Philadelphia Lead Disclosure Law
The Philadelphia Lead Disclosure Law, Section 6-803 of the Philadelphia Code requires landlord renting properties constructed before 1978 to provide a "Lead Safe Certificate" to tenant at the inception of the leasehold. The penalty for failure to provide the certificate includes abatement and refund of all rent paid, exemplary damages of $2,000 and payment of attorney fees.

If he is dangerous you could file a PFA. If the PFA is granted it would result in his immediate eviction.

FYI, Mark. The one available private landlord tenant office has closed and has not taken any new evictions since August 16th , 2024. For now, the Sherriff's office is the only option for legal eviction. Again, great video and info, thanks for making these. The reason for the private office closure is due to new insurance regulation by the City of Philadelphia, a 4 billion dollar policy, ( I was told by the closing office personal ) which no insurance company is willing to write.

So if the police officer is literally asked if he read the defendant their miranda rights and they testify they did not, is that really going to make a difference because my understanding is that police officers no longer have to read the defendent their miranda rights during/before/after arrest

This post confirms my understanding of the most recent state of the eviction process in Philadelphia and a recap of it's recent history, According to local news reporting , about evictions preformed by the Landlord Tenant Office, if an emotionally heated problem is caused by their eviction they must now re-schedule, rather than risk escalation. However, there was no mention if the reschedule would be at an additional cost to the landlord; I assume this to be a yes. I would further speculate that the Sheriffs' Office, the new better choice for eviction (I agree) would just handle it one and done, is my take. Their procedures were not spotlighted as was the Landlord Tenant Officer. They are the more official agency.
You are correct. The Philadelphia Sheriff does not charge a reschedule fee. The Landlord Tenant Officer charges $205 if the lockout need to be rescheduled.

How long do you have to dispute the pfa? When i got mine i had no money and no way to defend myself i was kicked out basically on the verge of being homeless so of course she was awarded the pfa.

I feel her public defender advised her after seeing the judge was receptive and understanding of my side of events. Now another 14 days of no contact with my 3 children. I’m just broken over this. How long is the process in average? Is the serving time counted in that lengthy process? Also is it a 30 days or 6 months notice that applies for occupants who once were tenants but stopped paying rent?
If the prosecutor tells you that the other defendant will testify against you and you file a guilty plea in order to evade testifying, then you find out that he is not on the witness list and the attorney general did not ask the partner to testify against the rest of the partners

Either one to say the truth they are worthless neither want to file a motion to suppress when asked to file one. The only way to get them off your case is to file a grievance against them, that will make them run
I have a few questions: 1. At which point are you supposed to surrender your firearms? Upon service of a temporary PFA? Or if a permanent PFA is ruled against you? 2. Aside from personal knowledge of the existence of the firearms, is there any way the police or courts know what firearms the defendant owns or their location? 3. If the weapons are stored at a different location / different jurisdiction, would the PFA be enforceable in that jurisdiction? Or would a 2nd PFA have to be filed in that jurisdiction as an extension of the 1st? 4. PFA vs. PFA: Is it a case of whomever files first gets priority? Or is it a case of whomever has the most prudent PFA? If both PFA's are mutually enforced or mutually withdrawn, what happens then? 5. If there is a settlement between PFA's, can there be mutual stipulations for withdrawal or otherwise? I.E. agreed upon return of personal property or monies, living arrangements, etc? They got me on a bogus PFA violation (ICC) and a bogus PFA itself that my psycho ex gf lied about just to get. The judge found me NOT GUILTY of the violation and then quickly threw out the PFA because neither had any merit. Now after several weeks the DA woman had several cops arrest me a day ago for a supposed NEW violation (that supposedly occurred a month ago when I got the first violation). How is this possible? The PFA had no merit to begin with. Whatsoever! Now that it's all been thrown out I have to go before the judge to explain this NEW alleged violation? (It was a txt to her mother saying to remind her that I'd be filings a PFA as well). They said the txt was after I was served but it was during the time they were there trying to talk in circle and get me to let them in.

Most people waive. There preliminary Hearing. If There In county jail becuz they hope that it speeds up the process That they will get released. But ppl who is out on bond. Don't usually Don't waive. The preliminary Hearing becuz they have resources. To get. a lawyer. Becuz they already out on bond
Does the defense get to explain their side during the preliminary hearing? For example, if a person is accused of stealing and there is evidence against them, however that person is mentally ill, is the defense granted to share that kind of information at the preliminary hearing?
The Defense may call witnesses but often does not present evidence unless it will rebut a prima facie case that a crime was committed.

hi so me and my landlord went through mediation via the EDP and we came to a written agreement i have honored everything on my end and have been paying consistently since the written agreement yet i am still being sued still what are my options to fight this because im actively trying to resolve this debt and my landlord is not understanding
isn't the officer contradicting himself in his testimony vs his written report, perjury by inconsistent statements? and isn't perjury a FELONY? How many times have we seen irrefutable evidence of an officer committing perjury only to NEVER be charged with the felony he/she/they just committed? The alleged witness "officer" is no longer reputable enough to give any witness statements. BRADY LIST ABSCONDER!
