I think Mr. Taimur has misrepresented the Islamic Jurisprudential System. At 6:13 he gives the impression or at least has the assumption that Diyyah is an option for the criminal while it is definitely not. Diyyah is an option for the family of the victim, if the family wants qisaas then qisaas is taken. So this concept of "پیسے دے کر چھوٹ جانا" is a misrepresentation of Shariah Law. He further misrepresents the concept of circumstantial evidence in Islam and I have discussed this in another comment.

Because Lawyers protect criminals which is why it is not Islamic. Islam wants to provide justice in society, if a criminal has done something wrong he should defend himself with not just arguments but also by evidence. An innocent man also has to do this job too. Trial period gave the criminals enough time for their defense, some criminals like Nawaz Sharif and Ishaq Dar they make an excuse of illness and health problems to delay the case and some criminals use stay order and delay the case for long time, and this is why their is no Justice in this society.
How can the jury who knows nothing about the law can make judgement. Judgment is given with consciousness like Sheikh ul Islam of Ottomans Abu Suud Effendi (R.A) has said. Why only few people in America are jury, why not the whole 34 million population of America are made jury as it is a democratic society.
Forensic evidence can be used in Sharia Courts. This is such a silly argument that forensics never existed in medieval era. Tell me did the forensic evidence was always used in British Law, Greek Law or Roman Law. So if in Anglo-Saxon law we can use forensics, we can also use forensic evidence in Sharia Courts. But some times a forensic evidence is not enough. I give you an example, there is a woman who asked for water in a desert from a man. The man said to her that he will give him a glass of water if she have sex with him. So she had sex with him. Now if the case is presented in court and according to forensic evidence it is proven that both man and woman had sex intercourse, what will be the punishment for them. Answer to me, let see how strong you are in logic.
So if a person is innocent how can you punish him because of circumstantial evidence. This would be injustice to a person who didn't kill anyone but he could be present at the crime by chance or may he would have gone their to help someone who is dying. There are so many cases in West in which they do such injustice.
It is because according to Prophet (Peace be upon him) woman is not equally intelligent as man. Now you are telling us that our Prophet (Peace be upon him) was wrong. And you should also know that in Islam liar's testimony is not considered because he is a liar and it is possible that he would be lying. No you tell me, was Umar Farooq (R.A) was wrong to put a liar on donkey when a liar gave his false testimony in court.

I think Mr. Taimur has misrepresented the Islamic Jurisprudential System. At 6:13 he gives the impression or at least has the assumption that Diyyah is an option for the criminal while it is definitely not. Diyyah is an option for the family of the victim, if the family wants qisaas then qisaas is taken. So this concept of "پیسے دے کر چھوٹ جانا" is a misrepresentation of Shariah Law. He further misrepresents the concept of circumstantial evidence in Islam and I have discussed this in another comment.
Diyyah is the principle punishment in Qatli khatah.

Because Lawyers protect criminals which is why it is not Islamic. Islam wants to provide justice in society, if a criminal has done something wrong he should defend himself with not just arguments but also by evidence. An innocent man also has to do this job too. Trial period gave the criminals enough time for their defense, some criminals like Nawaz Sharif and Ishaq Dar they make an excuse of illness and health problems to delay the case and some criminals use stay order and delay the case for long time, and this is why their is no Justice in this society.
How can the jury who knows nothing about the law can make judgement. Judgment is given with consciousness like Sheikh ul Islam of Ottomans Abu Suud Effendi (R.A) has said. Why only few people in America are jury, why not the whole 34 million population of America are made jury as it is a democratic society.
It depends on the circumstances and seriousness of crime. Which is why the decisions can be different.
Forensic evidence can be used in Sharia Courts. This is such a silly argument that forensics never existed in medieval era. Tell me did the forensic evidence was always used in British Law, Greek Law or Roman Law. So if in Anglo-Saxon law we can use forensics, we can also use forensic evidence in Sharia Courts. But some times a forensic evidence is not enough. I give you an example, there is a woman who asked for water in a desert from a man. The man said to her that he will give him a glass of water if she have sex with him. So she had sex with him. Now if the case is presented in court and according to forensic evidence it is proven that both man and woman had sex intercourse, what will be the punishment for them. Answer to me, let see how strong you are in logic.
So if a person is innocent how can you punish him because of circumstantial evidence. This would be injustice to a person who didn't kill anyone but he could be present at the crime by chance or may he would have gone their to help someone who is dying. There are so many cases in West in which they do such injustice.
It is because according to Prophet (Peace be upon him) woman is not equally intelligent as man. Now you are telling us that our Prophet (Peace be upon him) was wrong. And you should also know that in Islam liar's testimony is not considered because he is a liar and it is possible that he would be lying. No you tell me, was Umar Farooq (R.A) was wrong to put a liar on donkey when a liar gave his false testimony in court.

Your argument is illogical. If someone blinds me in one eye, then such criminal has not harmed the society and the state. First of all, he has harmed me, then the right of the society. Now, it becomes my right to exact revenge (retributive justice) in similar manner through legal recorce.
