id like for this to get added to, force the squatters to make restitution, force them to learn a trade they can get work at, like carpentry or something, and eventually be able to build or afford a place legally, and leave them better than when they first get arrested for squatting.

That’s not how the law works. With that logic all the people in jail for marijuana in states that have legalized should be out. Youre held accountable for the laws that were the law when you broke them.

They need to adopt a bill that is EXACTLY like the one that passed unanimously in Florida that makes the squatter guilty of trespassing and a felony for damaging the property as well as using a fake lease.
yes the fake lease portion is the most important part of the loophole that needs to be closed , otherwise all the current issues they're having will just continue , it only take 2 dollars and 15 minutes to go down to a public library and print out a fake leasing agreement.

@@chavvy9074 In reality yes, a squatter is a prolonged trespasser but to lawfully remove them they must be evicted just like a landlord/tenant civil case would be handled. The police won't remove them citing "it's a civil matter".
New York is insane to allow only 30 days for squatters rights.
Ohio for comparison takes 21 *YEARS* of the person living in a property, paying utilities and having no contact from the property owner to invoke squatters rights. Otherwise they're considered Trespassers that the police can remove, worst case is the squatter shows a fake "lease" to the police, police say it's a civil matter and you have to evict them, which takes only 30 days then the squatters are removed by court bailiffs and the sheriffs

The purpose of "squatter's rights" was so that, if you set out into the wilderness and establish a homestead, the government cannot then later evict you from that land without due process of law. It has _nothing_ to do whatsoever with houses that have been "abandoned" when there is a clear record of who the property owner is.

The thing is it wasn’t just “Wilderness”. It was inhabited by Native Americans and the government actually benefited with having squatters as cannon fodder so that if Natives contested the squatting then the US would use it as an excuse to break treaties and seize even more territory from tribal lands either by military force or bureaucracy.
Squatter's rights do apply to abandoned properties but in most states the property has to be abandoned for many years. If the property owner sets foot on the property it resets the clock.

Homeowners should never have to take these criminals to court just to get them out of their property….they should be arrested right away for trespassing and unlawful entry….especially if they won’t leave right away. These laws are actually attacking Tenants rights, squatters rights is a whole different thing that says if you spent over a decade improving and maintaining property someone who abandoned that property, or their kids, can't just come and take it from you, there are cases where a home was illegally sold 80 years ago but squatters rights protect the tenant in those cases.
These laws are written to circumvent the eviction process instead of streamlining it or funding it. The end result will be that landlords can remove legal tenants on the spot.
Give them(squatters) the vacant addresses of the politicians and police. After they personally suffer, changes will be made, hopefully at the federal level and not just state.

It’s amazing how many people want to demonstrate how little they know about the law and how they want to end up in legal trouble worse than the people who are screwing them over.
If you get some professional squatters and you try to do something illegal to evict them. Not only will they stay there, but you will end up paying the money and possibly paying an attorney money and still have to go through the courts to evict them.
Last I knew, breaking into ANY structure, was a crime.

My buddy had a simalar problem they requested him pay them 10k each for them to leave lucky for him he check on the property everyother day and was able to provide to the responding officers video of them breaking in and changing the luck as well as audio from them demanding money for him to leave.

Florida just passed a good law to fix this mess. New York needs to copy and paste the law as bill and pass it.

The issue is: How did the original law get so twisted that squatters had more rights than the owner. AND now we need another law just to protect the owners' rights? Unbelievable how far we have gone down the rabbit hole.

Best solution I read was where somebody rented it to a friend had the documents for proof of a rent agreement and his friend went to the Police and said he had people trespassing and the home he was renting and they were removed
yes somebody else did something similar. his mother had a house that squatters took over and she couldn't get them out. So he made her draw up a rental lease making him the new legal tenant and then he could call the cops and say that there were people trespassing in his house. So basically, a rent tenant has more rights than the property owner.
There are ways to do this, landlords are just lazy.

Proactve thinking, owners register their vacant property with local law enforcement. Anyone entering that home without prior authorization is arrested for criminal trespassing.

You can take over someone's house and you just have to say you have been there 30 days. And the fact that you can't turn off their utilities to at least have them pay for that, is outrageous.
They have to pay the utilities in order to qualify for adverse possession.

I have to think this is all due to the failure of legislature to realize how slow the court system is So much of the NYC legislature is based around the idea of 30 days. Correct within 30 days any infractions garnered or face massive civil penalties. But the bueracracy to get anything done in NYC makes it impossible to get anything done in 30 days. I have no problem giving strong tenant protections if the courts were speedy and allowed landlords the ability to get the obviously guilty ones out in a couple of months. Squatters for example are 100% obvious outcome cases. The squatter will eventually have to leave. But instead of 2 months, they can stay there rent free for 2 years. Waiting months between each hearing, and allowing people to delay again and again for another hearing is a completely broken system.
I remember the story a year and a half ago where squatters sat in a home in Brooklyn for years during the pandemic. The owners tried removing them the best they could using the legal system. The city meanwhile slapped them with $370k in civil fines for all the violations on the property caused by the squatters! The amount of injustice is unbelievable.
The original law was designed to protect ppl with a "legitimate" lease, not a fraudulent lease. There's the letter of the law & the spirit of the law. So why can't judges exercise common sense to fix this?

There is a difference between a renter and a squatter. Many break into homes and put up shop, some even steal places. It's ridiculous that victims have to loose thousands of dollars and time.

If a property is actually "abandoned," it should go to a government entity (the state, city or county), which then determines what to do with the property.
We need this law in California
Squatters who claim to be tennants should be obliged to provide a copy of a lease and rental agreement. If they don't they should be arrest for false official statement.
They provide fake leases. The police are not going to take time to figure out what is real or fake.

The entire USA should have a law that if moves into a home without permission can be arrested. If the home is vacant and the owner did not authorize the rental agreement or sale of the home. Those people should not have the rights a tenant does. Especially since they don’t pay rent or utilities

Police were called out to investigate a break-in, criminal trespass, or unlawful occupation. Intentionally misleading law enforcement officials by providing false statements or reports, especially with the aim of deceit, is, at the least, a misdemeanor. Once these criminals are shown to have had no right to possession and are removed, why are they not charged with impeding an official investigation, as well as theft? There are probably dozens of charges that could be applied. Destruction of property, receipt of stolen goods .... How about falsification of government documents, through claiming this as their address on driver's license, tax returns, welfare benefits?

This is necessary, but it's also not enough. Tenant laws are extremely lopsided and unfair to owners and we all know this.
If I own a property, no judge should be able to tell me that I have to allow anyone to remain on my property for free for any period of time. The squatter problem is a result of silly laws such as this.
Florida just passed a bill to kill squatter rights. if they can do it, NY damn sure needs to get ahead of this.
Illegal squatters (scammers) have abused this privilege. If a building or house is abandoned, no electricity or utilities, decent squatters have made the place livable according to law - and it’s usually years before they can claim ownership, in some states up to 30 years. But 30 days??? That’s insane. I’m glad the laws are finally protecting homeowners instead of the scammers.
This is why the 2nd amendment and large aggressive dogs to protect your property.

First i was mad at the squatter, then turned my anger to the police. Then someone told me, the police didnt want to get sued by squatter. Then i turned to politicians. Why the hell did you make this law.
Imagine paying for a car, and someone then using it against your permission, and law enforcement cannot do anything about it. I see no difference in regards to home and squatters. What right they have if they do not pay for the property?
The cops were in the wrong the guy had no proof of renting the house.. He left the house and then kicked the door in.
The 30 day rule is only if the person is living in your house while you live there.
A lot of squatters show fake leases and the police can't do anything other than refer them to the DA office to prove that the lease is fake. But they just allow people to move into empty houses. And we have seen people go on vacation come home and someone moved into their house. They have to evict them to be able to live in their own house.
NEWCOMERS are going to catch on and people will come home from work and find someone else living there.

They are already on Tiktok giving instructions on how to take over other people's houses. the other thing about squatters is that the law allows them to make a legal claim of ownership of your property, which means they are no longer trespassers, and if they can drag the legal battle out long enough while living there, they will legally 100% own your property.
@@anastasia10017 ridiculous I would advise to utilize a house alarm that contacts the police. I love to see how they convince the police that they have a lease and just rented the house.
I have seen stories of people going out for the day and come back and the locks are changed. There are people living in the house. The police tell the owner sorry you have to take them to court. Meanwhile you can see the photos of the woman who owns the house still up. So a couple of days later when that person left the house. The owner and neighbors broke in removed the squatter stuff. They changed the locks and did the same thing to the squatter. And the cops told the squatters the same thing go to court.
If there is a state institution on cars, drivers licenses, auto insurance, etc (DMV) then why not have one for homes and rental properties too? Why can't police arrive on scene when call, punch up the home's address in their computers and see who the owner is and or if they are renting it or any units, and to whom? Buying a home or moving? You have 30 days to register as the new owner or tenant with proof on hand, or risks continuous fines until you do. The police should be able to verify ownership, residency, and trespassing on the spot. And then the courts can get involved later to render punishment and or resolve any disputes. Just saying.

Anytime you break into a house for a roof over your head, and go years without paying rent and utilities, that’s how long you should be in jail for. They’ll think twice of doing it again, maybe. Don’t try and take what is not yours. Something people should have learned at the age of 5.

After seeing Actual Justice Warrior's video on the matter it's about dang time that there was, but also the local politicians that represent that area need to be contacted and demand that they be against squatters' rights for good after this situation. I don’t know what law changed to allow squatters to have rights in this country, but traditionally in historically attendant, is someone who has a verbal or a written agreement to use said space and they pay for the right to use it. That is what makes them a tenant. Moving in and not paying rent does not make them a tenant. It makes them a thief. They are using space someone else owns without paying for it, or even agreeing to live or use subspace. It goes against every business practice this country has devised to allow squatters to have rights, just because they inhabit a space. What is to stop any tenant from not paying rent and telling the landlord well I have rights. What rights do you have without document or a verbal conversation and the exchange of money. Core business principles. I’ve been a landlord where people did not pay rent. I could evict them in three days for nonpayment. Why does squatters have more rights than the people owning the property? A woman was just arrested after inheriting a home that was worth $1 million that had squatters in it. She wasn’t the squatter, she was the owner and she was arrested. How does this make any sense?

If anyone to wants to be re elected as Governor it would behoove them to change this law. How hard is it to make a law that says you must have a signed lease with the owner and stamped by a notary public otherwise you are a squatter or trespassing. Squatters should have to at a fine of up to $5,000 or more depending on damages and how much the owner has been affected. It’s not hard they just need to do it.
Bottom line no lease signed by owner and stamped by notary, you must vacate.

I really dont get the US. If a person/company is renting there is always a lease. Which is a legal document. No legal document, no rights. This is actually an easy fix. Its called depending on where you live, if you are going to rent something out, you give a copy with your local city, district, country etc a copy of that lease. We have to file permits all the time, even to build a shed, so why not give a copy of rent lease for the property. Taking to court etc cuase more problems, as its lengthy and during that time those squatters are going to ruin and tear that house up.
There needs to be a felony charge for squatting on someone’s private home.

The illegal migrants on Tiktok and IG are giving instructions on how to take over houses. They can do "repairs" to the house to strengthen their claim and drag and derail the legal process out for years and years until they can claim the property as theirs. Just a normal boring squatter case takes about 2-3 years to go through civil court to get the squatters out and there are no consequences for the squatters. The squatters know they have you over a barrel and that it is costing you money and they will leave if you pay them big bucks. So you are left with pay lawyers big bucks to get the squatters out or pay the squatters big bucks to get them to leave. And there are no consequences for the squatters - they just move to the next house and repeat the scenario. A woman here has squatters in her house, using her furniture and subletting out rooms and she changed the locks on the house and she is the one handcuffed and arrested by the cops. Another couple here bought a house and the squatters moved in before they could even move in and now it has been over a year of legal fees and they still can't get rid of them.
