  • The Tennessee Highway Patrol is investigating an incident involving a trooper who ordered video of a wreck scene destroyed.
    The video was shot by a NewsChannel9 videographer at a crash on I-75 on Thursday morning.
    An attorney with broad experience in the First Amendment says your video is your property and police have no authority to delete it.

      Actually the best way to stop the abuse by the Bullies In Blue is to win big money in court for their violation of your civil rights. Only after several million dollars in judgments will the state, county or city government be compelled to discipline the bullies or fire them to avoid additional lawsuits and judgments in the future.... {A police chief confessed that to me.}

    When cops commit crime they are " reassigned,retrained". If I ever go to court for a crime I'm going to request the judge reassign or retrain me instead of fines and jail

    The only reason you'd want the footage deleted is because you did something wrong and don't want anyone to see it.
    A good cop, doing his job properly, should want AS MUCH FOOTAGE AS POSSIBLE to back up his actions, should the matter ever go to court.

For example: my first time ever getting in trouble with the law i got a Terroristic threat for telling someone "shut up or ima kill ya" which i did not literally mean. FUCK THE POLICE!       The first ten amendments only apply to "the People" not to something that is not even mentioned.

      "The Citizens of each State shall be entitled to all Privileges and Immunities of Citizens in the several States." I fail to see the term "right" or "rights" in Article IV section 2.

    As usual when police do something against the law they are very seldom held accountable. I will tell this story till I die.
    I was at my dad's house. So was my youngest brother, his wife and two children. Some police officer apparently was in
    a hurry(to get a car part from an auto dealership) so he just pulled across the driveway to my dad's house and went
    into the car dealership. So my brother had stayed as long as he had planned to so he, his wife and two kids went outside to
    get into his car and found the driveway blocked. But here's the good part. He was NOT in a police uniform. He comes out of
    the car dealership and then the argument started. But this police was similar to the cop in this video but he didn't identify
    himself as a police. So my brother is standing there with his wife and two little kids and the cop starts threatening them.
    So my brother says "I got something for you" and starts to walk towards the house. Now what he meant is that he was going
    to call the police because we still didn't know that this was one. Then he cop pulled his gun on my brother and co. and
    stated more threats. What he didn't know at the time was that he had two guns pointed at his head. A 12 ga double barrel
    and an MI carbine. He likely will never know how close he came. But the police had been called by then and when they arrived
    they swept the whole thing under the rug.

    I stream mine to a cloud, so you can ask to delete it from my phone but I still have it... I do this to insure my safety.

      I don't know if those news cameras are set up to upload to the cloud like most smartphones but, if it was recording to a memory card and/or an internal hard drive, the footage could be retrieved with data recovery software!

    technically, the footage was not the reporter's property, it was the tv station's property. That is theft and a violation of your first amendment and others

      You need to check the penal law and our constitution buddy. I think you have a very vague understanding of it. Video is a property just like your car although it is intellectual property. Think of it this way, if you are parked illegally on the street, can an officer make you burn, crush, or destroy your car cause it illegally parked.

    I get the trooper wanting to move the car out of the median, but NO right to order deletion of the recording. The trooper is obviously a psychopath from his earlier problems, and is a danger to the community.

      Ed Bartek No, you missed the point and the context (partially due to my vague description of my examples) of that comment. The point is there is an actual reasoning for their actions (no, not to "retain power" for the sake of doing so or commit negligence in the context of real accountability. And North Korean law is law, not a molestable set of statutes that should be broken by tourists just because.). The difference here is that the Law Enforcement seek to erase the possibility of an account to which they can be held responsible in the event they are abusing their position.

It seems like your saying that north Korea has codified a perfect and unchangeable set of laws that can and should never be challenged (not sure if I have less human rights because I'm a tourist or not). The greatest strength of the American constitution is that it is a "living" document that is not without question.
      I guess I still miss your point because you have re-stated at the end that US officials seek to erase accountability and then fail to contrast that position with i guess North Korea? Unless you mean to say these things can't happen in North Korea because it's already against the law to film an official so then there can never be evidence of abuse of power and therefore never a need to erase it?

      Ed Bartek English is my only language.
      To attempt to make this explanation simple, I'll answer in points.
      1.) The DPRK authorities reason being one of being reasonably presentable as a nation (which is made difficult by the plethora of images of the least re-developed areas and their now destitute quality and the "make do" actions of the people a.e. using a ox driven cart in place of a tractor due to fuel shortages) and preserving military obscurity (no chance of capturing training exercises or actual military installations).
      2.) The point was that the laws of a nation are still laws (not saying they are perfect, but shouldn't be broken out of whim). The reasoning is that people feel compelled to disobey them out of a self reasoning that is founded on individual beliefs. (a.e. transparency of deemed secret areas like certain areas of the International Friendship Exhibit in North Korea.)
      3.) The point with U.S. law enforcement is that they (the offending ones) don't want the possibility of being held accountable for their offenses. The presumed logic being that "I am a officer of the law" = "I know the law and those that question me are being irrational" = "People should do as I say without question or else" or the divergent tangent of "I can do as a like because I'm of law enforcement thus I have special privilege".

    It's funny because there are a lot of bootlickers out there who always say "well, you have to understand that police officers have a very stressful, and dangerous job. They never know if the person they pull over will pull a weapon on him and endanger his life."
    So what? That's the risk they have to take for vying to be an officer of the law. If they cannot handle the mere possibility of encounters such as that, then they are not suited to wear the badge and assume that kind of power.
    And this is in a society where the policeman's word is pretty much the undisputed law. They seem to be able to violate your constitutional rights on a whim, they can set their own precedent for probable cause, and they can simply make up a statute you're somehow in "violation" of. and if you try to dispute them in court, 9 times out of 10, the judge is going to side with the officer. Usually called racketeering.

    Respect to the kid in that video . My fight / flight response would sure as hell been triggered by that guys actions and I would have tried to bolt. Yes, I would probably get shot but there are a lot of people out that that have an "overdeveloped" fight / flight response due to past events. I would have been around the corner before my brain even registered I moved. This cop has NO business wearing a badge and interacting with ANYONE and ANYONE who puts a badge on this guy IMO is also responsible for anyone he shoots/ beats / whatever. This is EXACTLY why people view police the way they do, They refuse to police themselves.

    Its extremely difficult to get rid of bad eggs, our local cop was one such.
    He did side work for my landlord and installed new locks on my cafe, he kept a spare key for himself and occasionaly did his FREE food shopping in my kitchen during the night when we weren't around.
    I kinda suspected something because things were moved in the cooler, I remember exactly where I leave things.
    I parked my car away from the business and hid awaiting, sure enough he entered and took some food. We filed a complaint, they forced him to retire. He still does detail work and drives a towtruck, still makes a lot of money and has a pension.
    But he's miserable, hates his life and no amount of money changes that.
    He messed with me and I got him good.
    They're basically stupid, just figure out how to trap them ....
    If someone wants to video them and give em shit, make sure that a second person is secretly filming you and don't let the cops know.
