- Police Scotland have been accused of 'making it up as they go along' in the wake of the SNP's new hate crime laws being introduced.
In the first 24 hours since it came into force, more than 3,000 complaints have been made to police and officers are having to be pulled from other areas of the force to cope with the deluge.
Speaking to Mike Graham, journalist and broadcaster Candice Holdsworth said: "It's so ill-planned, how are they going to implement this?"
Mike says: "Any decent barrister would demolish this in a court of law and say you're basically making it illegal for people to say things which are true."
Meanwhile, lawyer and broadcaster Andrew Eborn thinks the new legislation is going to encourage people to push the boundaries of the law.

I see many people becoming too distracted over the new legislation. This Law was designed to protect Islam and the SNP from criticism and ridicule. The strange thing is that if someone was taken to court for" misgendering" a "trans" person he would have to swear to tell the whole truth or commit purgery and go to prison. So if
asked to state if one agreed that a "trans woman" is indeed a woman, the law would oblige you to say no as that is the truth. But this is not really about trans nonsense at all, that is a cover. The real essence of the act is a defacto Islamic blasphemy law. All the rest is padding and a distraction.
So they say they will investigate every single reported incident, yes? If they then say they can only pick and choose what to investigate as they don't have the capacity, then are they not Actively discriminating against those people whose claims they decide not to investigate?
And where they have a built in filter to decide who to investigate and who not, then they will be evidencing an inherent bias.

Not really. I'd say the vast majority of people are totally uninformed about what they're voting for. Most just don't engage with politics. It's why we got here in the first place.

The Chief of Police could and should refuse to enforce any law that is obviously tyrannical and /or impracticable. The chief is obliged to do this. None seem to have that sort of courage and the woman now in charge in Scotland after the former chief resigned suddenly last year seems to have been chosen partly because she would go along with this act. She must have known it was coming and should have voiced concern if she had any. It is possible had she voiced any objection she would not have got the job.

You can't record a "none crime hate incident". If it is a non crime then is, in and of itself, not a crime so cannot be recorded.
But it's like taking DNA samples - your name etc will be kept on a register somewhere forever.
