Property buying issue. Property is in the name of Joseph and sons. But the Deed has only the name of Joseph as absolute owner. Should I pay all heirs equal . Or divid and pay his 3 sons one third and the rest to the sons and 2 daughters

Hi Sir,
An agreement was made in 1996, saying that within the mentioned date remaining amount should be given to seller and seller will come for registration. Buyer had given total amount within the mentioned date, but we asked seller orally multiple times for registration and seller timepassed these many years and now he is not coming for registration and telling I didn't sold the property.
Please tell me what should we do if we paid all the amount and seller not coming for registration. Thanks sir.
