      Because the courts benefit from all this, the judges and the 'lawyers' who are appointed to represent the victims. They will lie and perjure themselves to steal the victim's estates. I know from personal experience.

      I was under guardianship when I was 18-20. My distant cousin over medicated me to say I was unstable. Anyone can be a target unfortunately

      Yes! It should mandatory that a relationship between the conservator with the conservatee is established before conservators are granted guardianship rights.

      I think that's not the only issue. I think the issue is not letting the soon to be victim know
      and not having a court procedure in their presence where a judge and court appointed psychologist could hear the targeted person's stance and defense, and evaluate the situation.
      And even if the person had applied for conservatorship themselves, and their need confirmed by the court, they should be able to apply again to stop it or change conservators (not at whim but based on solid concerns and evidence)
      And they should be able to have the option to freeze their assets during conservatorship.
      If the state's so adamant about issuing this sht, then it should become a social state and take care of people themselves, using their own resources.
      "I am going to make a sleazeball the legal owner of all your posessions and accounts, and look after you using your money" is essentially what they're saying at the best of times.

      I mean, anyone can be deemed incompetent. It's not just restricted to elderly people. And apparently in Florida it's as easy as having a single person who barely knows you allege your behaviour is subjectively incompetent to them. The fact that it doesn't require the person in question to be assessed by a doctor and the case heard before a team of professionals is just insane.

    This is what happens when you leave your elderly parents who raised you in your time of need, alone. The system comes and takes advantage of them. Take care of your parents and stop handing them over to the state like a sack of potatoes

      While I agree with your sentiment, these wolves can step in and literally kidnap their victim and remove all communication with the outside world as they are kept captive in nursing homes. Children are totally cut out of their inheritance and last days with parents. Many children have had their parents removed from their, the kid's homes, and never seen again while sharks like these sell the parent's home and belongings at basement value to cooperating realtors who then profit themselves with sales within days at outrageously increased price over the original sale to the realtor. Legitimized theft. This generation is supposedly the greatest transfer of wealth to the next generation that this country has ever seen. It would be if we didn't have 40 hr trained wolves gobbling it up. It is a fact that the government saves significant money when a nurse's aide is sent to an elderly person's home to checkup and help out. Since aging in place is so much less expensive, where is our government in cleaning up this predatory crime?

      I wondered the exact same thing. It wouldn’t take much to get an interpreter and ask the woman directly, instead of asking everyone else with something to gain. It would be obvious if she didn’t know what was going on. But, her mental decline (if true) could also be why she sold the property to her nephew WITHOUT the realtor getting a cut. Maybe she knew she couldn’t take care of the hotel any longer and sold it to him to keep the property in the family before she became to confused to know what was going on. This happens all the time. The realtor seemed to have a smug, arrogance about her untrustworthy. I seem to remember this being quite a racket in certain places. The poor “patient” ends of footing the bill for all it!

    In 2006 my grandma fell and broke her hip and because she was almost blind and my grandpa had dementia they the state of Florida wanted guardianship over them and said they needed to be in an assisted living place even know we had someone that could living with them and take care of them. The kicker is they had alot of money and property already paid for we fought it and won

    When my husband and I were young newlyweds, my father-in-law sold us a very nice car for $50, and that was obviously for the bill of sale. He would have never sold it to anyone else for that price. We do things like that for family. Florida needs to go back to the drawing board with that weak guardianship law. 🤦🏾‍♀️

    When my grandfather was alive (2 years ago he passed) we unfortunately got to the point where we had to put him in assisted living (something I will never forgive myself for) it’s a very long story but basically the assisted living facility sold the place to a drug rehab facility and they actually tried hiding it from us as they were keeping the residents like my grandfather who had good money on one floor while the others were going to be drug rehab floors (they thought they could get away with this I don’t know how, maybe cause my grandfather had dementia but I would still see these people who were not elderly) a nurse called us to let us know what was happening and we immediately wanted him out but this was the start of Covid and no one was taking in new residents, so this nurse try’s acting like my savior and says she knows of places, turns out after she talked to my grandfather she learned he had money and was first trying to take him to her house and have us pay her triple the amount, I caught her in so many lies, that I truly got the impression her plan was to take my grandfather, get him to sign her over as caretaker and then steal his home, and money (she also found out my grandfather had a huge house as she was literally going into my grandfathers room and interrogating him for info, my grandfather is from the South and loves to talk so he thought he was talking to a friend. When we fired her she acted like she missed the lottery as she would not stop calling us begging us to listen. As to the awful facility by the time we found another facility to take him in, he passed away. Please be very careful with your old relatives as people will try anything to take from them.

      Because sometimes people are not mentally competent to take care of themselves. But the fact that it's apparently so easy in Florida is insane. The threshold needs to be a BIT higher than "they did something funny one time."

    As a notary loan signing agent I've seen ppl "sell" their property to family for $1.00 this is completely legal. What that realtor did however is criminal!

    How hard is it to have a competency hearing with an independent Competency & Control Board? And an independent Office of Guardian & Trustee who will look after matters of personal care and finances? They have that in Ontario, along with an official Rights Advisor, all who are there to protect the rights of mentally ill and/or elderly people if their competence is in question.
    The fact that the same person who alleges someone is incompetent can then also recommend someone to take guardianship is dodgy as hell.
    Can the USA not do anything right to protect its people?

      I moved from the US to Toronto a year ago and I won't ever go back to the US. In fact I petitioned to denounce my US citizenship. It's a true shit hole and its adult guardianship system is proof of that fact. It's all about money now. Anyway you can get a buck is the norm now in the US. Nothing is off the table. Obviously!

    Watch the movie because I care on Netflix. This is turning into a huge business for people. Mostly the primary caregiver/Doctor, someone who takes guardianship, (probably working for the county or city) and the Director of a facility. Try to change venue and get it away from the courts they are using, and into a higher court if possible. They are all in on it and profiting.

    I worked in healthcare and I can't tell you how rampant this issue is everywhere. Whether it's conservators, family members, or judges taking advantage of elderly assets. Its sickening really... APS takes ages to investigate these financial abusive cases.

    I hope she got her rights back. I saw one of these same issues and by the time the woman was able to sneak a cell phone in to get to the news for help, her guardian had sold or gotten rid of ALL of her belongings (including pictures and family heirlooms) and sold her home. So, she not only owned nothing but had no home by the time she was able to get out of the Elderly Care Home.

    I knew a lady named Libby, 98 years old. She outlived her family, no kids. She was like my grandma. I met her when I was 12 at a grocery store with my mom and we did her shopping after that. When I was 19 I couldn’t get ahold of her so I went to her house only to find it empty. The ONLY other person she knew besides us was her accountant who wouldn’t answer the phone. I tried so hard to find her. I even checked obituaries. I remember Libby’s house was full of sticky notes with her accountants name. She was calling dibs on her stuff bc Libby was well traveled and had very expensive foreign stuff. It broke my heart. All I can assume is her accountant did something like this to her. I found Libby’s obituary online in 2018. At the bottom it said that Libby requested no service! such a lie! I’m sure she asked for help to locate me and my mom. Breaks my heart she died alone and I hope she didn’t feel abandoned by us. I went to her house nearly every 2 days. I still cry about this a lot. I just miss her and I didn’t get to say good bye and she died alone because of someone’s greed.

    Family members tried to have my parents declared insane or similar to get them put into a nursing home and they told adult protective services that I had them held against their will … but the family members didn’t know I had already been made power of attorney and power of medical and they had been disowned and removed from the will ! And they didn’t get nothing but shut out completely forever and they all wonder why !

    Follow up in December 2020. The guardian was charged with fraud in relation to another elderly person where she had power of attorney. What did the judge do? Gave guardianship to another stranger.

    I'm a retired Realtor. This is HORRIBLE! You have the right to sell your property without any mortgages on it to anyone you want and for any amount you want.
    That horrible example of a human being who is also a Realtor should lose her license! This is why so many have a bad taste in their mouths about Realtors!
    Weed those out who do harm to others!
    I wondered why I was so popular as a Realtor! It was because you would 100% trust me and KNOW I have YOUR BACK!
    That is what fiduciary duty is all about! As a Realtor, you have a fiduciary duty to ALWAYS look out for your client's best interest and NOT YOUR OWN!
    Here is the definition of Fiduciary Duty that a Realtor is BOUND TO: A fiduciary is a person or organization that acts on behalf of another person or persons, putting their clients' interests ahead of their own, with a duty to preserve good faith and trust. Being a fiduciary thus requires being bound both legally and ethically to act in the other's best interests.

    They are called prospecting letters and the realtors won't stop until you sell them your property. I have often seen this in our housing bubble. Non stop phone calls etc. They won't leave you alone if they think they can get a bargain.

    This happens more frequently than you think. Working in LTC for 27 years, I have seen this happen many times. Please make sure all your affairs are in order as well as those of your elderly loved one so this won't happen to you or them.
