizens, have witnessed with horror and despair as some members of the United Nations Security Council (UNSC) have supported or even actively engaged in acts of genocide. The power of veto, held by a select few nations within this council, has been used not as a tool for justice but as an umbrella to protect their interests and inflame conflicts. This undemocratic practice undermines global peace and security.
The UNSC's failure to prevent or thwart genocides is a stark betrayal of the values that our civilised world holds dear. The heart-wrenching scenes from genocides around the globe are etched into our collective memory - bloodshed, cruelty and barbarity that could have been stopped in their early stages if not for the UNSC's ineffectiveness.
