Stopping Payment

- The plaintiff says she and her husband agreed to rent a house from the defendant but changed their minds. They say the defendant promised to refund all their money, but he didn’t, so they’re suing. The defendant says he returned everything but the last payment, which is way more than most landlords would do.
Case: 25-369

Baby, Ms. Tien came in ready to SLAY!!! 😂 She almost knocked the doors off storming in, and got to her podium faster than anyone I’ve ever seen. 😂
Had to rewind. I always never focus on the intro, only listen 😅
That’s GOTTA be a record! 🏃🏻♀️ 🤣
Right, she walked in with a mission 😊
lmao sprinted
😂😂
She came through those doors like she was about to win an award.
😅😅😅
Or start a fight 😂
He went from telling her she Really has to want it because there were a lot of interested people to, it was so hard to re-rent it. What a bunch of BS.
Ah valid point
I caught that too
There’s definitely pep in her step. She walked in like a boss and walked out like one
And she still looks like a fool.
She's a lady of stateliness
"It's not fair!!! She put me through a personal hell!!!"😭😭😭😭😭😭😭😭😭😭😭😭😭 You need to get some bread with that wine dude.
and a tiny violin!💕♥️❤️
@Public Square Semantics some bread does have cheese in it. 🤣😂😂💕
@Public Square Wow! That’s harsh.
He is going to be in for a big surprise if he does end up in hell... Lol
WHAT A BIG BABY 😂😂😂😂😂
She put him through a personal hell?!? This dude basically got a $19k loan interest free for 4 years, was able to put his mother in a home right away, didn't lose any money because she paid for the month he was out without argument and was super patient for 4 years getting paid back in small sums. This guy's nuts 😳
You're semi nuts like that guy. That's not how it works. If you don't make a lot of money and suddenly need a $20k lump sum to pay for some surgery and you sell your car in order to pay for it, and when the sale goes through you get the surgery and pay the $20k, you are now out the money. If the buyer comes around next week saying he decides he doesn't like the car and demands his $20k back wtf are you going to do about it? The only thing you can do is offer him to resell it and once that happens pay him back. Now let's say in this case the only new buyer is only willing to buy it using 6 installments over a year. Obviously you can't pay it all back at once so you're going to pay back in parts. In the case of rent you're losing money if you pay the full income back each month because you're then stuck making double payments and losing income. The fair thing would be to pay over double or triple the timeframe which would on this case be 1yr or 1
5yrs. So yea 4yrs was a lot. But at the end of the day the Asian lady was the one breaking a contract and putting both of them in the situation.
@Public Square exactly. Except even worse you had to use that 20k right away for medical bills so you literally don't have it. And you can't pay exactly what the new buyer is giving you or else you're still losing money. So you can maybe pay half or a third on order to deal with with the unexpected loan you're stuck with.
I agree with you guys that he was put into a loan unexpectedly that he didn't ask for. I'm just saying it worked out for him because he needed that money right away, according to him, to be able to pay for his mother's care in a nursing home. So, he had all that money upfront to do that got to keep the months rent so he wasn't out any money AND got a new tenant right away so he was collecting rent all that time. If she did move in he wouldn't have seen another rent check for over half a year because she paid 6 months upfront and that money still would have gone to his mothers care. At least this way it was kind of a blessing in disguise that he had that money upfront still got rent checks every month and got to pay it off slowly in small sums he could afford over the course of 4 years. Just saying it seemed to work better for him that she backed out and he found another tenant right away.. but that's just my opinion 🤷♀️
And it most definitely is an interest free loan! Whether he wanted or asked for the loan or not is completely irrelevant and has nothing to do with paying interest on a loan. Interest is a percentage of money you pay extra to have a loan. He paid her back exact dollar for dollar, nothing more, no interest. So yes, it most definitely is an interest free loan by definition!
Pp0p02@
She helped his life tremendously. He used that money like a loan.
He didn't ask for a loan. She signed a contract and broke the contract. And put him in a very bad position. He did everything he could to pay her back. He does have the right to keep a month's rent because he could not rent it out immediately.
The plaintiff is absolutely ridiculous.
@@sj4iy he's an old bullshitter. he probably had that cash all along, anyone who believes his story is young & naive. This guy is a scheister, he had the cash all along.
Had he paid her, what he owed her, he probably would have been done with her, and would not have experienced any stress and/or “suffering”.
“Let’s find out what The Weekend thinks “ took me out 😂😂😂😂
HILARIOUS 🤣🤣🤣
Damn she flew up to that stand.. lol she got some business to handle..😂
Plaintiff comin in like roadrunner. Meep meep.
😂🤣😂😂😂🤣
How can the landlord keep such bad records
The IRS will tear him out
Probably use one of the new 87,000 IRS agents Biden hired to crush the middle class workers!but I digress..
Maybe was an all cash deal
She came in like whoever got up there first was gon win the case 🤣 Dang...... 🏃🏽♀️
_What was tougher, this case or fighting that giant shark?_ *THE SHARK! And it got me at the end, **_just like the judge!_* - Come on, that was pretty funny 🤣🤣
She walked in the courtroom really fast😂😂😂
He kept $2450 for 4 years and all the interest for that time. What a creep. He had that money from the new tenant all this extra time.
He shows up to court wearing an untucked shirt , no receipts and complains. He's a victim in his eyes no matter all the facts thrown at him.
Lol!
Untucked? Who cares?
@@kathyhansen9546 i used to wear my shirt untucked when i went out on the town...
Then a good woman friend told me i should always tuck ...looks alot neater and put together.
But if a guy has a gut then he probably doesn't want to tuck...but he should wear a blazer then to hide his gut.,like i do now👍😉
Across the street from a school. So when you first looked at the home you didn't notice a big building across the street that said school? WTF!
So true 😂😂😂😂
Her husband must be a piece of work. A total simp I guess.
She rented the place on her own. It's the husband who wanted to break the lease.
It was probably worse than they thought. We use to live down the block from a school and whenever it was the weekday, we would have a bunch of cars blocking our drive way and parking infront of our home.
If "let's get to it" was a person. Baby came through those doors like a swift wind.
🌬️ lollll
It should NEVER have taken 4 years to pay back. He had rent coming in every month equaling 2600. Why wasn’t he turning this over to her?
Better yet, he should have been holding that money in escrow and pulling the appropriate rental amount out each month, not taking it all and spending it all up front.
@@jessica_meigs no you only required to put the security deposit in escrow. The 6 month he can do whatever he want with it.
Because he FELT like he didn't want to.
@@bobberry1463 He didn't even do that.
@@jessica_meigs he don’t have to put the rent money in anything. But he definitely should have paid her back in 6 months or less
He got rent paid by two people for the same home for the same 11- month duration. That's not allowable, either.
He's just victimized in his own mind and belief.
I like the defendant’s comment at the end lol 😆
I told my landlord I would pay 3months in advance because I knew I had bad credit. She gave me the place but said legally she couldn't take that much in advance. Luckily I've never been late once in 4years
Plaintiff entered the courtroom like a woman on a mission, then flipped her hair Charlie's Angel style, and told us just the facts, ma'am.
Love me some Dragnet❤.😊
She came stomping through 🥺.
😂😂😂 I thought the same
yeah. what an entrance.
Yes,exactly right ✅.
Cause why are you walking so fast with such short distance 😅
She walked in as if she was on americas next top model and not the peoples court 🤣
5 SECONDS! I think she won... fastest litigant to pass the doors and touch the lectern. Don't blink, she's a 'fast walker'.
He knows damn well that doesn’t look like The Weeknd 😂
That was a far reach 😂
😹😹😹😹
🤦🏾♀️🤦🏾♀️🤦🏾♀️😂😂😂😂
He always does that shit
I can’t imagine being able to afford 6 months worth of rent and using to… rent 😑
4 years to pay back the money? So he nickeled and dimed her at zero interest and now he complains? I bet it was him mother’s house and the rent was supposed to cover her care elsewhere but he just didn’t want to pony up the difference. If it was 4 years you can bet he’s probably getting 3600 hundred or more for the rental now .
I hate landlords so so so much. He’s like oh she changed her mind… $$$$$
And they hate you..
@@patrickchilds5486 found the guy who has to rely tenants to pay his mortgage
There was a lot of pain and suffering… 🤣😂😂😂😂😂💯
If basically getting a 19k bonanza for 4 years interest free is a "personal hell" for this guy he must live a care free life.
The judge was pretty nice to him; way nicer than she is to many other litigants! I think she was a bit charmed by him and didn't tear him down like she often does !
I think so too lol
Interesting case, nice people, what a change for TPC.
First off, the entire deposit should have been paid back immediately. Landlords aren't supposed to spend your deposit at all...they're supposed to put it in an account and hold on to it. Second, its really strange to me he went out and spent her entire first 6 months of rent before she even moved in. What if the place had issues, like an appliance goes out? Or the roof needs fixing? Would he have had the cash to pay for that?
First off ,even the judge said landlords don't need to put that in an account and keep it safe... And second stupidity is what stupidity does...the reason I rent is because I cannot come up with a deposit for a 🏠 of my own,and thipese people throw around nearly 20$ dollars for the first 6months rent!!! The house I'm in now is only worth $22,000!
@@wynottgivemore9274 you are wrong, he can spend rhe rent, but not the security deposit.
He didn’t have to let her out of a signed lease! He could have kept her rent left the place vacant for 6 months and been on his happy way.
@@billmoran3219 no he couldn’t. He would have had to prove that he tried to rent the place and if he didn’t he wasn’t getting anything. You’re supposed to mitigate your damages.
I don’t know it it varies by state but the Judge mentioned in another case that in NY or NJ a landlord has to put deposits in a separate account if they have 10 or more rental properties.
I love living near schools, hearing the children playing is comforting 😊
First time I've ever heard someone say that. Living near a school is helpful if your children live there, but the noise isn't preferable for many.
@@SRFAA I live in the U.K. and a lot of bungalows are built near the schools as the elderly like the background noise of children playing.
lol I don’t mind the noise either, but the traffic jam from drop off and pick up is an absolute nightmare.
U can tell the old man is from LA… his “personal Hell” is having to re rent a home 😂
I can't believe he pulled this..... and took 4 years.... oh my gosh, he looks really bad.
The plaintiff is bonkers. She saw that the house was across from a school - she gave the landlord a $4000 security deposit + SIX MONTHS RENT IN ADVANCE - and then broke the lease because it’s across from a school. 🤪
Being across from a school isn't fun.
Maybe the spouse, since he didn't come, is a registered s*x offender and can't live near a school.
It was her husband who didn’t like the noise. Seemed like she went rental hunting without the husband. Six months are not that long. I’m sure they could’ve tolerated the school noise for that long.
The way she busted her little bitty self in there 🤣😂
He got a 17k loan for 4 years with 0 interest and complaining
Personal hell? He’s ridiculous
I love how the defendant Trolled the guy in the hall, super dry sense of humor
This is a shame. I wish it hadn’t come to court, because he clearly benefitted from the up front payment by spending it on his mother’s care. And she was understanding and was taking payments. He should’ve just finished paying her. Shame.
9:06 I love how it just took her RIGHT out of basically her closing statements lol
0:13 That hair flip! 😎
She came thru them doors tuff!
What is wrong with that defendant? $1000 a month over four years and he wants pain and suffering? And no documentation of his payments? Is he just not very bright?
Stop it Mr. Shaw!! 🤣🤣🤣
Damn she walked in like she was about to take someone to jail
Disappointed that JM didn’t call him out at the end for complaining about how hard it was to re-rent. In the beginning it was said he told her she really needed to be sure because a lot of people are interested plus the fact of the 6mo. rent advance to make herself a more competitive renter (b/c it’s a hot commodity property).
I don't see Robert Shaw. But it is funny how some people will see something familiar in a person that others don't see. It's just the personal way we perceive others.
Omg the defendant is a DRAMA QUEEN.
that man said alltimers with his chest
Plaintiff missed out on asking for almost 4 years worth of interest on the money she was owed
Tien RAN into the courtroom.
She ran up at the podium...
Ironically he did the same thing, put his Mom into a rest home not considering normal money management rules. I am guessing the Mom lived with him and that saved his soul!
If not for the plaintiff, he wouldn't have been able to put his mom in a nursing home. He should have paid her back long ago. He's a whiny character 🤢🤮
Ah, the ol' I-want-my-money-back-because-I-decided-not-to-take-the-apartment case.
Smile 😃
Lol
But, in this case, she paid what she owned the self-entitled old man.
Pay the lady :P
The moment someone says "Basically" or "All-Timers" I gotta wonder just how truthful they are... Starting with "basically"...smh🙄
The defendant is ridiculous. She should’ve gotten the rent money from that unit every month and been pay back in six months.
3:00 Let me understand her reasoning... Because the property was across the street from a school, she doesn't want it because it was noisy? She couldn't put up with the noise for 30 mins in the morning and 30 mins in the afternoon? Right there she lost me.
It was her husband that didn't like it, but you see he's not even there...
@@shannontrent3702 yup, HE should be the one trying to explain. Even She doesn't agree with his "it's across from the school" line he used! LOL
She could have stayed 6 months then moved, he didn’t have to let her out of lease. 4 years to pay it back was ridiculous but she already had credit issues did she really want more problems in litigation for breaking a lease, hence once again he didn’t have to let her off.
Must be SO nice to not have sensory issues. While I agree she should have researched....he owed her PERIOD.
@@Aceofwolves He didn't have to let her out of the lease because her reason for breaking it was not something the law would recognize. He was being nice about it. And you try being stuck with a loan you never signed for and suddenly have to pay back.
She was ridiculous.
The landlord was a little wacky there.
It amazes me how many people call alzheimers "AllTimers" lol
I guess it’s a common thing in California to pay several months up front. I always paid my rent at least 4 to 6 months in advance. My landlord loved me. Why? So he doesn’t have to bother me and vice versa. I took very good care of the property and was there for 16 1/2 years. Loved doing it that way because it was less stressful for me.
I didn’t watch the video yet, but I know it’s gonna be something else w the way the plaintiff walked in 😂
She won the case
I used to watch Jaws all the time with my grandpa. can't help but love this guy when she makes that comparison

Me: Here we go again...
More like husband isn't on the show and they can't live there because he's on an offenders register and they didn't know there was a school opposite 🤣🤣🤣
This just had dumpster fire 🔥 written all over it on both parties
For a "businessman", sure doesn't have his ducks in a row..it's basic to provide proof, what was paid.
With bad credit why pay $2,500 x 6 months = $15,000 + $4,000 security Why why 🤣😂
To get the plave
She was incredibly patient with this guy and he tried to keep some of the money for himself. I mean what did he expect was going to happen??? That she was just going to let that go???
Not sure why the judge made such a big deal out of the plaintiff breaking the lease. Sometimes you make a decision and then change your mind. She accepted the consequence of breaking and that should've been the end of it. Weird how they gathered so many defendant sympathizers on the sidewalk. I doubt any of them would feel the same in the plaintiff's shoes.
As for the defendant, he seemed likeable throughout the case but once he started boohooing about having to re-rent and pay the plaintiff back, I was done with him. She was extremely patient to let it go on for almost 4 years and he was just being greedy.
That’s no Robert Shaw… don’t lie sir, nobody ever said you looked like him!! 😂
He said let's see what the wknd thinks 🤣🤣🤣🤣
He should have paid interest.
Dude is a character. He belongs in the movies . . .
What the hell? This crazy guy got an interest-free loan on $17K for four years and was still calling it “injustice” when he already got compensated for the one month rent! Unbelievable! 🙄🙄
Why she run into the court room🤣🤣🤣🤣
I always find it amusing when one side loses and they say thank you to the judge like they won 😅😅
He comes out and says he’s not happy with the outcome. Lol
Googling Robert Shaw rn😂😂😂😂
I'm sorry for her husband. I heard her voice for minute and I can't even
That defendant was definitely flirting with Judge Milian at the end! Lol!😲😳😍
13:25 This was NOT SECURITY Harvey!!!!
Due diligence is as RARE as common sense.
At 13:00 I loved his comment at the very end about the shark and the actor Robert Shaw 'he got me at the end, just like the judge'... ha ha ha
Harvey called that man The Weeknd 😅
Seems like two decent people. He’s lucky they don’t allow interest on the amount owed for nearly 4 years. I think he thought she would just go away and give up.
lmaoooo and did you catch how the hair was a bouncing.... Ms. Tien said 1 thing for certain 2 things for sure... I may sign contracts that I dont wanna fulfill but baby yall gonna get this intro!!!
*aggressively walks into courtroom*
She breached the contract, tough luck 🤦♀️🤷♀️
She had bad credit but had 19,600 😡
Maybe she should have used that to pay back the people she owes! Wtaf!
A WHOLE month???!!! Wow!!! How TERRIBLE that it took so long to be rerented!!!
I’m in Toronto and I paid 4 months plus my last month in advanced so that I could get my place. My landlord was picky and we wanted to sweeten the deal so we offered to pay more upfront. We’ve been here 4 years and love it! So worth paying upfront for
Cool. We didn’t ask. 😂
FUCK that

Can someone explain the not saying last name they always say? I mean if they have your first name and can see you on the video, it shouldn't be hard to ID you so it has to be something else?
I loved this case, I laughed the whole way through 🤣🤣🤣🤣
