  • Nicolae Miu will be sentenced for his role in the Apple River stabbing on Wednesday, July 31. Miu was convicted on April 11 of first-degree reckless homicide in the killing of Isaac Schuman, four counts of first-degree recklessly endangering safety in the stabbings of A.J. Martin, Dante Carlson, Anthony "Tony" Carlson and Ryhley Mattison, and battery of Madison Coen on the Apple River on July 30, 2022. Miu faces up to 97 years in prison, but it's ultimately up to Judge Michael Waterman.

    No one won on this one. Parents of these entitled children. Teach your kids respect. You went after an elderly man. I think this whole case is bad all around these kids ruined two lives.

      Drunk trouble making punks ruined his life, surrounded him, called him names and hit him, pushed him down into the water, I'm sure he was in fear for his life, they put their hands and more on him, not the other way around, if these were good people they would of been helping this older man look for the phone not bully him and then attack him and push him down into the water, the jury and the judge was bias and his lawyers should of asked for a change of venue, this guy didn't have a chance, they already knew what they were giving him!!!

    This seems so unfair. That's a life sentence for him. Was there a criminal penalty for the bullies who instigated this situation? Because there should be.

      @@Ashley6 I see your point but I do actually wonder. This is a man who carried weapons around everywhere he went, he’s got a machete in his car even! The swiftness with which he concealed the weapon, shortcut to the exit, blatantly lied to the police, and very casually pretended to be unaware of anything going on is quite telling. Then his defense and his prison calls are of the same stuff and is indicative of a very specific and atypical mindset which is profoundly disturbing.
      I truly doubt that this was his first violent act. I’d bet that he has other victims and behaviors over the years but also clearly has a high IQ and has been successful in remaining undetected.
      I kinda struggle with the idea that the kids “started it.” I mean, yes they were obviously obnoxious jerks but it would never occur to me to go on a stabbing spree every time I came across a group of teenage a-holes.
      Oh yeah, sorry for the overly long response! 🤣 I’m a psychologist who used to work with offenders.

      @@Ceeshore I agree with you. The jury got it wrong. I don't think he was defended as well as he could be. It wasn't until the final argument today that he said anything worth saying. The judge was fair though.

      Yes, teasing definitely deserves murder. It's sad that you're still holding on to being teased so long ago. You believe if this man got away with it then that somehow is getting back at the ones who teased you, but that is simply avoiding the fact that you're an emotionally weak individual.

    I believe he should have got time served. Do you notice how most public places have a policy that those under 18 have to be with adult supervision? Why do you think that is? Because of the chaos they cause to get a good "tiktok" video, to go viral. That's what they were trying to do with this man. When is enough, enough? As an adult we are supposed to say nothing, we are supposed to be recorded and harassed without any actions taken, and we are supposed to let those under 18 (even a group) to lay their hands on you without being in fear and definitely do not defend yourself. We have to play our part of being an adult so these kids can get a viral video.

      I wouldn't say it's fair. He might as well have been convicted of first-degree murder and sentenced to life. He'll likely die in prison, given his age and health.
      It makes one wonder: would the jury have convicted him of reckless homicide if they knew this would be the outcome? It seemed almost certainly to be a compromise verdict, and it's not much of a compromise if the punishment is still tantamount to life in prison.

      @@Electiger-y5k The average life expectancy of a male in the U.S. is 73.2 as of 2023.
      Also, senility is not the only concern. He has a history of significant health problems, and you can see he's not doing well. I'd be very surprised if outlives his sentence.

    He was actually the victim to begin with. These high drunk youngsters called him a pedo with no reason. And started to attack him physically. Including slapping him on his face and pushing him repeatedly in the water. He stabbed them after he was mistreated by them. The jury lost their minds in this sad case. God is the true Judge these bullies will not get away with this.

    I commend this Judge for noting all of the wonderful things about this poor man. But DO NOT agree with his sentencing. This whole thing was just one big accident that should have never happened. Maybe if we had better control of our children, things like this wouldn’t happen. This poor man has been put through the wringer and does NOT deserve this. I pray for everyone involved. ❤

The fact he has a history of heart issues is concerning. I think probation would have been a reasonable option for a man like Miu. This guy is not your typical defendant and most definitely doesn't pose a threat to society or his inmates

    This man is dying in front of our eyes, he is irreparably broken. I wish to God he hadn’t had that knife in his pocket, I wish the young man had lived, but I cannot see how he will survive the sentence, sad/tragic all around.

    He was the one that weirdly approached the kids starting the incident, killed one, stabbed 5, lied, fled the scene, etc. So in my opinion: you never know what to expect from a baby’s butt or a judge’s head.

    A tragedy , the jury failed this man , this is a sad and horrible tragedy, if there was ever a self defense case!!!!! THIS Is it !!! My prayers are with the miu family, I'd like to know how it's ok to attack a man and hold him down , that's a crime against me miu , there are a whole group of people in my opinion who should be charged, shame on them, and I feel for the family of Issac , but it's not Mr .miu fault

    To anyone defending Miu the psychopath, you need to watch his testimony, the victims testimonies, the video they filmed of him instigating & punching the young girl first.
    Facts, he was looking at them underwater w his goggles on
    Mius friends told him NOT to approach the young kids as they'd think he was a pedophile
    His friends said NOT to look for their phone as they had insurance & didn't care
    Miu checked his pocket to ensure he had his knife PRIOR to approaching them (he planned to do harm prior to approaching them
    Miu ran up to their tube's grabbing their legs & rope
    The teens yelled at him several times telling him to get away, to leave them alone to go go go
    Miu had MANY opportunities to leave but stated he DIDNT
    Mius friends told Miu to leave them alone but he still didn't
    It was ONLY AFTER Miu approached the 2 teen girls hovering over them, they told him to leave telling him he's a predator that he initiated the fight by PUNCHING the girl in the face & throwing her back
    It was ONLY AFTER Miu started it that the girls guy friends pushed Miu back & punched him
    (Mind you Miu already pulled his knife out holding it at his side PRIOR to punching the girl in the face AND Miu had a SMIRK as he held his knife)
    When Miu stabbed AJ, he held the knife blade up and "gutted" him from intestines up to diaphragm
    He said he would have gotten more if he could have to have more "bellies up".
    Miu LIED about the entire event to his friends, wife, police who arrested him & to investigators. He said he heard kids yelling & kids being kids. He said he didn't see anyone hurt (as the psycho floated past the destruction he caused causally as if nothing happened)
    Before police arrested him. He'd put on a long sleeve shirt, sunglasses and hat to disguise himself trying to walk past the first cop he saw.
    NOT ONCE did Miu state he was Assaulted, that he was fearful or fighting for his life until he realized they had a video of the entire event. Prior to that he LIED stating the kids had knives & they threatened him with it. All a LIE. Then Miu said that he took the kids hand that was holding the knife and used the kids hand to stab the kid. All a LIE. His entire testimony he "couldn't remember ANYTHING" except his feelings of annoyance claiming he wasn't angry. His lies are so preposterous it's disgustingly laughable.
    The guy is a straight up psychopath & should have gotten 2nd degree murder. I don't believe he planned to do that necessarily PRIOR to going to Apple river, but per the facts of the case, it shows he intended to do significant damage or kill them prior to his approaching them (again checking his pocket to ensure he had his knife). Another thing as he approached the kids initially, he put his goggles in his mouth to have his hands free to grab the kids. Miu instigated this entire thing & Assaulted them first. He's a ticking time bomb.
    The police found a MACHETE in his vehicle...Mius own wife testified he carries it with him "in the case of a road rage incident"
    For anyone who is naive or uniformed of these cluster b sociopathic psychopathic personalities I highly recommend you research & study it and listen to every interview & video of this case so you will not become of victim of his type.
    They are nothing but hateful, vindictive, offensive, manipulative, spiteful dangerous individuals who feel ENTITLED to punish anyone who they feel offended by. Any normal person would simply walk away from any conflict escalating whatsoever. He gutted FIVE kids who told him to leave them alone numerous times.
    He should have gotten life in prison without parole. Please watch every video before making uniformed assumptions. I admit I too thought the kids started it & felt bad for him UNTIL I watched every video & interview. I then was disgusted by him. He is a walking evil being.I 💯 believe he lost weight to appear this feeble old man playing poor me victim (typical) of the real perpetrators. Notice how none of the real victims acted this way?! Not ONCE was he remorseful for the damage and death he caused UNTIL immediately prior to sentencing. Miu deserves to rot a long life in prison, I hope he never is released.

      I did and the reason why he lied is what he said people get convicted for self-defense, and what do you know they proved his point they convicted him. He was scared and didn't want to go to jail that's why he lied. Have you ever been in a fight in water? It is very very scary! He's getting pushed and hit endure in the water feeling like you're going to drown and you feel like someone can kill you at any second. I have fought in the water and I couldn't even imagine going through what he went through being jumped by all them people. I feel sorry for the guy he got wrongly convicted

    It was Mr. Miu against how many drunken teens? At one point, they tried to drown him. Mr. Miu had a knife for cutting the rope with the tubes, he took it out to defend himself. I wish the parents would parent better to show their children to be respectful especially to elders. I am extremely sad for Mr. Miu, he is a good citizen, God Bless him🙏🏼 And he did walk away!!! It should have been time served only

      Yes, very scary but he also did not one thing to try and de-escalate.

    This is wrong on ALL LEVELS! When is it ok to be bullied by teens and you defend yourself and ur the bad guy? No I DO NOT agree with his actions. Best thing is to walk away and he should know this being an adult, but sometimes it’s hard to do bc the actions of others. I hate it for the one killed and those hurt, but ALL were at fault. Not just one.

    I am glad this judge took into account who he really was a person, not who he was forced to be on July 30th, 2022. It is a shame he lost everything over a bunch of losers who couldn't handle their alcohol and picked a "weak target" to prey on. May they all find accountability in their lives for the roles they played in this tragedy. 20 years was way below the minimum for the crime. For once, I feel the most sympathy for the defendant

    Did you guys forget Nicolae being a weirdo around the kids’ tubes searching for his friend’s cell phone? He thought for sure they had the phone so he was circling them and at one point charged at them. His odd behavior started the entire interaction.
    Nobody should’ve died that day. Crazy.

      Did you forget he was also physically attacked almost to the point of drowning before he attacked? I'm guessing so. Everyone that's against Nicolae seems to neglect to mention those FACTS. They also neglect to mention that his conduct was perfectly legal before being attacked in such a way that could have killed him. Be careful you don't end up at the end of someone else's knife with your logic. I have a feeling you probably will.

      Yes. It is so sad. The prosecutor here, is not telling the whole truth. How it went.
      I would have feared for my life as well, surrounded by so many...
      One thing though: he should have told the truth. Police interview. I think, that is, what made the jury give this verdict.
      For me, it was, self defense....but also could have been prevented. They all made stupid decisions. So difficult this.

      But he didn't walk away. Instead he killed a 17 year old boy and tried to kill 4 others. He had the knife, he pulled the knife and he used the knife. I think 20 years is a fair sentence for him. The family of Issac got a life without their child.

      I saw this trial, as a learning proces for my own children. For my son: never mock and taunt an older gentleman for nothing. And for my daughter: never go screaming into somebody's face, while you don't know the situation. The second group, should have said to the boysgroup: "move along boys, let this man alone". Instead of believing the childmolester/ r...ist story. Told my kids: Never ever, 13 against 1.
      But well, indeed Isaac being my son: I would have wanted Nicolae also in prison.

    The 'smirking' I'm really so sick of hearing about the 'smirking'... That is, clearly, the 'smile' someone has when they're paralyzed with fear. ' People smile nervously. It's a forced smile to hide discomfort. "Nervous grin' is a very common expression.
    The 'weapon'....People who have never feared for their life don't understand... Your hands are not enough of a defense... You *will* look for a weapon (a rock, a stick, a frying pan, a pen, a bottle, or the knife you happen to have in your pocket). 'Survival mode' is also a very common expression.
    The 'charging'....He did NOT 'charge' the group... He rushed over because for a moment he thought they were holding a 'found phone'. WHY would these young men be filming him? Had they not been filming him, he would've had no reason to bound through hip-deep water... And, yes, *anyone* moving through water quickly, moves like we saw him moving in the video.
    I heard a lot about what the Miu *should've* done differently, and the jury was clear about that. However, it appears that a lot of the frustration in the public is that these 'group members' (BOTH 'groups') just don't seem to realize that there were MANY things they *should've* done differently. I know young people suffered, so this will sound harsh, but had they just left Miu alone, Miu would've just kept snorkeling.

    Fair sentence! I just hope that the parents of those kids, as well as the kids (who I believe, are now legal adults) understand the consequences of their actions. It wasn't just Nicolae who was behaving poorly that day he was just the one who made a very bad decision. Those kids could just as easily walked away as well as the woman who chose to insert herself into the situation. I always found it weird that a grown-ass woman decided to jump in and stick up for a group kids in their late-teens who clearly outnumbered Nicolae. They were laughing, drinking and swearing and she somehow decided they needed help. Just plain weird, creepy behaviour on her part and I hope she has learned a lesson from this.

    A very unfortunate chain of events, poor decisions and a lack of attempt to avoid physical violence. The legal and criminal system is always in question and it is very difficult to reach a fair verdict in the end. The fact is that the anger, loss and grief could have been avoided if everyone involved in this terrible thing had stopped for a moment, thought about it and tried to act sensibly. Because everything can turn really bad in a split second.

      True but it did happen. He decided to use that knife. Even before that he went over to floats of teenagers and touched their legs. M may be innocent on his part, but it’s odd and the group reacted. Yes, they were immature and obnoxious but a normal adult does not react by staying there and stabbing them. I don’t think he is a monster, but he has obvious has issues as his actions were not appropriate. I find it disturbing his many are just hateful towards the group of young people and think because they were rude they deserved to die.

    I have floated the Apple River , there are always loud mouths on every float, I was one of them way back in the day, and yes these young people should of just shut up, and he should of walked away. But booze fueled outburst don't go that way. But he did not need to stab them, then lie about it over and over, blaming them for having the knife. etc., He needs to serve time, if this was my child I would not be happy with anything less then a conviction and serving time. It is easy to look from the outside in, but I believe the Jury made the right decision. Just my opinion don't rip my head off.

    Do I think he think Nik should serve some time in prison, absolutely, yes. He used unreasonable measures, lied and definitely should have made better decisions. But if the mouthy, looking for trouble gang, had floated on by, none of this would have happened. I’d love to have heard about their behaviour earlier in the day, because I very much doubt Nik was the first person they tried goading.

    The law is absolutely clear. What concerns me is that many of the people writing comments on UA-cam: 1) don't know the law, and 2) probably have access to lethal force, typically in the form of firearms. What's the law? You cannot use lethal force unless it could be reasonably concluded that you or someone was confronting the imminent danger of loss of life or... great bodily harm. That condition was not met when Mr. Miu chose to use lethal force. Mr. Miu was not facing a lethal threat. You can't knife people that you get into a shoving match or argument with. Twenty years is light sentence for the crime that Mr. Miu committed. The fact that people don't grasp these basic, incontrovertible facts and defend murder as self-defense is bonkers. I would say that most of these people have absolutely no idea what a real self-defense situation is like. Me? I do. I got shot (just missed my heart) when I was 24 in an attempted holdup and wound up driving myself to Martin Luther King, Jr. Hospital in South Central Los Angeles. I almost died. I've had to defend myself from the Crips, the Bounty Hunters, and the Nazi cell inside the LA Firestone Sheriff's Department. You people have no idea what self-defense against real (not imagined) thugs is like. Miu murdered someone's teenage son and gutted several others with his knife. And for what? Not a damn thing. You people should be ashamed of yourselves.

    This looks like mistrial.! Today the first time I came across this case. And then I watched some of the videos. I work Vegas behind the bar from 1988 till 2007. This guy have more than two beers just look at his eyes and body language. He’s not lying He cannot recall crap because he was so drunk. His wife and friends covering up for him because in their mind consequences on all of them. Why don’t you ask any police officers who do and perform traffic DUI will tell you I am right. Are we leaving in a banana Republic? children are not always right and I’m not saying he’s innocent. And knowing European culture when they ask him what he doing he probably did said he looking for a little girls by being sarcastic.

    The sentence was fair. Here is a case of entitled kids (adults, really) and an aging man who would have gotten vigilante justice sooner or later. He probably fantasized about this kind of situation, and he finally got it. The machete in the car was pretty telling. Road rage? Usually you would call 911. Maybe pepper spray? A machete? He likely had been humiliated in the past and was not going to take it anymore. He instigated, grabbed the rafts, smirked and hid the knife. Also, take away the alcohol and this would have been a very different scene.

    It was self defense. They were acting like bullies. If they would have left him alone no of this would have happened. He was trying to enjoy himself too.
    This is sad for all parties but if he walked away his life would have been ruined away. He would have been labeled. People need to stop being bullies.
    This did not need to happen. People think its funny to humiliate people. Everyone isn’t going to put up with it. And then u get this. They punched and kicked him. They lied and made a spectacle of him.

Miu Brought/introduced a deadly weapon to the altercation... not defensively, but rather offensively. MIU Testified "I Stood My ground..." ADA: "Didn't back up?"... MIU: "No, I didn't." Those were kill thrusts... Frontal attack thrusts... Slashing thru the mid-drift, pushing under the ribs... toward the pulmonary ascending or descending aortic artery... kill thrusts taught to completely overpower your target... his were Trained To Kill movements... With refugees, people coming from other countries... we DON"T KNOW their backgrounds... whether they've killed before... whether trained to kill... The kids also were not experienced criminals...

    The judge really ruined our entertainment by not showing the victim family interviews . It was spicy stuff . I read Isaac’s mother was so angry calling Nick a demon and saying Nick had no remorse and how upset she was her loser son is gone😂
