Not sure what point you think you're making - if it's certified to be used open, it can be used open. You see police riding like this _a lot._ But if you're injured purely as a result of the helmet being open, and it can be _proven_ that you contributed, you're partly responsible. But as the guy here says - a really hard thing to prove.
There are 2 types of flips ups,ones you can ride with in flipped up mode marked "P/J" on the label and ones you can't marked with "P" on the label. Ride around with a "P" on your head flipped up you are riding illegally.Have a crash with a "P" on flipped up then i'd imagine it gets very messy in court. A "P/J" on your head flipped up you are golden in any scenario because your riding legally with the correct safety gear and using it in the manner for which it was designed,if not then anyone who chooses an open face over a full face could be dragged to court saying they contributed to their own injuries because of their helmet choice.
What about those riders who choose to buy and wear an open face or pudding basin style of helmet? Surely the same could be said to them if they end up with injuries to their face? Why didn't they buy/wear a full face helmet in the first place??
Is it unlawful to wear a full face helmet without the chin strap fastened, as I was stopped for this many years ago but most people seemed to think it was just an over zealous copper.
did the visor get scratched during the collision . who knows , but if the rider said it was , they incriminated themselves. Flip visor up and has a collision which is the fault of the car driver, its irrelevant as the collision was the fault of the driver and any injuries that follow are the result of the collision which should have been avoided.
Except that a lot of the modular helmets are certified to be used in the flipped up mode, so where does that leave you?
