From watching the earlier trial it was clear to me the whole shebang was a complete mess. Not a hint of professionalism from anyone involved in the film and HGR was the ultimate fall guy for the tragedy.
5:29 - Baldwin has handled firearms on many other, higher budgeted and more professional films. I find it hard to believe that he didn't learn a thing about proper handling and safety from those prior experiences.
@@finalascent He counted on others to take care of that. My dad always focused on checking a gun... never assume. I grew up in a time when most dads were WWII veterans.... we were raised with gun safety rules. Always respect something that can kill you! 😊🙏
Learning/knowing and giving a sht are very different animals.
The bottom line is that it doesn't matter how you handle a gun if it doesn't have live ammo in it. He has no responsibility IMHO.

No where is it explained why live ammo would be on a movie set.
The court believes that Hannah G. brought the live ammo on the set by mistake. She denies this. I believe the ammo supplier had live rounds mixed in with the supply of blanks he gave to Hannah G. since he used the same caliber of live rounds on another movie set a month earlier. He denies this.

@@Migglesworth Yes, I read that during down time, people were shooting at cans and bottles to pass the time. Also read that live ammo not supposed to be on the set at all. Baldwin/ Hannah must have been aware, open and shut case to me, if I was on the jury.

If the defense tries to deflect blame to the management of the set by the company, they open the door to Baldwin's producer role being brought up. The judge has warned the defense of this.
The Judge has been competent. Neither side got everything they wanted and as of Yesterday it seemed the Judge was making some ruling that I view as hey defense,you made your bed now lay in it type rulings. For one thing the defense don't like the idea that the Judge is going to allow Transcripts from Baldwins Police interview with Baldwin bragging about his experience and knowledge using guns on movie sets. Now its possible for that to change,but in the streams I've watched I think the Judge is trying to go by the book.
Baldwin being an executive producer not just the star of the movie is even more liable for what happened. He was witnessing what was going on on set, he has also been around enough productions that he knows how prop guns are to be handled. He also should have known from experience that training “guns” that are pretty much just a gun shaped piece of plastic are to be used when rehearsing scenes like they were doing. So not only is he liable because he was the one fired the gun, he knew that safety rules were being violated, and did nothing about it as a producer. Being one makes you responsible for what is happening during production.
His executor producer role only extended to casting actors for the show. That's it.

Especially since he was probably one of the only executive producers on set most of the time, even if he didn’t feel it was his place to call out what was happening personally which he should have since he was personally involved, he knew who was the producer involved on that side of things was should have said something to them. No matter what he cannot just claim he was just an actor and not responsible for any of what happened. He has more responsibility because of his position.

The judge in the clip told the armorer at sentencing that she alone was responsible. Weird thing to have said, now that baldwin is going on trial.
This is unacceptable. The main reason I believe he is guilty is because he is an executive producer. Taking half of his responsibility out coukd result in a not guilty, specially now see this interview shows how irresponsible as a production they were
You are confusing civil and criminal liability. He accepted civil responsibility as an executive producer and settled a civil lawsuit with the victims family. This is about criminal charges, about his actions as the person holding the firearm, not the person in charge of the project.
Hannah Guitierrez really was bottom of the barrel. She was a total pothead, drank, and used cocaine every night. The tampering with evidence charge was from her throwing out a large bag of cocaine immediately after the shooting.
Her last boyfriend died because he was drunk and couldn't start his motorcycle because the court ordered breathalyzer installed on his bike wouldn't let him. Hannah gave him the keys to her bike. He consequently got in a wreck and died. His BAC was over twice the legal limit to drive.

She's lucky she only got 18 months if I were the judge and I had any discretion she would have 5 years for her drug use during that film when she was supposed to be doing her job
Wow, I feel for her. She’s clearly got some serious issues. I hope she turns her life around after getting out of prison. She’ll at least (hopefully) have some time to sober up in prison. Between Halayna and her boyfriend, to have two people die like that is going to be a heavy burden for her to carry in her life. I hope God changes her heart. Shes so young.

What I can't believe is the fact they had LIVE AMMUNITION on the set!! They were using the same guns to shoot live ammo between takes for fun as they were using as props in the movie!! I know nothing about being an "armorer" for a movie set, but I know this is INSANE!!

What if he wasn't a producer? What if he was "just an actor", but behaved the exact same way just because he's an arrogant prick, and felt himself to be the most important person on the set? Would that change anything?

I have read that actors are named producer in order to pay the actor a percentage of the gross profits for the film. They don’t actually produce anything. Creative bookkeeping. Or fraud.
Correct, it is an accounting trick. The other part of it is producers are often given that title because they invest seed money or pay the bills.

Exactly. Producer is not a defined role. It can mean many things. I doubt he was involved with actually organizing the logistics of the film. He was probably just a big name to get funding.
@@PatriciaKeel-ig9ni I was an investigator with the US FDA. Responsibility was not proven via a title. We had to collect other evidence such as job descriptions, statements from others, affidavits. I would even ask people what they were attesting to when they signed a document and then ask follow-up questions. You can't just go by a title.
As executive producer and actor, Alec Baldwin was responsible. AB should man up. He pulled the trigger. He hired HGR whether he hired her for financial reasons and sped up production instead of thinking safety first, AB was responsible.
His EP title might be meaningless. He could have been given that title for financing production or taking a cut later on... or just for agreeing to be in the film. It doesn't mean he ran anything. Or he ran everything. It's a stupid game.

@@catsupchutney Are you and hennesseyme9112 related? If he did his job as an EP (instead of it being a courtesy title for doing the financing or something similar), he would have listened to the first armorer. AB chose not to listen to that guy and others who were concerned what was going on.
Baldwin needs to go to jail. Cut corners, armorer is not qualified, I can see she deferred to Baldwin instead of enforcing the law she was bullied. Drugs should never be in a armors posession. UGH

Did the judge give any reasoning for throwing out evidence related to Baldwin's duties as producer?
I recommend going to Law of Self Defense with Andrew Branca here on UA-cam. He has been streaming the trail and pre trail hearings. I don't remember if the Judge explained her reasoning or not. But you can learn more by watching/listening to Branca stream it than any of us can explain. Branca is a Lawyer and can explain abit of what things mean.

This is where Baldwin is liable. For cutting corners on these aspects of the film schedule, not for his action as the actor holding a prop that had been mishandled prior to them declaring it safe and handing it to him for the scene.

Why was live ammo used on this set! Especially when the editing adds noise to any gun shot! since really shooting NEVER! sounds or acts like in movies. When most people hear a real gun shot they think it was firecracker, because movies make them sound like cannons

You don't have to necessarily pull the trigger if the hammer is partially back..."half-cocked". You just need to pull the hammer back all the way, in a "multi-fire" manner and the gun can fire. But... there never should have been live rounds on the set... period. 😢🙏💔
No matter how the gun was fired it was still in Mr Baldwin’s hands at the time, but I agree there is no reason ever to have live ammunition on a theatre set. In fact there should be no reason to even have operable guns considering the billions spent on other movie props.
Judging by your comment you obviously don’t have a clue how a single action revolver works. As soon as the hammer is pulled back to half cocked the trigger HAS TO BE pulled for it to fire.
If Baldwin had his trigger finger in the trigger guard and had the trigger depressed, when he pulled the hammer to full cock and released the hammer, the hammer would fall firing the round. Kinda like fanning a single action revolver. I’m really surprised none of these “Experts” have explained that concept.

Walking around holding the weapons like that…. I would’ve been fired immediately if I had done that on a set! The armorers I have worked with are very serious have zero sense of humor as they should.
That job was a impossible mission. Hannah Gutierrez-Reed was taken advantage of by the producers of that film.

I don't care what anyone says - Baldwin is a seasoned actor who has handled firearms many times on set. He should know his responsibilities as an actor which he clearly did not follow. He is guilty of depraved indifference to others' safety. And, if he wanted to obsecrate from any of his personal responsibilities as an actor, he should have made sure they had an experienced armorer who wasn't intimidated by him or other veteran personnel in order to completely direct him in all moments. This was his project, his baby and he is literally an A-List actor whose antics are accepted because of his star power in the industry - no matter what, he had the personal responsibility to follow protocol.

I doubt Baldwin had a lot of practical producer responsibilities, but of course there's a level of accountability there as a senior actor involved in the production.
Of course Baldwin was responsible and pulled the trigger, of course Hannah G.R. was incompetent BUT this guy is a total flake and I wouldn't want him in charge of guns on a set either. Hollywood is a hot mess.
He uncocked the gun and the pressure from the spring was still able to make the pistol fire. My friend was uncocking a gun and it was in the uncocked position but the hammer was resting on the firing pin on the bullet. About 4 or 5 seconds the gun went off. He had it laying on his leg when it went off. Nobody was hurt. But the bullet went between me and another friend that was standing less than 3 ft apart. It was a wake up call for all us.
When people complain about the many restrictions on doing business (----ie California) they must see from this tragedy why those rules are in place.
Of course older guns can fire without the trigger being pulled. Did you read the FBI lab report on the revolver that killed Halyna Hutchins on the Western Movie set of Rust? They tried to get it to fire without the trigger being pulled and with the hammer in four different positions. Guess what - it fired in two out of four positions AND the FBI described this as normal - operating as expected.
Unless the “old gun” is defective, it takes a sharp knock, such as dropping it or whacking the hammer. In the old West revolvers were typically capable of having 6 rounds but there was such a thing as the “cowboy load” where only 5 rounds were ever loaded and the empty chamber was always placed in front of the hammer. Sometimes it even had money instead of a round in it, called burying money. Riding a horse, especially trotting, jumping off a horse, falling, etc were all likely to lead to an accidental discharge - hence the cowboy load.
So old revolvers can accidentally go off without trigger pull

Films should have mandated inspections anytime live ammo is used on a set. There should be mandated reporters
They don't use live ammo. There's never supposed to be live ammo. Don't know if they've ever figured out who put real bullets in the gun. But the armorer is the one who's supposed to double check to be sure the gun is safe.

I don't think it is right to put ALL the responsibility on one person when multiple people were in leadership. There are various degrees of responsibility, not just one. No matter how safe one person is it takes the entire team to make it flow. Shady for them to put it entirely on her, when many more played a role
If you put aside he pulled the trigger and the gun was loaded with live rounds, he DID point it in her direction which you should never do. She wasn't an actor in the scene either, so he was careless that resulted in a death, therefore manslauter is the proper charge. So he should be held accountable 100% but like the armorer it only is a 18mo prison sentence for taking a life.

I've been listening to streams of the trail, to me the case against Baldwin is strong. The Prosecution has been given permission to introduce evidence of Baldwin bragging about his experience and knowledge,and evidence of Baldwin horse playing with the gun on set. Basically it seems like Baldwin broke multiple safety rules.
I guess he's going to have to live with the guilt, allowing his pride to get in the way of using his experience to provide a safe set.
