My prompts resulted in very beautiful illustrations when I first signed up but now after 8months they look like nothing even when using the same version. I've had long discussions with numerous people (artists, fellow writers, and graphic designers). it was always going to tough for artists to win their lawsuits based on how it was written. Even as an author, I find that trying to restrict what AI can be trained on is similar to trying to prevent students from not analyzing and learning from your work. As long as it doesn't spit out an exact copy of something then it doesn't breach any copyright laws. If you work within any of the creative industries learning and understanding how copyright works is extremely important. Just like the AI issues that the screen actors guild is dealing with. If they understood copyright law then they would understand that production studios can't use a person's likeness for commercial profit without their consent. In regards to written and artistic works, you can't copyright style so as long as it doesn't produce a visual duplicate of a written or art piece of work then copyright claims have no legal foundation. I've constantly told people that if they want to try to win then they need to change their argument.

    • @WholesaleTed
      @WholesaleTed  6 місяців тому +3

      Some good points. I would be interested in hearing arguments that laws in-general should be modified or updated due to AI (also interested in hearing arguments opposite to that as well) but based on CURRENT laws, there doesn't seem to be anything that Stable Diffusion/Midjourney are legally doing wrong.

    • @allnitedj72
      @allnitedj72 6 місяців тому +5

      @@WholesaleTed I believe that the first thing that you have to argue is how training an AI model (that does not store the training images) differs from an art student buying books of art, taking pictures at art galleries, looking up art through google and studying them to learn how to draw or paint.
      I should add that changing the law to allow art/writing styles to be copyrighted would destroy the creative community and make it impossible for thousands of artists to earn any decent income.

    • @federicoaschieri
      @federicoaschieri 6 місяців тому +1

      @@allnitedj72 Really interesting points. I think AI models do infringe copyright, because their training uses a literal copy of a copyrighted work to produce a product, the AI software, which is then sold or rented. This is very different from a student who just absorbs their own interpretation of the work of art for their own cognitive system, which is not a *good* that you sell or rent.
      If I’m right, AI companies could only sell already generated images, without allowing users to use the software themselves. It remains open the question as to whether they could be allowed to exploit economically the software output. There is mathematical evidence that AI has memory, and that you can extract back information. Indeed you can ask for a photo realistic rendition of a famous monument or landscape and you can clearly recognize it. So the system must have a literal memory of it. But for these arguments you would need a systematic scientific study.

    When painting for Etsy, is it necessary to give frame space, for example when painting a 24*36* painting? Some pictures on Etsy have a frame gap and some do not. If so, how many inches should be given? Is it possible to do it without giving any frame space? I added 2 inches from one side, is that a problem?

    I have uploaded my own images and fought with MJ to recreate them for hours and still couldn't get it close enough. We all trained by using reference images. I still paint using reference images many years later. As a professional artist, I understand the concerns of other artists, but this lawsuit isn't going anywhere. Time would be better spend either working with AI, perhaps incorporating it into their work, or learning to work around it by creating art that can't be replicated by AI. I do both.

    • @GiggaVega
      @GiggaVega 6 місяців тому

      Hey Veronica, I'm a traditional artist as well, mostly drawing, photography, videography, writing, graphic design. I have also used reference images , we all have. I have also used MJ since it came out & I have been paying for a private account where nobody can see what I create and my prompts.
      Let's be honest, most people that us Ai art apps are NOT artistically inclined at all & they all design the most static Same-y static images & it's hilarious. Best of all they are so uninspired that they use apps like Chat GPT to do their creative prompting for them lol & it's still generic garbage.
      Artists have nothing to fear from people using Ai tools.
      I have seen actually great stuff from actual artists. I use it to illustrate my short stories that are generally cosmic horror, Lovecraftian inspiration.
      If you create enough with it, an actual artist can bend Midjourney to their artistic will and have their own style, but it requires a lot of time & I also believe having a private account trains the tool to better create for you. I have consistent models for my female characters that replicate the same woman which the right words.
      Great luck & keep creating & designing. Oh yeah, that's what I call it, I say my Ai stuff is designed by me and created by MJ, because I didn't create the art it puts out, I only wrote my short story.

    My partner is an artist and he's very frustrated to see people make easy money by selling AI art. He's lost several potential customers because they only want something quick and easy and cheap so who would want to pay a lot of money for someone's hard work?
    I get it, I really do. You've learned and worked for years just so someone else can use your work to create cheap images to sell for a penny. He's fine with private use, no issues there. But, spending hours on your art and then someone comes along and earns money through your hard work is a bit of a slap in the face.

    • @allnitedj72
      @allnitedj72 6 місяців тому +1

      I can understand his feelings on this. But to play a little devils advocate. Is he fine with other artists studying his work? Is he fine with other artists creating works that are similar to his art style? That's the base underlying question here. If Midjourney doesn't store the art that its trained on (which as stated is impossible as the largest Stable diffusion models are only about 7-9 gb in size), then what argument is there that training an AI is different than new art students studying hundreds of artists' work? Is it a question of the artist not wanting someone to duplicate their style? If you know that the current arguments for this don't work (because the current arguments don't prove anything illegal) what other arguments can you use?
      And just to throw this out there as someone who has paid for commission artwork before, commissioned art isn't cheap. And you typically do get what you pay for (i.e. lower commission costs = lower quality of art). This has typically put commissioned art out of the reach of most people and out of reach of most start up businesses. So what is the argument behind restricting one person/businesses ability to progress in their endeavors just because it might impact someone else? AI has a lot of weaknesses and short comings. It can be very difficult to generate specifically formatted images. Its great a generalization or if you don't know exactly what you want, but if you have a need for a very specific pose or setting or background your playing Vegas odds on getting AI to generate it.
      Please don't take what I said negatively. I'm just trying to open up the conversation. Decisions made now without intelligent discourse and considering the ramifications could have huge negative impacts later.

      @@allnitedj72 @allnitedj72 Studying someone's art as practice is a widely accepted thing in the art circle. Earning money through pretending it's yours, or selling it without permission isn't.
      I won't argue about the whole "AI is bad" thing because I don't disagree with its use. I just disagree with people using it to make money.
      Asking permission is very simple. Collaborating with artists to create AI art should be quite easy, there should definitely be some that can be talked to.
      I'll say it again. I don't disagree with AI art used for personal or private use. I disagree with using it without consent to make money.

    I know about copyright law and have fought for years in federal court. Using the decision based on my case Gordon v McGinley, there is no way artists will win against these type of manifestation and depictions in AI. In my case, the defendant had 100% access to my work and even the judge in the appellate court said it was so similar he could not tell the difference but you can be sure the bigger company wins and these artists have to shut up and take it now because no one cared when it happened to me over 300 times.

      Your target market for that calendar is unlikely to be Europe, it would be the USA. @@WholesaleTed🙋‍♀️Hi Sarah, love your channel, as you are always very informative and present all your info so well.
      As far as something like a calendar goes, I would think that there must be at least one POD in Europe that offers them, and so shipping with in Europe would then be affordable.

    • @WholesaleTed
      @WholesaleTed  6 місяців тому +1

      It's actually not that surprising that there is no Europe-based POD provider that is printing calendars like this yet. The selection of products in Europe is always going to be much smaller.
      It is very expensive for POD providers to exist in Europe, compared to the USA, because the USA is set up as a whole for manufacturing.
      There are 2 countries in the world that dominate manufacturing: the USA & China. Not only is this due to their size, but it's also due to a range of different investments/policies that the countries have in-place, to support & encourage manufacturing.
      No country in Europe has this support in-place, making it much harder & more expensive to set up manufacturing there, which is why the selection of Europe-made (or Europe-printed) products is much less than what is available in the USA (and China).
      As a POD company, you have a much wider range of products available to you if you decide to become a USA-first store, which is why I always recommend doing that, rather than focusing on Europe. I don't really see any good advantage to picking Europe over the USA. It makes no difference to you, the store, given where you're physically based is irrelevant - all that matters is where your POD provider is based!

I knew it’s a tool can absolutely generate art and sell it (if you know how, in a smart way of using it). But it felt wrong. So now I’m learning creating art without AI, and designing my own logos with satisfaction. This isn't going to work. You are trying to copyright styles of artistic approach and ideas that people have had. Neither of those have been able to be protected in the past so, even if there was some success in this case, I think it would be challenged.
      For example the people who created the styles of various artistic movements were unable to copyright it, that is why images in pop-art style (just one example) are freely available even though particular works by artists are still within copyright. Keep individual images far enough away from the original and it doesn't matter that the style is instantly recognizable.
      The same with authors. When an author creates a world (JK Rowling springs to mind) they cannot stop derivative wannabes from writing additional stories in their worlds and capitalizing on the author's ideas.
      I wish it was otherwise, in a way. I have had a great idea that I'm taking to market in 2024 (I've done market research) and I already know that I'm going to be copied relentlessly once it's out there and there's nothing I can do about it.

      You are going to have to start by proving how a machine AI looking at millions of images to produce images which are not significantly like any one single image is any different from an art student looking at hundreds of images to produce images which are not significantly like any one single image.
      Yes AI can "look" at millions of images in the time it takes a human to look at mere tens or hundreds. Yes AI is going to grasp certain fundamentals almost instantly and is not going to require the hours of producing "learning" art. However, what AI will not be able to do is come up with its own ideas or uses. Humans will quite rapidly work out ways to use AI as a tool in completely new ways - just like the camera never put the paint artist out of existence and digital cameras did not put photographers out of existence. There will be a new generation of artists that will use AI in ways the man on the street cannot match unless he spends hundreds of hours learning how to be at which point he is no longer the man on the street but one of the new artists.

    Lawsuits are all failing because in order to violate copyright laws, an AI would need to be able to create nearly identical pieces of existing work. They cannot... And an artists "style" is not copyrightable. Art is abstract and cannot be patented even. If I see a piece of art, like the style, and decide to make some art resembling it by hand, there are no laws to stop me. In as much the same, when AI learns art, it's not copying the art identically, nor even storing the art to it's memory; instead it picks up on line, shape, color, etc - aspects of art as a person would. It's just like reading a book and giving a summary of what you read. You consumed the words, you cannot relay them in entirety, rather your interpretation of a series of events. AI does the exact same. Lawsuits will continue to fail. Otherwise, they'll have to start suing school children for reading books and writing essays - claiming "derivative" and education will come to a complete halt 🤫 Bob Ross created 10 million other Bob Ross' don't forget 😅

All types of artistic content are surveyed by people all the time before they produce anything so wouldn't they actually be copying a rendition of someone else's work or an amalgamation of artistic concepts? Inspiration generated by another artist isn't copyright infringement but an adaptation of a style of work towards a whole new creation. AI using artworks for reference towards new creations is just a new development that artists are going to have to accept. The fact that AI can generate millions of images in an instant at anyone's request should be what concerns journeymen maestros as they are only able to produce work a single piece at a time.

      Its true. Legally speaking AI isn't doing anything against the law. If artists want to change the law then they need to change their argument and understand the repercussions.

    ai art is generated by information fed by users, the ai systems do not come up with anything new, images are scraped off the internet and trained the ai models, this is a fact accepted by stable diffusion and all others so do not take it as rumor and a surprise, meaning the art coming out resembles art and styles from artist and movies and so on because is not new or original, if the ai systems are not fed with info it will keep spiting out the same look and feels based on material scraped off the internet unethicaly bordering illegaly, that is why are all this lawsuits going on.

    • @WholesaleTed
      @WholesaleTed  6 місяців тому

      This lawsuit is showing that this assumption that AI art "scrapes" images is not true though. They do not scrape images or download them, and store, them, they simply look at images which people have made freely available online and it is not legal to open a freely available image, and then just look at it 🙏

    *Old school artists just need to accept the fact that their skills are no longer exclusive. Now anyone can produce the same stunning images... so they're gonna just have to deal with it*

      then they'll stop producing art. because no one wants to spend the whole day creating an image, only for an AI to generate the same one in 2 seconds. there's no point in creativity anymore.

    "Insane" news you say?
    Some actual insane news for all the Ai haters is the FACT that Shutterstock, a globally active stock photography copyright management company with 80,000 account holders, that manages their 300,000,000 images ( yes, I just said three hundred million images! ) recently admitted that they have been secretly selling access to these images to the Ai image creation development company - OpenAi since 2021.
    They have been illegally selling OpenAi access to the images without the image copyright holders permission or knowledge and passed none of the profits that they made, on to those account holders.
    OpenAi used these stolen images to train Dalle 3, their latest Ai image generator.
    Dalle 3 is now available to use to create Ai generated stock photography images on Shutterstocks website.
    Why are none of the Ai hating commentators talking about this biblical scale theft?

      Shutterstock announced the OpenAI deal months ago, back in July. It is legally within the TOS.

    "Artist" sue other "artist" for steal each other "art".
    Mean while Midjourney uses art and give it to the people so everyone can enjoy creating their own piece of art.
    I really do enjoy the Ai Art community more and more.

    Unless Zazzle bought the font, the did steal it.
    Just training something on your style, is not stealing. All artists use inspiration from other artists for hundreds of years.

    • @rltreasure

      Companies like Zazzle stole the copyright because they didn't make a license agreement with the artist to be used on a mulit user, commercial site. The font is sold to individual users, not to corporations to abscond with and make millions off someone else's artwork!

    I feel sorry for real artist with all these ai apps taking their jobs or revenue where people just type in prompts then add it to print on demand flooding the market with things that were created in under 10 minutes by a machine where artist would spend time on something :( for every 10 videos you mention using an AI art app, to be nice to artists you should do videos on how to find and hire them.

      @@WholesaleTed Yeaa, people don't have much of a leg to stand on with AI technology, don't stable diffusion look at images and learn from them? It doesn't really steal the art or store it right?

      Based on what they've presented in court, no. They use training data sets from LAISON, which is essentially just a text file/spreadsheet of billions of URLs. These URLs link to images which have been uploaded for free online. The AI then opens up these URLs, looks at the images - and that's it.

    That judge is a bastard. Going to trial means a long drawn out legal battle which will no doubt cost the the creator of the font, Nicky, tons of money to keep going.
