    A Lawyer is explaining step-by-step, and showing you the actual law for the state. Despite the facts, people are still attacking his character based on feelings... This is the problem.

      Many lawyers have had different views on this case. I'd wait for some of the actual grand jury evidence to come out. I don't like that people are acting like the assault didn't happen.

      @@onthepath2809 sometimes they do, there is an element of law that deals with reasonable belief. Arbery may have had had a reasonable belief that these men meant him harm. Also the McMicheals may have reasonably believed arbery committed felony burglary based on information they had received. This is a sticky situation because Arbery could not know for a fact that the men were going to cause him harm. And the McMicheals could not know for a fact that arbery was not armed. This is for a jury to decide. But just an example, If a guy comes running out of a gas station with his hands full of cash and cartons of cigarettes with a gun in his waistband, I may draw my weapon and hold him at gunpoint. If it turns out the money was from the ATM inside and he used his card to get it, then bought the cartons of cigarettes, had a carry permit for the gun and was running out because he just got a call his wife was in a car wreck. Well he had not committed any crime but a reasonable person would believe he had and that would be enough to make a lawful citizen arrest. depending on how much info the McMicheals had, it may rise to the level that they reasonably believed Arbery had committed felony burglary.

      @@anthonysimpson2847 Of course he, having knowledge that he committed no crime, would also have the right to shoot you for committing aggravated assault by pointing a gun at him...
      That aside, I would like to clear up something from your post, because what you typed is factually inaccurate. According to OCGA 17-4-60, "A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.
      As Colion already detailed, there is no violation of law that occurred, and you can't speculate as to Arbery's intent for being in the house. This isn't reasonable. Whether or not they "could know for a fact arbery was not armed" is IRRELEVANT.

    as a contractor I always post a no-trespassing sign on any project I do simply because I want to protect myself from people coming on my projects and getting hurt and wanting to sue

      In MyFlorida.com it is a FELONY to trespass onto a construction site, 🏗🚧🔨. I do not condone or support the suspects but the victim is not completely clear either.

      DL Lambert , if this had happened in Florida, I guess. And, in Texas you can use deadly force to protect property at night. But, it didn’t happen there, either.

      Did you watch the video? This happened in Georgia, not Florida, where as far as we can tell the conditions for criminal trespass were not met.

      Same here. Every single house we've built in an area with nearby neighbors, there will always be people who want to come and snoop around. Some ask, most don't. Not really a big deal because we make sure to lock up all tools, but we do post "No Trespassing" and "Construction Personnel Only" signs mainly to protect ourselves from any lawsuit in case some idiot did walk into the house and fall down the staircase or step on a nail.

    the fact that people are attacking colion over his view and understanding of law only shows that there is no loyalty or integrity on the internet. nearly a decade we've all listened to this man and called him a voice of reason. 10 years of videos, training, advice, actual work towards protecting and recovering our 2a rights, working with the nra, telling people "that's my guy"... all that and 1 difference in opinion (colion is right, btw) has people calling him racebaiter and what have you? sad, really. this man deserves better than that.

      This is why when shit hits the fan, some people are always going to stick to their own, regardless of who is right or wrong. This is why many black people will never feel truly accepted in this country. Yes, it's about skin color. No, it shouldn't be, but that's not the reality of living in this world. You can serve your country, be an officer of the court, uphold the constitution, defend this country and its allies against all enemies, foreign and domestic, and people might appreciate and respect that. But when it comes down to an issue where skin color is factored in, suddenly all that doesn't mean shit and you can be turned on.

      I'll be honest. Had Warrior Poet, Tim Kennedy, etc said what Colion said, they'd not been like this. Its because he is a black man. He knows the law and that's a threat to some of them.       A long gun can't be drawn. It can only be carried. Either with a sling or in your hands. An openly carried long gun is the equivalent of a holstered pistol. Don't conflate drawing a pistol from a holster with carrying a long gun. They're not the same thing.
      Open carry laws protect your right to carry a long gun. That includes holding it in your hands.
      In jurisdictions where open carry is legal, holding a shotgun in one's hands is not automatically a crime. When it's legal for people to openly carry firearms, a man holding a long gun is not automatically a lethal threat. In other words, you can't shoot somebody just for standing there holding a long gun at low ready or at their side. There has to be a credible threat. You also can't charge somebody and try to take their firearm just because they're standing there holding it. That makes you the lethal aggressor.
      Finally, if you have reason to believe that they are trying to detain you until police arrive, regardless of whether they have a legal right to do so, you're on shaky legal ground if you use lethal force against them in that case, because whatever led you to believe they're trying to detain you on behalf of police undermines your claim that you were in reasonable fear for your life.

      How do you not draw a shotgun? Look at you focusing on that instead of the obvious: DO NOT attack armed people or try to fucking swing at them. That is the operative message here. Deal with the cops. Arbery didn't want to go peacefully, because he knew he was guilty of multiple trespassings already.

    So let’s start with this, should he have been in the home, probably not. But at the end of the day that is definitely not a crime punishable by death. So I’m sticking with my previous assessment that the guys who shot him are assholes.

      It's an open house under construction with no gate and no sign. Ppl often walk around houses like that to check out the craftsmanship or to see if they want to buy the property. Like i said above I've I've inside every new house on my block, nobody ever blinked.
      These guys wanted to hurt someone and they used that as a flimsy excuse to do it. I fully believe they would have likely killed a white man if he looked "street" enough but they didn't. They killed a black man and said the n word and spit on the ground after shooting him. I saw their little text messages about hunting raccoons with "gold teeth and afros"
      To defend them is to defend not only racism but a very on the nose and blatant trashy and murderous brand of racism I want nothing to do with.
      What they did was evil and wrong. Whether he was in that house or not it's not like it was breaking and entering.
      The guilty verdict was spot on. So was the not guilty verdict for Rittenhouse. It's sad that a lot of ppl can't differentiate the nuances there. The cases are almost polar opposites and ppl still think they're the same on BOTH sides. It boggles my mind.

      This happens alot, we would get dispatched to calls where the description would be like "black guy in the neighborhood and he doesn't belong here"...our Sgts. would have to get on the radio and tell dispatch we would NOT be responding

      @@susand495 just how do you tell an outsider to a neighborhood, by the skin color? do you otherwise know know each and everyone in your neighborhood? what if he had just purchased or rented a home down the street and went out for a jog and was curious about the home being built, like millions of people do? could he have been visiting some relatives, or friends, or girlfriend, or fiance that he was about to marry in a few days, etc and just the same went out for a relaxing jog around the neighborhood? could he have been a contractor who was asked to give an estimate of a service needed in the many phases of a home construction ( putting up sheetrock, for instance )? our instinct can be affected by paranoia, preferences, and a number other negative things that, at a minimum, must be left at home or gotten rid of. If these guys had stayed at home, had mind their own business, he would still be alive. they could have not continued to give people a bad name, make things worse; the whole world is always watching! - TOTAL respect for other people's rights is the antidote for this sickness ( lithium pills for those who need it would help too ).

    I’m a 70 year old southern raised white man. I myself have seen a house under construction and out of curiosity, looked inside. This man stole nothing, harmed nothing and threatened no one. The three men that accosted him should at most, call police. It’s very clear as a lifelong southerner that these three were the aggressors and race was at the least, part of it. This man did not deserve to die. It is their fault as determined by the jury and I can’t see why all this arguing is still going on.

    I'm a construction superintendent, I run job sites, and I can't stand when someone walks in on my job site, even with signs posted and fencing up. Should someone be chased down and stopped by gun point...nope

      what if it is a completed home which appears not completed. What if someone lives inside - say your mum but she left the garage door open and there was no car parked or any indication that anyone lived in the house. Should the person who trespassed be free? What if the trespasser was a convicted rapist?

      Even if they do not steal anything from the job site they could be injured. If injured, the trespasser then sues the construction company for the trespasser's own stupidity.

      Thank you. And as someone who does wholesale real estate I can also attest to this. And for every 1 person that walks in while work is being done, 4 more walk in off hour. And having a single camera up on a construction is fairly common nowadays and it is not evidence of people “breaking in” or “casing the joint”

      He lived 10 miles away, not a very close neighbor.. I love looking at homes under construction. I tend to ask first and I dont sprint off when confronted by a different neighbor though. Not saying at all that he deserved to die. Wish he had not charged a guy holding a gun and tried to rip it away. Also wish the dumb asses had just waited for the police to find him. Hell, he had 10 more miles to jog home, so Im sure they would have seen him with a jog that long. Could take up to a bunch of hours if he stopped to look at every construction site he jogged past for 10 miles while on the way home. Maybe he had to pee, wait no there was a metro outside,,, may have needed a water because he did not start out planning on jogging 20 miles, but the run just felt right.. maybe shade, hell I dont know why he went in a house 10 miles from home and dont know why the retired cop could not come up with a damn better plan than standing there with a shot gun! Why would he let the guy grab it anyway, he should have just shot,, oh wait HELL no, that gets us where we kinda already are.. Just dont go on 20 mile jogs and stop looking at your neighbors house anyway you nosey assholes! And there were 2 of you, why was your weak ass son in the back of the truck while a guy is trying to take your dads gun and shoot him. Wait, DAMMIT here we go again, we dont know if he would have shot the dad if he were able to get the gun away, maybe he wanted to clean it or something, I dont know.     I conceal carry every day. I would NEVER chase anyone down like that if I just suspected them of wrongdoing. I certainly would not pull my self defense tool on a person I saw looking in an open unfinished house. I have walked into open construction sites many times to see the inner workings!

    I’m a home builder and developer. People are always walking through houses until the doors and windows are installed and it’s locked up. As long as they’re just looking around (not stealing or vandalizing) I don’t really care, you never know who a potential buyer might be. Most other builders feel the same way. Most of the theft I’ve encountered is done by the neighbors taking things like plywood, brick to build planters, etc. The next most common theft for me is people out looking for ideas on their house, likes the finish on my cabinets so they steal a drawer to show their painter the finish they want. Typically a person walking/jogging by on foot isn’t going to steal anything.

      @Disheveled Man The main point is that he did not have to jump a fence, open a window, or a door to get in. There also wasn't a no trespassing sign. When my Great grandma died, her house was left vacant for a few months while we renovated it. One day a neighbor called us and let us know that a homeless person set up shop in the backyard. We called the police, but all they could do was warn him to not come back or he would be arrested. The cops then advised us to put up no trespassing signs in the windows so that the police can arrest anyone else that tries to set up shop again.

      I think the problem is everyone jumped to conclusions (as usual) and when the whole story comes out (Just like Michael Brown) the waters get muddy. Video casing the house. Video of a neighbor confronting him then he starts "jogging". His combative history with authority. Charged with bringing a gun to his high school. Watching him punch Travis 3 times in the head before anyone drew any gun. I don't know about you but someone says "stop" with a shotgun in their hand I'm not going to attack them. Travis filled all the boxes for self defense. He was retreating. Ahmaud was advancing on him. He struck him first.

      What is needed is a little perspective. Why are we even talking about this case? The media literally cherry picks cases where blacks get killed by commiting crimes. He was justifiably killed in self-defense while assaulting somebody trying to rightfully detain him because he was suspected of committing a burglary. they have him on video at this house dating back months. Stuff had been stolen their repeatedly and only a gullible nitwit would make the excuse that this guy was just innocently looking around and then started running away when somebody called the police on him. It's obvious he was up to no good. And when confronted, his first instinct was to assault the man with the gun, presumably to take the gun and kill him as we often see is the case with people assaulting someone who is armed. It is only after the media turn this into a racial issue and started crying racism that these innocent men were charged wrongfully with homicide. Even from the video it is very clear that the black man charges and attacks.       I agree with you. I like Colion videos and agree with a lot of his points.
      ...But, in this case, I think Colion is actually wrong. No matter how I look at it, it’s legal to open carry a shotgun, and if someone charges you, then you can shoot.
      Now, if any point, the two white men had pointed a gun at Arbory, at that point, Arbory was in the right to charged them. At that point, Arbory was acting in selfdefense and they are wrong for killing him.
      Jus because you are openly carrying does not mean you are a threatening someone with it though. I expected more from colion because he is pro-gun. But in this case, I feel like he is making a poor analysis of every American to self-defend yourself.

      So it was justice that the guy who ONLY recorded it and followed in his truck and turned the video over with his attorney because it showed his innocence, was convicted of murder? Why is it that just because conservatives won the Rittenhouse case we think we owe something now and can't stay principled? I understand that the first two guys have to pay for a death that shouldn't have happened but the guy who followed? Really? That sits well with you that people can come in your neighborhood from 20+ miles away to "jog" when your neighborhood is continuously plagued by crime and the police pass a photo of Arbery around yet can't make it there in time if you call police and you not only can't do anything about it or even record someone else trying to stop him?       Art. Auberry accosted the man holding the gun and tried to take it ways from him. He had a choice in the matter. When he reached the back of the truck he made a run to the right and should have kept going in that direction. The shotgun wasn't pointed at him.     I believe in gun rights, I really do but some people need to realize...
    Shooting someone is a real, permanent act and that everyone who owns and carries a gun should pray at night that they never have to.
    You should take great pains to not put yourself in a position to be forced into shooting someone even in self defense.
    Rule #1 If you see someone’s life being placed in immediate danger by another in the commission of a crime... Do what you need to do. Realize their may be consequences, but understand that life is precious and worth the cost.
    Rule #2: If a crime is being committed on your property and in your presence which may present an immediate threat to you or your family...do what you need to do. Your safety is of the utmost Importance.
    Rule #3 if you see a crime being committed, and it is occurring off of your property… And nobody is in immediate danger, call the cops and let them deal with it. Take a picture or some video with your phone if you like so the cops will have some evidence but by all means maintain your safety as a first priority. It is not necessary for you to get involved in stopping every petty burglary and mailbox theft in your neighborhood and certainly those don’t warrant someone getting shot.
    Rule #4 if you did not see a person do anything wrong, mind your own business.

      You do understand that most gun owners also practice non deadly forms of self protection (marshall arts) and a vast majority of times a gun has been used in a good way is by citizens just brandishing a gun. Personally I think a majority of gun owners already know and understand what you are talking about but the issue is with number 3. I understand what you mean but I think that a non deadly way to use your gun in that situation is, one get the perpetrator’s attention and inform them that if they flee that they will be shot and if they stay you have completed step one, step to is to call the cops and inform them that there is a POTENTIAL perpetrator and inform them of the situation, once the cops arrive then your job is complete. That is how number 3 should go.

Would the victim have “attacked” the shooters if they would had not intercepted him? If not, the shooting happened BECAUSE of what they did, not the victim.
      If a unknown civilian tried to stop me, and was brandishing a weapon, I wouldn’t cooperate. I have no reason to believe that their motive is lawful, since we live in the USA. you know, land of the free? Innocent until proven guilty? And I would think the laws of self defense are on my side.       More security video has just come out of Ahmaud Arbery on the same property in the middle of the night. This was days before the incident. I highly doubt he was jogging in the early hours of the morning. Why would you go into the same property several times and in the middle of the night, unless you are up to no good?

      It's abandoned buildings for me. I find them fascinating, and I like looking inside them. There's a story in every one of them. When we were looking for houses, we often walked into homes under construction. It never occurred to me that I might get shot later after doing it. But, I never did it in Brunswick, Georgia, thank God.

      I dunno.... Gotta wait till all the facts are in before making a judgment.
      From what I've been told the cops were serving a search warrant because Taylor's ex had "packages" delivered there and he was supposedly a drug dealer or something to that effect.
      When the cops kicked down the door the Boyfriend opened fire. The cops returned fire.... bad day for everyone.
      I guess the boyfriend said he thought they were burglars or something...... There's some doubt as to whether or not they announced themselves coming in the door.
      I'd say it's still way too early to make a judgment call on that one.

      Georgia citizen arrest law:
      a private person may arrest someone if a crime is committed in his presence or “within his immediate knowledge.” But if it is a felony, the citizen can stop someone from escaping if the citizen has “reasonable and probable grounds of suspicion.”

Now Arbery did attack the son with the shotgun and they struggled for the gun, which resulted in shots fired. Not saying it is a good outcome but common sense saying it you attack people with guns then you might get shot, besides you are not suppose to conceal a shotgun in Georgia.

    Colion, I have always found your analysis to be fair and spot-on. This case is no exception. I would add that, even if Mr. Arbery had gone into the garage and carried out a bunch of expensive power tools, it would still not have been lawful for a CCW permit holder to draw his or her gun. There was no imminent threat of great bodily harm!!! A cold burglary is not the same as armed robbery! If they could not detain him with non-lethal force, they should have let him go. Documenting any crime and turning it over to the police is what should be done when there is no imminent threat of great bodily harm. As a CCW permit holder, I would NEVER produce my firearm if there was no imminent threat to me or an innocent bystander.

      In Texas, there is also a distinction if the incident is in the day or night. A daylight burglary has a much higher level of imminent danger before lethal force is justified

      If you hear a woman yell "rape, rape!" and you turn the corner of the street and see her on the floor bloody, and a man running from her, guess what?       @Rusty Shackleford , You do not listen. You must look at what happened just before Arbery ran at the one man. You purposely ignore that and jump to the fact that he ran at him. That is not only dishonest but deceitful. You cannot prove Arbery did anything wrong for those two men to try to detain him. They had no reason (as far as we know at this time) to detain him and especially with a gun. You like only one fact and ignore the rest of the facts. All the facts are the "totality of the circumstances". This is required to make an accurate assessment of the situation. You did not do this.       SmittyinPHX Yes, but that doesn’t mean they are acting in a lawful manner. Police rushing at an active shooter are a threat to the active shooter, but that doesn’t make the active shooter lawful in his/her actions.
      Who knows what compliance would have gotten Arbery? If he complied, he might be alive, or he might not. He apparently felt the need to defend himself in that manner and (based on current evidence) was lawfully allowed to do so. Unfortunately it didn’t pan out for him and cost him the ultimate price. Maybe fighting back was what got him killed, but either way, his killer(s) are in the wrong here and they may very well pay for it with their lives.

      @@imzanky6321 this doesn't really meet the open carry defense. Open carry is entirely for your own self defense, they didn't happen to have the guns on them and by chance ran into him. They quite changed that defense by taking their guns and truck and chasing a kid down blocking him in the roadway and then pointing a gun at him because of a suspected crime, which was at best a trespassing. If the police did that to anyone for trespassing I'm sure there would be a media firestorm.
      It's a verbal technicality that they had guns in the open but it's not going to be a usable defense. They placed themselves into that position and escalated the incident. Ironically it was them who pointed the guns first, which is why Arbery tried to defend himself with what he had, his hands. Also, if you are a gun carrying American, which I hope you are, I'm sure you'd be threatened by some random people in plain clothes and a truck stopping you in the street and pointing a shotgun at you. So in that case I would hope you'd give them some lead.

      His REAL last name is spelled “ARBURY” - I have seen multiple ‘media’ outlets misspell his name, but none were spelled correctly. You would think the media would have got his name right, in such a horrendous circumstance, to honor him & his grieving family.... right?
      And, as always, the media puts ‘no charges have been filed’ to throw fuel on the fire, but there’s a reason why they aren’t charged - they aren’t guilty of a crime, or the investigation and facts if the case takes time, sometimes weeks.       When i was a kid they were building 3 new houses next door to mine, and my friends and I would go in them and hang out, play paintball, etc. when no one was there. Honestly it seems like they would be more justified in shooting me for "vandalism" than this guy, who just ran in and out.
      I suppose I was just a kid though, and he was an adult, but even if he was still stealing from a construction site it's not worth killing over.

    There's just so much going on here it's hard to know where to start . After 20yrs active duty , in the SO communit, and for the last 15yrs working as a shooting/tactical instructor, it's hard for me to imagine this father worked as a police officer for some 30 odd yrs. The lack of judgement as well the astronomical lack of any professionalism showen by this individual boggles the mind. It's hard to fathom any father that would needlessly put his own son in harms way. Mr. Arbury might have made some better decisions in hindsight, but then , any hindsight he would have ever contemplated , was taken from him . I really don't know if there was a racial component here or not . I do know this . The father and son should not have been walking around free for 2 months. They should have initially been booked for felonious stupidity and locked up while a proper investigation was done . My condolences the the Abury family.

      @@eshootziscrs2868 If they were officers responding to the 911 call made, they would have been making an articulably reasonable Terry stop as part of their investigation. Citizens don't have the power to make Terry stops. So, yes, it would be different for officers because officers have vested powers from the state to handle these matters as agents of the law. In fact, if they were officers attempting to make a Terry stop and the exact same thing happened, they would have been justified in shooting Arbery because they were justified in making the Terry stop.
      Since the dudes in the truck don't have that authorization to make a Terry stop, all they're left with is illegally brandishing a weapon (the driver pointing a shotgun directly at Arbery) which is a felony and clear threat against Arbery's life with no justification for the action. Therefore, the actions that took place were self-defense on Arbery's part.

    No faith in humanity, instead of debating and arguing on how this all could have been avoided, we talk about how the shooting is justified. No one in Aubrey shoes would just stand there and want guns pointed at them. There was no reason to bring weapons into the situation and using laws to justify a needless death are inexcusable. Last time I checked, justice is blind not cruel.

      If anything arguing if the shooting is justified is more important than arguing about how this could've been avoided. If we argue how this could've been avoided nothing would change. If we argue if the shooting is justified then that decides the future for the people that killed him. Arguing how it could've been avoided would literally solve nothing.
      What if I said " if I had guns pointed at me then I would've just stopped." Which is a way to avoid the situation going as far as it did, it would still change nothing because the events already happened. Also not only that but there are many ways this could've been avoided and the answer to avoid this would probably change depending on the person.

      there's nothing else that could have occurred while he was inside the house that wasn't recorded that would have changed the legality of the matter. There was no report of assault of anyone inside, nor of arson, nor of vandalism, etc. Moreover, video surveillance systems often record only while there's motion in the field-of-view of the camera...no more motion and the camera shuts off waiting for the next motion trigger event.

    I'm a General Contractor, and I've built housing developments before, people would constantly come by after hours to check out the construction. It sucks because technically they're trespassing, but I never encountered I'll intentions. When I explained they need to leave per safety osha regulations they were usually understanding about it. The point is, they should just have asked his purpose there and send him on his way.

      Here's where he's losing it: He's referring to the standards that need to be met to get a CONVICTION of ARBERY at TRIAL. These standards DO NOT need to be met to justify an ARREST. Cops... and CITIZENS... do not need to hold a jury trial and find the suspect GUILTY before an ARREST is justified!
