I am a Quad Pilot and I am also a Police Officer. I have no problem following the rules, but like you I would like to see this rule. Honestly, I am embarrassed by this confrontation. I am glad it was kept civil and in a discussion type format, I wish all my contacts with people went this way. I do believe in the Law, but I also believe in peoples rights not being infringed upon. Every time you press them for written proof of some sort of directive, rule, ordinance or law they started to stammer. You can tell from their response that they had no clue. I am guessing that this came down from somewhere above them where it was discussed in a meeting or something like that and maybe it was verbally told to them, but when they have no written proof to back up what they are saying it just makes them look stupid. Not sure where this was filmed at but I do know that you can not fly in National Parks. Where I am from a business owner can refuse service and ask you to leave his property w/o any cause at all and you have to do it. This being public land I am not sure how that would work other then the way you laid it out. Also you can not seize a persons real property w/o cause or a warrant. It does not seem like there is a written policy, law or ordinance to back the officers up so they can not seize your property.
most likely its a park policy concerning public safety. I do not actually believe they can keep his drone but I think he was more giving him the option to enter without it or leave.
My first question would be, "If you don't have a written policy anywhere, how do I know that you didn't just make it up?" and then "If you won't show it to me or even tell me where to find the rule, how do I know that you're not lying to me about it even existing?"
I live about 45 minutes from this park. They are pretty strict about anything new. These Metro Parks are a joke, and so are the Rangers that regulate them. They basically make their own laws and dont give a shit about ACTUAL laws.
A citizen that pays your salary asked you to provide the written law that they are breaking. Can you provide it? No? Then this is harassment. Basically "We don't like it, and we are "THUH LURRRR!!!!!" Dare to oppose us and we will use our authority to harass you. Do it and we'll steal your equipment! Hur hurrr!!! This is the best profession for high school bullies..... You can "refer" to whatever you like, if it's not a law, you can't enforce it. You don't get to just make up laws on your own, that's not the job.
after he failed to show me proof that it was a regulation or law I would have continued flying let him take it video the whole thing and then sue the police department for stealing my property
for the record. with the park and them saying it's a "public safety issue" reply with "so is Frisbee and riding a bike, but recreational activities are for public areas." always refer to it as recreational activities.
There is a level of expectation. a Frisbee can't do a reasonable amount of harm and riding a bike has it's limitations. You have certain places to ride the bike you just can't ride it around people. This issue seems to have been well discussed and taken into consideration and the decision to not allow him to fly a drone over a crowd of people. There is no telling what happens if the think malfunctions and hits someone. It's a very reasonable decision.

+Kartracer6 if you or anyone else is that afraid of my drone... go home... leave the park. but you have no right to tell me that what I'm doing is wrong or not allowed. just like I can't tell you to stop playing Frisbee... I can only give you more room. you talk about courtesy, yet, give none. nor do you present logic that I find to be conclusive of any real danger beside that which is expected on a day to day basis.
+Kartracer6 also... you just said the risk is for those who participate or spectate... why would you spectate my drone if you're afraid I'll hit you? this logic applies to a sport. you just said it yourself...

the mere fact he is being questioned without criminal activity afoot is a violations. Plus the threat of taking the helicopter would be a seizure of his property with no law that gives him that authority. He doesn't make the law, his job is to enforce it whether he likes it or not.
Matthew Mathews 1.) him being questioned isn't illegal. They told him multiple times he wasn't being detained for any crimes. No law says you can't approach and ask someone questions. 2.) taking the item may have been more of a threat then an actual promise. They never actually seized the item from him. Honestly what they should have done was asked him to comply or leave the park. But to be fair the officer was extremely professional and polite and explained to him that his actions where unsafe.
First comply with what? If there is no law against flying the drone then there is nothing to comply with. Second, Every state has their own laws on criminal procedure and I will give you that. But here in New York, polie encounters for a request of information reduces questioning to a general nonthreatening encounter in to ask briefly about identity, address, destination, and or a reason for being in the area. Any communication in NY other than name and destination requires articulable facts that support founded suspicion that indicates criminality is afoot.• For example, a police officer may not ask the occupants of a lawfully stopped vehicle if they posses a weapon w/out founded suspicion for that inquiry like bullets in plain view on the floor. Therefore, unless there is founded suspicion that someone is violating a specific law, the police in New York cannot just start asking you questions. Again every state is different, here our State Constitution give its people a lot more protections than is federal counterpart.
Matthew Mathews Law? It's a policy. They deemed it a public safety issue. This isn't about the law, the park can make policies and police them even if they aren't a law (as long as they aren't breaking the law by making them).
Drone - an unmanned aircraft or ship that can navigate autonomously, without human control or beyond line of sight. Hate to say it guys but saying "I don't like calling it a drone." is like pointing at a potato and saying you don't want to call it a potato. I am an avid R/C enthusiast and I hate the negative connotation the word carries, but trying to correct someone on it or tell someone it is not a drone is entirely incorrect.
***** Drone - an unmanned aircraft or ship that CAN navigate autonomously, without human control or beyond line of sight. CAN...not should.. It is capable of going out of line of sight, therefore it is a drone.
Lunar Fire I'm not arguing what I would or wouldn't call any of them. Personally I hate the term 'drone' and the negative connotation it carries. I'm simply stating correct use of the word.. And if in you're example you have FPV attached to your plane which allows you to operate it beyond your own line of sight - then yes it is a drone. It has absolutely NOTHING to do with the actual frame/means of propulsion. Fixed wing can be in the category just as much as multi-rotor. This is the reason the FAA blanketed their regulations across all model aircraft and not just multi-rotors.
Rules concerning flight with drones in Denmark Fly height with shall not exceed: 100 m Minimum distance to public aerodromes: 5 km Minimum distance to the urban built environment *: 150 m Minimum distance to major public roads: 150 m Minimum distance to the larger number of people: 150 m Minimum distance to accident sites: 200 m Minimum distance to police stations, prisons and arrest houses: 150 m Minimum distance to the Royal family properties: 150 m Minimum distance to military areas: 150 m It's probably different in other countries. It's hard to control a drone and only many hours doing better, there are errors on some drones and them is controlled using a phone or tablet they are not completely stable and if they lose the signal may fall down, close all apps before the flight for the best wifi signal on parrot.
Can anyone update me what would happen if the person in this video decided to fly his drone in this area today, what are the rules and regulations? Not living in America makes these things harder for me to follow. Thanks in advance
I think it's not allowed to fly drones in public areas but im not 100% sure. But most police don't really care about drones as they have better things to do.
In Thailand there were supposed to be new laws coming in to ban drones but it never happened so I am very happy that I can fly anywhere except near Private Property & The Royal Families Residences
+Drone Compilations I don't fly drones (quadcopters) but RC helicopters and the rules all not too clear on that at the moment. if you would like to know more about drone regulations visit the AMA site but the last 6 months there were some drastic regulations announced but they never became a law. so the police doesn't know how to regulate the flying of drones at the moment. BUT!!! all i can say is that the drone hype haven't done good for the other rc flying hobby. because of D-bags that fly them and causing trouble for the rest. all i can say is use common sense when flying. like never fly over a crowd. if you are asked to leave don't make a problem about that and search for a new spot. and if you can join a rc club that has a dedicated field.
I run a business flying these drones and I must say with the new regulations taking action on August 29th under Part 107 of the FAA, you may not fly over any persons or facilities not participating in the event as a cause of safety hazard if the drone fails and falls and injures someone. You now have to be certified to fly drones commercially by the FAA.
In case you didn't know, videos on UA-cam made with drones are not commercial unless you monetize them in which case you are required to hold a remote pilot certificate.
YESSS!!!! Thank You For Another Video +Drone Compilations!!!... I Wish I Could Also Do What Your Doing But I Dont Know How Or What To Do, It Would Be Cool If Me And You Could Work Together But, You Know, That I Dont Know You And You Dont Know Me. Anyways Have A Great Evening/Day!
Drone Compilations I Already Know Im Going To LCC Community College In Kinston,NC For Drone/UAV Education and then im going to look for another college for engineering And Things Like That! Have A Great Day To You My Friend!
I hate the AMA fields. To me, it is just a racket - you have to pay for membership to fly there, then you have to have insurance....just a scam for a group of buddies from long ago that found a way to make money from other people that love to fly RC planes. There are a lot of good things about those types of groups, but it is only because of the individuals within the group - some of them are good people and not part of the scam, just one of the conned.
so if you break an unwritten rule they will steal your property... That's some real B.S. .. Welcome to the Police State. Defy these unwritten rules!!! What the hell happened to liberty.. Justice... Good job asking for the written rules. And great job for standing up for your liberty and mine. As a "drone" pilot myself, I am in 100% total agreement with you. before long they are going to tell us we don't need to have "drones" at all..
@5:15 after the word "confiscation" by the cop - the discussion is over. You either stand your ground or give in. If people are going to do this stuff, they should make up their minds to either go all the way or not start. If the cops were wrong, you let them confiscate, arrest or whatever else they are going to do without putting up any further argument or resistance. Then, after the dust settles you take it up in court. If you aren't willing to go all the way, these half-ass attempts simply annoy cops. Lawsuits would get their attention better.
I watched this again, because someone commented to my post. I can't believe 5 years has past since the last time!!! But here's my take after watching it again. If the park is Federal, State, County, or City owned (or any other governmental body), then one of two things need to happen: 1) A Law/Code must be past saying such. OR 2.) A Blanket Law/Code must be passed stating that the park manager has the right to set any policy he wishes and that the policy itself can be enforced (weaker but MAYBE valid). Now if it's a PRIVATE park, that's a whole different ballgame and they can do what they like - it amounts to trespassing and not RC-Aircraft stuff. So, assuming it's a public park, some type of law or code must be put through the legal process before an "enforcer" can enforce anything. I would have said, "I intend to keep flying." He would have said, then, "I intend to confiscate." I would not have "let" him confiscate by saying, I do not agree to your confiscation but I wont try to resist or stop you. Let him confiscate. Get it all documented. Then sue the officers involved personally, sue the department they come from, sue the governmental entity that they represent. Get lots of $$$ from having your rights trampled by government and causing you distress, sleepless nights, etc. They buy a whole bunch of RC-Aircraft and a Mansion to fly them around. ;)
The National Park Service has banned all takeoffs and landings of any type of aircraft in any national park and many states have followed similar paths. You can fly over the park as the park does not regulate the airspace, some parks have also banned operating the drone from inside the park also e.g. going to the border of the park and taking off then walking in the park with the drone flying overhead.
Lol really...drone hobbyists....LMFAO aaaahahahahahahahahahahahahahahahahahahahahahahahahahahahahah did you really just say that and are serious...what do you feel misled by the title thinking you were going to see.... what.......come on bro...i've seen some anal replies but your's is number one lol.
you guys think your being smart but truth is all your going to accomplish is giving these assholes reasons to make up laws etc to stop us flying our drones .well done !!!
He is correct. You cannot control it every second. You could easily cause injury however unlikely. Just dont fly in a park when people are around. Btw im a fpv racer, let the police do their job. It makes me cringe imagining hitting someone in the back of the head at 50mph
Can't be a public safety issue unless you fly OVER someone. As for the threat of confiscation if you were to fly, that could net you a pretty tidy some of money in the theft of property lawsuit that would (and should) follow.
Cops who say "THERE IS NO DISCUSSION ABOUT IT" and it not willing to, or cannot site laws all need to be fired immediately. They are violating lawfully acting citizen's rights and violating their oaths. This video is 6 years old and this stuff still is happening. It's time to hold them accountable!!!! #StopEarningTheHate. #EndQualifiedImmunity
It is a remote "CONTROLLED" Aircraft. Which means you can avoid injuring other people by controlling the flight path. I am sure people play football or soccer or some other ball sport in the same park, but that ball flies UNCONTROLLED thru the air, weighs alot more than a quadcopter, and therefore is more of a public safety threat.
I've dealt with the same cop at Kensington metro park for a couple different reasons. he also said that we could not operate our RC plane's quad copter's he Evan stopped my friends and I on a separate occasion for riding our longboards on the paved trail. those officers need to chill out and let us fly and ride our longboards.
The problem with these kind of encounters is, it will force law makers to implement restrictions and make the use of drones more problematic. Just fly the thing without attracting attention and we will be left alone
The argument about not always being in control can apply to cars. Apparently it would be OK to fly the drone over the park as long as the controller is outside.
Still a lawsuit, interfering with lawful actions, someone needs to hire an aviation attorney and drive around the country with him and fly at all these sights. Sue them all
Here after George Floyd and protests have calmed. My take as a college student. Being indian I experience racism differently than most. While Blacks appear to get physical hurt while indians get verbally harrased. So many police are well intentioned but I see many that are not. I wish we had a solution but we simply do not. There is no amount of protesting that will remove the thought of racism from peoples mind. For everyone out there. I cannot force you to be equal. But on behalf of the colored community, I request you to be equal.
My friend had a drone(quadcopter) and he brought it to my house, we flew it around from my house to the park right by us, the cop was pointing at the drone, my friend told me that the cop was mad and he wanted to play around, so he landed on the cops car and took off.
So much better had he said, Will you issue a written violation WITH a statue number? Funny part would have been them trying to find the reg number to write down.
Jesus, why don't you just understand the difference between law, policy, regulations, and the fact that no human has authority over another human. A cop can't just make something up and force it down a civilians throat as if it's fact. Sheeep
+Lisa Turner sheep? I know that the cop was out of line and that they were trying to enforce something without any legislation but Jesus.. sometimes you can be the bigger person and just say whatever and let it be. tomorrow is another day and your toys will still be there to play with.
As of this month these "local" officials no longer have say as to whether we can fly in their parks, the FAA has taken over the federal regulations and since they control the air, well they are the only ones who can say no according to their website.
As of April of 2017, Michigan passed a law, section 259.305 sec. 5 that makes all rules and policies unenforceable. These parks can no longer push their policy because they are public parks.
His rights were disrespected, trampled, and disregarded, but the pigs were nice about it, so he punked out, shook hands and went home with his tail between his legs, to clean out his pannies. Wow; what a hero.
Should he have taken out a .357 mag from his car trunk and smoked the pigs for what they did? Now im not saying that he would be wrong for doing it.. because I don't think he would be. I think he would be well within his righs as a free citizinen.... on the other hand. I'm just not willing to kill over such a small quarrel.
How far above something does private property extend? does the air space above my property boundary extend into space? this is ludacris... but on a serious note... if I launch from say national forest and just so happen to be passing over a national monument on the way somewhere else how can they prove I was filming the monument?
I know that here in Bakersfield, Calif. there is a law preventing ppl from flying RC air craft of any kind in city parks, county parks, here, is a different story.
@ 4:15 they can confiscate the drone and then the owner/operator can sue the city for violating his 4th amendment rights against unlawful search and SEIZURE specifically in the absence of a written law or ordinance.
YOU only need to provide first name for police contact... if you aren't being accused of a a crime of course and the cop doesn't have exigency.. folks always forget one of the three...probable cause, exigency or warrant..they forget exigency.
They just make up rules and Laws as they go. That makes them above the law. That's a perfect demonstration of violating your rights as a citizen because they "feel" it's a public safety hazard. So they just make up rules at will. WOW......and even on camera they felt perfectly within their rights to say that on camera. It's amazing how ignorant about the law our own police are. That's actually scary!!!!
There's a State Park right next to the Kensington Metropark, you could have walked there and use the drone... the rules in the State Parks are different...
6:25 "this is electric so it doesn't make any noise." I fly drones and unless he has some sort of fuck magic drone. It probably makes a noise. just proves this guy wants to make up shit to go against what the cop is saying.
God I hate people who get mad at drone it's like getting mad at someone who throws paper airplanes or thoughts spinning characters that kids can get that seemed to hurt kids
This guy doesn't mean to cause problems, but he holds up 3 police officers for several minutes. HA! I think the police should be able to keep their facilities secure and free from possible espionage at will. That guy should have been arrested. Welcome to the 21st. century DUDE.
Some people just love confrontations with cops. Notice how he keeps asking for a written rule when he knows full well that they don't carry a "law library" with them! Even after he knows he's not going to get to fly there anymore he still continues to argue BECAUSE HE'S LOVING THE CONFRONTATION!
I am a Quad Pilot and I am also a Police Officer. I have no problem following the rules, but like you I would like to see this rule. Honestly, I am embarrassed by this confrontation. I am glad it was kept civil and in a discussion type format, I wish all my contacts with people went this way. I do believe in the Law, but I also believe in peoples rights not being infringed upon. break these nonsensical rules that you don't know and we'll steal your shit. murica!

Did you just commit genocide? Oh sht i just did too with my words! 😱
Also, remember not to drive your car through neighborhoods people live in.
the cop has to show the statute..they are breaking the law by enforcing a law that isn't written.. this is an UNLAWFUL order...
You couldn’t be anymore wrong
'..the clarification is very simple - we dont allow that..'
:D
That bit did it for me too!
Awesome videos guys! You should make "Drones vs Guns"? I think that would be really cool!
Either way though I love all the videos, keep it up :)
Won't be that easy for them since it's not like everyday you get to film a guy shooting down drones

Eric Lewandowski same!
So fuck with them then. I would be CONSTANTLY flying and baiting them out. Constantly.
i like it when people argue like grown men

It's probably different in other countries.
If you are in turkey Never fly a drone
What a dumb cop. I was waiting for him to say You can't use your iPhone in the park because you might drop it on some kids head. :)
In case you didn't know, videos on UA-cam made with drones are not commercial unless you monetize them in which case you are required to hold a remote pilot certificate.
Nice channel bro just discovered you 👍🏼
why would they even make drones if we can't fly them anywhere
Oh
@Kollin King you dumbass
2:37 he asked you where u was parked to get yr I'd off the licence plate. That's illegal too
Have a great day my buddy! =) I hope I inspire you to do great things in the future!
Drone Compilations I Already Know Im Going To LCC Community College In Kinston,NC For Drone/UAV Education and then im going to look for another college for engineering And Things Like That! Have A Great Day To You My Friend!
That is great I hope you learn loads of new cool stuff!
wait but planes crash to and they still allow those don't they?
By this idiot pigs logic... maybe we should make drugs and drinking and dtiving illegal. Then they will go away too.......... oh wait.... DOH.
Lern too spel
As of October 2022, there are no village ordinances or state statutes that prohibit drone operation in Milford, MI. These officers are full of crap.
So you can enforce laws that haven't been written? "Yes I can." lol.........
so if you break an unwritten rule they will steal your property... That's some real B.S. .. Welcome to the Police State. Defy these unwritten rules!!! What the hell happened to liberty.. Justice... Good job asking for the written rules. And great job for standing up for your liberty and mine. As a "drone" pilot myself, I am in 100% total agreement with you. before long they are going to tell us we don't need to have "drones" at all..
lol the cops says the clarifications are very simple, we don't allowed that..lol
really though? I would've said well if you can't prove it's a by-law or policy I don't have to obey. They sound like their running a dictatorship smh
The cop pretty much admits he is doing illegal stuff by not allowing him to fly in the park...
The park regulation video, if they confiscated it sue state for illegal search and seizure. mainly the seizure.
Just making rules and policies up on the spot, love it when police know nothing about drones. Hahahaha
Technically you cannot fly over a populated area and a park would fall under that.
He said policy, not law and he has no right to take that drone
This is why people should get their part 107 certification. You’ve tested with the FAA and can prove you know more about drone law than they do.
Get arrested for it, then sue them for false arrest. Then they will stop.
You can always tell if a pig is lying cause their lips are moving
@5:15 after the word "confiscation" by the cop - the discussion is over. You either stand your ground or give in. If people are going to do this stuff, they should make up their minds to either go all the way or not start. If the cops were wrong, you let them confiscate, arrest or whatever else they are going to do without putting up any further argument or resistance. Then, after the dust settles you take it up in court. If you aren't willing to go all the way, these half-ass attempts simply annoy cops. Lawsuits would get their attention better.
!!!!!!!!!!!!!!!!!
They buy a whole bunch of RC-Aircraft and a Mansion to fly them around. ;)
In the UK we are not allowed over 400ft, where privacy could be a problem and commercially needs a licence.
The thing people don’t get is if u say “I don’t have to show Id” that makes you suspicious and gives the police probable cause
Cop Logic
If you own something that has a record button
YOU should be arrested
how the fuck is this a drones vs cops video. its a video that should've been titled 'drone hobbyists vs cops'
I think the drone and drone hobbyist go hand in hand
Lol really...drone hobbyists....LMFAO aaaahahahahahahahahahahahahahahahahahahahahahahahahahahahahah did you really just say that and are serious...what do you feel misled by the title thinking you were going to see.... what.......come on bro...i've seen some anal replies but your's is number one lol.
harry guy its not like the drones are fighting the cops. its more like drone operators against cops
I prefer the term; Drone Enthousiast.
you guys think your being smart but truth is all your going to accomplish is giving these assholes reasons to make up laws etc to stop us flying our drones .well done !!!
He is correct. You cannot control it every second. You could easily cause injury however unlikely. Just dont fly in a park when people are around. Btw im a fpv racer, let the police do their job. It makes me cringe imagining hitting someone in the back of the head at 50mph
And that's how you get arrested for resisting arrest
Was this in Michigan?
Can't be a public safety issue unless you fly OVER someone. As for the threat of confiscation if you were to fly, that could net you a pretty tidy some of money in the theft of property lawsuit that would (and should) follow.
This is the only job I know of where you don't have to know anything about the job and you still get paid.
Is this in Michigan? Kensington Metro Park?
Sue them all
Beginning in this vid they didnt say it was a privacy problem it was a public safety problem
Stop talking shit.
Yeah yeah yay 👌
Very friendly policeman.
That's are free world?!!!!
our*
Apparently..
Lern too spel
Cops don't have the luxury of making the laws.
So much better had he said, Will you issue a written violation WITH a statue number? Funny part would have been them trying to find the reg number to write down.
Jesus, why can't you just say "OK" and ground your drone for a little bit instead of trying to outwit the police on policy.
@@6monthsago941 hm. I'm unsure the founding fathers would consider that prudent.
These parks can no longer push their policy because they are public parks.
just don't fly if there are cops
whats a goddamn park for
Still to this day there are no regulations regarding drones not being allowed in public parks period
The first cops sound so dumb lol
Policy is never law. Never comply.
did anyone else get the sky viper add
Two hours and the next part is coming out?
That was two hours ago :)
I'm just not willing to kill over such a small quarrel.
is it coming part 3,4 etc..?
His car could malfunction (happens all the time), how dare he drive in the park. I hope he gets terminated because of his THIS IS MY TOWN attitude
The dog thing is supported by law and jurisdiction.
The FAA has sole jurisdiction.
To everyone who may be confused or may want to learn on the new FAA regulations being put out, go to the FAA website and click part 107
@ 4:15 they can confiscate the drone and then the owner/operator can sue the city for violating his 4th amendment rights against unlawful search and SEIZURE specifically in the absence of a written law or ordinance.
YOU only need to provide first name for police contact... if you aren't being accused of a a crime of course and the cop doesn't have exigency.. folks always forget one of the three...probable cause, exigency or warrant..they forget exigency.
should of said a kite can not be controlled at all times but u can fly them lol
Arbitrary enforcement. Common these days. It's illegal and needs to be stopped.
Good video
They just make up rules and Laws as they go. That makes them above the law. That's a perfect demonstration of violating your rights as a citizen because they "feel" it's a public safety hazard. So they just make up rules at will. WOW......and even on camera they felt perfectly within their rights to say that on camera. It's amazing how ignorant about the law our own police are. That's actually scary!!!!
Will i have a problem if im filming as a foreigner?
There's a State Park right next to the Kensington Metropark, you could have walked there and use the drone... the rules in the State Parks are different...
You want to know where the rule is for public flying over it is in the FAA rules and regulations look it up
It is a secret rule and the public doesn't get to input or property rights.
Law enforcement is exactly as the name implies. They enforce laws they DO NOT make laws up especially on the fly.
The cop was enforcing his opinion
This guy doesn't mean to cause problems, but he holds up 3 police officers for several minutes. HA! I think the police should be able to keep their facilities secure and free from possible espionage at will. That guy should have been arrested. Welcome to the 21st. century DUDE.
Some people just love confrontations with cops. Notice how he keeps asking for a written rule when he knows full well that they don't carry a "law library" with them! Even after he knows he's not going to get to fly there anymore he still continues to argue BECAUSE HE'S LOVING THE CONFRONTATION!
Lmao I live a half a mile away from Kensington state park
If you don’t want trouble, show the ID. If they start pulling shit on you, then please ask some questions.
