So, when you cash a check at the bank and the bank teller gives you more than the check amount, is it yours or the banks?
A transaction was completed but someone made an error. I did the right thing by ounting the money and making the teller awate of the error.
If the funds were not returned the teller would've been responsible to pay the bank.
Same situation here, in my opinion the buyers financial responsibility was satisfied but the transaction is not complete until the goods are delivered to the buyer. In this case I believe the buyer was not entitled to cash that was not part of the original purchase agreement.
Likewise if you were making a purchase at a department store they would not allow you to leave with the contents present in this bag.

Morally it belongs to the first person who sold it. Now it belongs to the customer who bought it because the transaction was complete once she paid for that bag. That seller was wrong. Lets reverse this , do you think that seller would give it back to the person she bought it from after she paid for it.
Actually, once an item is sold whatever is found belongs to the new owner. It’s like when you sell a house, you lose rights to everything you left inside.

The seller was not wrong. The difference is that the first person that sold her bag off, was not thorough enough to search and empty her bag before handing it over. If she searched and found her $1,000, she also had the right to remove her money first as this seller now has the right to remove the contents of her sold bag first. If she didn’t check the bag and had handed it over, then the buyer had the right to keep the contents of the bag even if she told her later.
I would have given it back to the rightful owner, not the trader. However, if the owner Never to return for the money… it is totally belong to the customer.

I don't know laws in Nigeria but in the US possession is 9 tenths of the law. The customer bought the bag, money exchanged hands for the bag right? That bag and everything in it belong to the customer. If the owner had searched before receiving money for it, she would've had a right to it.
I believe that as long as it has not left her shop or first handed over to the customer who paid for an empty bag, it is the shop’s right to keep the contents of their bag.
This would not be contractually the case. The argument would be that the sale is not complete, and the buyer has not gained possession of the property. Moreover there is no actual meeting of the minds regarding the items to be sold/purchased.
As a Nigerian lawyer (American based), this is literally the wet dream of many a contract law professor as it raises questions of when a sale is complete and title transferred. In any event, whether technically or common sense while the purchaser may be entitled to the bag itself, nothing gives her a right to any of the internal content, nor was this what was intended by either of them. Especially in the context of bargaining that goes on in Nigerian markets - the money and jewelry was not part of what was bargained for. Case closed :)

True no one should be obliged to look for the original owner but the yard sale buyer would have been gone with their purchase. This case was where the transaction was still in progress and the seller rightfully searched and emptied out her merchandise before handing over the bag paid for, so the contents belongs to the seller just as it would belong to the buyer had she already been handed over her purchase.

Once the bag was bought it is in the possession of the person who bought it. It is the decision of the person that bought it as to whether to give it back or not.
True but not before the seller hands over the bag she bought. She paid for an empty bag and an empty bag she must have. If for some reason, the seller forgot to first search and empty out the bag (like the original owner did), then the seller has no right to lay claim to what was in the bag already sold and taken by the buyer.

Am from Nigeria and with stuffs like this, a lot of people buys from such traders who sells second hand or knockoff goods, so if u order or pay for something and u don't collect it immediately, they keep it aside and go on to attend to other customers, but when u come to collect it, its normal for the seller to check the bag infront of the customer again even if they have checked it before just to avoid any mistakes like this because u never know who might have kept something in there and had forgotten to retrieve it, it could even be a kid that left something in there, you never know with these things and also to show the customer that the bag is in good condition. But since the bag was not handed to the customer before the goods was found, the content of the bag belongs to the seller

If there were illegal drugs in the bag the customer or the owner of said bag would be accused as if it was theirs, no question. But now that money is found in the bag - and a large sum at that - it doesn't belong to the customer and instead belongs to the seller/trader 🤨 I feel like in this case, there is no way to track the real owner of the necklace and money; I doubt the seller knows who gave the bag up. Because the seller didn't do their due diligence in checking the bag first before selling it, the bag and its contents belong to the new owner.
No, the seller did her due diligence as we saw by first searching and emptying out the contents before handing the empty bag over right there in the store. That’s the usual process of purchase and the seller said they do that to every thing sold before packaging to deliver to the buyer’s hand. The trader was still in possession of the bag hence why they were checking pockets before handing it over because they sold the bag not its contents...the money/necklace is rightfully theirs.

I remembered a couple years ago, I donated clothes, shoes, jewellery, electrical, Bibles, books written by well known preachers and the Social Work books I used at University to qualify as. social worker. It was bags and bags of items, didn’t have the time to check the bags which she did before posting them and lo and behold, in one of the bags, she found American dollars. She brought the money back for me and I told her to keep it. I can’t remember how much but, it wasn’t a substantial amount as the shop owner found. It was enough to buy something on her travels to Ghanaian 🇬🇭. If she hadn’t found it, the person she gave the bag to then and they had found it, it would be theirs because the bag now belongs to them. I didn’t mind because what she was doing a Charitable cause, made me feel thankful. I donate to her Charity Foundation every year and others. God bless 🙏🏾❤️
I'm trying to put myself in both the customer and seller's shoes...the customer paid for the bag, not the contents found in it! Although the seller should have checked her bags before displaying them for sale. It was just unfortunate that when she checked the inside of the bag and pulled out the contents, the customer saw what was in there.
Buyer can see all she wants! It is not yet her bag. If the seller did not check, and handed over the bag, then it’s buyer’s luck and at her discretion to return, keep or split found money or not. The transaction was still in progress and the seller owns the contents of anything in her store. Who even goes into a store thinking that the seller could have first bought the product already used from somewhere else? The seller can claim they bought it new and left the money in there themselves (and that is even irrelevant). Seller owns the contents at that point

Why is the customer calling the police? No crime has been committed against her. The seller is supposed to check the inside of items she is selling, they do that in dept stores also. They money does not belong to the customer first off, it also doesn't belong to the seller either it belongs to the person the seller bought the bag/ bags from and it's up to that person to confront the seller to have it returned. So for now the seller lucked up not the customer who is just being greedy and wanting more than what she paid for. The customer bought the bag and not the contents of the bag.

We shouldn't have an " all or nothing" atritude to live peaceably in life. Fact: the money and necklace belong to the original Seller. In the event that the Seller couldn't be reached, the Trader inherits it. Fact: the Customer purchased the bag already which is now the Customer's property, lint and all😅. However neither the Trader nor the Customer earned that money or necklace so why not split the money between both of them and let the Trader keep the necklace and the 500 for discovering it. Fact: Neither of them would have gained a penny if it wasnt for the original Seller. I hate to see our sisters fight over the two "M's" ( Men and Money)

It could be intentional. The original owner probably wanted to bless someone. If the customer bought it before the seller found it, it belongs to the customer. If you bought a car from a dealership and found a necklace, would you return it to the dealership? No? Ok, then.
You can’t compare both scenarios. Dealership had every right to check their car first to see if they can find the necklace first and take it out before giving it to the buyer. As you yourself said, the buyer of the car would have driven off with their car and found the necklace later to keep it. That is fine but that’s not what happened here.

Yes I know how people forget to remove items/money. My dad is very forgetful. He’s always sending his nice clothing to the garment cleaners and leaves all kinds of stuff in his pockets including money.
It’s not the customers,just the bag. Money and jewelry should be turned over to authorities and see if rightful owners claims it ( with proof of ownership). If no one can rightfully claim it after a certain amount of time, then authorities use their judgment as to who gets it, shop owner or customer.

My response to this situation is quite late. After mulling it over, AND DISCUSSING the scenario with friends (who own and/or manage shops), we came to unanimous conclusion:
1. The shopkeeper/manager/owner (whatever) had a nasty attitude towards the customer.
2. As the shopkeeper/manager/owner (whatever) she has THE RIGHT to the contents of the bag - even if discovered after "the sale".
3. Ethics in place .... the shopkeeper/owner/manager - with the right attitude - could have averted such a scene, by acting calmly, and EXPLAINING her "ethics" to the customer.
4. The customer could have got a 2nd opinion from a lawyer (or such) of her situation.
5. We all agreed with your sentiments (the customer is not always right), that the shopkeeper has a right to the contents of the bag - they DO NOT belong to her.
We disagree with the comments that the contents of the bag belong to the customer. Unfortunately, the shopkeeper/owner/manager behaved rather badly and needs to correct herself.
Fumzi, the bag is okrika! Its practically IMPOSSIBLE to find out where the bag came from talkless of who owned it. Used bags are imported into Africa from all over Europe and the USA. In my view the seller should keep the money and necklace ( considering she bought the bag from the okrika merchant who imported the bale of assorted used items) and transported it to her shop at her own expense.The customer paid N4k for a bag, so how come she gets N1.7M. No, that sounds odd. Worst case they can split it, but the customer is acting so nasty. The seller should " no gree for anybody " this 2024!

No one has the right to tell the store owner when, how or where to prep or search to clean out the contents of her goods to be sold. It is at her discretion. No one owns anything till it has been handed over and they have left the store.

I completely agree with you! The transaction was not completed because they are still in her store. If she had given the bag to buyer without first searching and emptying out the contents (like the original owner did), then contents become the buyer’s own . After all, I and (most people) wouldn’t think someone else owned the bag before the seller/owner.
Similar situation happened in a cold store/ poissonerie. A customer bought a big fish then told the store keeper to help slice the fish in pieces, a red plastic bag came out from the stomach of the fish , a huge sum of money, and was a serious struggle btw the buyer and the seller.
My opinion- buyer owns the money, but they should share the money for the sake of piece. Or send it to me...😅

If it was just paper/stuffing, the customer would not have cared if the seller removed it and discarded it. There would not have been a thought about it from the customer if it was not valuable.
On the other hand, if it is not customary for the seller to remove whatever is in the purse and it is sold as is for the customer to remove the stuffing from the bag, then whatever is in the purse should belong to the customer.
Now, the mystery is, how that purse with money and a personal item got to that seller unless the item was stolen to begin with and got sold to the seller. Whoever it belongs to originally would also have a hard time proving that the necklace and the money was theirs.
This happened to me, I.have lost my. green card I definitely remembered that I forgot it in a dress I have bought at H and M, I have return the dress, so the card is gone ...

If i was the customer, i would not have fought for it and just quietly bought the bag. If the seller tracks the previous owner to return the items or not has nothing to do with me. That transaction took place between them.

Coming to this situation, I think the trader can keep the money, because had she searched her bags earlier. she would have gotten it in the first place. Its neither hers nor the buyers

Legally, the contents of the bag belong to the person who purchased it. Think of a yard sale or mystery storage - once money exchanged hands for the bag, it belongs to the purchaser and its contents of it belongs to her.
If the money didn’t exchange hands (fair exchange), it still belongs to the owner
Obviously the money belongs to the first person who sold this to the seller.
Spending stolen money would come back to bite you one way or the other. It could demolish your life on the long term.
Once the money has been exchanged for the merchandise the sale is complete. The fair thing to do was for the store owner/seller to keep the jewelry and split the money with the new owner/buyer. Both parties should have then walked away happy.

My first argument is that the term “this” bag exists as purely verbal. Eg. All that’s needed is the mutual understanding of a specific style of bag that is being purchased. However, what if the seller has more than one of that bag in stock? The seller is at liberty to provide “any” of that specific style of bag. The customer could be paying for the bag in the sellers hand or “this bag” (another bag of that same style in the stock room).
My second argument is that just because the customer has paid for the bag it doesn’t mean they have paid for the items inside of it. For example if you purchased a Gucci bag in store and decided you wanted it gift wrapped after. If the sales assist where to find a small Gucci purse placed inside of it, would they let you keep it because you purchased the bag? No. You’ve paid for the bag (fabric surrounding the item), not the item inside of it.
My third argument is that the verdict also rests in the ambiguity of place, possession , and time. Say for example the item has been placed in the customer’s hand (confirming “this bag” and taking it out of the purely verbal sense), the customer had even walked out of the store and discovered the money afterwards….then the argument could be made that it belongs to the customer.
Morally I feel it belongs to the seller, simply based off of the fact the she was selling the “bag” and only received payment for the monetary value of that bag. The items being inside was a mistake, and based on my argument of time and physical possession, seeing as the seller is the one who initially acquired the bag and has had possession of that bag, the items inside of it belong to her.
Different scenarios. Your check amount is specified and accounted for. Error not returned will only cause a deduction from the checking account affiliated.
The problem came once the transaction occurred between shop and customer. If the sales person did their job and diligence price to accepting the cash from the customer, there would have been nothing to discuss. Once “payment transaction” occurred the bag and all contents in this “2nd hand bag” belongs to is rightful purchaser. Again, that’s possibly acceptable in that country but at least in the U.S. there are courts and laws that make what occurred arguable.
Seller keeps the money and cash and give the customer the bag. Fumi you are right, it belongs to the first seller.

What??!! I am surprised with some of the comments. LOL and laughing bc I believe it is a cultural thing. When my mom passed, we gifted & donated alot of her clothes. I am the only girl of 3, so her traditional silk garments, her jewelry, & a few luxury bags I kept for keepsake. It still smells like her. But I made sure to check all the zippers & pockets & check it over & over again. In one of her bag, I found cash & gold. Now, it could've belonged to me, but I gave that to my father. Moral of the story... check everything & check it again. It sure does not belong to the "customer" and it belongs to the trader/vendor bc she needs that $$$ more than that "client." It is her livelihood. However, in this case they could've split it & both walked away happy. But I would love to know if the authorities were ever called 😆😅🤣😂

If this was taken to court a trier of fact would say the seller was wrong and the purchaser was entitled to the contents of the bag which she already paid for. I personally would have tracked down the previous owner and returned the money and necklace.
