Notice the prosecution isn’t as sure as Judge Simpson? That’s because the State of Michigan says anyone who isn’t a felon can ask for whatever emails they want from their local government and don’t have to say why or what they’re going to do with them. A local government worker got another worker charged with a felony for how she did her job. Think about that. It wasn’t the local government administration or lawyer who went to the Sheriff, it was another employee. And the crime? Forwarding an email and or electronic calendar invite. Since the crime was committed while acts of local government were being done and between two government workers, it’s all supposed to be open. If they don’t want everyone in their business, maybe the Sheriff and the Prosecutors office should have waited until the “victim” employee had gone to the head of the local government where the board, the attorney representing the local government and the “victim” could have an official, legally closed meeting. The Sheriff and the Prosecution should have declined to bring the charge until the attorney for the local government stated the information forwarded was not on the government server. Because if it was it’s public information. I’m guessing since the prosecution says in this video that they can’t even get someone to pull it now, they didn’t get that information before charging someone with a felony. This is an extraordinary charge that challenges who controls how each arm of local government works. This woman was asked for information in her capacity of a government worker who is supposed to uphold the law of open government. If you can be charged with a felony for complying with freedom of information because a coworker didn’t like how it made them look, and if you don’t have 92,000 (taxpayers are paying her legal fees) to defend yourself, where does that leave us as a country? The case is outrageous by the nature of the events the prosecution took to bring this felony charge, and this woman, to court. And now the defense has to make sure they don’t make Judge Simpsons friends look bad because that hurts his sense of decency. Meanwhile the whole case is about open government and Judge Simpson doesn’t like the way it looks that the defense asks for public information and server data that is literally supposed to be the crime that the prosecution had evidence of before filing a felony charge. I agree that for the defense to be right, a whole list of people didn’t do their job. So no one thinks it’s possible a bunch of government workers took the word of their superior(s) or became too afraid to be the one to tell them they were wrong? Because look what happened to the defense attorney when he asked for information that is public anyway. Judge Simpson could have told the Prosecutor the information can be asked for through FOI and they have to respond in four days and then put the hearing off for a week and be done with it. Judge Simpson could have said the most important part of all of this is that the government be open and work within the law and to that effect the server data and emails were a priority so the public had faith in how their local government is run and that its done openly. But no. Judge Simpson cares deeply about those he works with and even though this case has been brought in a way that circumvented all historical workings of local government, he’s going to punish the defense for not make it less clear what’s happened.
This is what happens when you hire your friend who went to law school but has zero experience in a court setting. What I got from this is that there is a FOIA request, for some reason, from the defense for certain information. In response to that request there likely was communication between the individuals involved which the defense then attempted to compel discovery on too early.

Look at how upset Judge Simpson is for the people working on the prosecutors side just because the defense is asking for information that is a) public information anyway and information that b) is literally the evidence of the crime that the prosecution should have had before charging the felony. Now look at the prosecution - who works with these people. The prosecutor isn’t making any impassioned declarations on the impeccable ethics of the people working this case and assuring the court and the community that every step of this prosecution has been by the book - especially since the felony charge is against a local government worker while working her local government job. Rather, he makes some demure statements about how no one in IT can pull the evidence/server data. He doesn’t say their IT person is an expert, Judge Simpson did that and then the Prosecutor stayed silent on the matter. The prosecutor doesn’t say they pulled the server data/evidence of the crime (an electronic crime allegedly committed on the government server) and had their IT expert (a local government worker) review it and that they 100% knew then, before the charge, and 100% know now that it is evidence of a crime and that they stand behind it. They don’t have the server data/evidence of the electronic crime to give, and that alone proves they didn’t pull it or review it before charging the felony. The prosecutor instead says someone is on leave now in the IT department and the IT person left has so many IT issues with elections that it’s taking 40 hours a week for several weeks to address. He doesn’t say either is an expert who already pulled and validated the data which is also the evidence of the crime itself. The prosecutions problem is the defense is being paid for by the tax payers and she can now afford an expert to call bullshit. Also, this is actually a significant legal case where a government employee is being charged with a felony for forwarding an email and/or calendar invite that seems to be public information under Michigan law. This case could have significant real world consequences for all government workers in Michigan. So it’s going to be put under extreme scrutiny and public review in addition to legal review. I bet the prosecution didn’t think the lady would be able to afford a good defense and could make her take a plea deal. It’s too late now. And the prosecutor knows the emails can be obtained through public information and may get out anyway, so he’s not as confident in his colleagues as Judge Simpson is.
